TOWN OF PINE GROVE 2016 SEWER RATE ORDINANCE

BE IT ORDAINED BY THE COMMON COUNCIL OF THE TOWN OF PINE GROVE, WEST VIRGINIA:

I. PRIOR ORDINANCES-- The provisions of any prior Ordinances of the

Town are hereby repealed and replaced insofar as the matters herein addressed

are addressed in such prior Ordinance provisions are not inconsistent or in conflict

with the provisions herein said prior Ordinance provisions shall remain in full force

and effect.

I I . SEWER RATES - REGULAR USERS - The following sewerage rates

shall be effective as to all of the territory served by the pine Grove Municipal Sewer

System for all domestic, commercial and small industrial users based upon the

metered water consumption for each user:

A (1) RATE- EFFECTIVE NOVEMBER 25,2016 -- $6.64 per 500 gallons

B (1) MINIMUM CHARGE- EFFECTIVE NOVEMBER 25,2016

i. Each metered location served shall be subject to a minimum charge equivalent to 4,500 gallons of usage with no bill to be rendered for less than $59.76

ii. Any Regular Use location served that is not metered, if any, shall be assessed a Fee equivalent to 7,500 gallons of usage with a minimum of $99.60 per month.

Cleaning Services shall be assessed a Fee for each delivery into the Town Sewerage Collection System of $39.93 for each one thousand gallon delivery. Deliveries of less than 1,000 gallons shall be charged $42.36 each and Deliveries of fractional thousands over 1,000 shall be rounded up to the nearest thousand.

Large Industrial users shall be assessed a Fee of $3,3993.03 per sewer

Random or “Drop-off users such as Motor Homes or Septic Tank

D DELAYED PAYMENT PENALTY

The above tariff is net. On all accounts not paid in full within twenty (20) days of date of bill, ten percent (1 0%) will be added to the net amount shown. This delayed payment penalty is not interest and shall only be charged once for each bill where applicable.

E DISCONNECTION

If any bill is not paid within forty (40) days of date of bill, water service to the customer will be discontinued. Water service will not be restored until all past due water bills and sanitary sewerage bills have been paid in full and all accrued penalties plus a re-connection charge of $50.00 for water and a like re-connection charge of $50.00 for sewer have been paid.

F TAP-ON -F E E

The connection charge (tap fee) shall be $250.00 or the actual cost of installation, including materials and labor, whichever is greater.

G MULTIPLE OCCUPACY

On apartment buildings or other multiple occupancy building, house trailer (mobile homes) court or park, each family or business unit shall be required to pay not less than the minimum monthly charge herein established.

PUBLIC NOTICE OF CHANGE IN RATES BY THE TOWN OF PINE GROVE NOTICE is hereby given that the Pine Grove Municipal Sewerage System, a public utility, has adopted by ordinance on November 1,2016, a tariff containing increased rates, tolls and charges for funiishing sewer service to 312 customers located at or near Pine Grove, West Virginia, in the County of Wetzel.

The proposed increased rates and charges will become effective November 25, 2016 unless otherwise ordered by the Public Service Commission and will produce approximately $16,473.60 in additional revenue, an increase of 10%. The average monthly bill for the various classes of customers will he changed as follows:

The increases shown are based on averages of all customers in the indicated class. Individual customers may receive increases that are greater or less than average. Furthermore, the requested rates and charges are only a proposal and are subject to change (increases or decreases) by the Public Service Commission in its review of this filing. The Commission shall review and approve or modify the increased rates only upon the filing of a petition within thirty (30) days of the adoption of the ordinance changing said rates or charges by:

(1) Any customer aggrieved by the changed rates or charges who presents to the Commission a petition signed by not less than twenty-five percent of the customers served by such municipally operated public utility; or

Any customer who is served by a municipally operated public utility and who resides outside the corporate limits and who is affected by the change in said rates or charges and who presents to the Commission a petition alleging discrimination between customers within and without the municipal boundaries. Said petition shall he accompanied by evidence of discrimination; or

Any customer or group of customers who are affected by said change in rates who reside within tlie municipal boundaries and who present a petition to ihe Commission alleging discrimination between said customer or group of customers and oilier customers of the municipal utility. Said petition shall he accompanied by evidence of discrimination.
