Attached is a notification received from Finland of a bilateral agreement concluded with Macao for the period 1 January 1987 to 31 December 1991.

With reference to Article 4 of the Arrangement Regarding Inter-national Trade in Textiles (hereinafter referred te as the MFA), dene at Geneva en I Deeember 1§73, and te the Protocol extending the MFA, done at Geneva en 31 July 198S, I have the honour to notify the Textiles Surveillanee iedy ef a Memorandum of Under-standing between the Government ef Finland and the Government of Maeau, signed on IB November 1916. The Memorandum provides for limitations to the exports te Finland from Maeau of five categories ef textile products. Restraints are effective from 1 January 19S7 to 31 Deeember 1991.

The product coverage ©f tht Memorandum is identieal with the previous Memorandum of Understanding. The category containing wemen's and girls' knitted underwear has been moved frem Annex I (quantitative limits) to Annex 11 (administrative eentrel). The category (new CAT-II) containing knitted ©r ereeheted jumpers, sweaters, cardigans, blouses and T-shirts has been moved fr©m Annex II te Annex I. The base levels have been slightly adjusted and the annual growth rate has been raised te i,S per cent, which means an increase ©f 0*6 to 1,6 per cent in all categories but ©ne. The Memerandum provides fer carry ever and carry ferward, taken together up to 10 per eent, ef which carry ferward shall net represent mere than 6 per cent. It aïs© allews fer a swing ©f S per cent*

The Government of Finland believes this Memerandum ©f Understanding is in eenformity with the provisions ©f the MFA and its Preteeel ©f Extension.

MEMORANDUM QF UNDERSTANDING BETWEEN

THE GOVERNMENT OF FINLAND AND

THE GOVERNMENT OF MACAU RELATING TO THE EXPORT

FROM MACAU OF CERTAIN TEXTILES AND TEXTILE PRODUCTS

FOR IMPORT INTO FINLAND

During the consultations held in Masau m November 11, 19§§ between a delegation front Finland ana a delegation Iron Macau ana having regard te the Arrangement Regarding International Trade Textiles, in particular Article 4, and te the Freteeel extending the aaid Arrangement dated July 31, 19S§, agreement was reaehed a§ fellows;

1. The fellowing arrangemente shall apply for the period of January 1, 1917 to December 31, 1991.

2. Naeeu agrees to voluntarily restrain the exporte to Finland of the textile produete specified in Annex 1 to the limite set out in that Annex.

3. Finland will for the purpose of the present arrangemente admit imperte of the textile produete of Macau origin eet out in Annex I to the agreed li-mite, provided that such importe into Finland are covered by an export au-thorization and a certificate of origin, as per specimen at Annex XXI. The export authorization ehall bear an endereement by competent efficiale to the effect that the consignement concerned has been debited to the agreed levels fer ©apports to Finland for the relevant period. The date of ehipment indicated on the export licence shall be considered to be the date of exper tation,

If the information available to the Finnish authorities through the import surveillance system shows that the quantitative limite for the produete spe elfied In Annex I have already been reached or that the unueed balance ©Î these limits are insufficient to cover the goods specified in the expert su thorization(s), the Finnish authorities may, subject t© the provisions of Articles 5 and 6, refuse to admit importe of such produete for any quantity in excess of the quantitative limits set out in Annex I. In such a ease the Finnish authorities shall immediately inform the Macau authorities.

5. E&qperts may exceed the limits in between all categories by five(6) per cent provided that a corresponding reduction is applied to the ether limite. For the purpose of calculating such a reduction the conversion factors listed in Annex l shall apply,

6. Carry-over and carry forward taken together shall not exceed ten (10) per cent, of which carry forward shall not represent more than five (6) per cent. The limit set for 1986 in the previous agreement can be carried over to the limits of 1987 up to ten (10) per cent of feese limite.

7. Macau shall endeavour to ensure that exports of the textile preduete sub-ject to quantitative limits are spaced out as evenly as possible ever the year, due account being taken, in particular of seasonal factors.

8. Imports of textile products specified in Annex II from Macau te Finland shall be subject to administrative control.

In respect of these products Finland will authomatically Issue import li-censes upon the presentation of export licenses issued by the competent Ma-cau authorities.

Finland may request consultations with Macau with a view to reaching a mu-tually acceptable solution for the imports of these products when limita-tions on trade in such products may be necessary to eliminate real risks of market disruption.

The Parties shall enter into consultations as soon as possible with a view to reaching agreement within two months at the latest.

Pending a mutually acceptable solution Finland shall have the right to in-troduce a quantitative limit at an annual level not lower than that reached by imports of the product in question in the twelve-month period termina-ting two months preceding the month in which the request for consultations was made.

9. Finland and Macau agree to consult together, at the request of either party on any matter arising from the implementation of these arrangements.

10. Macau will forward to Finland monthly statistics on a cumulative basis on the textile products for which authorizations for export to Finland have been issued. Finland will forward to Macau monthly statistics on a cumula-tive basis on imports from Macau of the said products.

11. Either Party may at any time terminate these arrangements provided that at least one hundred and twenty days notice is given, in which event the arran gements shall come to an end at the expiry of the one hundred an twenty days period.

12. The Annexes to this Memorandum of Understanding shall form an integral part thereof.

Done in Macau on November 15 in the year of 1986.
