Come Join us to learn about Procurement opportunities for an upcoming UT – High Density Storage Addi-

tion project in Austin. The approximate 10,000 S.F. High Density Storage build-ing will be used for remote storage of library materials. The new addition will be a warehouse style building with pre-cast insulated concrete wall panels, Ff-60 concrete floor slab and the roof framing will consist of steel bar joists and metal deck. The high-density area has no windows, and as few penetrations of walls and roof as possible. The building will have separate HVAC and dehumidi-fication system with particulate and gas filters to maintain a constant tempera-ture at 50°F +/- 5°F and relative humidity levels at 30% RH +/- 5%. During these subcontractor outreach sessions you can learn more about the project, meet the project team, discuss scope of work packages, learn about UT re-quirements and how to pre-qualify with Turner. We are also hosting a pre-proposal conference on August 4th for the early proposal packages (precast panels, steel and shelving) that will pertain to the project shown in the second attachment. OSHA Delays Enforcing New Safety Reporting Requirements

The agency on July 13 moved the enforcement date to Nov. 1 from Aug. 10. OSHA's action came one day after a coalition of industry groups filed an emergency motion in a federal district court to prevent the provisions from going into effect. For the first time, the provisions would prohibit “incident-based” employer incentive programs and routine mandatory post-incident drug-testing programs. Construction organizations say that, when such programs are tied to safety incidents on jobsites, they help employers to make worksites safer, often by identifying the source or cause of an injury or other inci-dent. Greg Sizemore, the Associated Build-ers and Contractors’ vice president of health, safety, environment and workforce development, said in a statement, “It’s inconceivable to us who study how to improve safety performance that OSHA would want to limit drug and alcohol testing as part of the investigation after an accident or near-miss incident. Root-cause analysis is key to devel-oping procedures that prevent fu-ture incidents, so we need to know whether drugs or alcohol were a factor.”In the rule, which OSHA is issued in its final form on May 11, the agency says programs that re-quire post-incident drug testing unlawfully retaliate against employ

ees and can create a culture of in-timidation. Kimberly Darby, an OSHA spokes-woman, says the requirements that are being postponed prevent em-ployers from discriminating against or discharging employees who re-port a injury or illness. "We delayed enforcement of this provision be-cause we wanted to take the time to provide more compliance assistance to stakeholders," she says. Organized labor supports the OSHA rule. AFL-CIO President Richard Trumka said in a statement issued in May that the regulations "will bring workplace injury and illness report-ing into the 21st century and provide important new protections to work-ers who report injuries." The coalition, which includes ABC, the National Association of Manufac-turers and the American Fuel & Petrochemical Manufacturers, filed an emergency motion in the U.S. District Court for the Northern Dis-trict of Texas, Dallas Division, re-questing a preliminary injunction against the anti-retaliation provi-sions. Industry groups generally oppose the entire rule, which they say would not improve jobsite safety but could increase lawsuits and public shaming of employers. The rule requires employers to file safety-incident reports electronically. Those reports are publicly available ediate action in advance of the effective date.” A challenge to the broader rule, which goes into effect in 2017, “is under serious consideration,” he adds. Advocates of the regulation say the electronic reporting require-ments will create transparency and improve the accuracy of data about jobsite safety, which should create better outcomes.

Small businesses’ bank accounts vulnerable to cybercriminals

It’s a chilling moment when a small business owner discovers hackers have stolen thousands of dollars from the company checking account. Cybercriminals took an average $32,000 from small business ac-counts, according to a December survey of owners by the advocacy group National Small Business Associa-tion. And businesses don’t have the same legal protection from bank ac-count fraud that consumers have. T h e Electronic Funds Transfer Act, passed in 1978, states that it’s intended to protect individual consumers from bank account theft, but makes no mention of businesses. Whether a business is protected depends on the agreement it signs with a bank, said Doug Johnson, a senior vice president with the Ameri-can Bankers Association, an industry group. Any business is vulnerable, but small companies are less likely to have security departments and procedures to guard against online theft than big corporations do. They also don’t have big revenue streams that are able to absorb losses from a theft. Sandy Marsico, owner of Sand-storm Design, a Chicago marketing company, said her company accounts were attacked twice. Her bank con-tacted her in December 2014, saying a transfer of over $50,000 to Mexico had been requested from her checking account. The thieves had obtained the account information; Marsico said she still doesn’t know how. The bank did an investigation but didn’t share its findings with her. Marsico didn’t approve the transfer, the account was closed and a new one opened. But the following November, someone began withdraw-ing money from the new account in increments ranging from $1,000 to

$4,000, a total of $20,000 in the course of a month. Marsico didn’t discover it until she got her monthly statement. The bank, which again did an investiga-tion but didn’t tell Marsico the results, again reimbursed Sandstorm. Marsico has since moved some of her accounts to another bank. Cybercriminals are changing methods as companies and banks find ways to prevent attacks. Thieves are increasingly using realistic-looking emails to trick compa-nies into transferring money from their accounts with what’s known as wire transfers, said Avivah Litan, a security analyst with research company Gartner. Often, an employee receives an email purportedly from a company executive asking them to transfer the money from the company’s account into a specific external account. If employ-ees don’t check to be sure the request is legitimate, they might go ahead and authorize a withdrawal. The FBI reported last August that more than 7,000 U.S. companies of all sizes had been victimized in emailed attacks since late 2013, with losses of more than $740 million. The government said the number of identi-fied victims had surged 270 percent between January and August of last year. Criminals can also operate by planting malicious software known as malware on a company computer, often via an email that has a link or attach-ment. If the computer is used to log into a bank account, the malware can record the login and password and send it back to the criminals, who then withdraw funds. Business accounts are safer at banks that use what’s known as two-factor authentication, requiring unfamiliar account users or devices to supply additional information like one-time access codes, said Timothy Ryan, a managing director with the security company Kroll in New York.

Subcontractors say late and delayed pay-ments are becoming an ever more pressing issue, even as the construction market and the overall economy show strong signs of improvement. An ENR survey of 640 subcon-tractors found that more than 30% of payments from general contractors are coming in late, with an average delay of 36.4 days. The problem, if anything, has gotten worse over the past few years, say subcontractors, with some owners and prime contractors standardizing less-than-prompt payment on many projects as a general business practice. “It’s terrible,” says C. Carroll Heyward, Sr., chief executive of W. B. Guimarin and Co., an HVAC and plumb-ing contractor based in Columbia, S.C. That company’s payments now roll in nearly 90 days late. On average only about one out of three payments is late, the survey shows. But for 83 subcontractors who responded to the ENR survey, the problem is far worse, with more than six out of 10 payments delayed or late. A total of 168 subcontractors reported to ENR that at least 40% of their payments are late now. How much state prompt-pay statutes help prevent even further deterioration in pay practices isn’t clear. All 50 states have prompt-pay laws, and some cover private construction as well as public works. Terms and interest penalties vary. So do the relation-ships on the payment chain that is covered: owner to prime, prime to sub and sub to lower tiers.

Difficulties in collecting final payments sometimes drag out for years, some sub-contractors have said. The Alexandria, Va.-based American Subcontractors Association, which regularly fights the battle for improved payment practices, has had its own payment surveys. ASA’s most recent data cited “slow final payment” as a very serious issue, with another 27% calling it “somewhat serious.” “Certainly there are owners and prime contrac-tors who are good payers or generally good payers,” says Colette Nelson, the ASA’s chief advocacy officer. “There are also owners and prime contractors who are simply preda-tors. It is really easy to be the lowest bidder if you are not going to pay your subs.” For W. B. Guimarin and Co., the problem of late payments has escalated dramatically over the past couple of years, Heyward says. Back in 2013, payments were coming in, on average, 49 days late. That jumped up to 82 days in 2014 and 120 days last year. The delays have puzzled Heyward, who says that with interest rates still at rock-bottom levels, there is not a

lot to be gained by someone else holding onto the money owed to his company. “I am just confounded by it all,” he says.

86 Days Past Due Jim Slack Jr., president of Slack & Co. Con-tracting, Inc. in Houston, notes his average payment is now 86 days past due. He’s con-vinced that the delays are part of a conscious and growing technique by general contractors and owners to improve their own cash-flow situation at the expense of their subs. Project owners can certainly collect interest on subcontractors’ payments money while it sits in their bank accounts, notes Slack, whose company performs excavation and grading. But if the owner or general contractor is borrowing money themselves, it can delay the point at which they have to take out money and start paying interest on it. “We are farther down the food chain,” Slack says. “In my opinion it is a conscious effort by those parties to improve their cash flow.” “It’s getting worse,” he says of the late payment trend. An execu-tive at a Pennsylvania specialty contractor offered a similar assessment. Not long ago, a large percentage of her firm’s work was paid within 30 days. Now that has ballooned to 60 days. Some of the delays may be due to the local economy, which has taken a hit with the decline in oil and gas prices, which have made shale oil extraction less economical. “Lately in the past two years, things have gotten progressively worse in terms of getting paid,” says the Pennsylvania executive, who preferred not to be identified. “If I had all the money that was owed me right now, I would be walking tall.”When it comes to ensuring they are paid what they are owed, subcontractors have developed different strategies. Heyward has tried to weed out the bad apples while adding a percentage or two to his bid if he has reason to believe that pay-ments will be delayed. “We have actually quit quoting some customers who in our opinion have been abusive in how they have paid their subcontractors,” he says. By contrast, Slack takes full of Texas’ mechanics lien laws to make sure his company gets paid what it is due. Slack starts with an initial notice signaling his intent to file a lien, sending it to contractors and project owners. If that doesn’t shake the payment loose, he follows that up in 45 days by filing a mechanics lien on the property. “I don’t care if it’s my mother, I will file a lien on the project,” he says.
