Shri Ajit Singh Sheoran, Principal, Government Senior Secondary School

Dhigaon Jattan (Bhiwani), while being posted at Government Senior SecondarySchool Bawani Khera (Bhiwani) was chargesheeted vide Order No. 5/ 185-2009HRG-I(1) dated 26.07.2011 under Rule 7 of Haryana Civil Services

(Punishment and Appeal) Rules, 1987 on the following charges:-

That he took girl students of 10+1 and 10+2 on tour to Delhi, Agra,Jaipur, Sikri and Mathura instead of Delhi and Agra without

permission of the competent authority.

That being co-education school, he had only taken girl students for

the tour organized by him and instead of two days tour, he hadextended it to four days without seeking permission of higher

authorities. Further, he had acted in an objectionable and obscene

manner during the tour with the girl students and he had taken awaythe mobile phones of girl students from them. An FIR was registeredagainst him in Bawani Khera Police Station on 04.12.2009 is respect

of his wrongful acts.3. That he forced the girl students to see film of obscene nature at

Jaipur. He also kept the girl students without arrangement for their

food and lodging/rest etc.

He replied to the said chargesheet on 28.10.2011 and finding the same

as unsatisfactory, Shri R. K. Taneja, IAS (Retd.) was appointed as regularinquiry officer vide order dated 09.03.2012, who submitted his report on21.08.2012. Regarding charge No. 1, this part of the charge has been proved bythe inquiry officer that he has taken the girl students for tour to Delhi, Agra,Sikri, Jaipur, Mathura and Vrindavan, instead of originally planned tour toDelhi and Agra only. Regarding charge No. 2, it has been proved that theincumbent has extended the tour to four days instead of originally plannedtour of two days without seeking the approval of the competent authority. Ithas also been proved that the incumbent has taken away the mobile phones ofgirl students without any cogent reasons. Regarding charge No. 3, though thecharge of showing of obscene film has not been proved, yet this part of the

charge clearly stands proved that he has violated the government policy and

guidelines to keep the students away from cinema halls. Regarding the part of

charge of not providing proper food and lodging/rest etc., the same has beenproved. Thereafter, as provided in Rule 7(6) of Haryana Civil Services(Punishment and Appeal) Rules, 1987, a communication alongwith copy of theenquiry report was sent to the said incumbent on 17.09.2012 to submitrepresentation within one month, if he so desires. The said incumbent has senthis representation dated 04.12.2012. He also sought personal hearing beforetaking any decision in the matter. Accordingly, he was heard in person on19.02.2013.

During personal hearing, he submitted that during tour Smt. Anita,female lecturer, three male teachers and one peon also accompanied him. Hefurther submitted that the girls had to leave in the morning, but got delayed till3:00 P.M. and thereafter, a boys group also started following them up in a busand girls came to my residence, requested for accompanying and this is how,he accompanied them. He stated that the tour was originally planned for twodays, but these places could not be covered. He further stated that the maleteachers were not to be accompanied in original planning except Jugal Kishoreand female teadiers, as lecturers were on marking duty. He submitted that inthe said eventuality, he accompanied them and he changed the route, insteadof Delhi, to Jaipur and Mathura and came back to school on 01.12.2009. Hefurther submitted that on 2nd and 3rd December, he attended the school andsuddenly on 4th December, two journalists came and raised the issue and thenparents too came and raised the same issue. He emphasized that actually theparents of the girl students were sent by boys, whose bus was following andthese were the students of the same school.

I have gone through the chargesheet, reply thereof, report of regularenquiry officer, written representation in consequence thereof, submissionsmade at the time of personal hearing, State Policy on Excursion Tour ofstudents studying in Government Schools from VI-XII classes from 2009 to2010 and connected provisions of Haryana Civil Services (Punishment andAppeal) Rules, 1987. It is clear that charges stand clearly proved to the extentenunciated above. There is not a scintilla of doubt that the incumbent hasflouted the basic ingredients of State Policy on Excursion Tour of students, asdetailed above, especially taking girl students to film, taking girl studentsbeyond 100 kms and accompanying himself in the tour, being Head of theInstitution, which were clearly barred in the said policy.

CS.NR_Taking an overall view of the matter, a penalty of stoppage of gimp grade

increments with cumulative effect is inflicted upon Shri Ajit Singh Sheoran,Principal, Government Senior Secondary School Dhigaon Jattan (Bhiwani), as

provided in Rule 7(7) read . with Rule 4(1)(v-A) of Haryana Civil Services

(Punishment and Appeal) Rules, 1987.

Their appointment is against a purely temporary post which is liable to beabolished at any time and position no promise of subsequent permanentemployment. No offer of permanent vacancy can be made them at presentin this respect, they will have to take their claims like others who havebeen recruited similarly. In case they are married, they will produce the following certificate to •

his/her Head of office:- "That he/she is not having more than one livingspouse."In case they are unmarried, they shall have to furnish a declarationto the effect that each of these will not have more than one living

spouse.They will be required to pass a test in Hindi or English as per ChiefSecretary instructions issued vide Memo No. 12/ 38/95-2GSI dated20.01.1998, 17.01.2007 and 13.03.2012 at the speed of 25/30words per minute respectiVely within a year from the date of joiningtheir duties otherwise they shall not be allowed their annualincrements until they pass such test. On passing the test they willbe allowed increment from the date following the day of test onwhich they pass without payment of arrear of increments. Theirdate of increments will, however, not be postponed on account oftheir failure to clear the test within the prescribed period.They will not undertake higher studies of any kind without priorpermission of the competent authority. Consequently, no leave ofany kind will be granted for the prosecution of higher studies.They will be required to produce the original Educational documentsand Date of Birth Certificate, Handicapped Certificate and Haryana

Domicile certificate.They shall• have to furnish fitness certificate from the Chief MedicalOfficer as required under Rule 3.1 of Punjab CSR Vol-I Part-I before

joining their duties.If they have not been vaccinated within last twelve months theyshould have it done before reporting themselves for duty.No TA/DA and joining time will be paid to them for joining this post.They will remain on probation for a period of two years, from thedate of their appointment. The period of probation can be extendedin accordance with the existing rule on the subject. For passingtheir performance during the period of probation, their work conductwill be taken into consideration, if their work and conduct duringthis period is not found satisfactory their services will be terminated

without any notice.Their appointment is subject to have passed Matriculation or its

equivalent examination with Hindi.Their services will be governed by the Haryana Education

Department sub offices Ministerial (Group-C) Services Rules, 1983.Their character and antecedents have been got verified and in casesubsequently any adverse facts come to the notice of the State Govt.regarding his character and antecedents, his services are liable to be

terminated.
