ENCLOSURE – 2 Raju Sagi

Raju threatened pharma boss: CBI Oct 21, 2010 |

• Correspondent New Delhi, Oct. 20: The CBI on Wednesday placed before the Supreme Court a statement of Hyderabad-based Gland Pharma’s director, Mr B.N. Rao, in a bid to make a case against former Satyam chairman, Mr B. Ramalinga Raju. to cancel his bail, while his counsel tried to give an altogether a new twist to the projection of the “inflated” share price of the company. The CBI’s special prosecutor, Mr H. Venkatesh, in an affidavit, placed before a bench of Justices Dalveer Bhandari and Deepak Verma stated that the statement of Mr Rao was recorded on September 21 following a complaint from Gland Pharma that Mr Raju was “misusing” his liberty to put pressure on Mr Rao, a witness in the case. The additional solicitor-general, Mr Haren Rawal, appearing for the CBI explained the contents of the affidavit stating that Mr Rao’s statement had revealed that “Mr Raju and his family members thro-ugh their five investment companies and 10 front companies had acquired 39.45 lakh equity shares of Gland Pharma for a value of `26.03 crore between June 2000 and April 2006”. “These were the proceeds of the crime,” Mr Rawal alleged while urging the bench to cancel his bail on the face of the evidence placed before the court. Mr Rawal said Mr Raju had tried to “influence” Rao despite clear instructions by the CBI, enforcement directorate and the Company Law Board not to indulge in any such activities. Rebutting the charge of CBI, Mr Raju’s counsel, Mr Ashok Desai, said the whole issue of the so-called statement was a result of a letter written by Mr Rao, much before the case was registered and hence, it could not form the basis for the relief sought by CBI. Mr Desai also tried to give altogether a new twist to the Satyam scam, saying the whole issue of “inflated” share price, which Mr Raju explained in his January 7, 2009 letter to the Satyam Board, was in fact “aimed at saving the company from being acquired by others”. “The management was worried that the share of the company may be purchased by outsiders and the company would be taken over by others. They inflated the price of the share. I am not saying that this is a fair or nice practice. I will not approve it. I am only pointing out that there was no siphoning of money from the company,” he claimed. Surprised over such an argument, the bench asked Mr Desai whether such a practice was followed in the corporate world. “Are other companies also doing this (inflating share price)?” Justice Bhandari asked.

Raju Sagi ENCLOSURE – 2 (contd.) “Companies do inflate the price of shares to ensure that the shares are not purchased by their competitors,” Mr Desai said. Mr Raju’s counsel then read out the entire text of Raju’s January 7, 2009 letter and said “it nowhere indicates the admission of the crime.”

Giving Raju company are Sri Lankan-origin American hedge fund manager Raj Rajarathnam (third), former Merrill Lynch CEO John Thain (2nd) and Goldman Sachs' Lloyd Blankfein (1st).

My Dear Durga,

Your husband's Hate Mails

I have suffered ignominy for well over two years putting up with Hate mails from your husband;consisting of scurrilous attacks aimed at humiliating me and my family and Dr.Prudhvi Raju'sfamily. I have silently suffered with a view to save your family relationship with your husband.It also appears that my patience has been misconstrued.

I tried, in vain, to have his close relatives and well wishers to intercede and prevail upon yourhusband to give you the courtesy, a wife ( for over 37 years ) deserves. I fully appreciate yourapproach for making the marriage to survive. Notwithstanding my prayers in support to yourwish, facts are facts and the documents from your husband, it is high time, are addressed as

they need to be.

The emails relating to this subject which came to my possession are 60 plus pages starting from27th July,2010 and ending with 22nd September ,2012.

The first email was the outcome of his visit to the Farm House on 21't June, 201-0 (a day afterKavitha's wedding) when the sight of a new Bungalow made him "go berserk" ( email ofTthSeptember,2O!2). Hethenstartedabarrageofemailswithpersonal attacksonmeandmyfamily, and attacking, more painfully, Gland Pharma which is today supporting severalthousands of men and women directly or indirectly.

False claims to huge finances and properties as per email of 7th September makes his positionabundantly clear. I quote from email of the 7th Septem ber, 2OL2:

........ tronsfer the educotionol foundotion along with the colleges in the nome of SAGI

KANAKA DURGA and her doughters - KAVITHA and DEEPIKA ond US $e million in cosh.or

USD S 3 million plus yeorly income from L0 acres of Srungovrukshom lond from 1977including income from 200 coconut trees from 1984 compounded ot 1-8% thru 2012 plus 70

acres of ogricultural land locotion to be nomed. "

This mail read along with 50 odd pages in my possession prior to this one, in my opinion, leadsme to consider his hate mails are directed towards;

Demand for Dowry; and / orSustained Blackmail for Extortion; and /orHolding you Hostage for Ransom

There are many falsehoods; Frequent threats of Divorce; unabashed claim to having treatedyou like a servant, slave and subjected you to physical abuse; and perverse references toDr.Prudhvi Raju's family (who gave shelter for over six months at a time he was without a job)in most dishonorable and heinous terms.

Unauthorisedly registering WEB sites solely with intention of

1) destroying me by damaging the companies which will affect the livelihood of severalthousands of men and women directly or indirectly;

2) soliciting complaints from lnvestors /Employees and postingthe mails to L42 people onL5th November,20L1,;

3) writing to US Govt. authorities stating the interests of Health and Public safety of U S

citizens are at stake if Heparin lnjections of Gland Pharma are permitted into US

are issues that need to be addressed.

Hence this letter to you. These interests, above all, make it obligatory for me to takelegal recourse. I realize I may be putting my daughter's interests at risk. 28 months of patience,you will agree, is long long enough and now "Protecting" the interests of the Company and"honour" of my family take precedence.

It is open to Dr.Prudhvi Raju and his family members to take appropriate remedies to themalicious references made to them. The same applies to my son, his wife and children (whowere also targets of his ire).

I also reserve my right to exercise on further course of action as directed, from time to time, byCompany attorneys and also my personal attorney.

Yours affectionately,

PVNRaju

P.S.: As said above, the documents in my possession contain several objectionablestatements for which your husband is answerable. We shall pursue these mattersdirectly with him from now onwards.ru
