Minutes of the regular session of Municipal Council held on December 21, 2010, in Council

Chambers of the Municipal Administration Building, Annapolis Royal, N.S. at 10:00 a.m.

Present: Warden Reg Ritchie; Councillors: Brian ‘Fuzzy’ Connell, Wayne Fowler, Paul McDonald,

It was moved by Councillor Vitiello, seconded by Councillor McDonald, that the minutes of

the regular meeting held on November 16, 2010, be approved as circulated. Motion carried

unanimously.

Monthly Report – The Municipal Solicitor gave a report on the following legal services for the month

regulations.

o Unsightly Premises Matter – conversation with Planning staff re access to land to complete clean

up.

o Decommissioning of Wind Turbines – discussion was held with the Solicitor regarding the

decommissioning of turbines.

MOTION 101221.02 Decommissioning of Wind Turbines

It was moved by Councillor McWade, seconded by Councillor McDonald, that Staff research

jurisdictions other than Nova Scotia on how the issue of decommissioning is addressed.

Motion carried unanimously.

o Kings Transit – Solicitor is still waiting for information from Kings Transit in order to prepare a

submission to the arbitrator.

Councillor McDonald moved, seconded by Councillor Connell, that the monthly report of the

Municipal Solicitor be accepted as presented. Motion carried unanimously.

Whole, Deputy Warden McWade moved, seconded by Councillor McDonald, that Municipal

Council approve the following changes to various policies:

Approve AM-2.4.1 Performance Evaluation Policy

Amend AM-2.1.3 Statutory Holidays & Paid Holidays Policy

Amend AM-2.1.6 Compassionate Care Leave Policy

Councillor Newton moved, seconded by Councillor Vitiello, to amend the motion by dividing it

into three separate motions, one for amended policies, one for approved policies, and one for

repealed policies. Motion carried unanimously.

MOTION 101221.04 Approve New Policies

In accordance with the recommendation of Staff and seven day notice given at Committee of the

Whole, Deputy Warden McWade moved, seconded by Councillor McDonald, that Municipal

Council approve the following new policies: AM-2.4.1 Performance Evaluation Policy, AM-1.3.5

Committees of Council Policy; and AM-1.3.7 Appointments to Joint, Regional or Community

Organizations Policy. Motion carried unanimously.

MOTION 101221.05 Approve Amendments to Policies

In accordance with the recommendation of Staff and seven day notice given at Committee of the

Whole, Deputy Warden McWade moved, seconded by Councillor Vitiello, that Municipal

Council approve the following amended policies: AM-2.1.3 Statutory Holidays & Paid Holidays

MOTION 101221.06 Approve the Repeal of Policies

In accordance with the recommendation of Staff and seven day notice given at Committee of the

Whole, Deputy Warden McWade moved, seconded by Councillor Trimper, that Municipal

Council repeal the following policies: AM-1.2.2 Standing, Special & Advisory Committees

Policy and Constituting Resolutions for Committees. Motion carried unanimously.

o Nominating Committee Recommendations

Annapolis County Municipal Housing Corporation

MOTION 101221.07 Change in Appointment to Annapolis County Municipal Housing Corp.

It was moved by Deputy Warden McWade, seconded by Councillor Roberts, that Councillor

Newton be replaced by Councillor Fowler on the Annapolis County Municipal Housing

Corporation Board. Motion carried unanimously.

MOTION 101221.08 Councillor Appointments to Committees and Boards

Pursuant to the recommendation of the Nominating Committee and Committee of the

Whole, it was moved by Deputy Warden McWade, seconded by Councillor Connell that

Municipal Council approve Councillor appointments as amended in the preceding motion.

Motion carried unanimously. (See Schedule A)

Bay of Fundy Transportation Coalition

MOTION 101221.09 Council Appointment to Bay of Fundy Transportation Coalition

In accordance with the recommendation of Committee of the Whole, Deputy Warden

McWade moved, seconded by Councillor McDonald, that Councillor Newton be appointed

to the Bay of Fundy Transportation Coalition. Motion carried unanimously.

AVRSB Bridgetown P12 Committee

MOTION 101221.10 Appointment to AVRSB P12 Committee – Request Denied Pursuant to the recommendation of Committee of the Whole, it was moved by Deputy Warden McWade, seconded by Councillor Vitiello, that there not be a Council-appointed assignment to the AVRSB Bridgetown P12 Committee, but that any Councillor may attend on their own and report back, and that staff inform the Committee of this in writing. Motion carried, 9 in favour, 1 against (Newton).

Annapolis Valley Regional Library Board

MOTION 101221.11 Appointment of Two Members to AVRLB

In accordance with the recommendation of Committee of the Whole, Deputy Warden

McWade moved, seconded by Councillor Fowler, that Municipal Council continue to have

two appointees, 1 Councillor and 1 Citizen on the Annapolis Valley Regional Library

Board. Motion carried unanimously.

MOTION 101221.12 Orderly & Peaceful Conduct Bylaw In accordance with the recommendation of Committee of the Whole, it was moved by Deputy Warden McWade, seconded by Councillor Vitiello, that Municipal Council authorize staff to take action to ensure compliance with the S5 Orderly and Peaceful Conduct Bylaw. Motion carried unanimously.

o Valley Waste-Resource Management Authority

Disbursement Policy

MOTION 101221.13 VWRMA Disbursement Policy

In accordance with the recommendation of staff and Committee of the Whole, Deputy Warden

McWade moved, seconded by Councillor McDonald, that Municipal Council approve the

amended policy wording with regard to the annual operating surplus and deficit as suggested by

Valley Waste-Resource Management Authority. Motion carried unanimously.

Capital Reserve

MOTION 101221.14 VWRMA Capital Reserve Pursuant to the recommendation of staff and Committee of the Whole, it was moved by Deputy Warden McWade, seconded by Councillor Connell, that Municipal Council approve Option 6 of the Valley Waste-Resource Management Authority Management Centre Capital Replacement Reserve Policy as circulated. Motion carried unanimously.

o Sidewalk Ploughing and Ice Control

MOTION 101116.01 Sidewalk Ploughing and Ice Control In accordance with the recommendation of staff and Committee of the Whole, Deputy Warden McWade moved, seconded by Councillor Fowler, that Municipal Council approve Public Works to provide winter sidewalk maintenance using internal resources and that the Municipality provide winter sidewalk maintenance to all municipal sidewalks. Motion carried unanimously.

Re: Long Service Recognitions

Mountain Lea Lodge and Adult Residential Centre o 35 Years of Service – Councillor McDonald, Chair of the Annapolis County Municipal

Housing Corporation, and Neil Cook, MLL & ARC Administrator, recognized 35 years of service with a gift and framed certificate to (Marion) Mickey Scott from Mountain Lea Lodge.

o 30 Years of Service – Councillor McDonald, Chair of the Annapolis County Municipal Housing Corporation and Neil Cook, MLL & ARC Administrator, presented the following employees with gifts and framed certificates for 30 years of service: Sherry Robinson-Smith, Joan Marshall and Cathy Phinney from Mountain Lea Lodge.

o 25 years of Service – Councillor McDonald, Chair of the Annapolis County Municipal Housing Corporation, and Neil Cook, MLL & ARC Administrator, presented framed certificates and gifts representing 25 years of service to Darlene Jackson, Joy Taylor, and Tammy Verran of Mountain Lea Lodge.

o 20 years of Service – Councillor McDonald, Chair of the Annapolis County Municipal Housing Corporation and Neil Cook, MLL & ARC Administrator, presented a gift recognizing 20 years of service to Catherine Theriault of Mountain Lea Lodge.

MOTION 101116.02 Private Sewer, Morse Property, Nictaux

Pursuant to the recommendation of staff and Committee of the Whole, it was moved by Deputy

Warden McWade, seconded by Councillor Chipman, that Municipal Council approve

acceptance of the existing private sewer line on Morse Drive (a private road) on the property of

Keith & Barbara Morse, Highway 201, Nictaux, subject to the Morse’s giving the Municipality

an easement for operation and maintenance purposes. Motion carried unanimously.

o Bear River Waste Water Treatment Plant Expansion Options Assessment and Preliminary Design

Report

Assessment and Preliminary Design Report

In accordance with the recommendation of staff and Committee of the Whole, Deputy Warden

McWade moved, seconded by Councillor McDonald, that Municipal Council accept the Report

on the Bear River Waste Water Treatment Plant Expansion Options Assessment and

Preliminary Design as circulated, and that the Municipality request confirmation of acceptance

by the District of Digby and agreement to proceed immediately with Detailed Design and the

preparation of tender documents, and that the Municipality carry out the recommended Plant

modifications in 2011 and 2012. Motion carried unanimously. o M5 Full Tax Exemption Bylaw Amendment – First Reading

MOTION 101221.16 M5 Full Tax Exemption Bylaw Amendment – First Reading

Pursuant to the recommendation of staff and Committee of the Whole, it was moved by

Deputy Warden McWade, seconded by Councillor Connell, that Municipal Council give first

reading to amend the M5 Full Tax Exemption Bylaw by adding the following (inclusive of

area rates) to be effective April 1, 2010:

Fire Department ($15,161) In accordance with the recommendation of staff and Committee of the Whole, Deputy Warden McWade moved, seconded by Councillor Newton, that Municipal Council authorize a payment of $15,161 from the Fire Services Reserve Fund to the Port Lorne Volunteer Fire

o Community Recreation Grant Program (CRGP)

MOTION 101221.18 CRGP - Annapolis West Senior Games ($600)

Annapolis West Senior Games ($600)

Pursuant to the recommendation of staff and Committee of the Whole, it was moved by

Deputy Warden McWade, seconded by Councillor Trimper, that Municipal Council approve

a grant in the amount of $600 (for a total project of $1,214) to the Annapolis West Senior

Games from the Community Recreation Grant Program for 2010-11. Motion carried

unanimously. o Bylaw Enforcement – Firearms Usage

MOTION 101221.19 Bylaw Enforcement – Firearms Usage In accordance with the recommendation of staff and Committee of the Whole, Deputy Warden McWade moved, seconded by Councillor Vitiello, that Municipal Council prohibit staff from possessing firearms during periods when they are performing their duties as municipal employees. Motion carried unanimously.

o YMCA - Fundy Y

MOTION 101221.20 YMCA – Fundy Y

Pursuant to the recommendation of Committee of the Whole, it was moved by Deputy

Warden McWade, seconded by Councillor McDonald, that if the Member of Parliament is

able to identify an additional $50,000 in funding for the YMCA development project over

and above the $300,000 that has already been requested, that Municipal Council authorize a

contribution of $50,000 of in-kind services to the project (in addition to the approximately

$320,000 in annual mortgage payments for the facility). Motion carried, nine in favour, one

against (Chipman).

Additions to the Agenda

Re: Unsightly Matter – Hurlburt – C. Mason, Manager of Protective Services showed pictures of

the property taken this week, showing that the items that had been requested to be removed have,

for the most part, been removed or relocated as requested.

MOTION 101221.21 Unsightly Matter – Hurlburt – File Closed

It was moved by Deputy Warden McWade, seconded by Councillor Connell, that Municipal

Council accept the clean-up work that has been done on the Hurlburt property as satisfying

the requirements of the Unsightly Premises Order issued in June 2010, and that the Hurlburts

and the complainants be advised that the file is now closed. Motion carried unanimously.

New Business

Re: Resolution Regarding Banking (Signing Authority) -

Deputy Warden McWade moved, seconded by Councillor Vitiello, to approve the Resolution

Regarding Banking as presented and attached. Motion carried unanimously. (See Schedule B)

Re: Emergency Management Office (November 9th

) – informing of a direct deposit in the amount of

$6,677.34 from the 911 Cost Recovery Fund, which is to provide assistance for the costs associated

with administration of civic addressing programs for the year ending March 2011. It was moved by

Councillor Vitiello, seconded by Councillor Chipman, to receive for information. Motion carried

unanimously.

Re: Health Promotion & Protection (November 10th

) – informing of funding approved in the amount

of $150,000 for the redevelopment of the Lifeplex Wellness Centre under the Recreation Facility

Development Grant program for 2011/12. Councillor Vitiello moved, seconded by Councillor

Chipman, to receive for information. Motion carried unanimously.

Re: Champlain Elementary School Advisory Committee (November 22nd

) – requesting the creation of

a safe route for pedestrians between the Annapolis Royal tidal station on the causeway and the

Annapolis County Public Works building in Granville Ferry.

MOTION 101221.23 Champlain Elementary School Sidewalk Request - Referred

It was moved by Deputy Warden McWade, seconded by Councillor Fowler, to refer this

request to Director of Municipal Services for consideration. Motion carried unanimously.

Re: Nova Scotia Sport Hall of Fame (November 26th

) – requesting a donation to help enrich the

education program. Deputy Warden McWade moved, seconded by Councillor Vitiello, to receive for

information. Motion carried unanimously.

Re: Department of Health (November 29th

) – a copy of a letter to the Annapolis Community Health

Centre acknowledging a recent meeting held regarding the Ross Report. It was moved by Deputy

Warden McWade, seconded by Councillor Vitiello, to receive for information. Motion carried

unanimously.

Re: Royal Canadian Legion Branch 001 (December 1st) – inviting Municipal Council to the annual

New Year’s Day Levee, being held January 1 from 11:00 a.m. – 4:00 p.m. It was moved by

MOTION 101221.26 ACPS File #2010DA-005 – Gary & Margaret Mailman

Development Agreement Amendment

Subsequent to the report of the Planner, favourable recommendation from the Upper Clements

Area Advisory Committee, and following the full consideration of the related goals, objectives

and policies of the Upper Clements Area Municipal Planning Strategy, Deputy Warden McWade

moved, seconded by Councillor McDonald, that Municipal Council amend the existing April 3,

2001 development agreement with Gary and Margaret Mailman to permit the construction of a

seasonal thirty unit Recreational Vehicle Park facility, as per Policy 5.1.11 of the Upper Clements

Area Municipal Planning Strategy, and

that Municipal Council give Notice of First Reading of Council’s intention to amend the existing

Mailman development agreement, and

that Municipal Council hold a statutory Public Hearing on January 18, 2011 at 11:00 a.m. in the

Council Chambers of the Municipal Administration Building in Annapolis Royal, to discuss

Council’s intention to amend the existing Mailman development agreement.

be scheduled for January 11, 2011, at 9:00 a.m. to discuss Council’s intention to amend the

Annapolis County Subdivision Bylaw. Motion carried unanimously.

consolidating operations; offers received on two buildings & adjacent land - could create direct &

spin-off jobs. ABCC will contribute to Fundy Y project.

Re: Annapolis County Fire Services Association – Councillor Chipman reported the Association met

on November 29th

, and noted that the fire departments would like to meet individually with the

Municipal Services Director to discuss the audit. Natural Resources and the Annapolis County Trails

Society will be invited to the next meeting to discuss emergency access on the trails. Fire Marshal

Harold Pothier was also in attendance.

Re: Annapolis Valley Regional Library – Councillor Roberts reported that the Library is looking for a

new location for Headquarters, which is currently in Bridgetown. The building is not suitable for their

needs and the lease runs out in 2013. Options have been suggested for Kings County. A New

Horizons for Seniors grant was received ($7,000) which will be used for the Bridgetown Branch. This

will be discussed further at January Committee of the Whole.

Re: Soldiers Memorial Hospital – Councillor McDonald presented a report supplied by Councillor

Wilkins which included news that Dr. Michelle Saxon has joined the Middleton Collaborative Practice.

Re: Southwest Nova Biosphere Reserve Association – Councillor McDonald reported that Lisa

Camperman is the new Project Coordinator. One of the new projects will be to work with other

groups in an effort to save time and resources by eliminating duplicate research and studies.

Re: Trans County Transportation Society (TCTS) – Councillor McDonald presented the following report

on behalf of Councillor Wilkins: The 2005 Perry Rand bus was sold to Carleton Road Industries for

$20,000; a 2006 9-passenger van was purchased for $13,000.

Deputy Warden McWade moved, seconded by Councillor Fowler, that the foregoing monthly reports

be accepted. Motion carried unanimously.

Additions to the Agenda

Re: Yarmouth Ferry – concerned that the situation is not being addressed sufficiently. Jr. Theriault met with business, 25% business lost last year, on average, because of the loss of the ferry. Yarmouth County is dying. With the loss of Convergys, and the only solution that Economic Development has is to ask for economic support, we need to start actioning a political reaction. Further discussion will be held at January Committee of the Whole. Re: Phonebooks and Flyers - Springfield – Councillor Roberts noted that she has personally had to acquire and deliver Annapolis Valley West phonebooks and valley area flyers to the residents of Springfield. She would like to know why Bell and flyer services won’t do this. Councillor Newton noted that the flyer services are provided by two different agencies; they are franchised and have territories, creating conflict for one to deliver flyers to another area.

Homtosta Farm (December 8th

) – James and Jennifer Ward are requesting the Municipality to merge 7.8 acres currently within the Town of Bridgetown boundary with adjacent properties in the Municipality. The Town of Bridgetown will be discussing the matter in January. This was circulated for information.

Community Services (December 10th

) – informing of pending changes on Board membership (the previous Annapolis Valley Housing Authority was amalgamated with the Tri-County and South Shore Housing Authorities on December 1

st, forming the Western Regional Housing Authority).

They are requesting Council to recommend a reappointment/replacement of the citizen member on the new Board. This was circulated for information.

Robert & Jennie Mann (email December 13th

) – expressing concern that Municipal Council approved the adjustment of the boundary with the Town of Bridgetown regarding Kanjana Estates, but that they did not change the boundary for Richard & Shea Griffiths and the Town of Middleton, and requesting a specific explanation of why it is done for one and not the other. Discussion was held and it was noted that Municipal Council does not operate with a double standard, i.e. – the Kanjana request was supported by both municipal units and the NSURB was involved; the Griffiths issue was not supported by both municipal units.

MOTION 101221.29 Boundary Concerns It was moved by Councillor Connell, seconded by Councillor McDonald, that the Municipal Solicitor respond to Mr. Mann. Motion carried unanimously.

Annapolis West Health Foundation (December 14th

) – informing of funding commitment of $80,000 towards the capital campaign for the Fundy Y. It was moved by Councillor McDonald, seconded by Councillor Roberts, to receive for information. Motion carried unanimously.

Digby Health Foundation – the CAO reported that $50,000 was committed on Saturday morning at the press conference held in Cornwallis Park. The Press Conference was well attended with more than 100 in attendance. 6 funding announcements were made.

Transportation and Infrastructure Renewal (dated December 16th

) – in response to Council’s letter of March 24

th requesting a flashing light be installed at the intersection of Trunk 1 and Old Mill

Road in Wilmot. Upon review of the data available, a red/amber beacon will be installed at this intersection as soon as manpower and equipment are available. This was accepted for information by consensus.

Convergys Update – The CAO reported that there are two transition teams, one to work with employees for job/interview skills, and one for investment attraction to fill the void. Government and local partners are working together on this. It is timely that the Wardens/Mayors hope to meet with Minister of Economic Development in January to urge their support in replacing yet another employer in our area.

Finance Questions – Councillor Connell noted the projected deficit for year-end of about $80,000 (deed transfer tax mostly), and that even though Council hasn’t raised the tax rate, it has collected more through higher assessments. His concern is that with a projected deficit, how does the Municipality keep hiring people? (i.e. - Winter Active program), when these activities should be able to be run in-house. The Director of Corporate Services informed that this program is funded through a Health Promotion & Protection grant, not County dollars.
