It is our newly formed Gladstone Region Youth Council. The previous Gladstone City Council formed a Youth Council but it has not functioned since 200l. Departments across our organisation will be able to utilise the members of the Youth Council to gain the youth perspective on projects that are being planned. It is indeed an exciting and historic event and Councillors look forward to working with the team of Youth Councillors. G/2 MESSAGES OF CONDOLENCE Nil.

G/5.2 ENGINEERING SERVICES G/5.2.1 TRAFFIC ENVIRONMENT ADVISORY COMMITTEE (TEAC)

MAJOR ITEMS 13 MARCH 2014 Purpose: The purpose of this report is to allow Council to review the minutes and consider the major recommendations identified at the Traffic Environment Advisory Committee (TEAC) meeting held on 13 March 2014. Officer's Recommendation: That Council:- 1. Note the TEAC minutes from the meeting held on 13 March 2014. 2. Adopt the concept plan prepared by Gladstone Drafting - Drawing No. GD0436-

C12 (Rev A), as the preferred arrangement for the entry and exit points for heavy and light vehicles along the northern side of the Dawson Highway between Aerodrome Road and Penda Avenue, Gladstone.

3. Install a full length median between the existing median at the intersection of

Kirkwood Road and Dixon Drive and the roundabout at the intersection of Kahler Close and Dixon Drive, as shown in Technical Drawing - 13-096-602 Rev 1, thus addressing the concerns in relation to the existing road arrangement.

The estimated cost of these works is $52,500 and the project is to be added to Council's Long Term Financial Plan as a 2015/ 2016 project.

4. Address the safety concerns at the corner of Kellett Street and Higgins Street,

Gladstone by carrying out the following works in accordance with Technical Drawing 13-027-003:-

(a) Install stop signs and stop line marking; and (b) Relocate the existing "No Through Road" sign located on the western

approach to the intersection.

The estimated cost of this works is $1,200 and shall be funded from the 2013/ 14 Road Services Budget - RDC0332 - Various TEAC Resolutions.

5. Install two (2) rural bus set down areas, as per Concept Drawing No. 13-117-

002 (Rev 0), on either side of the road reserve approximately 270 metres from the intersection of Schulze Road on Wyndham Road, Beecher.

The estimated cost of these works is $50,278 and the project is to be added to Council's Long Term Financial Plan as a 2015/ 2016 project.

G/5.2.2 NORTON ROAD REALIGNMENT PROPOSAL Purpose: The purpose of this report is to allow Council to consider a request from Mr Charlton Doblo of "Eden" Norton Road to realign a Norton Road segment which is continually damaged as a result of flooding and therefore isolating residents. Officer's Recommendation: That Council seek a firm quotation from "Charlton Earthmoving" to construct a deviation of Norton Road, between chainage 5.47km to 7.14km as per Concept Design (ECM Document # 3632447) "Attachment 2" to the Officer's Report without calling open tenders, in accordance with Section 234, and Section 235, of the Local Government Regulation 2012. The reasons being that because of the location of this work, the conceptual nature of the design, the intimate knowledge required of the site, the Queensland Reconstruction Authority deadline for expenditure of funds, the time available until the next wet season and Council considers that this work is specialised in nature and thus it would be impractical and disadvantageous for Council to proceed to an open tender process. G/5.2.3 AGNES STREET AGNES WATER LAND RESUMPTION Purpose: To obtain a Council resolution to proceed with the resumption required to acquire the land required to allow for the widening of Agnes Street. Officer's Recommendation: Council will be asked to resolve as follows: That because:

a) the registered proprietor of Lot 1 on RP856970, Kenneth John Tucker, notified Council that he was constructing a fence along the boundary of his property. As part of the construction, Mr Tucker arranged for a surveyor to survey Lot 1’s boundaries;

b) the survey of Lot 1 indicated that the roadside boundary of Lot 1 was approximately 150 millimetres from the south-eastern edge of the sealed road surface;

c) in order to improve sight distances and safe travel movements in the area, on 21 May 2013, Council resolved to acquire, by agreement, an area of 200m2 for the creation of a 6 metre wide footway along the south-east frontage generally in accordance with Concept Plan (ECM document No: 3111649) and if agreement could not be reached then a compulsory acquisition be pursued;

d) during the course of the negotiations, Mr Tucker contacted Council to advise that he was no longer concerned with having footpath frontage to Lot 1;

e) to increase pedestrian safety, Council implemented measures by changing the road area fronting Lot 1 to a “Share Zone” and installed an official traffic sign for a 10kph speed zone;

f) subsequent Council investigations indicate that, despite the implementation of the foregoing measures, safety concerns for pedestrians and sight distance for vehicles remained a risk issue;

g) having regard to the implemented measures and Council’s subsequent investigations, Council Officers redesigned the proposed area to address the remaining risks relating to sight distances and safe pedestrian travel movements. The redesigned area equates to a proposed acquisition area of 13m2 as per Concept Drawing No. 13-118-902[Revision 2] attached to the Officer's Report;

h) negotiations between Council and Mr Tucker and the parties’ respective solicitors have failed to reach an agreement to acquire, by private treaty, the area of either 200m2, 119m2 or the subsequent 13m2,

Council resolves:

1. to amend the resolution G/5.2.1 Agnes Street/Tom Jeffrey Park/Lot 1 RP856970 Access, Footpath, Pedestrian Safety Concerns by

reducing the area proposed to be acquired from 200m2 to 13m2 generally in accordance with Concept Drawing No. 13-118-902[Revision 2];

2. to acquire, in accordance with the Acquisition of Land Act 1967 and the Local

Government Act 2009, the part of Lot 1 on RP856970 that comprises the pink hatched area depicted on Concept Drawing No. 13-118-902[Revision 2];

3. to serve a Notice of Intention to Resume in accordance with Section 7 of the

Acquisition of Land Act and thereafter to proceed in accordance with the requirements of that Act, with the intention of obtaining publication in the Queensland Government Gazette of a proclamation vesting the land in Council, subject to due consideration of all objections made in accordance with the provisions of the Act;

4. to delegate to the Chief Executive Officer, pursuant to Section 257 of the Local

Government Act: a) Council’s power under the Acquisition of Land Act to prepare, execute

and serve Notices of Intention to Resume, pursuant to Section 7 of the Acquisition of Land Act, upon any and every person who, to Council’s knowledge:

i. will be entitled to claim compensation for the taking of the land

and interests concerned ;or ii. is a mortgagee of the land;

b) Council’s power to hear the grounds of objection to taking of the land for

and on behalf of Council where such objection is validly made under a Notice of Intention to Resume and to prepare a report thereon for the consideration of Council; and

c) as applicable, Council’s power to negotiate a resumption agreement or

compensation terms with the person(s) entitled to claim compensation, for final approval by Council.

G/5.3 CORPORATE AND COMMUNITY SERVICES G/5.3.1 WATER CHARGES - BITS SAINTS AFL CLUB Purpose: To seek Council direction on the matter of potable water consumption by sporting clubs who utilise effluent to irrigate sports fields. Officer's Recommendation: THAT:

1. Council note the report from officers that the Council-provided treated effluent irrigation system servicing Boyne Island/Tannum Sands AFL Club was out of service for much of the 2013 calendar year.

2. Despite the Boyne Island/Tannum Sands AFL Club not seeking prior approval

to do so, Council recognise that the use of potable water as a replacement irrigation source by the Club was done out of necessity in maintaining sporting fields for public benefit in these unusual circumstances.

3. Accordingly, and consistent with the intent of Policy P-2014/24 (Water

Concessions for Sporting Bodies and Other Not For Profit Organisations), Boyne Island/Tannum Sands AFL Club be offered an ex-gratia concession on water charges for the period that the treated effluent system was unavailable, representing 50% of total consumption (recognising that some consumption was for uses other than playing field irrigation) and $650.22 be credited to the relevant account.

4. Officers work with relevant clubs (including modifying leases where appropriate)

to ensure that rights and responsibilities over access and consumption of water resources (both treated effluent and potable supplies) is clarified, using this BITS AFL case as the benchmark.

G/5.3.2 EXPRESSION OF INTEREST 115/14 - LEASE OF LAND FOR TELECOMMUNICATION TOWER - LOT 7 SP 133050

Purpose: The purpose of this report is to seek Council's view in relation to an Expression of Interest 115/14 - Lease of Land for Telecommunications Tower on Round Hill Gladstone. Officer's Recommendation: THAT:

1. Council note the outcomes of the recent Expression of Interest exercise for constructing a telecommunications tower Round Hill Gladstone, with one proposal received from Jones Communication.

2. The Chief Executive Officer be authorised to negotiate a Lease over part of Lot

7 on SP133050 (Round Hill, Gladstone) with Jones Communication for the purposes of constructing a telecommunications tower, subject to the following conditions:

a) Lease terms to be negotiated in line with equivalent arrangements for tower

leases in the region. b) Jones Communication being obliged to allow co-location of services on the

No vehicles or trailers to be taken onto the beach or permitted to use beach access paths or boardwalks. Activities are to occur in consultation and conjunction with the Tannum Sands Surf Life Saving Club and Surf Life Saving Queensland. The business is permitted to allow one vehicle (without a trailer) to be parked in one of the public parking bays on Millennium Esplanade. The activity must not obstruct or interfere with pedestrians or beach going activities.

G/5.4.2 ILLEGAL DUMPING AND LITTER PREVENTION STRATEGY Purpose: The purpose of this report is to advise Councillors of the results from public consultation submissions received in response to the Draft Illegal Dumping and Litter Prevention Strategy that was sent to key stakeholders and advertised to the community in August 2013 and to seek Council endorsement of the strategy for implementation in Divisions responsible for addressing this matter. Officer's Recommendation: That: 1. Council endorse the Illegal Dumping and Litter Prevention Strategy. 2. The strategy is actioned by nominated Council Divisions, with annual reporting of activities presented to Council. 3. Council accept financial assistance from Gladstone Ports Corporation towards

developing communication plans to assist with the reduction of litter entering the Harbour catchment areas within the region.

The report includes additional information collected from State Government department officers regarding the use of the area adjacent to the reserve and within the river boundaries following a meeting onsite on 1 May 2014.

G/6 COUNCILLOR REPORTS G/6.1 COUNCILLORS' REPORT - MAYOR GAIL SELLERS Purpose: Cr Sellers submits the following report. Finance Summit Cr Margaret de Wit, President of the Local Government Association of Queensland (LGAQ) opened the Finance Summit with a hope that she could "plant the seed" that we should be working together as Queensland Local Government and join as one to find ways to deliver even better service. An extremely interesting speaker with non-local government background was Mr Craig White of the Australian Agricultural Company (AACo). He delivered my favourite quote of the day "Leadership is a privilege bestowed on you by those who believe in you". Attached to the Councillor Report is a link to the LGAQ website with the Speaker Presentations. Civic Leaders Summit President of the LGAQ opened the Civic Leaders Summit with the belief that our community "is at, or near the ability to pay". She followed this with information on Infrastructure Charges and government reduction in funding for Local Government. Mr Graeme Samuel AC of Monash University believes that leadership requires: the 3 C's - Conviction, Courage and Communication. He followed this with the need for Queensland Councils to communicate to our communities on Infrastructure Charges. Logan Regional Council has Annual Innovation Awards and a Conference Report Template with a feature of 'one thing I will do differently because I went to that conference". During the ICT Productivity Opportunity Session, it was stated that councils need: mobile technology for field workers; social media channel usage and adoption of relevant apps. Mr Roger Corbett AO Chairman of Fairfex Ltd spoke on changes to retail, the digital revolution and innovation. He believed that if staff take an idea to the Councillors that they should come out with a better idea. Change for change sake is not necessary but innovation is imperative. The most interesting session was Bringing Productivity to your Council through Apps. The LGAQ App Store will bring changes to the way we do business; we can research if there are apps for most functions at council e.g. Meeting notes, information on engineering projects sent to the community and Disaster management. The LGAQ conference has saved $60 000 in printing costs as well as needing three less staff. Information on the Civic Leaders Summit will be presented at an upcoming Meeting. Budget Tours Last week, Councillors took part in three days of Budget Tours. The tours took in all parts of the region and many kilometres were covered. It gave the Councillors a first-hand look at some of the areas of recommendation in our 2014/15 budget.

Cr Lanzon said that he was pleased that there has been interest shown in the Dudge's historical collection to be taken over by a group in the Boyne Valley. Gladstone Region Environmental Advisory Network (GREAN) and Gladstone Healthy Harbour Partnership Meetings Cr Chapman noted that he attended the Gladstone Region Environmental Advisory Network Meeting and the Gladstone Healthy Harbour Partnership Meeting last week. He advised that the Healthy Harbour Partnership group have developed an outline of the type of reports to be submitted and a trial report will available at the end of the year.
