Made by the CEO under the Forest Management Regulations 1993 regulation 98.

1. Citation

This order is the Public Firewood Areas Order 2012.

2. Commencement

This order comes into operation as follows —

(a) clauses 1 and 2 — on the day on which this order is published in the Gazette;

(b) the rest of the order — on the day after that day.

3. Previous orders revoked

The orders listed in Schedule 1 are revoked.

4. Public firewood areas

(1) The areas of State forest named in Schedule 2 column 1 and described in Schedule 2 column 3 are —

(a) set aside for the purposes of the collection of firewood by members of the public; and

(b) designated as being areas to which the Forest Management Regulations 1993 regulation 100 applies.

(2) The locations of the areas referred to in subclause (1) are shown on the relevant DECMAPs referred to in Schedule 2 column 2.

This delegation is to have effect only if, at the meeting of the Authority, there is not a quorum of Authority members able to vote on the Matter by reason of the operation of section 12 of the Act, illness, absence, vacancy in the office of an Authority member or other cause. In circumstances where this delegation applies and the voting on a Matter is equally divided, section 11(2)(d) of the Act applies and if one of the delegates is not the Chairman or the Deputy Chairman, the member exercising this delegation, who has served as a member for the longest period, shall be the presiding member for the purposes of section 11(2)(d) of the Act as it applies to the exercise of this delegation. Call for Public Submissions The Western Australian Planning Commission proposes to amend the Peel Region Scheme, in respect of land in Oakley, east of the Pinjarra townsite, and is seeking public comment.

The purpose of the amendment is to transfer about 282.9 hectares of land in Oakley from the Rural zone to the Industrial zone in the Peel Region Scheme.

5.19.2 In areas determined by the local government to be a medium bush fire hazard area having regard to “Bush Fire Hazard Areas” mapping prepared from time to time, the local government may require any proposed new building to comply with the requirements of Australian Standard 3959 (as amended from time to time).

5.19.1 All areas identified as bushfire prone on the Bushfire Hazard Assessment Maps are designated bushfire prone areas for the purposes of the Building Code of Australia.

5.19.2 Bush Fire Hazard Assessment maps are contained within the Local Planning Strategy, held at the local government offices and form part of the Scheme for the purposes of this clause.

5.19.3 If an owner disputes the land's identification within a Designated Bushfire Prone Area that owner may provide suitable written evidence from a qualified bush fire expert, to the local government, and request reconsideration of that identification.

5.19.4 On receiving a request made under clause 5.19.3, the local government may by notice in writing served on the person who made that request—

(a) determine that the land is not within a Designated Bushfire Prone Area; or

(b) determine that the land's identification within a Designated Bushfire Prone Area is correct.

Renumber clause 5.19.3 accordingly. 8.2 Modify clause 8.2 of the Scheme as follows:

Except as otherwise provided in the Scheme or any relevant Local Planning Policy adopted under Part 2 of the Scheme, for the purposes of the Scheme the following development does not require the planning approval of local government:

(a) the carrying out of any building or work which affects only the interior of a building and which does not materially affect the external appearance of the building except where the building is:

(i) located in a place that has been entered in the Register of Heritage Places under the Heritage of Western Australia Act 1990;

(ii) the development will be located in a heritage area designated under the Scheme;

(iii) the development otherwise requires planning approval including single houses in the Leeuwin Naturaliste Ridge Conservation and Leeuwin Naturaliste Ridge Landscape Amenity Zones, and single houses in any Special Control Area identified at Part 6 of the Scheme;

The proposed works are scheduled to commence around April 2013 and will be completed by late 2013. The Corporation is currently seeking regulatory approvals and work will commence only after these have been obtained. The location of the proposed works is within the existing Water Corporation reserve, located on Fallon Road.
