The Georgia Composite Medical Board (GCMB) held its regular meeting on August 5, 2021 via

teleconference at 2 Peachtree Street, Atlanta, GA 30303, to consider Medical Board matters.

CALL TO ORDER Dr. Dalton called the meeting of the Georgia Composite Medical Board to order at 7:32 a.m.

AGENDA Dr. Marshall made a motion, seconded by Dr. Gross to approve the agenda of the August 5, 2021

meeting. The motion carried unanimously.

MINUTES Dr. Gross made a motion, seconded by Dr. Marshall to approve the minutes of the July 1, 2021

meeting. The motion carried unanimously.

ELECTION OF OFFICERS Dr. Marshall made a motion, seconded by Dr. Gross to approve Matthew Norman, MD as the Vice-Chairman of the

Georgia Composite Medical Board.

CHAIRMAN’S REPORT Dr. Dalton gave a message regarding the upcoming year.

Dr. Dalton discussed Committee Assignments and advised Board members to let us know of any

concerns.

The September 2, 2021 Board meeting was scheduled to be a face-to-face meeting, but due to the current

COVID situation, we will continue to meet virtually.

EXECUTIVE DIRECTOR’S REPORT Ms. Hughes, Executive Director, presented the following report:

1. Ms. Hughes provided an update on staffing news and introduced the new licensure manager David

Harris.

2. Ms. Hughes encouraged the Board to review the Georgia Board of Health Care Workforce

visualization website.

3. CE Brokers contract has been signed, kick off meeting next week.

4. Hospital IT Departments has been complaining about the Recapture on the site, we have a solution

and will present to everyone next week.

5. Updated Emergency Rule for Practice Through Electronic or Other Such Means during Continued

COVID-19 Economic Recovery.

6. The Board set the following dates for 2022, all meetings are on Thursday and locations will be

announced later this year:

7. Quarterly FSMB Update on USMLE.

COMPACT – What happens if an applicant does not comply with the Board’s requirements?

a. Contact the COMPACT Commission regarding the State of Georgia’s (SOG) law

requirements for licensure – submission of 3 reference forms, NPDB Report, CV, and

Malpractice Questionnaire – and ask if the COMPACT Commission will take action against

those physicians who do not comply with SOG’s requirements because the benefit flows

through the COMPACT instead of the SOG.

b. If the COMPACT Commission states they will not take action, then the Georgia Composite

NURSE PROTOCOL ADVISORY COMMITTEE Dr. Norman presented the Nurse Protocol Report:


The Committee recommended the following:

1. What are the requirements for a psychiatric DNP for her supervision? Also, we have a Pediatric

NP…does her peer review have to be done by a Pediatric NP versus just an NP? Chief Medical

Officer question is for Board of Nursing and peer review should be only if there is an issue.

2. My name is Monica Castro. I am interested in starting my own IV hydration and injection mobile

spa. Need an agreement in order to operate and should have a delegating with specialty such

as Family, Primary, Internal, and or Emergency.

3. I would like detailed information on starting and operation of a IV Hydration business or program

in the state of Georgia. Need an agreement in order to operate and should have a delegating

with specialty such as Family, Primary, Internal, and or Emergency

4. I will be administering Botox and filler but not writing prescriptions. From what I read, I do not

need a DEA number and only need to submit a nurse protocol agreement if I am writing

prescriptions. NP needs a collaborating agreement and Form C in order to administer Botox.

Botox is considered prescribing.

5. Question about prescriptions for Stimulants considered scheduled 2N drugs. Where can I find the

policy on whether I am allowed to prescribe them. I see ADHD children and ADD adults who

sometimes have a need for stimulants. NP is not allowed to prescribe the stimulants and

Schedule IIs.

6. As inpatient nurse practitioners we often prescribe schedule I and schedule II medications during a

patient’s hospital stay. These orders are all co-signed by our physicians who are rounding that day.

The medications in question for RSI would be etomidate, rocuronium, succinylcholine,

midazolam, atropine, and Propofol. These would administer only in the inpatient setting, and we

would not be prescribing these medications otherwise. However, our supervising physicians will

be at a remote location. Are we still covered at APRNs legally if this is delineated in our protocol

agreement? Schedule I drugs cannot be prescribed. The medication describe in questions can

be ordered under a physician in a hospital setting.

7. With the Opioid Crisis, it looks like the Federal Gov-DEA has made changes regarding the

requirement of waivers to prescribe Buprenorphine (Suboxone). They also show that NP’s holding

schedule III/IIIN DEA’s can now prescribe this medication. My question is what is GA rules

regarding this? NP must have a special certificate for Buprenorphine and may find the

waiver and instruction on website Samshon.gov to complete the waiver.

and provide ‘over-the-counter-devices’ found in OCGA 43-34-192(17). Providing any other device or

service is the practice of orthotics found in OCGA 43-34-192(12) and OCGA 43-34-192(15) and she

must be licensed as an orthotist in order to perform.

The Committee referred Rule 360-31-.01(2) to the Rules Committee to clarify that a professional

(referral) reference must be from a physician, physical therapist, occupational therapist, or case manager

only.
