    Step 3 READ AGREEMENT INFORMATIONOffer available to residential customers only. Business packages available by request. By signing above customer agrees tocontinue services for a term of 2 years, then continue month to month until the agreement is cancelled by either party. If customer cancels its service or any portion thereof, or has its services or any portion thereof terminated as provided above,prior to the expiration of the contract term, customer shall be obligated to pay BRMEMC the monthly reoccurring rate, of canceled service(s), multiplied by the months remaining in contract. Such termination charge shall be paid to BRMEMCwithin thirty (30) days after such cancellation by the Customer. Digital TV and voice services offered under this Agreement byAmericas Center Corporation (channel lineup subject to change). BRMEMC and/or Americas Center will maintain ownershipof fiber optic and video equipment, and upon termination of this Agreement, customer agrees to return said equipment ingood working condition, or pay an equipment replacement fee of $200.00 per set top box, $25.00 per remote, and $15.00per power cord. Acceptance of Terms of Service and Acceptable Usage Policy (as is posted online at www.brmemc.com) isrequired, and by virtue of signing this document customer agrees to be bound to said Terms and Policy. Broadband chargesbegin on the date of BRMEMC work order completion (pricing subject to change). Installation is to an outside NID near theelectric meter base. Prior to inside installation, a quote with estimate will be provided to customer. Customer grants

    BRMEMC the right to construct, operate, access and maintain fiberoptic lines and associated pedestals, or other apparatusnecessary for such installations. The undersigned does not convey any land, but merely grants an easement for such fiber

    optic facilities. The benefits and considerations of such fiber optic installations shall inure to any successors and/assignees of BRMEMC or the consumer.

    Thank you for choosing BRMEMC Enhanced Voice powered by FidelityCommunications Services III, Inc. Complete Voice Service, a voice over Internetprotocol service. The rates, terms and conditions under which Fidelity CommunicationsServices III, Inc. and its affiliates (collectively, Fidelity) will provide its CompleteVoiceService to you can be found at www.brmemc.net or by contacting Fidelity at 800-392-8070.

    In addition, The Federal Communications Commission requires that Fidelity notify youabout certain limitations on Fidelitys E911 service:

    YOU MUST PROVIDE YOUR CORRECT ADDRESS . If you do not correctly identifythe address where your multimedia terminal adaptor (MTA) is located, or if you movethe MTA away from the original address, your emergency calls may be routed to thewrong emergency authority, or emergency personnel may be misdirected to the wrongaddress. YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE THERESPONSIBILITY TO IMMEDIATELY NOTIFY FIDELITY, THROUGH ITS AGENT,BRMEMC (Blue Ridge Mountain EMC) OF ANY CHANGE IN YOUR SERVICE

    ADDRESS. You must not relocate the MTA to a different address. If you changeresidences, you must contact BRMEMC at 706-379-3121 for information on whether theCompleteVoice Service can be transferred to your new residence and what therelocation will cost. If you wish to disconnect the CompleteVoice Service, you mustcontact BRMEMC for information on the necessary procedures.

    THERE MAY BE A DELAY UNTIL YOUR ADDRESS IS ENTERED IN THE E911DATABASE. When you initially order service, or if you notify BRMEMC of a change inyour service address, there may be a delay before the address or change in address isentered in the E911 database seen by the emergency service provider.

    USE OF A NON-NATIVE TELEPHONE NUMBER MAY LIMIT EMERGENCY AUTHORITIES ACCESS TO YOUR LOCATION INFORMATION. If you are using anon-native telephone number (a telephone number from a different exchange than theone in which you are using the CompleteVoice Service), emergency authorities or

    personnel may be unable to determine the location from which you are calling.

    POWER OUTAGES MAY DISRUPT YOUR E911 SERVICE. Your Multimedia Terminal Adaptor (MTA) includes a battery backup that provides up to 6 hours of backup powerin the event of a power outage. The MTA must be plugged in to maintain a chargedbattery. YOU EXPRESSLY ACKNOWLEDGE THAT YOU WILL NOT BE ABLE TOPLACE OR RECEIVE CALLS, INCLUDING CALLS TO ACCESS EMERGENCY 911SERVICES, IF YOU ARE EXPERIENCING A POWER OUTAGE AND THE BATTERYPOWER ON YOUR MTA RUNS OUT.

    BROADBAND CONNECTION FAILURE WILL DISRUPT YOUR E911 SERVICE. YOUEXPRESSLY ACKNOLWEDGE THAT YOU WILL NOT BE ABLE TO PLACE ORRECEIVE CALLS, INCLUDING CALLS TO ACCESS EMERGENCY 911 SERVICES, IFBRMEMC OR FIDELITY IS EXPERIENCING AN OUTAGE IN ITS NETWORK.

    YOUR E911 SERVICE WILL NOT WORK IF YOUR MTA, OR OTHER EQUIPMENTREQUIRED FOR THE COMPLETEVOICE SERVICE IS IMPROPERLY INSTALL EDOR CONFIGURED.

    BRMEMC Enhanced Voice Messaging

    With BRMEMC Voice Messaging, you and other users are called subscribers. As a subscriber, you can use the system to receive messages fromoutside callers and send messages to other subscribers with in the network. You can manage your voice messages from any touchtone phone,customize mailbox preferences and set up notification options.

    Your general access number, mailbox number (telephone number) and personal identification number (PIN) will be needed each time you useBRMEMC Enhanced Voice Messaging system.

    GENERAL ACCESS NUMBER : 706-770-2100

    MAILBOX NUMBER: your ten digit telephone number (including area code)PIN (four digits): Default PIN is 1234.

    INITIALIZING YOUR MAILBOX:

    1. From a telephone keypad, dial the General Access Number:2. A voice prompt will ask for your mailbox number. Enter your ten digit telephone number and press (#).3. A voice prompt will ask for your personal identification number. Enter the default PIN (1234) and press (#). The system will then prompt

    you to enter a new PIN.4. At this point, your mailbox is initialized. You can now record your name announcement and greeting. If you want to set up your mailbox at

    another time, press (*) to exit to the Main menu, or simply hang up.

    ACCESSING YOUR MAILBOX FROM ANY PHONE:

    1. Dial the General Access Number:2. Enter your mailbox number and press (#).3. Enter your PIN and press (#). You can also reach your mailbox by dialing your own telephone number, wait for the greeting to begin

    playing, and press (*). An Enhanced Voice Messaging will then prompt you to enter your ten digit mailbox number. After pressing (#), thesystem prompts for a PIN.

    ACCESSING YOUR MAILBOX FROM YOUR PHONE:

    1. Dial the General Access Number from the same telephone number as your mailbox number.2. Enter your PIN and press (#).

    CHECKING MESSAGES :

    When a new message is deposited in your mailbox, a message waiting indicator may light on your phone or you may hear a stutter dial tone whenyou pick up the receiver. Once you listen to or open a new message, it is saved until you delete it.

    1. Access your mailbox.2. The system plays your message inventory, stating the total number of new voicemail messages. Then, the system automatically plays new

    voicemail messages.3. While the messages are playing, you can press (*) to hear the Main menu options, where you can select from the message type and new and

    saved messages.4. Press (1) to listen to new messages or press (2) to hear saved messages.

    CHANGING USER OPTIONS:

    To change your name, greeting, PIN, message playback options or notification options:

    1. Access your mailbox.2. Press (9) for User Options and follow the voice prompts for the option you wish to modify.

    HELP?If you miss an instruction, wait and the options will be repeated. If at any time you get frustrated and wish to leave your voicemail box, simply hangup. You will not lose any messages or settings. If you need help setting up your voicemail box, or have any questions concerning BRMEMC EnhancedVoice Messaging, call 828-837-1017.

    UNDERGROUND ELECTRIC AND/OR FIBER SERVICE

    This Agreement, dated as of

    1. Whereas, Applicant has applied to the Cooperative for undergroundelectric and/or fiber.

    2. Whereas, the conditions for such service are stipulated in CooperativesPolicy Bulletin No. 326, included by reference thereto as a part of thisagreement and with which the applicant acknowledges he is familiar,

    particularly the General Conditions attached hereto; and,

    3. Whereas, in keeping with said Policy, the Applicant agrees to make a cashcontribution, in advance of construction.

    NOW, THEREFORE, the Cooperative does hereby agree to make such undergroundinstallation in keeping with its own plans and specifications and at a time convenient tothe Cooperative, which convenience includes availability of materials and equipment,favorable weather conditions and prior commitments.

    This agreement is binding for current and all future applications for underground electricService. IN WITNESS WHEREOF, the parties hereto have affixed their respectivesignatures as of the year and date first above written.

    BLUE RIDGE MOUNTAIN ELECTRIC MEMBERSHIP CORPORATION

    POLICY BULLETIN NO. 326

    SUBJECT: UNDERGROUND SERVICES - EXTENSION POLICY

    The Cooperative will extend underground service, upon request, to its consumers under thefollowing conditions:

    I. GENERAL CONDITIONS (applicable to all underground installations)

    A. All charges required to be paid under the terms of this policy will be payable inadvance or by credit arrangements satisfactory to the Cooperative. After the line isconstructed no refund of contributions will be made by the Cooperative.

    B. Where it is necessary to trench along roads, streets or drives (due to inadequate right-of-way, etc.), or where water lines, sewer lines, shrubs, trees and grass sod are

    subject to damage during underground installations, the Cooperative will not beresponsible for damage, replacement or repair resulting from or required as a resultthereof.

    C. Underground installations will be made with the understanding that, should it benecessary to uncover the cable for maintenance and/or repair, the Cooperative willuse reasonable care and diligence to preserve and protect water lines, sewer lines,sod, shrubs, trees, driveways, etc., but will not be responsible for loss of or damage tonatural or man made objects, including but not limited to water lines, sewer lines,sod, shrubs, and trees, or replacement of paving.

    D. Where, due to rock that cannot be moved by standard excavating equipment, the

    owner or developer shall be charged by the Cooperative the actual cost of drilling and blasting through affected area. Where there are other unusual conditions, such ashigh water table, which require installation procedures not normally used, the excesscost of such procedures may be charged by t he Cooperative to the owner ordeveloper.

    E. If the applicant requires outdoor area "Security" lighting as provided for under RateSchedule LS, applicant will be required to pay a security light installation fee and anyadditional cost resulting from underground installations according to Policy Bulletin

    No. 336.

    F. The provisions of Policy Bulletin No. 320 concerning acquisition of "Right-of-Way

    Easements" apply to extensions made under this policy.
