In the spring of the following year, 1853, a

prevent the disease from spreading. The con-

of the city were unpleasant iu tbe e&trcuie. Thiswas oue of the depots ua tbe Nurtbwestrrn ruutc. and1 bave since had to enter tn ro in various parts of thecity, hat in all of thein I find the same appearance ofbeing ovcrcruwded and dirty. On milking some in-

quiries on this subject, I was informed that thecompanies arc, and have been for a lng time,

uf combining aud building an elcg.mt depot, and that tbey hare been in negotiation with tbe CityCouncil to this effect ever since the great fire, and haveoffered what they consider an adequate price for apiece of land on the lake front which is adapted to

their purpose. But the City Council refuse to grantit except for an exorbitant pri?e, and they will noterect ermanent buildings until this question is settied, especially as tbe land they seek is in just thelo.cation most desirable. One would fancy the City

Fathers would desire the advancement of the cityenoug to grant this. During my first short sojournin tbe city, I was favored with a ride through manyof the principal streets, and had pointed out to me

some few spots where the ruins of the fire arc yetstanding. But what were tbey aincog such Mocks ofelegant building; which hare arisen phosniX'like to

repair the wastes T

The ride through the tunnel under the river, wben

one of tbe bridges was up and the street blocked with

carriages, (so tbst it would require some minutes be.fore I could get a chance to pais over), was anothernovel censation. Cool and dark, so that ittinoatly lighted with gas, it was a dungeon-lik- place

and I had tt confess to a feeling of relief wben I saw

the faint streak of daylight at tbe further end, andbegan tu emerge. Tbe more so, as in some places Icould see tiny streams of water trickling down thearched stone sides.

The streets of Chicago where the private residencesare built, both on the South and West sides (so far asI have seen), are very beautiful, some of them pala-tial, and building is continually going oq. A stran-ger wonders where so many rich people are to befound to occupy all these new residence, especiallyas eery one seems to echo the cry of hard times andMat much money. The churches of Chicago are ele-

gant. The Union Park Church, (Congregational J, isune of the n: t modern and was erected without anylimit to expense, and in consequence is laden with anelegant dibt. The worshippers seem elegant, too, indress and manners, but at a church wcleome given inthe church parlors to their new pastor and his wife.Mr. and Airs. YanJervecr, it seemed to a strangerlooking on. that half the people present were stran-gers to each other, and for easy c rdiality and socialintercourse the simple little chureh parlors in Hono-lulu are ahead. The St, J bns Episcopal church haserected a splendid new edifice, but with great prudence are worshipping in tbe basement until theyhave means enough to 6nih the main building with-

out dbt. After a few days in Chicago, your corre-spondent left for a visit tu a brother in the northernpart of Wisconsin. So far north in fact, that tbeplace is not laid down on tbe maps. Tbe railroadterminates it Cbinpewa Falls, a thriving litt'e townon t e Chippewa river, and then followed a long stageride of 14 miles to Rlosmer. Tbis plaee was fmnd tohe a ibrifty, growing little town in the lumberwhere a busy little stream, une of tbe tributaries oftbe Chippewa, was driving saw, planing and fl unrigmills, and no doubt in a few teirs the iroo rail willbe poshed on tn tbe north, and tbe new s

will lay down this and many other little towns on thenow blank space, and tourists will seek tbe charminglakes and streams, far in the north of Wisconsin.

During the fortnight spent here I bad occasion tonote the sodden changes in temperature to which t beelands of the temperate aona are subject. Travelingone day in ilanit melting beat, tba day terminatedtn a heavy rain sturm witb thunder and lightnirxand the wind shifting in the night to tha northwest,a long, cold storm of fear days aad eights succeeded.

when the thermometer sank to a few degrees abortfreezing point, and parlor stores were brought intoservice, and winter clothing seemed comfortable. Dutas soon as the storm was pa?l and tbe son showed btsface again, straightway tbe other extreme came, andthe thermometer marked 104 in the son at noon.Winter wraps were shed aul muslin dresses, fans andparasols were in fashion, and " melting hot " againwas the err. The crops of wheat and other grainfairly laughed out, and the garden vegetables noddedt each other in growing, a- - if to say " which of uswill get onto the table first." I was surprised to fiudsuch fine farms in that region of the Stat. Tbe peo-

ple of the town were preparing for a grand picnic cele-

bration of the Centennial fourth, and many and ur-

gent were the solicitations that tbe stranger frotn thetropics, should stay and join in it. lint my stepswere set iu another direction, and before the FourthI was again in Chicago, There I found the streetsguy with preparations for toe eomig gala day.

i lags ot every Mte were advertised by long stream- -

ers buns from ton bottom of the treat dry coodsunder ejection

wks and decorations seemed to be legion, ail gaywith fancy flag, deriees and colored lanterns, whitethe little urchins were already getting a foretaste ofthe glorious day, and popping off fire crackers nndtorpedoe.-- iJt.jrgcrel rhyme advertisements uf 6ieworks were thrust inio the hands of every passer-b- y

on every corner. Pat we did not stay tu endure thecrowds or confusion in the city .but the eveuing beforetook passage in a crowded train uf 10 passenger carswhich wended its slow way not into Illinois, stoppingat every suburb and crussing to let cut tbe rwaru Heager city folki bound ' er j the day in the country.Tne Centennial Fourth was preceded and followed byfloods of rain. In ire I for some hours on the morn-

ing of the Fourth, the eaer pierickers feared theirplans for tbe dav wrre wholly upset, but tbe old say- -

ing "rain before seven, e'eir before eleven " heldgood, ana the wagons gay with t; ani piled foil

f happy, patriotic yooth, passed y in every direc- -

tion. cheering and singing national sonsfS.In La (trange, one of the quietest and most heauti- -

ful suburbs of tbe city. I spent a quiet, restful daywith the family of II. II. Lyman, jr , who is now asuccessful lawyer in Chicago, and who is much inter-este-

in buildiug up tbis suburban town, going in andout of the city daily on the cars. The Chicago

tbe next day, gave full accounts of the celebra-tion in Philadelphia, and all tbe other great centres.Tbe night after, as I have already intima ed, wasfearfully ctnrmy. Lightning, thunder, wind and raincombined, made the hours almost frightful and 9utsie

fearful casualities were reported from floods in Iowathat night.

Of course the usual number of accidents and casu-

alities resulting from the free use of gunpowder arereported, and probably the bereaved parents andmaimed children, will have cause through life to re-

member the Centennial Fourth.tl aLBSBStt, III., July 10. Having taken a run

off the track into this beautiful State for a fer days.Imust end my second letter with a few words aboutthis charming little bur. This is tbe site uf KnoxCollege, an institution where young ladies and gentle-men pursue their education together rerj much a atPunahou, only here tbe ladies have a separate estab-lishment for boarding and sleeping. The friends Ivisit here hive ebarge of the Young Ladies' Home, and are now enjoying a vacation. Of course tbelarge halls, spaemus parlors and d rtuitnries arc slilland deserted now and seem very lonely, while thetarge dining room hoiks as u it were just loosing forits full quota of bright, young girlish faces It makesone almost long to see them though all would bestrangers, I find our Island views and pressed ferns,as well as the Hawaiian Sabbath school a greatsource of interest aud pleasure to all I meet.

I do not expect to re.icb Philadelphia immediately, but tbe eiposit; i. wili keep, and that is the order oftbe day now, both in city and cnntry. It is posi-

tively refreshing thc-- e hot days to look across thestreet from this building into tbe lovely park, thickwith trees and carpeted with greenct of grass. Ithas rained a good deal this summer all through tbeWest, and every two or three days there are violentthunder storms. tho streets are so tuu Idythai I must forego my carriage ride until to morrow, and at noon on the morrow expect to return to Chi-

cago, li. A. C.

dence. Original was not produced and the copywas nummed.

It wna not necessary for us to decide in thiscase. bet her ttie production ot the original l-

icense itself was the only evidence nr even thebeat evidence of the tact that deteiidunl was utthe lime of the alleged sale n licensed vender ofspirituous liquors, if thu record required by law

lu this case, however, the cletk o' the InteriorDepartment produced the bond filed by defend-

ant, and t lie copy of the license required by tbeslulutu form ot the bond to be annexed to thebond. (See sec. 26. chap. 41. Penal Code, andthis would seem to be sufficient.

But it is conli uded that the notice to producethe original license was nut reasonable. Nowwhether a notice is reasonsble or not is a questionupon which the court must exercise u sound dis-

cretion iu reference to the circumstances of theparticular cose.

3 v end. 296, 7 Cow. 739. 7 Wend. 216, IflWend. 50.i.

The suture of this action would naturally ap-

prise the defuudaut that the government wouldcharge him either with the possession of the

r that proof would be offered that such alicense hud been Issued to bim. The denmud forit then could not have surprised defendant.

The court notices ul.--o that the placd of busi-

ness, where this liceuse aulhoiized the vending ofspirituous liquors, is described in the bond pro-

duced as the ' ltoyui Hotel," coruer of Merchantand Nunnnu streets, Honolulu, being in thesquare adjoining the police court. This was quiteaccessible to the defendant and un opportunitywas offered him to produce the original which we

roust infer he declined to avuil himself of. us themagistrate cotes original not produced." Un-

der the circumstances, therefore, a delay of onlysay five minutes would have been necessary toenable the defeudaut to produce the license, undnotice early III the trial was sutlicient in this cose.no disposition beiru? shown by defendant of lailliuguess to produce it.

On the second point. The magistrate tooktbe testimony of the several persons to whom theliquor was MM who swore that they were nativeUawaiiaus. born iu this kingdom. But the mag-

AW A (chinaman) vs. J KAMtO, ADJtlX-ISTRATU- R.

In Banco,opinion et Harris, J.

The first ground of exception is that tbe de-

fendant had judgment at this term of the Courtin another action in which the plaintiff claimed as a m ot inouey, being halt of thn proceeds of anawa crop, said to belong to him and tbe deceasedman Aniuni as partners.

This suit was in the nature of an action for theconversion of partnership goods, over which theplaintiff averred that he had a right as a partner. He might have claimed the whole goods, is well

as a half of ihem, if he bad cbosen. Tbe wholequestion raised was partnership or no partnership.Under the allegations and proofs, if he were apartner be was entitled to recover without abate-

ment and would bare been entitled to recover,if he bad claimed tbe whole of the crop. If bedid not ebow himself to lie a partner under tbeallegations and proofs in tho first actiun. hewould not be eutitled to recover anything. Tbejury was so instructed aud fouud thai be was nota partner.

In this action tbe plaintiff accep'.s the first verdiet as conclusive, and brings bis aclioo claiminga quantom meruit for work and labor done by

him for the beoefit of Aniani and bis estate. This is clearly a different cause of action cer-

tainly not adjudicated in the first suit. There-fore tbe first exception is overruled.

Do the second point of exception we are of

opinion that Ali's testimony of what be was pay-ing on a rice plantation was admissible.

The plaotiog of rice as well as of mi is anoperation and required a like kind of hi

bur. One might as well say that hoeing cornand mowing grass, or planting potatoes and plant-ing wheal were not similar employments.

Upon tbe third exception, the concluding in-

struction of tbe court to wit : That tbe jurywould fiud for the Bide on which the evidencepreponderated, was all that tbe defendant couldrcqaire.

With regard to tbe last exception, namely tbeintroduction of the Chinese account book, tobow what bad been done with some money

which appeared daring tbe trial to have beenreceived by tbe plaintiff for the sale of some awa.

It is sufficient to say that there was no noticeof let off given by tbe defendant, and tbe wholequestion of the money received for awa wastherefore not in issue. It having traospired inthe course of tbe testimony tbat a sum of moneybad been received, it neither harmed norbenefitted one side or the other to continue tobow what had become of it.

Exception overruled and plaintiff may havejudgment pn tbe verdict.

Shall Prisoners Testify- ?A bill fixing rales of practice in regard toeridenee,

and which includes a provision allowing parties to

testify in both civil and criminal cases has been in-

troduced in the Legislative Assembly and is now un-

der discussion. In lS72abill with a similar provis-

ion was defeated probably on sccoant of the proposedreform in criminal practice. There is but little doubtbut thai a hill for allowing parties in civil cases to

testify would have parsed if it had been offered by it-

self. Arain are these two somewhat distinct andradical reforms proposed in one bill. It may be saidthat the principles of hjth kinds of eases are the same, yet although this is largely true, the circumstances oftbe application of these principles are so widely differ-

ent io criminal eases from wbst they are in civil cases, that it is impossible to do justice to tbe question ofthe proposed change in either case when combinedwith the other in one motion.

The question of altowiog a prisoner to be a witnessfor himself, is one of great importance, not only to thepublic but to parties themselves, aud cannotbe safrlyleft to follow the settlemaut of the similar question incivil esses.

The bill provides for the prisoner to be a witnessfoff himself or not, as he or bisccuusel decides is mo.lprudent, and contains a warning clause thsthis refas-- I

at to testify shill nol be d against him. Tnisplan has at first sight the appearance of great plausibility, but on examination vve hnd strong reasons todoubt its policy. It is hardly a practical matter tomake a witness in his own Bass, out of a prisoner. Asa rule, the majority of prisoners are guilty of Ihe of-

fences charged, and the proposed chango gives to acias. ot men who are notoriously without priociploor conscienee, (be strongest temptation to perjury, which they would not be slow to take advantage of.On tho other hand the discretiou given by tho proposedlaw to the defence, places the counsel in a mcst pain.fat situatiou. " ly not calling tho prisoner ho mightexpose himself te the imputation of a tacit ooofessionof guilt, by calling bim bo n.ight expose sn icnocentman to a which might make bimlook guilty.'' The provision uf tho statatc tbat thesilenco of tho prisoner should not be construed unfa-- :vorably, would be insufficient to save the juiyand tbocourt troin unfavorable taipressions. Ihsy could nothelp such iiupre-sion- s if they tried, and this fact isenough in itself to condemn the proposed ehauge incriminal trials, especially as tbe oppusiag advantageis only testimony that generally the jury will not be-- ilicve.

I agree with those who favor this change, that thopresent system is imperfect and nods modification, but not in the way proposed. Unprofessional think-ers wi-- easily see the hardship of sealing the tonguesof those who of all others are best informed and mostnbto to clear up the apparent contradictions of evi-dence frequent in criminal cases. Hut shall thisbe broug. t about if prisoners are not to be introducedas witnesses? Tho practice of interrogating prisonersafter tbe evidence agaiust them is iu, was the rule inKugland for centuries. This old practice uith somemodifications, contains tho Solution tJ this question. The proceedings would be something as follows : Atthe preliminary examination after thcevidenco againsttho prisoner is taken aud before committal, he is ques- -

tiooed by the committing judge iu open cuurt or, theevidence against him, the questions and answers be--

ing rocirded in lull aud scut up with the depositions."At the trial. says James Mepheus who hastreated clearly and fully on this subject in his masterlywork on the criminal laws of England. I think thecounsel tor the crown ought to interrogate the pris-oner at the end of his case and before the prisoner'sdefence. I would allow him to nsk leadingqucstions, and I vtcu'd allow tho counsel for tho prisoner to re-

examine, and the judge and jury to interpose anyquestions they pleased " And he furthermore says

" the objection to making it tho duty of the judgeto examine him is, that it is of the lirst importaucothat the prisoner should bo carefully protected againstanything liko intimidation. The authority ot thoCourt and tbfl sentiment of ihe public would effectual-ly protect bim against anything of this sort on thepart of the Counsel for tbe cruuu, but no one couldprotect him against the judge." The prisonerwould not bo compellable to answer, but wouldreply to what questions he clo.se. I think it will boreadily seen that such a system would favor the ac-

quittal of the innocent and the conviction of tbo guilty,if this is so, it is .in unanswerable argument fur it.Simply ns a proceis for arriving at the truth of a mat-ter, It is superior to the proposed change, in that itdraws from tbe prisoner all tbe information re is will-

ing to give, while in the other case a prisoner .who isready to testify to a part of his information, will re-

fuse to go onto the stand to save himself from beingcompelled to testily on other points, aud su the wholeof his information is lo.t. It seems a reasonable andhumane method to allow ono charged with an offenceagainst the laws, an oppurtanity of explaining

suspicion which tho evidence has thrownaroand him. Such a system is strongly analogous tothe practico inequity courts, where tho defendant isallowed tu file his answer replying to each nnd ercryitem of tbe bill of complaint and to add other explan-atory matter in evidence of the complaint withoutbeing exposed to tbo misconstructions of tho witnessstand anil is just as necessary for the proper iccuiityof the prisoner as that is for tho proper defence ofherespondent. - II.
