This order is the Public Firewood Areas Order 2012.

2. Commencement

This order comes into operation as follows —

(a) clauses 1 and 2 — on the day on which this order is published in the Gazette;

(b) the rest of the order — on the day after that day.

3. Previous orders revoked

The orders listed in Schedule 1 are revoked.

4. Public firewood areas

(1) The areas of State forest named in Schedule 2 column 1 and described in Schedule 2 column 3 are —

(a) set aside for the purposes of the collection of firewood by members of the public; and

(b) designated as being areas to which the Forest Management Regulations 1993 regulation 100 applies.

(2) The locations of the areas referred to in subclause (1) are shown on the relevant DECMAPs referred to in Schedule 2 column 2.

DELEGATION NO. 28 The Environmental Protection Authority (“the Authority”), acting pursuant to section 19 of the Environmental Protection Act 1986 (“the Act”) has resolved to hereby delegate to those members (or member) of the Authority who are present at a meeting of the Authority and who do not have a direct or indirect pecuniary interest, or any other interest which precludes them, him or her from consideration/discussion and voting on a matter (“the Matter”) that is before the meeting of the Authority, all of its powers and duties under Part IV, Division 1 of the Act in respect of the Matter, for the duration of the meeting.


This delegation is to have effect only if, at the meeting of the Authority, there is not a quorum of Authority members able to vote on the Matter by reason of the operation of section 12 of the Act, illness, absence, vacancy in the office of an Authority member or other cause. In circumstances where this delegation applies and the voting on a Matter is equally divided, section 11(2)(d) of the Act applies and if one of the delegates is not the Chairman or the Deputy Chairman, the member exercising this delegation, who has served as a member for the longest period, shall be the presiding member for the purposes of section 11(2)(d) of the Act as it applies to the exercise of this delegation. Acting pursuant to the powers conferred by Section 67 of the Western Australian Marine Act 1982, the department by this notice revokes Notice MX401 as published in the Government Gazette on 27 November 2007, relating to the 5 knot speed limit within Bandy Creek Harbour. Providing that this revocation will apply only on Sunday 11th November 2012 between the hours of 1100 and 1230 and will only apply to bona fide vessels competing in approved aquatic events during the Blessing of the Fleet Ceremony. Furthermore, pursuant to the powers conferred by Section 66 of the Western Australian Marine Act 1982, that the above navigable waters will become a Boating Prohibited area that will apply to all vessels, other than bona fide vessels competing in approved aquatic events during the Blessing of the Fleet Ceremony. Furthermore, that subject to Navigable Waters Regulation 48A, all of the above navigable waters may be used for water skiing by bona fide vessels competing in approved aquatic events during the Blessing of the Fleet Ceremony.

Acting pursuant to the powers conferred by Regulation 10A (b) of the Navigable Waters Regulations 1958, I hereby close the following area of water to swimming between 9.00pm and 9:50pm on each night from Friday 9th November to Tuesday 13th November 2012—

Perth Waters, Swan River All the waters within a 75 metre radius of the firing position; located on the foreshore, approximately 75 metres west of the Barrack Street Jetty Complex.

This area is set aside for safety measures during the set up and display of pyrotechnics.

INSTRUMENT OF EXEMPTION—EXTENSION OF PERIOD The Minister for Mines and Petroleum, pursuant to the powers conferred on him by section 19 of the Mining Act 1978, hereby further extends the exemption granted on the 8 November 2002 and published in the Government Gazette dated 15 November 2002 and previously extended until 7 November 2012 for that area of land described in the schedule hereunder, not being private land or land that is the subject of a mining tenement or application there for, from Division 1 to 5 of Part IV of the Mining Act 1978.

(MINOR AMENDMENT) Expansion of Industrial Zone—Alcoa Pinjarra Refinery

Call for Public Submissions The Western Australian Planning Commission proposes to amend the Peel Region Scheme, in respect of land in Oakley, east of the Pinjarra townsite, and is seeking public comment.

The purpose of the amendment is to transfer about 282.9 hectares of land in Oakley from the Rural zone to the Industrial zone in the Peel Region Scheme.

The Western Australian Planning Commission hereby certifies that, in its opinion, the amendment does not constitute a substantial alteration to the Peel Region Scheme.

The plan showing the proposed amendment and the amendment report, which explains the proposal, will be available for public inspection from 9 November 2012 to 18 January 2013 at the following locations— the offices of the Western Australian Planning Commission (140 William Street, Perth);

4.20.2(f) Delete clause 4.20.2(f) and renumber provisions accordingly. 4.24 Add an additional clause 4.24.2 as follows:

4.24.2 Where development or redevelopment of properties in the Village Centre Zone is envisaged, the incorporation of residential uses up to a density of R60 will be considered, in an effort to create greater diversity of use, increased security and to stimulate additional life and vitality within the centre of the village. Any such residential development shall comply with the Mixed Use provisions of the R Codes.

Schedule 1 Amend the definition of ‘lunch bar’ as follows: lunch bar means premises or part of premises used for sale of take away food (in a form ready to be consumed without further preparation) within commercial or industrial areas, but does not include premises servicing evening meals or premises with drive through facilities.

Introduce the following definition in Schedule 1 of the Scheme: Brewery means breweries, cideries and distilleries licensed as a producer under the Liquor Control Act 1988 and used to sell liquor for consumption on the premises.

Introduce the ‘brewery’ use class to Table No. 1 of the Scheme as a ‘A’ use in the following zones:

Priority Agriculture; General Agriculture; Tourism; Industry; Service Commercial;

And as an ‘X’ use in all other zones. Schedule 1. Amend the definition of ‘rural worker’s accommodation’ under the land use

definitions in Schedule 1 to read: Rural workers accommodation means a building or structure, excluding the principal residence of the owner/manager which is used to accommodate workers employed in agricultural or intensive agricultural pursuits on the farming property.

5.19 Delete clause 5.19.1 and 5.19.2, introduce a new clause 5.19 5.19.1 In areas determined by the local government to be high or extreme

bush fire hazard areas as shown in the “Bush Fire Hazard Areas” mapping contained in the Local Planning Strategy (as amended from time to time), all habitable buildings whether or not they


Provision Modification require planning approval pursuant to the Scheme shall be constructed so as to comply with the requirements of Australian Standard 3959 (as amended from time to time).

5.19.2 In areas determined by the local government to be a medium bush fire hazard area having regard to “Bush Fire Hazard Areas” mapping prepared from time to time, the local government may require any proposed new building to comply with the requirements of Australian Standard 3959 (as amended from time to time).

5.19.1 All areas identified as bushfire prone on the Bushfire Hazard Assessment Maps are designated bushfire prone areas for the purposes of the Building Code of Australia.

5.19.2 Bush Fire Hazard Assessment maps are contained within the Local Planning Strategy, held at the local government offices and form part of the Scheme for the purposes of this clause.

5.19.3 If an owner disputes the land's identification within a Designated Bushfire Prone Area that owner may provide suitable written evidence from a qualified bush fire expert, to the local government, and request reconsideration of that identification.

5.19.4 On receiving a request made under clause 5.19.3, the local government may by notice in writing served on the person who made that request—

(a) determine that the land is not within a Designated Bushfire Prone Area; or

(b) determine that the land's identification within a Designated Bushfire Prone Area is correct.

Renumber clause 5.19.3 accordingly. 8.2 Modify clause 8.2 of the Scheme as follows:

Except as otherwise provided in the Scheme or any relevant Local Planning Policy adopted under Part 2 of the Scheme, for the purposes of the Scheme the following development does not require the planning approval of local government:

(a) the carrying out of any building or work which affects only the interior of a building and which does not materially affect the external appearance of the building except where the building is:

(i) located in a place that has been entered in the Register of Heritage Places under the Heritage of Western Australia Act 1990;

(ii) the subject of an order under Part 6 of the Heritage of Western Australia Act 1990; or

(iii) included on the Heritage List under clause 7.1 of the Scheme;

(b) the erection on a lot of a single house including any extension, ancillary outbuildings and swimming pools, except where—

(i) the proposal requires the exercise of a discretion by the local government under the Scheme to vary the provisions consider a proposal under the Performance Criteria of the Residential Design Codes; or

(ii) the development will be located in a heritage area designated under the Scheme;

(iii) the development otherwise requires planning approval including single houses in the Leeuwin Naturaliste Ridge Conservation and Leeuwin Naturaliste Ridge Landscape Amenity Zones, and single houses in any Special Control Area identified at Part 6 of the Scheme;

Schedule 3—RU2 Modify the ‘Restricted Use’ provision for RU2 as follows: Description of Land: Lots 1-14 and 101-117 (inclusive) Orchid Ramble, Wooditch Road, Margaret River. Restricted Use: Single dwelling, ancillary accommodation and associated outbuildings. Residential development and associated uses in accordance with Table 1. Zoning Table of the Scheme, subject to the conditions of this Restricted Use classification.

Schedule 2 Add an additional use right for Lot 1 Rosa Brook Road, Margaret River, as ‘A55’ with the additional use: 3 Chalets. Add the conditions:

Amend the permissibility of a Child Care Premises from an ‘X’ to an ‘A’ use in the Rural Residential zone, and Family Day Care from an ‘X’ to an ‘A’ Use in the Rural Residential Zone.

Schedule 1 Height when used in relation to a building that is used for—

(a) residential purposes, has the same meaning as in the Residential Design Codes; or

(b) purposes other than residential purposes, means the maximum vertical distance between the natural ground level and the finished roof height directly above.

Schedule 12 (a) Under ‘Residential Uses’ – ‘Guest House, Residential Building’, delete ‘Guesthouse’ and modify the parking requirement by deleting “1 space for every 4 beds, plus 1 additional space for every 4 beds for visitor parking” and replacing with “1 bay for every 2 beds”.

(b) Under ‘Commercial Uses’ add the use types of ‘Small Bar’ and ‘Brewery’ to ‘Hotel/Tavern’ and modify the parking requirement to read:

“1 unit of accommodation where appropriate and 1 Bay per 6m2 of bar space (areas occupied by customers, excluding servery areas) or where determined by the local government - 1 space per 6 patrons.

(c) Under ‘Tourist Uses’: (i) add ‘Guesthouse’ to the ‘Bed and Breakfast’ use type. (ii) delete the parking requirement and ‘qualifications’ relating

to ‘Holiday House’ use type that reads: As per RCodes plus 1 additional space per bedroom for houses with more than 2 bedrooms and 2 bays provided on site as per the RCodes plus capability of parking additional vehicles on site.

and replace with the following parking requirement: ‘1 space per room used for accommodation’

Schedule 15 Modify the minimum lot size at SPA 20 in Schedule 15 from 302m² to 320m².

2.1 Identify Lots 72 and 73 Bussell Highway, Cowaramup within the Residential Zone with a density code of R15;

WA401* WATER AGENCIES (POWERS) ACT 1984 FITZROY CROSSING WATER SUPPLY SCHEME

Proposal to upgrade Fitzroy Crossing Water Treatment Plant and equip bore As a part of the upgrades to the Fitzroy Crossing water supply scheme, the Water Corporation is planning to increase the town’s water treatment plant capacity and improve water quality, equip a bore, upgrade transfer infrastructure and upgrade an access track. These works involve— constructing granulated activated carbon filters and ultraviolet disinfection equipment equipping existing bore 1/99 with headworks and commissioning it, to provide additional

water into the scheme replacing 242 metres of the existing water main with a new DN150 main upgrading the access track to bore 1/99. The proposed works are scheduled to commence around April 2013 and will be completed by late 2013. The Corporation is currently seeking regulatory approvals and work will commence only after these have been obtained. The location of the proposed works is within the existing Water Corporation reserve, located on Fallon Road. A copy of this notice of proposal (referred to as IF82-95-1-1) is available for viewing during office hours at the Corporation’s head office, John Tonkin Water Centre, 629 Newcastle Street, Leederville, or at the Broome Regional Office on Blackman Street.
