To:RiverLaneRanch(hereinafterreferredtocollectivelyas“RLR”)andemployees,officersandagents(hereinafterreferredtocollectivelyas“RLRemployees”).

“Equineactivities”atororganizedby“RLR”shallincludeanyhorserelatedactivitythatapersonparticipatesinorisaspectatorof,including,butnotlimitedto:riding,arenaortraillessons,cattlepenning,roping,barrelracing,clinics,showsorgymkhanas,daycamps,boarding,leasing,breeding,training,horsesales,groupprograms.

“Inherentrisks”ofequineactivitiesshallmeanthosedangersorconditions,whichareanintegralpartofequineactivities,including,butnotlimitedto:

1. thepropensityofanyequinetobehaveinwaysthatmayresultininjury,harmordeathtopersonsonoraroundthemand/ordamagetopropertyintheirvicinity;

2. theunpredictabilityofanequine’sreactiontosuchthingsassounds,suddenmovementandunfamiliarobjects,personsorotheranimals;

3. theequine’sresponsetocertainhazardssuchassurfaceandsubsurfaceobjects;4. collisionswithotherequines,animals,peopleandobjects;5. thepotentialofaparticipanttoactinanegligentmannerthatmaycontributetoinjurytothe

participantorothers,suchasfailingtomaintaincontrolovertheequineortoactwithinhisorherability.

1. I agreeasaprecondition tomyparticipation inan“equineactivity”organizedby “RLR”andconductedby“RLR”and/or“RLRemployees”,and in furtherconsiderationof“RLR”allowingme to do so, to be strictly bound by the terms of the Waiver, Assumption of Risk andIndemnityAgreement(hereinafterreferredtoas“TheAgreement”).

2. Iacknowledgethat“equineactivities”involveINHERENTRISKSthatmaycauseSERIOUSINJURYANDPOSSIBLYDEATHTOPARTICIPANTS.

3. I fully understand the risks and dangers associated with my participation in this “equineactivity” and ACCEPT SAME ENTIRELY AT MY OWN RISK. I also understand that whileparticipatinginthishigh-risksport,itisSTRONGLYADVISEDby“RLR”and“RLRemployees”touseappropriate safetyequipment, includingaHELMETwith fixedharness, and require such

usebyaminorparticipant.Anyfailureorrefusaltousesuchequipmentshallbestrictlyattheparticipant’sownrisk.

4. IherebyWAIVEANYANDALLCLAIMSwhichImayhave,nowor inthefuture,against“RLR”and“RLR”employees”andrelease“RLR”and“RLRemployees”fromALLLIABILITYfor injury,death,propertydamageoranyotherlosssustainedbymeasaresultofbyparticipationinthis“equineactivity”DUETOANYCAUSEWHATSOEVER including,without limitation,negligenceon the part of “RLR” or “RLR employees”. I further AGREE TO INDEMNIFY “RLR” and “RLR”employees”foranyandalllegalfees(onasolicitorandhisownclientbasis)orlossesorcostswhichmaybeincurredindefendinganylawsuitorclaimImaybringagainstthem.

5. I appreciate that This Agreement applies whether “RLR” is at fault or not and it limits theliabilityof“RLRemployees”tothesameextentas it limits the liabilityof“RLR”eventhough“RLR employees” are not formal parties to This Agreement. I understand that “RLR”, insecuringexecutionofThisAgreementbymyself, isactingasagentortrusteeonbehalfoforforthebenefitof“RLR”employees”,whoshalltothisextendbeorbedeemedtobepartiestoThisAgreement.

I HAVE READ AND UNDERSTAND THIS AGREEMENT. I UNDERSTAND THAT THIS DOCUMENTCONTAINSAPROMISENOTTOSUE“RLR”OR“RLREMPLOYEES”ANDARELEASEANDINDEMNITYFORALLCLAIMS.
