Pacquiao City Councilor (President, Liga ng mga Barangay)(0B) WHEREAS, according to the Philippine Rice Research Institute (PhilRice) of the Department of Agriculture, Filipinos waste an average of two tablespoons of cooked rice (9 grams of uncooked rice) every day, which is equivalent to P23 Million a day, or P8.4 Billion a year, or the consumption of nearly 2.6 million Filipinos a year; WHEREAS, a sustained and nationwide campaign to boost farmers' morale and motivate them to adopt technologies to further improve farm productivity and encourage the general public to be responsible rice consumers are necessary to complement the government's efforts to achieve rice self-sufficiency; WHEREAS, part of the strategy to attain rice self-sufficiency is intensified information campaign and social marketing to enjoin producers, consumers, and policy- makers to help achieve the said goal; WHEREAS, with the steady increase in the price of rice amidst uncertainly regarding the stability of its supply, there is an urgent need to devise a mechanism to promote responsible rice consumption by avoiding rice left-over or rice wastage when served as packed or combo meal or during catering or plated meals; WHEREAS, the Philippine Rice Research Institute (PhilRice) is spearheading a campaign called "Be RICEponsible" to prevent rice wastage and is urging the LGUs, through the Department of the Interior and Local Government, to support the campaign; (,) Ile\ Ordinance No. 23, series of 2015 Page 1 vyw.spgensantos.ph 083.302.0263

Santos is enjoined to proclaim the month of November as National Rice Awareness Month;

ORDINANCE NO. 23 Series of 2015

AN ORDINANCE INSTITUTING POLICIES FOR RESPONSIBLE RICE CONSUMPTION IN THE CITY OF GENERAL SANTOS

SECTION 1. TITLE. — This Ordinance shall be known and cited by its short title as the "GSC RICEPONSIBLEORDINANCE."

SECTION 2. DECLARATION OF POLICY. — The City of General Santos shall adopt measures, which shall ensure responsible rice consumption and rice conservation and shall educate the consuming public not to waste rice in order to attain rice self-sufficiency.

SECTION 3. DEFINITION OF TERMS. — For purposes of this Ordinance, the following terms shall be defined as follows:

3.1 Food Service Industries — refer to those businesses, institutions, or companies doing business in General Santos City responsible for preparation of plated, packed, or combo meal with cooked rice for a fee, such as restaurants, school, offices and hospital cafeterias, catering services, canteens, eateries, fast food chains, or any other similar establishments.

3.2 One-Half (1/2) Cup of Rice - refers to one-half cup of regular serving of cooked rice or not more than 80 grams of cooked rice; price of one-half cup of rice shall be half the price of regular serving of cooked rice.

SECTION 4. MANDATE AND COVERAGE. — All businesses and institutions involved in the preparation and sale of meals, including but not limited to restaurants, schools, offices, hospitals, cafeterias, catering operators, fast food chains and other related services are required to comply with this ordinance.

4.1 All business establishments covered by this ordinance shall include in their menu, as an option to the consuming public, a One-Half Cup of Rice serving. It shall be the default serving or shall be presented as an option for plated/set meals with corresponding reduction in prices.

• • 4.2 As a form of public information and awareness campaign, such option shall

be mandatorily contained in the menu and menu board and be made known by the attending service crew, waiter, waitress or cashier to the consumer before the latter shall commence ordering.

4.3 Those rice-at-buffet-tables and eat-all-you-can-rice products of food service industry establishments shall be exempt from this ordinance but are likewise required to inform and remind their clients or customers about rice conservation and responsible rice consumption.

4.4 All food service industry establishments shall be required to install or mount posters and/or distribute leaflets or flyers or establish a sound and effective information and education campaign (IEC) mechanism about this Ordinance to encourage patrons and customers to conserve rice.

4.5 The City Nutrition Council, in cooperation with the Local School Board, Local Health Board, City Social Welfare and Development Office (CSWDO), GSC Field Health Service, GSC Hospital Services, City Agriculturist's Office, City Economic Management and Cooperative Development Office — Tourism Division, and other relevant offices and agencies of the city government shall be tasked to incorporate this Ordinance to their related programs.

SECTION 5. DATA GATHERING ON RICE WASTAGE. — In order to continuously monitor the rice conservation status in the City, the food service industry establishments shall collect data on rice wastage.

5.1 Data gathering shall be done from opening to closing hours of the food service industry establishment for seven (7) straight days on the following periods:

5.1.1 One (1) month after the publication of this Ordinance; 5.1.2 Six (6) months after the publication of this Ordinance; 5.1.3 Every last week of January of every year thereafter.

5.2 Data collected will include the following:

5.2.1 Standard weight (in kg) of 1 serving of rice; 5.2.2 Total amount (in kg) of cooked rice for the entire operating day; 5.2.3 Total amount (in kg) of un-served/unsold rice at the end of each

operating day (rice left at the pot); and 5.2.4 Total amount (in kg) of rice wastage from the plates of customers.

In order to do this properly, there must be a separate trash bin for rice to which the servers will throw every rice waste directly.

SECTION 6. POWER TO MONITOR, INSPECT, AND ENFORCE. — The City Nutrition Council in coordination with the Barangay Nutrition Council shall be empowered and tasked to be the lead office in the inspection of food establishments for purposes of implementing this ordinance. The implementation shall be in accordance with the provisions of Title 6- Citation Ticket otherwise known as Ordinance No. 12, series of 2013 and Ordinance No. 17, series of 2003.

• • SECTION 7. PERSONS LIABLE. — Violations to this Ordinance shall be imposed

on the following:

7.1 Owners, proprietor, proprietress of businesses, juridical or natural persons are liable for the failure of the food establishment to include in their menu an option of half cup rice serving;

7.2 Owners, proprietor, proprietress of businesses, juridical or natural persons are liable for the failure of the service crew, waiter, waitress or cashier to inform the customer of such option before the customer commence ordering his/her food; and

7.3 If the violator is a corporation or juridical person, the responsible and liable person shall be the owner, president, proprietor, operator, or manager thereof.

SECTION 8. PENALTY CLAUSE. — The following penalties shall apply:

8.1 Fine of Two Thousand Pesos (P2,000.00) for the first offense. 8.2 Fine of Three Thousand Pesos (P3,000.00) for the second offense. 8.3 Fine of Five Thousand Pesos (P5,000.00) for the third offense and

succeeding offenses and revocation or cancellation of business permit/closure of business operation.

SECTION 9. MONITORING AND REPORTING. — The City Nutrition Council shall collect and maintain records of pertinent information but not limited to the abovementioned data which include rice wastage data, complaints, violating and penalized food service industry establishments, and other relevant information. The City Nutrition Council shall submit semi-annual reports to the City Mayor and Sangguniang Panlungsod — Committee on Agriculture on the outcome of the program.

SECTION 10. TRANSITORY PROVISION. — All business establishments shall be given two (2) months after its publication to comply with the mandatory provisions of this Ordinance.

SECTION 11. SEPARABILITY CLAUSE. — If, for any reason or reasons, any part or provision of this Ordinance is held to be unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be in full force and effect.

SECTION 12. REPEALING CLAUSE. — Any or all ordinances, orders, rules and regulations, resolutions, or part or parts thereof, which are inconsistent with any provision of this Ordinance, are hereby repealed, amended, or modified accordingly.

SECTION 13. EFFECTIVITY. — This ordinance shall take effect fifteen (15) days after its publication in any newspaper of general circulation within the City.
