1101. Demsnd For Court Msrtiaf.

Except as otherwise provided in the UniformCode of Mili&ry Justice, no person in the navalservice may demand a court martial either onhim- or herself or cm any other person in thenaval service.

1102. Limitations on Ce& Punishments.

1. Instruments of restraint, such as handcuffs,chains, irons and straitjackets, shal 1 not be

applied as punishment. Other instruments drestraint may not hs used except for ssfe custodyand no longer than is strictly nccesssry underthe following circumstances:

a. As a prscuution against escaps during thetransfer ota person in custody or cordhement.

b. On medical grounds by direction of themedical officer.

c. By order of the commanding officer orofficer in charge, if necessary ta prevent psrsmrsfrom injuring themselves or others or fromdamaging property, provided thot other methodsof control are considered ineffectual. In suchinstances, a medical examination shall & madeat the earliest practicable time, preferably inadvance of the restraint, to ensure that nomedical contraindication exists. Thecommanding ofiicer or officer i“ charge shallsubmit a lettsr report of the details to the nextsuperior authority and, if no medical officer isavailable to conduct the examination, shallsubmit a message report in lieu thereof.

2. When restraint is imposed on an individual, itshould be in such a manner as tmaccomplish the

desired degree of restrsint with a minimum offorce. Attachment of an individual ta a fiisd orimmovable object should be authorized onlywhen all elss fails snd then a continuous guardshall be Wstsd with spscfic instructions to carefor the individual w restrained in the event of anemergency.

3. Except in cases of members of tie Naval sndMarine Carps Reserve psrforcning inactive dutyfor training for a psriod of less thsn seven days,the punishments of extra duties aod hard laborwithout confinement shall not bs pa-formsd on

Sunday, although Sunday counts in thecomputation of the. period for which suchpunishments me impossd.

4. Guard duty shall not be inflicted aspunishment.

1103. Suspension or Arrest of an Officer.

1. An officer placed under arrest or restriction(with or without suspension fmm duty) on bosrdship shall not be contined to his or her room orrestrained fmm the pmpsr use of sny part of theship @ which, before his or her suspension,arrest or contlnement, he or she had a right,except the quarter-deck and bridges, unless sucharrest or restriction shsll be nscessary for thesafety of the ship or of the officer, or for thepreservation of good order and discipline.Similarly, at a naval ststion or other place onshore, the arrest or restriction impossd shall notbe unduly rigorous.

2. An officer, when placed under arrest, sha 1Inot visit his or her commanding officer or othersuperior officer unless sent for or to obtain

medical treatment or in case of emergency. Iftheofflcer umisr arrest has business requirings.ttention, he or she shall make it known inwriting.

1104 Treatrnentand Relesae of Prisoners.

1. Persons in confinement shall be in thecustody of a master-at-arms or other persondesi~ated by the commanding officer. Theyshall not be subjected to cruel or unusualtreatment. They shall be visited as necessary,but at least once every four hours to aacertaintheir condition, and to care, as may beappropriate, for sheir needs.

2. The commanding officer shall direct theirreleasa promptly upon the expiration of theircOnfinemenL In case of fire or other suddendanger which may imparil their lives, they shall,subject to such special orders as the commandingoflker may have issued, be removed to a place ofsafety or, when 2ppropriats, releasad within thelimits of the mmmand by the master-at-arms orother custodian, and the commanding ofllcershall be promptly informed oi the action taken.

3. No greawr force than that required torestrain or confine the offender shall be used in&g int.a custody a person intoxicated fromindulgence in skohol, or under the influence ofmarijuana, narcotics or other controlledsubstances.

1. Prisoners sbafl be ccmtlned only in brigs orother facilities designated as naval places ofconfinement by the Secretary of tbe Navy.However, in cases of necessity, the senior officerpresent may mxhorize temporary ccmtlnementin spaces which provide sufficient securityfeatures, safety for both the prisaner and guardpsrsomel, and adequate living conditions:

2. Intoxicated persons or persons under theinfluence of marijuana, narcotics or othercontrolled subsknces shall not be conf:ned inany place or manner that may be dangerous tothem in their condition.

110S. Temporary Restoration to Duty.

A commanding officer or other competentauthority may temporarily release and restoreto duty any person in custody or underrestriction, arrest or confinement, should anemergency of the service or other sufficientcause make such measure necessary. The orderfor temporary release shall be in writing andshall assign the reasons. Should the person beunder charges, they need not be withdrawn, andsuch temporary relesae and restoration @ dutyshall not be a bar to any subsequentinvestigation or trial of the case that theconvening authority may think proper la order,nor ta the investigation of any complaint theaccused may make in regard to the custody,restriction, arrest or confinement.

1107. Refusal to Return to Duty.

No person in the naval service shall persist inconsidering Kim- or herself in custody or underrestriction, arrest or confinement after he or shehas been released by proper authority, nor shallhe or she refuss to return ta duty.

1108. Accusations, Replies and CounterCharges.

1. Reports or complaints, and statementssubmitted in reply to writtsn accusations or inexplanation thereof, shall be couched intemperate language and shall be confined topertinent facts. Opinions shall not be expressednor the motives of others impugned.

2. Persons in the naval service to whom reportsor complaints are submitted for statement shallnot reply by making countercharges.

1110. Stsndsrds of Conduct-

All Department of the Navy personnel are

exwcted to conduct themselves in accordancewith the highest standards of personal andprofessional integrity and ethics. At aminimum, all personnel shall comply withdirectives issued by the Sscretary of Defense andthe Secretary of the Navy regarding theStandards of Canduct and Government Ethics.

1111. Pecuniary Dealings With EnlistsdPersons.

1. No officer shall borrow money or acceptdeposits from, or have any pscuniary desiingswith an enlisted person, except as may berequired in the p+rmance of his or her duty,and except for the sale of an item of persona Ipropsrty which is for sale to other persons underthe same conditions of guarantee and for thesame consideration, and never having been thepropsrty of the Government.

2. Superiors, of flag or general grade, mayauthorize, ss a duty, an ofi%er or ofilcers to

accept deposits from an enlisted person for thesole purpose of temporarily safeguarding the

‘enlisted psrson’s personal funds under emer.gency or opsrstional situations.

1112. Landing Money and Engsging in aTrade or Business.

1. No persan in the naval service on active dutywho makes a loan of money to another memberof the armed services shall knowingly charge,demand or receive money or other propertyconstituting interest in an amount or having afair value in excess of eighteen percent perannum simple intsrest.

2. Unless authorized by the commanding ofilceror bigher authority, no person in the navalservice on active service, either actingindependently or as an agent far another, shallengcge in a trade or business on board any shipof the Navy or within any naval activity orintroduce any article for purposes of trade onboa-d any ship of the Navy or within any navalactivity. The regular or systematic extension ofloans for profit is within the meaning af the k-m“’business” for purposes of this article.

1113. Endorsement of CommercialProd uct or Process.

Except as necessary during contract ad-ministration tn determine specification or othercompliance, no person in the Department of theNavy, in his or her official capacity, shallendorse or express an opinion of approval ordisapproval of any commercial product orprocess.

1114. Report of Deficit or Excess of Pu blicMoney or Property.

Any person in the Department of the Navy whohas knowlsdgeof a deficit or excess of publicmoney orpublic propsrty shall take prompt andappropriate action to bring the matter to theattention of his or her commanding officer orappropriate superior.

111S Report of Fraud.

If any person in the Department of the Navy hasknowledge of any fraud, collusion or improperconduct on the part of any purchasing or otheragent or contractor, m on the part of any person

I employed in superintending repairs, receiving or

receipting for supplies, or having knowledge ofany fraud, collusion or improper conduct in suchmatters connected with the Department of theNavy, he or she shall report the sameimmediately in writing b the proper authority,specifying the particular act, or acts ofmisconduct, fraud, neglect or collusion anddesc.riblng any evidence which may assist inproving same.

1116. Adminkrative Control of Funds.

No person in the Department of the Navy shallmake or authorize an expenditure from or createor authorize an ohiigation under any

appropriations or fund in excess of the amoumavadable therein; nor shall any such personinvolve the Gcwemment in any contract or otherobligation for the payment of money for anypurpose in advance of appropriations made forsuch purpose, unless such contract or obligationis authorized by law. No person in theDepartment of the Navy shall accept voluntaryservice for the United States or employ personalservice in excess of that authorized by Iaw,except in cases of emergency involving thesafety of human life or the protection ofproperty.

1120. Personal Privacy and Rights ofIndividuefs Regardiag TheicPersonaf Recocds.

1. Except as specifically providsd in this ssction,maintenance of parsonal records of individuals,and the release of those records, shall be inaccordance with the provisions of the PrivacyAct and directives issued by the Secretary of theNavy.

2. Except as specifkally provided in this section,the release of departmental records to privateparties shall be in accordance with theprovisions of the Freedom of Information Actand directives issued by the Secretary of theNavy.

1121. Disclosure. Publication end Securityof Official Information.

1. No person in the Department of the Navyshall convey or disclose by orel or writtencommunications, publication, graphic (includingphotographic) or other means, any classifiedinformation except as provided in directivesgoverning tbe release of such information.Additionally, no psrson in the Dspertment of theNavy shall communicate or otherwise deal withforeign entities, even on an unclassW1ed basis,when this would commit the Department of theNavy to disclose classi@d military information,except as may be required in that person’soficial duties and only after coordination with

and approval by a releaae authority designatedby competent authority.

2. No psrson in the Department of the Navyshall convey or disclose by oral or writtencommunication, publication or other means,except es may bs required by his or her officialduties, any information concerning theDepartment of Defense or forces, or any person,thing, plan or measure pertaining thereto,where such information might be of possibleassistance 1A a foreign power; nor shall anypsrsan in the Department of the Navy make anypublic speech or permit publication of an articlewritten by or for that person which is prejudicialto the interests of the United States. Theregulations concerned with the release ofinformation ta the public through any mediawill bs as prescribed by the Sscret.ary of theNavy.

3. No person in the Department of the Navyshall disclose any information whatever,whether classillad or unclassified, or whetherobtained from ofilcial records or within theknowledge of the relator, which might aid or beof assistance in the prosecution or support of anyclaim against the United States. Theprohibitions pres-cribsd by the first sentence ofthis paragraph are not applicable ti an offker oremployee of the United States who is acting inthe propsr course of, and within the scope of, hisor her official duties, provided that the

disclosure of such information is otherwiseauthorized by statute, Executive Order of thePresident or departmental regulation.

-t. Any person in the Department of the Navyreceiving a request from the public forDepartment of the Navy records shall begoverned by the provisions of Lhe Freedom ofInformation Act and implementing directivesissued by the Secretary of the Navy.

5. Persons in the Department of the Navydesiring LOsubmit manuscripts LOcommercialpublishers on professional, political orinternational subjects shall comply withregulations promulgated by the Secretary of theX avy.

6. l$operso ninth enavalservic eonactivedutyor civilian employee of the Department of theNavy shall acL as correspondent of a newsservice or periodical, or as a television or radionews commentamr or analyst, unless assigned tosuch duty in connection with the public tiairsactivities of the Department of the Navy, orauthorized by the Secretary of the Navy. Exceptas authorized by the Secretary of Lhe Navy, noperson assigned to duty in connection withpublic affairs activities of the Department of theNavy shall receive any compensation for actingaa such correspondent, commentator or analyst.

1122. Adverss Matter in Officer FitnessReports and Enlisted PerformanceEvaluation Reports.

If adverse matter appears in a fitness report ofan o~icer of the Navy and Marine Corps, or in aperformance evaluation report of an enlistedmember, E-5 and above, of the Navy and MarineCorps, or in related cm-respondence, the report orcorrespondence may not be placed in tbe officialrecord unless the member reported on was firstafforded an opportunity ta submit a writtenstatement regmding the matter. Any statementsubmitted by the member shall comply with theregulations prescribed by the Chief of NavalPersonnel or the Commandant of the MarineCorps, as appropriate, shall be couched intemparate language and limiled Lo pertinentfacts, and shall not question or impugn themotives af aaotber person. If the person reported

on does not desire b make a statement, thatpersmn shall so state in writing.

1123. Adverse Entries in Medical andDental Records.

1. The medical officer or dental officer shallinform the person concerned whenever an enlryis made in such person’s medical record or dentalrecord of a serious il Iness, operation, injury orphysical defect which may adversely afTect, inother than a temporary degree, the person’sefficiency in the performance of duty.

2. The medical officer or dental officer shallinform, in writing, the commanding officer andthe person concerned whenever an entry is madein the latter’s medical record which indicates

a. that a disease or injury may beattributable ta misconduct

b. the use by such person of intoxicants ta adegree presumed to disqualify such personphysically, mentally or morally for performanceof duty; or

c. Lhe use by such person of marijuana,narcotic substances or other controlledsubstances as defined in these regulations.

3. The medical officer or dental of’liter normallyshall permit access tn the rscord by the personconcerned when adverse entries are made.Should the medical officer or dental officer deemthe condition impractical LOinform the memberof the entry or ta permit him or her access to therecord, the medical officer or dental ofllcer shalladvise the commanding ofiicer, and shall make anotation of this action and opinion in the record.As soon as circumstances permit, the personconcernsd shall be notilisd of the adverse entryand the rmt.ifhtion shall be noted in the record.The person concerned has the right ta make andhave entered in the record such statement inrebuttal as may be desired. If the personconcerned does not desire to make a statement,he or she shall so stats in writing.

1124. Misconduct and Line of DutyFindings.

Except for the medical and dental entriesreferred tn in the preccchng articIe, no adverseentry concerning misconduct and line of dutyshall be made in any person’s official recordexcept in accordance with the provisions of theManual of the Judge Advocats General.

GENERAL REGULATIONS

I

Inspection of tbe Record of a Personin the Naval Service.

1. The record of a person in the naval servicemaintained by the Chief af Naval Personnel orthe Commandant of the Marine Corps shall beavailable for inspection by the person or a dulyauthorized agent, designated as such in writingby the person.

2. A request for inspection made under thisArticle need not comply with the requirementsof the Privacy Act.

1126. Correction of Naval Records.

1, Any milibmy record in the Department of theNavy may be correctccf hy the Secretary of theNavy, acting through the Board for Correction ofNaval Records, when the Secretary considersthat such action should be taken in order tocorrect an error or to remove an injustice.

2. Applications for corrections under this articlemay be made only sftsr exhaustion of all otheradministrative remedies afforded by law orregulation,

3. Applications for such corrections should besubmitted to the Sscretary of the .Navy (Boardfor Correction of Naval Records) in accordancewith procedural regulations established by theSecretary of the Navy and approved by theSecretary of Defense.

1127. Control of Official Records.

No person, without proper authority, shallwithdraw oflicial records or correspondence fromthe fi Ies, or destroy them, or withhold them fromthose persons authorized @ have access to them.

1128. Official Records in Civil CouI-&-

1. Department of the Navy psrsonnel shall notprovide official information, testimony, ordocuments, submit to interview, or permit aview or visit, for litigation purposes, withoutspscial written authorization.

2. Department of the Navy psrsonnel shall notprovide, with or without compensation, opinionor expert testimony concerning officialDepartment of Defense information, subjects,parsonnel or activities, except on behalf of theUnited Ststes or a party represented by theDepartment of Justice, or with special writtenauthorization.

1129. Records of Fitness.

1. Records will be maintained on officers andenlisted persons of the h’avy sad Marine Corpswhich reflect their fitness for the service andperformance of duties. Promotion andassignment to duty is determined by anindividual’s record, of which the rccm-d of fitnessand psrfm-mance is an integral part.

2. The fitness and performance t-sport is decisivein the service career of the individual ot?ber andenlisted person cnd bss cn important influenceon the etl’iciency of the entire Department of theNavy. The preparation of these rspmts shall beregarded by superiom and commending officersas one of their most important and responsibleduties.

3. The Chief of Naval Operations and theCommandant of the Marine Corps shall beresponsible for the maintenance andadministration of the records and reports intheir respective services,

1130. Officer’s Duties Relative ti Lsws.Orders and Regulations.

All officers in the rmval service shall aequsintthemselves with, obey and, so far ss theirauthority extends, enforce the laws, regulationsand orders relating to the Department of thaNavy. They will faithfully and truthfullydischarge the duties of their offices to the best oftheir ability in ccmformsnce with existing ordersand regulations and their solemn profession ofthe oath ofofflce. In the absence of instructions,they shall act in conformity with the policies andcustoms of the service to protect the publicinterest.

1131. Requirement of Exempl& Conduct.

All commanding offkers and others in authorityin the naval service are required b show inthemselves a good example of virtue, honor,patriotism snd subordination; ta hs vigilant ininspecting the conduct of all persons who areplaced under their command; b guard againstand suppress all dissolute and immoralpractices, and ta correct, according ta the lawsand regulations of the Navy, all persons wbo sreguilty of them; and ta &ke all necessary andpropsr messures, under the laws, regulationsand customs of the naval servics, to promots andsafeguard the morale, the physical well-being

and the general welfare of the ofticers andenlistsd persons under their commomi or charge.

1132 Compliance With LAwful Orders.

All persons in the naval service sre required toobey readily and strictly, and to executepromptIy, the lawful orders of their superiors.

1133. Language Reflectigan a Superior.

No person in the naval service shall uselanguage which may tend to diminish thecofidencs in or respect due ta his or her superiorofftcer.

1lM. Exchange of Duty.

No person in the naval service shall exchangs ansssignsd duty with another without permissionfrom his or her commanding officer orappropriate supsrior.

1135. Relations With Foreign Nations

Persons in the Department of the Navy. in theirrelations with foreign nations snd with thegovernments or agents theraof, sbslI ccmform tainternational law and to the precedentsestshlished by the United S@tes in suchrelations.

1137. Obligation to Report Offenses.

113S- Responsibilities ConcerningMcrijusma, Narcotica and Other Cmr-trcdlcd Substances

1. Afl persomel shsll endeavor h prevent andeliminate the unauthorized use of marijuana,nsrcotics cnd other controlled substances witilnthe naval service.

2. The wrongful possession, use, introduction,manufacture, distribution and possession,manufacture, or introduction with intent todistribute, of a controlled substance by personsin the navfd scrvics are offenses under Article112e, Uniform Cade of Military Justice. Exceptfor authorized medicinal or other authorizedpurp05M, the possession, use, introduction, ssleor other trsnsfer of marijuana, narcotics, orother controlled substances on bosrd any ship orcraft, airmcft of the Department of the. Navy orwithii any base, naval station, or other placeunder the jurisdiction of the Department of theNavy by all persons is prohibited.

3. The term “controlled substance” means adrug or other substance incl.dsd in Schedule 1,II, 111, IV, or V established by Section 202 of theComprehensive Drug Abuse Prevention andControl Act of 1970 (84 Stat. 1236), as updatedend republished under the provisions of thatAck

1139. Rules for Preventing CollMonsAtloatand in the Air.

I All persons in the naval service responsiblefor the operation of naval ships, craft andaircraft shall diligently observe theInternational Regulations for PreventingCollisions at Sea (commonly called theCO LREGS), the Inland Navigation Rules,

domestic and international air trafficregulations, and such other rules andregulations as may be established by theSecretary of T-portation or other competentauthority for regulating tratllc and preventingcollisions on the high seas, in inlcnd waters or inthe air, where such laws, rules and regulationssre applicable to nsval ships end sircraft. In orderto communicate with his or her family, asguaranteed in the Oeneva Convention Rdative@ the Treatment of Prisoners of War, he or shemay give the names rind addresses of his or herparenb, gusrdians or next of km.

2. Except as provided in the foregoing, allpersons in the naval service captured by theenemy shall evade enswering further questionsto the utmost of their ability and shall mske nooral or written statement disloyal to or harmfulta the United Statea or ita allies.

3. When a person in tbe naval service is aprisoner of war or otherwise detsined by ahostile entity so that circumstances preventresort to the normal chain of command, acommissioned oflicer of another armed force whois not a medical ofiicer (msdiesl corps, dentsl

m~s, mme mrps or medical service mrps), orchaplain is a superior commissioned officer withrespect to a psrarm in the naval service who isjunior in rcnk.

1141. Codeof Conduct forhlembersoftbeArmed Forces of the United States.

1. Regular training in and explanation of theCode of Conduct for Members of the ArmedForces of the United S&tes shall be conducted inaccordance with directives issued by theSecretary of Defense and the Secretary of theNavy.

2. Instructions in the Code of Conduct forMembers of the Armed Forces of the UnitedS!@es shall be included in the general mili!arytraining program of the command.

3. A text of the Cade of Conduct for Members ofthe Armed Forces of the United States shall beposted in one or more conspicuous place% readilyaccessible to persmmel of the command.

1143. Unavoidable Separation from aCommand.

A person in the naval service who is separatedfrom his or her ship, station or unit due toshipwreck, disaster or other unavoidablecircumstances shall proceed as saon ss passibleto the nearest United S.atss military activityand report to the commandin~ officer thereof.

1143. Report of a Communicable Disease.

All persons in the naval service shall reportpromptly to a medical representative, or whereno medical officer is readily available, ta higherauthority, the existence or suspicion ofcommunicable disease in persons with whomthe y are living or otherwise come in contict.

1144. Immunisation.

Persons in the naval service shall permit suchaction to be taken to immunize them againstdisease as ig prescribed by compstent authority.

1145. Service Examinations.

1. Persons in the Department of the Navy,without proper authority, shall not:

a. have in their possession, obtain, sell,publish, give, purchase, receive or repraduce anyexamination paper, or any copy thereof, oranswer sheet thereto, for any examinationwhatsoever which has been, is, or is to be,administered within the Department of theiNavy.

b. attempt or offer to have in theirpossession, obtain, sell, publish, give, purchase,receive or reproduce any examination psper, orany part or capy thereof, or answer sheet thereto,for any examination whatsoever which has been,is, or is to be, administered within theDepartment of the Navy.

2. Prior to, during or after any examinationwhich is to be, is being or has been administeredwithin the Department of the Navy, persons inthe Department of the Navy shal 1 not, withoutproper authority, disclose, or solicit thedisclosure of, any information regardingquestions or answers to questions an suchexaminations.

3. Persans in the Department of the Navy shallnot engage in any unauthorized form of giving oraccepting assistance or self-help during theadministration of amy examination within theDepartment of the Navy.

1130. Redress of Wrong Committed byeSuperior.

1. U any person in the naval service considershim- or herself wronged by an act, omission,decision or order of a persun who is superior inrank or command, that person shall not fail inmainlining a respectful hearing toward suchsuperior, but may report the wrong to the properauthority for redress in the manner provided inthis article. The report should clearly identifythe respondent (the superior against whom it ismade), the wrong complained of and the redressdesired. A complainant (the person submitting areport under this article) may be heldaccountable by the oflicer responsible for theresolution of the report if the report is found tabe vexatious, frivolous or false. The report maynot be joined with reports by other com-plainants.

2. If the respondent and the complainant areunder the command of the same immediatecommanding officer, such commanding officershall resolve the report of wrong. Except wherenecessary in order ta effect redress, if redress isfound to be warranted, the immediatecommanding ofiirer is not required to forwardeither the report or the resolution to a higherauthority. Complainants who considerthemselves wronged by such a resolution may

proceed in accordance with Article 138, UniformCode of Military Justice.

3. If the respondent is the commanding ofiker ofthe complainant, ss defined in the Manual of theJudge Advocate Oeneral, the report is not areport of wrong cognizable under his article, butis instead a complaint of wrong cognizable underArticle 138, Un”iorm Code of Military Justice.Such complaint shall be submitted, forwardedand resolved in acmrdance with the Manual ofthe Judge Advocate General.

4. A report of wrong against aDy other personsuperior in rank or command to the complainantnot within the stops of paragraph 2 or 3 of thisarticle shall be in writing and shall & forwardedvia the commanding ofiker of the complainant,the respondent, the commanding affker of therespondent, and officers in the chain of commandto the otlcer exercising immediate generalcourt-martial jurisdiction over the respondent.The ofticer exercising general court-martialjurisdiction shall inquire into the matter andtake such action in conformity with applicablelaw and directives as may be warranted toredress the wrong. if any, complained of. To theextent practicable, the provisicms of the Ma””alof the Judge Advocate General should bereferred to for guidance concerning thereaalution and processing of such a report. Theofficer exercising immediate general court-

martial jurisdiuion sha)l, in accordance withthose provisions, transmit la the Secretary of theNavy (Judge Advocate General) a true

1151. Direct Communication With theCommanding Officer.

1. The right of any person in the naval service tocommunicate with the commanding 051cer in aproper manner, snd at a propsr time and place,shall not bs denied or restricted.

2 Officers who are senior to the executiveoffbr have the right to communicate cikectlywith the commanding of!lcer, but they shallkeep the exscutive oftker informed on mattersrelated tn the functioning of the command.

3. A head of department, or of any other majorsubdivision of sn activity, has the right tocommunicate directly with the commandingficer concerning any matter relating to thatdepartment or subdivision, but shall keep theexecutive officer ‘tiormed.

Persona in the naval service shall not jointogether for the cnmmon purpose of protesting orcnmphining agsinst orders or details to duty,complaining of particulars of duty or procuringpreferences.

1154. Communications to the Congress.

No person in the naval service, in his or herofficial cspacity, shall apply to the Congress orto either house thereof, or to any committeethereof, for legislation or for appropriations orfor Congressional action of any kind except withthe consent and knowledge of the Secretary ofthe Navy. Nor shall such person, in his or herot%cial capacity, respond to any request forinformation from Congress or from either housethereof, or from any committee of Congress,except through, or as authorized by, theSsmetary of the Navy, or as provided by law.

1155. Dealings With Members of Congress.

No person may restrict any member of an srn-mdforce in communicating with a member ofCongress in the member’s personal or privatecapacity, uniesa the communication ia Unlawfdor violates a regulation necessary to the aacurityof the United Statas.

115S. Forwarding Individual Requests.

Requests from psrsons in the naval service shallbe acted upcm promptly. When addressed tohigher authority, requests shall be forwardedwithout delay. The reason abould be statedwhen a request is not approved or recommended.

1157. Laave and Liberty.

Leave and liberty will be granted to tbemaximum extent practicable.

115S. Quality and Quantity of Rations.

I. Meals served in the general mess shall besamplsd regularly by an ofilcer detailed by thecommanding o~lcer for that purpose. Should heor she find the quality or quantity of the foodunsatisfactory, or should any member of themess objact ta the quality or quantity of the food,the commanding officer shall bs notitled andshall take appropriate action.

2. No person employed in the service of thegeneral mess shall receive any compensationfrom persons entitkd to subsist in the mess.

11S9. Possession Of WeapOns.

Except as may be necessary to the properperformance of his or her duty or as may beauthorised by proper authority, no person in thenaval service shell:

a. have concealed about his or her personany dangerous weapon, instrument or device, orsny highly explosive article or compound; or

b. have in his or her possession anydangerous weapon, instrument or device or snyhighly explosive article or compound on boardany ship, craft, aircrafl, or in any vehicle of thenaval service or within any base or other placeunder naval juriedktion.

1160. Possession of Government Property.

h’o person in the Department of the Navy shallhsve in his or her possession any property of theUnited States, except as msy be necessary b theproper performance of duty or as may beauthorized by proper authority.

1161. Uniforms, Arms and Outfits.

1. The clothing, arms and accoutrementa whichare sold or issued by the United S@tes to anypersmr in the naval service shsll not be sold,bsrtered, exchanged, pledged, loaned or givenawsy to urmuthorized psrsonnel.

2. Persons in the naval service shal I not-have, intheir possession, without permission from praperauthority, any article of wearing apparel orbedding bclongirrg M any other person in thenaval service.

1162. Alcoholic Beverages.

1. Except as may bs authorized by the Sscretaryof the Navy, the introduction, possession or useof aIcoholic beverages on board any ship, crsft,aircraft, or in any vehicle of the Department ofthe Navy is prohibited. The transpor~tion ofalcoholic beverages for personal use ashore isauthorized, subject to the discretion of the officerin command or officer in charge, or higherauthority, when the beverages are delivered tathe custody of the officer in command or ofiicerin charge of the ship, craft or aircraft in sealedpecksges, securely packed, pmparly marked andin compliance with customs laws andregulations, and stored in securely lockedcompartments, and the transportation can beperformed without undue interference with thework or duties of the ship, craft or aircraft.

Whenever an alcoholic beversge is brought on “board any ship, craft or aircraft fortransportation for personal use ashore, theperson who brings it on board shsll at that timetile with the 051cer in commsnd or ofilcer inchsrge of the ship, craft or aircrstl a s~tementof the qusntity and kind of alcoholic beveragebrought on board, together with a certifkationthat ita importation will be in compliance withcustoms and internal revenue laws andregulations and applicable State or 10CS1laws atthe plsce of debarkation.

2. The introduction, possession and use ofa[coholic beverages foT personsl consumption orfor sale is authorized within naval activities sndother places ashore under naval jurisdiction tothe extsnt and in such manner as the Sacretaryof the Navy may prescribe.

1163. Discharge of Oil, Trssh snd Garbage.

1. Except as authorized by law or regulation, nooil, oily wasts or trash shall be discharged intoUnited States or foreign internal waters orprohibited areas. The United .%@,es prohibitedarea is designated as waters within 50 miles ofthe United Ststes coastline. The Chief of NavslOperations shall provide descriptions ofprohibited areas for other nations. Trashdischarged at sea should have, or ,be packagedfor, negative buoyancy.

2. Garbage shall not be thrown overboardwithin a contiguous zone which is 12 miles ftimany coastline.

3. Any oil slick within 50 miles of the coaatlineof the United States shall be repyrted as soon aspossible to the nearest Coast Guard DistrictHeadqunrtsrs.

1164. Equal Opportunity and Treatment

Equal opportunity shall be afforded b .11 on thebasis of individual effort, performance, conduct,diligence, potential, capabilities and talentswithout discrimination as to race, color, religion,creed, sex or nations] origin.
