Ministerial Declaration (Bull Bar Exemption) Order 2014
I, Duncan Gay, Minister for Roads and Freight, pursuant to section 19 of the Road Transport Act 2013, make the following Order.

1 Citation This Order is the Ministerial Declaration (Bull Bar Exemption) Order 2014.
2 Commencement This Order takes effect on and from 16 September 2014.
3 Effect This Order remains in force until 16 September 2016 unless revoked earlier.
4 Definitions In this Order: Vehicle frontal protection system has the same meaning as in Clause 25 (5) to Schedule 2 of the Road Transport
(Vehicle Registration) Regulation 2007. Ground clearance has the same meaning as in Clause 78 (1) to Schedule 2 Road Transport (Vehicle Registration)
Regulation 2007.
Unless stated otherwise, words and expressions used in this Order have the same meaning as those defined in the Road Transport Act 2013.
5 Application This Order applies to a motor vehicle that has a GVM not over 4.5 tonnes that is fitted with a vehicle frontal protection system that does not comply with AS 4876.1–2002 Motor vehicle frontal protection systems—Road user protection.
6 Declaration Clause 25 (3) to Schedule 2 of the Road Transport (Vehicle Registration) Regulation 2007 is declared not to apply to a motor vehicle for which this Order applies only if the motor vehicle complies with the conditions stated in Schedule One of this Order.

Condition
If the bull bar is fitted to a vehicle of a model type first manufactured after 31 December 2002, the forward offset must not exceed 75mm or 9 degrees. The forward offset must be measured between the front face of the topmost horizontal member and the most forward point of either the bull bar’s supporting member (which can be the bumper or the horizontal channel where the bull bar has replaced the bumper), or a horizontal member whose base is not more than 100mm above the supporting member. The top and bottom ends of all vertical members must be curved rearwards. There must be no sharp edges on forward facing members. Flanges of members constructed from I-sections must have chamfered or rounded edges. If the vehicle frontal protection system incorporates the front bumper or a horizontal member, the ends must go at least partially around the side of the vehicle or be capped. Open frames are not allowed.
The vehicle frontal protection profile may be stepped vertically up to 100mm using non-circular members. Greater steps are only allowed using circular tube or pipe formed to achieve the change in profile. A member can only project a maximum of 50mm beyond the point of intersection with another member. Brackets and other components connected to the vehicle frontal protection system must be fitted rearward of the front face and not protrude above the top of the vehicle frontal protection system.

The vehicle frontal protection system and attachments may extend beyond the original width of the vehicle providing it does not extend beyond the standard mirrors on either side or, if there are no side mirrors, 150mm, and the overall width of the vehicle and attachments do not exceed 2.5m.
If lights and/or indicators are obscured by the vehicle frontal protection system frame, additional lights and/or indicators must be fitted that meet their necessary performance requirements and effective range to comply with Part 5 of Schedule 2 of the Road Transport (Vehicle Registration) Regulation 2007. Additional lights are not required where mesh is fitted to frame in front of or beside the light cluster provided the field of view is only interrupted by the mesh.
If the vehicle frontal protection system obscures the number plate to any extent, the number plate must be securely mounted in a manner that complies with clause 61 of Schedule 2 of the Road Transport (Vehicle Registration) Regulation 2007.
If the vehicle frontal protection system extends above the line of the bonnet, the driver must have an unobstructed view of the surface of the road 11m in front of them when sitting in the normal driving position.
The vehicle and any frontal protection system must continue to comply with clause 78 of Schedule 2 of the Road Transport (Vehicle Registration) Regulation 2007.

Explanatory Note:
The notice of licence suspension or cancellation is used by the NSW Police Force or appointed Authorised Officers to advise a person in writing that their driver licence is either cancelled or suspended. Clause 58 of the Road Transport (Driver Licensing) Regulation 2008 specifies that the licence cancellation or suspension notice is to be in a form approved by the Authority.
By section 4 of the Road Transport Act 2013, “The Authority” means Roads and Maritime Services. By section 48 of the Transport Administration Act 1988, the Chief Executive, Roads and Maritime Services may undertake any function of Roads and Maritime Services, including the approval of this form.

ALTERATION OF PURPOSE/CONDITIONS OF A WESTERN LANDS LEASE
IT is hereby notified that in pursuance of the provisions of section 18J, Western Lands Act 1901, the conditions of the undermentioned Western Lands Lease have been altered as shown.

The purpose of Western Lands Lease 1225, being the land contained within Folio Identifier 4932/769179 has been altered from “Pastoral Purposes” to “Grazing & Cultivation (Dryland)” effective from 1 September, 2014.
As a consequence of the alteration of purpose/conditions rent will be assessed annually in line with the Western Lands Act 1901 and Regulations.
The conditions have been altered by the inclusion of the special conditions following:
SPECIAL CONDITIONS ATTACHED TO WESTERN LANDS LEASE 1225
1. The lessee shall only cultivate 5,115 hectares shown cross-hatched on the diagram below.
2. The lease shall only be used for the purpose of Grazing & Cultivation (Dryland).
3. The lessee shall ensure that sand hills and other soils with a surface texture of loamy sand or coarser are left uncultivated unless specifically approved by the Commissioner.
4. The lessee shall ensure areas with a slope greater than 2% are not cultivated, until any soil conservation measures documented in a plan approved by the Commissioner have been implemented at the lessee’s expense.
5. The lessee shall ensure land within 60 metres of any texture contrast or duplex soil area remains uncultivated except in accordance with a plan approved by the Commissioner. Texture contrast (or duplex) soils are soil types which have a sandy to loamy topsoil abruptly overlying a clay subsoil and are prone to scalding (producing clay pans and hummocks).
6. The lessee shall ensure incised drainage lines, other than man-made structures, which carry water after storms are left uncultivated in the channels and for a distance of at least 20 metres on either side of the banks of the channels except when the Commissioner specifi es otherwise.
7. The lessee shall ensure that there that there is no cultivation or ancillary works associated with cultivation undertaken within at least 50 metres of the bank of Yanda Creek adjacent to Area J, and 500 metres of the bank of Yanda Creek adjacent to areas L and M.
8. The lessee shall ensure that no cultivation is undertaken within 300 metres of any property boundary fence-line, except for the western boundary.
9. Cultivation adjacent to any established road used by the public is permitted, however the lessee shall ensure that such cultivation is carried out such as to not interfere with the road formation.
10. The lessee shall ensure stubble is retained on the soil surface and shall not be burnt, except with the approval of the Commissioner or his delegate. Where such approval is granted, stubble burning is to be carried out as per requirements of the NSW Rural Fire Service.
11. The lessee shall undertake any appropriate measures, at his/her own expense, ordered by the Commissioner to rehabilitate and degraded cultivated areas.
12. The lessee shall establish windbreaks at his/her own expense as may be ordered by the Commissioner to provide adequate protection of the soil.
13. The lessee shall ensure that cultivation and cropping do not alter the natural flood regime or obstruct the reasonable passage of floodwaters. Crops are not to be protected by levees.
14. The lessee must undertake any fuel management and/ or provision of fire trail access in accordance with fire mitigation measures to the satisfaction of the NSW Rural Fire Service.

I, the Honourable Victor Dominello MP, Minister for Aboriginal Affairs, following consent by the New South Wales Aboriginal Land Council (NSWALC), do, by this notice pursuant to section 231 (2) of the Aboriginal Land Rights Act 1983 (the Act) extend the appointment of Mr Peter HILLIG as administrator to the Gandangara Local Aboriginal Land Council for a period of six (6) calendar months, from 20 September 2014. During the period of his appointment, the administrator will have all of the functions of the Gandangara Local Aboriginal Land Council and any other duties as specified by the instrument of appointment. The administrator’s remuneration and expenses are not to exceed $330,000 excluding GST without the prior approval of NSWALC. The administrator’s remuneration may include fees payable for the services of other personnel within the administrator’s firm who provide services as agents of the administrator.
