    MUTUAL FUNDS

    The market regulator is putting togetherguidelines for banks and nationaldistributors to check mis-selling of mutualfunds.

    Mutual funds cannot invest more than 10per cent of the total net assets of a schemein the short-term deposits of a single bank,the Securities and Exchange Board of India

    guidelines recommend.

    GOVERNING MUTUAL FUNDS

    Announcing guidelines for parking offunds in short-term deposits ofscheduled commercial banks (SCBs)

    by mutual funds, the regulator saidthat investment cap would also takeinto account the deposit schemes ofthe bank's subsidiaries.

    The Sebi has also defined 'short term'for funds' investment purposes as aperiod not exceeding 91 days.

    MUTUAL FUNDSIt has also asked the trustees to disclose detailsof all such funds parked in short-term deposits inhalf-yearly portfolio statements under a separateheading and has said that AMCs should alsocertify the same in its bi-monthly compliance testreport.

    All the short-term deposits by mutual fundsshould be held in the name of the schemeconcerned only, it added.

    The Sebi said that these guidelines are aimed atensuring that funds collected in a scheme are

    invested as per the investment objective statedin the offer document of an MF scheme.

    The Sebi has also asked the trustees of a fundto ensure that no funds are parked by a schemein short term deposit of a bank, which has

    invested in that particular scheme.

    Violation of guidelinesy SEBI may initiate action for suspension ao

    cancellation of registration of an intermediaryholding a certificate of Registration who fails toexercise due to diligence or to comply with theobligation under SEBI regulation.

    of any of the provision of the regulation.whileany proceeding of suspension or cancellationis pending, SEBI may order suspension forlaunching of any schemes not exceeding threemonths.
