Please be advised that this matter was considered by Council at its Council meeting held on March 4 , 2015. In this regards, Council adopted the following resolut ion:

Moved by Mayor Fosbrooke , s e c o n d e d by Counci l lor Gordon; W h e r e a s the Provincial Government has recently introduced "Bill 52, Protection of Public Participation Act, 2014" ; and W h e r e a s Bill 52 seeks to amend the Courts of Justice Act, the Libel and Slander Act and the Statutory Powers Procedure Act in order to protect expression on matters of public interest; and W h e r e a s Bill 52 is commonly referred to as Anti-SLAPP legislation and is intended to enact many of the recommendations put forward by the Ant i -SLAPP Advisory Panel of 2010; and W h e r e a s SLAPP l i t igation, an acronym for Strategic Lawsuits Against Public Participation, is a tactic which is often viewed as a means to silence, int imidate and deter people f rom participating in discussions on matters of public interest; and W h e r e a s the Province has stated that the ability to freely participate in public discussion about matters of public interest, wi thout fear of retr ibut ion, is fundamental to a fair and democratic society; Now therefor be it hereby reso lved that the Township of Southgate express its support for Bill 52 which should help protect and encourage freedom of expression on matters of the public interest and discourage the use of the courts in ways that unduly l imit that f reedom; and Be it fur ther reso lved that the Mayor be requested to wri te a letter and forward this resolution to the Honourable Kathleen Wynne, Premier of Ontario, Bill Walker, MPP for Bruce-Grey-Owen Sound, and to the Association of Municipalities of Ontario (AMO); and Be it fur ther reso lved that the Clerk be requested to circulate this resolution to all other municipalit ies in Ontario to request endorsement of this resolution be sent directly to the Government of Ontario. CLERK'S DEPARTMENT

The Planning and Infrastructure Services Committee of the Council of the City of Brampton will hold a public meeting on Monday, April 13, 2015. The meeting will be held in the Municipal Council Chambers, 4th Floor, 2 Wellington Street West, Brampton, Ontario commencing at 7:00 P.M.

The purpose of this Public Meeting is to give an opportunity to the public to provide input into planning applications received by the City. These are not proposals by the City of Brampton unless specifically identified as City initiated proposals. No decisions are made at the public meeting. Members of Committee attend in order to hear public input but not engage in debate about the merits of the application. A recommendation report with respect to the item below will be prepared by staff and presented at a future Planning and Infrastructure Services Committee. The item will then be forwarded to the Council of the City of Brampton for a decision. If the recommendation is favourable, the Council will not adopt the proposed amendment until at least 30 days from the date of the Public Meeting.

N O T E : Prior to the Planning and Infrastructure S e r v i c e s Committee Meeting, an informal open h o u s e will be held in the Atrium, 1st Floor, with respect to the application. The open house will start at 6:15 P.M. and continue until 6:45 P.M.

The Council of The Corporation of the City of Brampton passed the following resolution at its meeting of February 25, 2015:

C056-2015 W H E R E A S Canada Post has announced the discontinuation of door to door mail delivery services in the City of Brampton in favour of transitioning to community mailboxes and has started this transition in other municipalities; and

W H E R E A S Canada Post has not provided the City of Brampton with a specific date for the transition to community mailboxes; and

W H E R E A S Canada Post has not provided the City of Brampton with proposed locations of new community mailboxes; and

W H E R E A S all existing community mailboxes in the City of Brampton were planned and integrated into communities while new proposed community mailboxes were not planned for and will be difficult to situate in many neighbourhoods; and

W H E R E A S the transition to community mailboxes will be especially hard on seniors and people living with mobility and health challenges and could undermine their ability to live independently; and

W H E R E A S the transition to community mailbox delivery will have a negative impact on existing communities requiring increased maintenance for litter pick up, snow and ice control, graffiti cleaning, vandalism repair and potentially cause parking and traffic issues resulting in higher costs for the municipality;

T H E R E F O R E B E IT R E S O L V E D THAT:

Prior to Canada Post making efforts to replace the door to door mail delivery service with community mailboxes within our boundaries, the City of Brampton requires:

1. Canada Post to conduct public engagement sessions with impacted communities for all concerned residents; and

2. The public engagement sessions are to be hosted by the local Member of Parliament (M.P.) and Canada Post representatives to discuss the transition and what kind of postal services City of Brampton residents need; and

3. That the City of Brampton will not endorse Canada Post's actions prior to the consultation process being satisfactorily completed; and

4. That in the event that Canada Post proceeds with removing the door to door mail delivery in the City of Brampton in spite of the opposition of City Council, the City of Brampton will have complete approval over where any future community mailboxes will be located and all costs for maintenance in and around the mailboxes will be borne by Canada Post; and

5. That the City of Brampton send a letter to Deepak Chopra, Chief Executive Officer Canada Post, to inform Canada Post that the City of Brampton supports the existing delivery system and wishes to retain this valuable service for our communities; and

6. That the City of Brampton send a copy of this motion to the Honourable Lisa Raitt, Minister Transport, Peel Regional Council and all other municipalities in the Region of Peel and the GTA for endorsement and to the Association of Municipalities of Ontario, the Federation of Canadian Municipalities, and all Peel Region M.P.'s and M.P.P's.

RE: Bill 66: Great Lakes Protection Act, 2015

Dear Mayor and Members of Municipal Council:

I am writing to you today with regard to Bill 66: Great Lakes Protection Act 2015. The stated purpose of the bill is "protect and restore the Ecological health of the Great Lakes-St. Lawrence River Basin" and "to create opportunities for individuals and communities to become involved in the protection and restoration of the ecological health of the Great Lakes-St. Lawrence River Basin."

It goes without saying that the Ontario PC caucus is fully supportive of improving and protecting our Great Lakes eco-systems. However, Bill 66 has raised questions with regard to the duplication of governance, the absence of funding to implement initiatives, uncertainty surrounding stakeholder representation at meetings of the Guardians' Council and the potential for further erosion in the power of local planning authorities and municipalities.

As you consider the impact of Bill 66 i would encourage you to apply the Rural and Northern Lens created by the AMO Northern & Rural Working Group. The lens is meant to be employed by provincial ministries to assess the impacts of new policy initiatives or changes in existing programs before they are implemented. I have attached "a copy of ROMA's rural lens for your reference. ! have also included a map that shows that 105 out of 107 ridings across Ontario are affected by the Great Lakes- St. Lawrence Basin Watershed.

As Bill 66 progresses I invite you to submit your feedback so that I can bring your views on Bill 66 forward during debate and committee hearings.

At the end of the day the rural and northern lens is about people. It is about the livelihoods of nearly 2 million people who call rural and northern communities their home. It is about the communities these people live within, their jobs, their built and natural environment, the services they receive and the quality of their lives.

The Rural and Northern Lens provides us with an invitation. An invitation to all levels of government to do better with what they have and to ensure that the needs and requirements of rural and northern residents are met so that they may thrive and succeed. The Lens is particularly important forthe provincial government. Various ministries must accommodate the needs of a large and urbanizing province and it is critical to ensure that Rural and Northern needs are not lost in the development of policy. This Lens can help.

It is a tool culminating in the sample chart below. It provides a quick visual representation ofthe positive and negative impacts of public initiatives. The need is obvious.

THAT the Town of Halton Hills supports the coordinated efforts of the County of Wellington, Township of Puslinch and Town of Caledon to protect municipal interests in the appeal process before the Assessment Review Board;

AND FURTHER THAT the Town of Halton Hills requests that MPAC include aggregate producing properties in the group of special purpose business properties that are subject to new Advance Disclosure Protocols in respect of assessment valuation methodology as part of the organization's preparations for the next reassessment cycle;

Regarding: Valuation of Aggregate Producing Properties

Dear Mr. Wisniowski,

At the recent ROMA/OGRA conference, representatives of the County of Wellington and

Township of Puslinch met with Joan Young, MPAC's Vice-President of Stakeholder Relations to

discuss the municipal perspective and concerns related to the assessment of aggregate

producing properties.

To summarize the current situation, across the Province of Ontario, approximately 100

municipalities are affected by a substantial number of outstanding assessment appeals at the

Assessment Review Board relating to the assessment treatment of aggregate producing

properties (gravel pits); these appeals date back to the 2009 tax year and affect taxation up to

the present day. The central issue in these matters is the method of valuation that should be

applied to arrive at fair and equitable assessments for property tax purposes.

As a municipal host to substantial aggregate operations, we stand to be significantly affected by

the outcome of these appeals, which will have far-reaching implications not only for prior tax

cycles, but also into the future. Concern about the level of financial hardship and negative

consequences that may result continues to grow as these matters will impact the broader

municipal community in a material way.

The purpose of this communication is to confirm that the Town of Halton Hills supports the

coordinated efforts o f t he County of Wellington, Township of Puslinch and Town of Caledon to

protect municipal interests in the appeal process before the Assessment Review Board. We

trust that MPAC will similarly treat this outstanding body of appeals as a key priority.

We are also respectfully asking that MPAC include aggregate producing properties in the group

of special purpose business properties that are subject to new Advance Disclosure Protocols in

respect of assessment valuation methodology as part the organization's preparations for the

next reassessment cycle. It is the municipality's position that a comprehensive valuation

methodology needs to be developed in conjunction with extensive stakeholder consultation to

achieve a stable and defensible assessment method into the future. In our view this approach

will bring greater certainty and predictability to the future valuation and tax treatment of this

unique and complex property type benefiting taxpayers, municipalities and the assessing

authority.

a priority and subject to Advance Disclosure Protocol in the near future.

ISSUE: The Ministry of Transportation (MTO) is currently reviewing the statutory framework for off-road vehicle (ORV) safety in Ontario.

RECOMMENDATION:

That ROMA writes a letter seeking further clarification on MTO's proposals for improving ORV safety, highlighting the concerns addressed below.

BACKGROUND:

MTO's review seeks to broadly examine and gather input on a number of ORV-related issues, including, but not l imited to, the current rules for operating ORVs in the province, the potential for extending on-road access (i.e; by Way of the road shoulder) for single-rider all-terrain vehicles (ATVs) to additional ORV types (e.g. two-up ATVs, side-by-side ATVs, util ity terrain vehicles), a minimum ORV operating age, mandatory helmet use, and rider training.

The review is an extension of a consultation that MTO held on January 15-16, 2015. Since this meeting conflicted with a ROMA Board Meeting, Jim Ginn, Mayor of Central Huron, attended on behalf of ROMA. He will be providing an overview of that meeting and insights that can be used in ROMA's submission to MTO.

Proposals currently under consideration:

• Amend Highway Traffic Act {HIk) Regulation 316/03 to extend on-road access to additional ORV types that carry one or more passengers (e.g. side-by-side ATVs, two-up ATVs, utility terrain vehicles).

• Stakeholders have previously requested MTO to consider enhancing the existing ORV operating age requirements. Proposed changes being considered have included clear passenger age restrictions and a clear definit ion for "adult supervision".

• In addition to clarifying age restrictions, MTO has also previously been asked to encourage more ORV riders to receive proper training on how to handle their vehicles. Consideration is being given to mandating training for operators under the age of 16 years similar to the requirements placed on snowmobile operators.

In previous years, the government indicated its concerns with safety related matters regarding ATV use, particularly increasing on-road fatalities and injuries that were occurring with already permitted single rider ATVs. The government had stated that it was not in a position to expand access to a broader group of ORVs without addressing existing safety concerns. There were also concerns that federal transport laws did not require ORVs sold in Canada to.meet a minimum safety standard. It appears that MTO is now considering extending on-road access to additional ORV types, including side-by-side ATVs, UTVs, and two-up ATVs.

ANALYSIS:

Improving overall road safety is a matter that all municipal governments share. However, ORV use continues to be a divisive issue amongst rural residents. Travel using side-by-side ATVs and other ORV types represents a primary means of transportation in many northern Ontario communities and FONOM and NOMA have expressed their support in the past for amendments to the Highway Traffic Act regulations that would allow side-by-side ATVs the same road travel provisions as single rider ATVs. In areas of rural southern Ontario where there are more communities, limited space for multi-use road activities, and varying perspectives on ORV road use, the matter is more complicated.

MTO will need to consider the fol lowing matters in terms of their ORV safety proposals f rom rural municipal governments:

• Municipal Liability: There are still ongoing joint and several liability concerns that municipal governments face with any activity that occurs on municipal roads and trails. MTO will need to address these and create an approach that would allow municipalities to open their roads to additional ORV types wi thout fear of additional lawsuits. Until this is addressed, municipal governments may opt to prohibit ORV activity on roads despite MTO's desire to open up provisions for ORV road access.

• Sharing of Roads: How will MTO's safety proposals align with the Ministry's principle of improving road sharing with non-motorized vehicles such as bicycles? MTO has made it clear in its Cycling Strategy (#CycleON) that it wants to improve cyclist safety on local roads, in particular giving cyclists access to road shoulders. How will ORV safety

. measures guarantee that all users will be safe and be able to share roads well since ORV users will also be using road shoulders under the Ministry's proposal?

• Permissive Use: It appears that MTO's proposal will create permissive use of ORVs on local roads and leave the responsibility of administration and road access to municipal governments in the form of by-laws. Municipal government would be responsible for implementing by-laws that would govern on-road access to include the various ORV types. Essentially, municipal governments will need to contend with multiple pressures f rom local groups and residents in favour and against permitt ing ORV access onto local roads. >

• Enforcement: Permitting more types of ORVs means that further enforcement will be required to ensure that rules are being followed e.g. that ORV users are not shortcutting through farmers' fields to access a road/trail, etc. MTO does not address enforcement concerns in its proposal which will certainly become a local responsibility. Additionally, while age restrictions on ORV users is an appropriate safety issue to address, age checks will also need to be enforced to ensure that rules are not being broken. Again, this measure will most likely fall onto the shoulders and the pocketbook for local law enforcement.

• Training: Any proposed mandatory training of ORV operators should not be the responsibility of local governments. MTO or a nationally recognized training program administered by a third party, such as a trail organization, is the more appropriate body.
