Maison funeraire Lessard- Stephens Funeral Horne is "I"immins' longest establishedfuneral horne, having served the community and surrounding areas for over 95 years. Since itshumble beginnings in 1723 with Mr. Sarnuel Walker, followed by Mr. John Stephens' keen senseof entrepreneurial skills, our funeral home has continuously strived to serve its families with theupmost respect and dignity they deserve.
In my 30- plus years of experience as a funeral director, I have had the opportunity toobserve and follow the evolution of the funeral industry. Families' needs have evolvedsignificantly over the last two decades. The trend in the industry turned to cremation as adisposition alternative. Our business statistics show that 20 years ago, the cremation rate was30%; 10 years ago, 50%, and currently 80%. This demonstrates a substantial increase in thedemand for cremation, which we predict will continue to rise in the years to came.
T' o better serve our community and surrounding areas, Maison fun6raire Lessard-Stephens Funeral Home is in the planning and application stage of obtaining approval to installand operate a crematorium within the City of Timmins.
EK Cillin & Associates Inc., all Engineering firm from Stratford, ON, was hired toconduct a. Preliminary FCA Feasibility Assessment for 34 Elm Street. South in November 2017.The purpose of the assessment was to verify if this location complied with noise and airemissions for a crernator according to the Ministry of the Environment. Attached is the reportfrom EK C_«illin & Associates which states that this site has preliminary approval for a cremator.
Furthermore, I have communicated with Mrs. Cindy Welsh, Manager of Planning for theCity of'"T" immins, in regards to our plans for a cremator at 34 Elm St. South. She has confirmedthat according to the city by- laws, the proposed location meets the proper zoning f'or' such anoperation.

I hereby request from the City of Timmins, a written approval in support of theinstallation of a cremator at the proposed location, as required by the Funeral, Burial andCremation Set-vices Act, 2002, Section 83( 3). Dear Michel:
EK Gillin & Associates Inc. ( EKG) was retained by Maison Fun6raire Lessard- StephensFuneral Home Inc. ( Lessard- Stephens), to conduct a Preliminary ECA FeasibilityAssessment for the property at 34 Elm Street Street South, Timmins. Lessard- Stephensis looking for a location to install a cremator for the purposes of incinerating humanremains. The purpose of the assessment is to determine the feasibility of obtaining anECA for such a facility with respect to air emissions, noise impact and zoning.
The site for the proposed activities is located at 34 Elm Street South, Timmins, ON. Thissite is zoned as EA- GC General Commercial and is mostly surrounded by commercialzoning. There is an existing building onsite. The cremator will be the primary use of thisbuilding.
The main funeral home services site is located across the street at 21 Elm Street South.
There are two noise sensitive receptors in the area. The closest is a house located to
the east, about 18m from the center of the property. The second is a hotel located to theNW, about 60m from the center of the property.

1. 0 BACKGROUND
1. 1 Air Emissions
Air Emissions are regulated at the provincial level. Section 9 of the Environmental
Protection Act ( EPA) forms the basis for the Air and Noise Approval Program in Ontario.Section 9 requires companies to obtain an approval before construction, alteration,
extension or replacement of any equipment or structure that may emit or from whichmay be emitted a contaminant into the natural environment, other than water. Approvalis also required for the ongoing operation of any equipment that may discharge acontaminant to the atmosphere. The wording of Section 9 is broad and as a result, mostindustrial processes or modifications to industrial processes and equipment require thesubmission of an application for an Environmental Compliance Approval ( ECA) unless
explicitly exempted. Section 194 of the EPA provides an exception to ECA requirementsif the equipment was in place prior to June 29, 1988; however, the MOECC has re-
examined this issue and determined that approvals can be issued for existingequipment installed prior to this date. This determination by the MOECC now facilitatessite-wide approvals to capture all equipment for approval.
O. Reg. 524/98 exempts fuel- burning equipment where the total thermal input of all fuel-burning equipment used to provide comfort heating in the building is less than 1. 58million kilojoules per hour. Other exemptions include any equipment, apparatus,
mechanism or thing that is used for the transfer of outdoor air into a building or structurethat is not a cooling tower, and the ventilation of indoor air out of a space/ room wherethe mechanism does not discharge any contaminant produced by the activities ( withinthe space/ room) other than heat or noise.
Air quality and atmospheric emissions are addressed through air contaminant point-of-impingement ( POI) concentration standards and air pollution dispersion algorithms. POIis defined as the point where airborne emissions from a facility come into contact with alocation beyond the property line. Air dispersion models acceptable to the MOECC maybe used to predict contaminant POI concentrations. The MOECC' s Standards
Development Branch has released a publication entitled " Summary of Standards andGuidelines to support Ontario Regulation 419105 — Air Pollution — Local Air Quality".This publication outlines all of the applicable standards and guidelines that govern POI
standards in Ontario. According to MOECC representatives, POI limits have been set sothat, in theory, if these limits are met, then the AAQC will also be met.

In July 2005 " Ontario Regulation 419/05 Air Pollution — Local Air Quality", was published
and took effect November 30, 2005. This regulation revokes and replaces Ontario
Regulation 346 General —Air Pollution and introduces:
New effects- based air standards with variable averaging times;New air dispersion models;
A new risk- based decision making process;Outlines the required content of Emission Summary and Dispersion ModelingESDM) reports; and,
Outlines the circumstances under which a person could request an alteration to astandard set out for a contaminant.
1. 2 Noise Emissions
Noise is considered a contaminant under the EPA. As such, an ECA is required forequipment that generates noise under Section 9 of the EPA. Facilities that emit noise
must conduct a noise screening or acoustic assessment that demonstrates compliance.Noise screenings apply a minimum separation distance that a facility must be awayfrom a nearest noise sensitive receptor. This ' minimum separation distance' is
determined by a facility' s NAICS code, the class of neighbourhood as well as the typesof activities that occur at the facility. All facilities that do not meet the minimum
separation distance as determined in the noise screen process must complete a more
detailed acoustic assessment in order to validate that they are in compliance with theministry guidelines.
Acceptable noise levels in residential and recreation areas are determined as outlined inthe MOECC Publication " NPC-300 Environmental Noise Guideline" ( NPC- 300).
1. 3 Zoning
Generally, restrictions for areas that are zoned for industrial uses are minimal. Not allindustrial zones permit the same land uses and specific industrial designations haveimposed restrictions. Commercial zoning designations are more restrictive than
industrial zoning. Often times many types of industrial processes are prohibited frombeing installed in these zones. In many instances, exemptions or even rezoning arerequired prior to installation of industrial processes. The legislation that governs zoning
for the City of Timmins is By- law No. 2001- 7100.

2. 0 COMPLIANCE ASSESSMENT
2. 1 Air
Air dispersion modelling was conducted using US EPA AERMOD. The assessment wasbased on the specifications of the proposed unit and details of the surrounding area,
The location of the cremator stack was chosen where it would be likely to fit well withinthe building. Also, the presence of HVAC and unit heaters were also modelled.
The results of the modelling show compliance with the limits imposed by O. Reg.419/05. A full Emission Summary and Dispersion Modelling Report ( ESDM) can be
developed when the proponent wishes to apply for an ECA.
2. 2 Noise
Noise modelling was conducted using SoundPlan 4. 0 noise modelling software. Thesoftware employs calculations specified in ISO 9613- 2: 1996, which is accepted as theindustrial noise standard for demonstrating compliance in Ontario.
The output from the model was compared to the limits in the NPC- 300 Guideline anddemonstrate compliance with the applicable limits.
2. 3 Zoning
As indicated above the zoning for the proposed incinerator location is EA-GC - General
Commercial.
As described by By- Law No. 2001- 7100, there are two types of activities which includecremators in their descriptions. These two types of activities are presented below.
Funeral Home
Means a building or part of a building wherein undertaking services are offeredand may include subsidiary activities such as the sale of caskets and funeralaccessories, memorial services, crematorium, provided such activities are clearly
secondary and incidental to the main undertaking service.
Cemetery
Means a cemetery within the meaning and as regulated by the Cemeteries Actand may include a crematorium, mausoleum and columbarium.

A Funeral Home, as described in the by- law, is a permitted land- use for the zoningdesignation EA- GC — General Commercial. However, according to the by- law, thecrematorium would have to be the secondary activity at the site and not the primaryactivity. The proponent will require written permission from the municipality to operate inorder to receive a license for a cremation facility through the BAO.

3. 0 CONCLUSIONS AND RECOMMENDATIONS
A summary of the air and noise results can be found in Appendix A. From the results ofthe air and noise assessment it is likely that the facility will be able to meet the provincialrequirements for the installation of a cremator facility at the site referenced above.
The proponent will also require written permission from the city to engage in theproposed activity on the site.
