The submission of this Report is an annual requirement by the State which stipulates the Redevelopment Commission must provide this report annually to the Council. I will be happy to answer any questions anyone may have concerning this annual report.

GOSHEN REDEVELOPMENT AUTHORITY 2019 ANNUAL REPORT
The Goshen Redevelopment Authority (“Authority”) was established by Ordinance 4822 in accordance with Indiana Code 36-7-14.5 for the purpose of financing of local public improvements for lease to the Goshen Redevelopment Commission (“Commission”). Ordinance 4822 was passed by the Goshen Common Council on April 7, 2015 and adopted by Mayor Allan Kauffman on April 9, 2015. The Board of Directors of the Authority held their annual meeting on March 11, 2019 at which the 2018 Annual Report was presented. The Board of Directors also elected officers as follows who shall serve from their date of election and until their successors are elected and qualified.

Secretary-Treasurer -- Michael A. Landis The annual report requirements for the Redevelopment Authority are set forth in Indiana Code 36-7-14.5-9. Section 9(c) does not apply to the Redevelopment Authority as the Authority does not have any TIF districts. The information required under Indiana Code 36-7-14.5-9(c) for each TIF district is provided in the Goshen Redevelopment Commission’s annual report pursuant to Indiana Code 36-7-14-13(e) and will not be repeated here. The Authority does have the following bond obligation in which the bond payments come from the lease rentals paid by the Goshen Redevelopment Commission: Redevelopment Authority Economic Development Lease Rental Refunding Bonds of 2015 The Redevelopment Authority and the Goshen Redevelopment Commission entered into a Lease Agreement on April 25, 2015. The Authority acquired from the Commission three projects located in the Commission’s Southeast Economic Development Area. The Authority then refunded the Commission’s outstanding Tax Increment Revenue Bonds of 2008 by issuing Economic Development Lease Rental Refunding Bonds of 2015. The Authority is leasing to the Commission the three projects previously mentioned. The Lease Agreement is for 14 years, and the annual lease payments from the Commission
are due on January 1 beginning January 1, 2016. The lease rentals are paid from the Commission’s Southeast Economic Development Area TIF funds.
The Authority’s Economic Development Lease Rental Refunding Bonds of 2015 in the aggregate principal amount of $5,105,000 were sold on June 19, 2015 to Old National Bank. The interest rate on the bonds is 2.70% per annum. The bonds have a final maturity date of January 15, 2028. The bonds maturing on or after January 15, 2024 are subject to optional redemption and mandatory sinking fund redemption prior to maturity. The interest on the bonds are payable semiannually on January 15 and July 15 each year beginning January 15, 2016, and principal is payable annually on January 15 beginning January 15, 2016. The bond payments come from the lease rentals paid by the Commission and are paid to the trustee, The Bank of New York Mellon.
A copy of a special purpose report dated June 18, 2015 and prepared by H.J. Umbaugh & Associates Certified Public Accountants, LLP pertaining to the Authority’s Economic Development Lease Rental Refunding Bonds of 2015 is attached to this annual report. The special purpose report includes a comparison of debt service and lease rental payments; the amortization of $5,105,000 of Redevelopment Authority Economic Development Lease Rental Refunding Bonds of 2015, and a schedule of lease rental payments.

Goshen Economic Development Commission 2019 Annual Report
The Goshen Common Council established a Department of Economic Development and the Goshen Economic Development Commission by Ordinance 2225 passed and adopted on August 26, 1974. The Commission consists of three members appointed by the Mayor, one of which is selected by the Mayor, one of which is nominated by the Elkhart County Council, and one of which is nominated by the Goshen Common Council. The members of the Goshen Economic Development Commission for the 2019 calendar year were: 1. Donald Riegsecker -- Nominated by Elkhart County Council and appointed by Mayor for
term beginning September 8, 2018 through January 31, 2021. Donald Riegsecker was replaced on December 17, 2019 by Jeff Taylor due to a conflict related to certain assisted living facilities proposed to be financed by the issuance of economic development revenue bonds.
2. Jeff Taylor -- Nominated by Elkhart County Council and appointed by Mayor to replace Donald Riegsecker beginning December 17, 2019. Jeff Taylor’s appointment is limited to issues involving Green Oaks of Goshen, LLC and continues until the proposed financing has closed or the proposed assisted living facilities project has been withdrawn, whichever occurs first.
3. Zacharious Bontrager -- Nominated by Goshen Common Council and appointed by Mayor for term beginning August 21, 2018 through January 31, 2020.
4. David S. Newell -- Appointed by Mayor for term beginning February 1, 2018 through January 31, 2022. David Newell resigned and was replaced by Allan J. Kauffman on December 17, 2019.
5. Allan J. Kauffman – Appointed by Mayor for term beginning December 17, 2019 through January 31, 2022.
The Goshen Economic Development Commission does not have a department budget, nor does the Commission have any income (from taxes, transfers or otherwise). Any expenses that may be incurred by the Commission are absorbed by other budgets of the City of Goshen. Activities of the Goshen Economic Development Commission in 2019 include the following: Goshen Theater, Inc. At the request of Goshen Theater, Inc., the Goshen Economic Development Commission approved and recommended to the Goshen Common Council the issuance and funding of its Taxable

Economic Development Revenue Note, Series 2019 (the “Series 2019 Note”) and loan the proceeds in an amount not to exceed $850,000 to Goshen Theater, Inc. to finance a portion of the rehabilitation of the Goshen Theater at 216 South Main Street, together with all necessary appurtenances, related improvements and equipment. The Goshen Redevelopment Commission pledged $850,000 in TIF revenues for the issuance and funding of the Series 2019 Note. The Goshen Common Council passed Ordinance 4995 authorizing the issuance of the Series 2019 Note. The closing for this financing occurred on March 29, 2019.
Green Oaks of Goshen, LLC
At the request of Green Oaks of Goshen, LLC, the Goshen Economic Development Commission and Goshen Common Council both passed inducement resolutions on December 17, 2019 for the proposed issuance of economic development revenue bonds in an amount not to exceed $22,000,000 to finance a portion of the acquisition, construction and equipping of an assisted living facility to be located at or near 282 Johnston Street. No further action was taken in 2019 by the Commission or the Council with regards to this proposed financing.

RE: Public Hearing and Notice of Availability of Draft Community Development Block Grant (CDBG) 2020-2024 Five-Year Consolidated Plan & Program Year 2020 Annual Action Plan
The City of Goshen's CDBG Five-Year Consolidated Plan 2020-24 and Annual Action Plan for Program Year 2020 have been prepared and are available for public review and comment beginning April 2, 2020. Due to the COVID-19 public health emergency, City of Goshen offices are closed to the public, so a hard copy of the plan is not available for review. The Plan is available on the City website at http://www.goshenindiana.org/cdbg.
The City will hold a public hearing on the proposed Five-Year Consolidated Plan 2020-24 & 2020 Annual Plan on Tuesday, April 21, 2020, at 7:00 PM during the City Council meeting in the City Council Chambers, at the Goshen Police and Courts Building, 111 E. Jefferson Street, Goshen. The Goshen Police and Courts Building is handicapped accessible. Non-English speaking persons and others needing special assistance to participate in the hearing process should contact the City as soon as possible.
The public hearing will include a review of the proposed Five-Year Consolidated Plan 2020-24 & 2020 Annual Plan, a review of the current 2019 program year, and opportunity for citizen comment.
The following priorities were among those identified for community and neighborhood development in the City of Goshen for the 2020-2024 CDBG Consolidated Plan:

The proposed use of CDBG funds for program year 2020 is as follows:
1. Public Service Grants - Provision of services to low and moderate income households andpersons City-wide $49,000
2. Owner-occupied Rehabilitation of homes occupied by low and moderate income householdsthrough loans, grants and deferred payment loans City-wide $116,029
3. Multi-family Housing Rehabilitation - Two projects to create and preserve affordable housing$372,000

ANALYSIS City of Goshen, City of Goshen Department of Redevelopment, and Peterson Weaver, LLC, request a rezoning from Agricultural A-1 and Industrial M-1 to Commercial B-2 for 311 W Madison Street (six tax parcels, ± 35.324 acres) and 212 and 324 W Washington Street, for development of a City park at 311 W Madison, including a multi-use pavilion and parking, and to align existing split zoning for all three properties. The subject property is currently nine tax parcels, with three property owners, and a total of ± 37 acres. The six tax parcels owned by the City of Goshen contain existing B-2 zoning, along with A-1 and M-1. The property at 212 W Washington Street (two tax parcels) is a combination of B-2 and M-1 zoning, and the property at 324 W Washington Street (one tax parcel) is a combination of B-2, M-1 and A-1 zoning. The rezoning is being requested in part to facilitate development of a City park at 311 W Madison Street, to include a multi-use pavilion and parking. Parks are a Conditional Use permitted on all zoning districts, but a property with multiple zoning districts complicates the review process, as each district has different developmental standards. The subject property is adjacent to the central business district, and the rezoning to B-2 will standardize the zoning and match the adjacent zoning to the north and east. The M-1 District is the final remainder of an old industrial corridor along the Millrace canal that has been rezoned and redeveloped, for a mix of residential and commercial uses. The rezoning request includes the properties at 212 & 324 W Washington Street, as each of these properties is currently a mix of B-2, M-1 and A-1 zoning, and the rezoning to B-2 will remove the existing split zoning, and align with the existing B-2 District. The site plan submitted with the rezoning is not part of the rezoning and is not being reviewed by the Plan Commission or Council, but demonstrates that B-2 requirements are able to be met for the area to be rezoned. RECOMMENDATIONS Staff recommends the Plan Commission forward a favorable recommendation to Goshen Common Council for a rezoning from Agricultural A-1 and Industrial M-1 to Commercial B-2 for 311 W Madison Street, and 212 and 324 W Washington Street, based upon the following: 1. The rezoning is consistent with the existing zoning and land use in the area. 2. The rezoning is consistent with the Comprehensive Plan, including:
Land Use, Goal L-1: Prioritize the reuse and redevelopment of existing land and structures. Community Services & Facilities, Goal C-3: Provide and expand parks and recreational activities for all
citizens. Natural Environment, Goal NE-2: Maintain and increase open spaces and parks.
3. The rezoning to B-2 will match the adjacent existing zoning and resolve existing split zoning for all three properties.

WHEREAS INSITE Development, LLC, and City of Goshen Department of Redevelopment submitted an application on the 26th day of February 2020, to approve a PUD major change to amend the Millrace Townhomes PUD to permit development of duplexes, and the Goshen City Plan Commission did after proper legal notice conduct a hearing on said Petition as provided by the Law on the 17th day of March 2020 and recommended the adoption of a PUD major change and this Ordinance by a vote of 5-0. ANALYSIS Millrace Townhomes, LLC, and City of Goshen Department of Redevelopment request a PUD major change and PUD preliminary site plan approval to amend the Millrace Townhomes PUD to permit development of duplexes. The subject property is generally located between River Race Drive and South Second Street, south of Monroe Street and north of Purl Street, and is zoned Commercial B-2PUD. When a PUD is developed, it contains specific use and developmental requirements that are in addition to, or in place of, the underlying zoning district requirements. A PUD is always tied to a site plan, with a PUD preliminary site plan adopted when a PUD is established or modified, and a detailed PUD final site plan reviewed as development occurs. Changes to a PUD are defined by the Zoning Ordinance, and may be minor or major. Major changes include those that change use, character or intensity of the development, and those that increase traffic or utility issues, reduce parking, or encroach into required setbacks. Changing stated conditions of a PUD are also typically major changes. PUD major changes require review as a public hearing at Plan Commission, with final approval by Council. As a PUD develops, the original PUD conditions remain in place unless specifically changed, so major changes typically add to or modify the original requirements. A PUD is intended to provide unified development, streamline the review process, and provide flexibility based on specific site conditions. The Millrace Townhomes PUD was established in May 2014 by Ordinance 4784, with PUD final site plan approval and primary approval of a three-lot subdivision granted by the Plan Commission in September 2015. The Millrace Townhomes PUD was proposed with approximately 24 attached single-family residential units on individual lots. The original developer did not proceed with construction, and the property was transferred back to City of Goshen Department of Redevelopment in July 2018. Millrace Townhomes, LLC, has entered into an agreement with Goshen Redevelopment Commission to purchase and develop the subject property, proposing 16 residential units in eight duplexes on eight lots. One purpose of the Millrace Townhomes PUD is to provide residential density within walking distance of downtown, and although the current proposal reduces the total number of units, the duplex use provides more density than detached single unit development. The original Millrace Townhomes PUD specified attached single-family residential use, which is residential units on individual lots, so the PUD major change is needed to allow duplexes, as although duplexes are functionally similar to attached single-family units each unit of the duplex is not on an individual lot. Because the duplex use is functionally similar and provides density it is a reasonable change. No other aspects of the Millrace Townhomes PUD will change. PUD preliminary site plan approval is requested as part of the PUD major change, to establish the preliminary site plan. Requirements of the Millrace Townhomes PUD and B-2 District are met. PUD final site plan review, including detailed landscape and lighting plans, will be submitted as part of the City's administrative site plan review process, Technical Review, and may be reviewed by Staff on behalf of the Plan Commission. A new major residential subdivision application will be required, to establish the proposed eight lots.

Millrace on the Canal PUD Major Change Letter of Intent:

We are proposing the development of Residential Duplexes on 8 individual lots. There are two types of duplexes; a townhome and flat version (see sheets Al.1, Al.2 & Al.3). Each duplex consists of 2-3 bedrooms with an enclosed garage containing 2 parking spaces. The minimum occupied area of a residential unit is 1500 square feet.
The property was rezoned from M-1 to Commercial B-2 with a Planned Unit Development (PUD) Ordinance No. 4784 on May 6, 2014. We are requesting that Condition #1 be amended from permitting single-family residential units per lot, to permitting two residential units per lot.
We request that the following Approved PUD Conditions remain in place:
Condition #5: No minimum lot width or minimum lot area is required. Condition #6: Minimum setbacks of O' will be permitted for front, rear and side setbacks. Condition #7:Two parking spaces are required for each residential dwelling unit, and will be provided on site and in the adjacent public right of way. Condition #8: Parking shall be as generally depicted on the approved preliminary site plan, maneuvering and parking within the right of way permitted, subject to final PUD site plan approval. Condition #9: Each residential dwelling unit shall contain no less than 1,200 square feet of occupied space. Condition #11: Site lighting, parking lot lighting, and building security lighting shall not glare or trespass onto adjoining properties. Condition #12: Landscaping is required following the requirements of Goshen Zoning Ordinance. Condition #13: B-2 district regulations shall apply, except when in conflict with provisions of Millrace Townhomes PUD. Condition #14: The Goshen Commission shall review and approve the overall primary subdivision before any development occurs.

ZO Section 5000, Landscape Regulations: We have proposed street trees and landscaping along South Second Street to meet Section 5000.2. (See Sheet Al.OJ.
ZO Section 5180 & Appendix C, Visibility Requirements: Our proposal does not impede on the requirements of this ordinance. All buildings and fences are set back to be within the distances described in Appendix C, Diagram #4. There will be no visual impediment between a height of two and one-half feet and eight feet above the established grade level of the intersecting streets. (See Sheet Al.OJ.
We believe our proposal meets the City's intent to provide residential density with variety of housing types, have people living downtown thereby conserving non-renewable fuel resources and reducing pollution by supporting a walkable and livable community.

WHEREAS Ordinance 5008 approves the 2020 minimum and maximum compensation, including wages and benefits, for Civil City and Utilities employees.
WHEREAS City Administration would like to add a new Community Development Specialist position to the Community Development Department.
NOW, THEREFORE, BE IT ORDAINED by the Goshen Common Council that Ordinance 5008, Exhibit A, 2020 Positions, Classifications and Grades, shall be amended to add a new Community Development Specialist position under the Community Development Department. ORDINANCE 5042
Additional Appropriation Ordinance for Central Fire Station Repair and Renovation,
Police Training Facility Improvements, and COVID-19 Public Health Emergency
WHEREAS, it has been determined that it is now necessary to appropriate more money than was appropriated in the annual budget; and WHEREAS, the Common Council approved an additional appropriation for repair and renovation of the Central Fire Station in the amount of $150,000 in Ordinance 5019 on October 1st, 2019 of which, due to the nature of the project and efforts by Goshen Fire Department to contribute substantial time and labor, $117,661.51 was unspent at year end and reverted to the General Fund; and WHEREAS, the Common Council received a memorandum from Fire Chief Dan Sink on January 7th and discussed this funding in a public meeting; and WHEREAS, the Central Fire Station project was ongoing through early 2020, appropriated funds were borrowed from Police Department fuel funds on a temporary basis to maintain continuity of the Central Fire Station project; and WHEREAS, these funds need to be replenished to meet the fuel needs of the Goshen Police Department for the remainder of 2020; and WHEREAS, the Goshen Police Department has obtained a shooting range and training facility on East Lincoln Avenue that is need of renovation; and WHEREAS, Mayor Jeremy P. Stutsman presented the Common Council at its March 17th meeting a proposal to create and fund a budget line for the purpose of responding to the COVID-19 public health emergency, along with parameters for use of funds in the line and including that any funds remaining in the line at the end of 2020 be placed in the Rainy Day fund; and WHEREAS, the Department of Finance created the General Fund budget line (101.510-07-439.0911 BD WORKS/EMERGENCY SUPP SVCS) which was initially funded with appropriated monies from BD WORK/Other Services Charges which had been appropriated in the annual budget for trash collection services; and
WHEREAS, trash collection services must still be performed and paid for the entirety of 2020 out of the BD WORK/Other Service Charges line; Now THEREFORE: Be it ordained by the Common Council of the City of Goshen, Elkhart County, Indiana, that for the expenses of the taxing unit the following additional sums of money are hereby appropriated out the funds named and for the purposes specified, subject to the laws governing the same:
