GRAND HARBOR PROPERTY OWNERS ASSOCIATIONSAFETY AND ACCESS CONTROL (SAC)

POLICY AND PROCEDURES (P&P)

I. POLICY

The Grand Harbor Property Owners Assoclatlon (GH POA) has responsibility for subdivisionSafety and Access Control which originates from within a hierarchy of controlling documents,specifically the subdivision's: 1) Articles of Incorporation, 2) Bylaws, and 3) Covenants, Conditionsand Restrictions (CCR's, a.k.a., Deed Restrictions). CCR'sfor each of the Grand Harbor Subdivision'seighteen Sections all include the inferred right of property owner's to a reasonably safe, secure,managed living environment, in part as follows:

ARTICLEII,Section 8, "Road and Street Easements:" The roads and streets in the Properties arenot dedicated to the public, but shall be operated as private streets with each Owner havingan easement for the use and benefit of such Owner of a Lot fronting thereon or adjacentthereto, ...easements shall include rights of ingress, egress and passage over and along saidstreets in favor of ..., the Association, the Owners and their ... successors and assigns, guests,invitees, licensees, designees and the successor(s)-in-title to each Lot Owner, and in favor ofthe invitee and designees of each successor(s)-in-title to each Lot Owner, but not in favor ofthe public.

ARTICLE/II, Section 9, "Annoyance or Nuisances:" No noxious or offensive activity shall becarried on upon any Lot nor shall anything be done thereon which may become an annoyanceor nuisance to the neighborhood.

ARTICLE/II, Section 21, "Motor Vehicles:" No unlicensed motor vehicles shall be allowedwithin the subdivision. No motor bikes, motor cycles, motor scooters, go-carts, or othersimilar vehicles shall be permitted to be operated on the Properties, if, in the sole judgment ofthe Association, such operation, for reason of noise or fumes emitted, or by reason of mannerof use, shall constitute a nuisance or jeopardize the safety of the Owners, his tenants and theirfamilies.

ARTICLEVII.Section 2. "Control:" The right of control of access through such entry way andgate by owners, their guests and invitees, shall be upon such terms as determined by theProperty Owners Association.

Grand Harbor residents physically residing within gated confines of the subdivision accesstheir property on private roads, subject to Association-imposed rules for vehicular conduct and trafficsignage. This P&P attempts to further explain the significance of intra-subdivision "law" enforcement,in using contract enforcement personnel and equipment, both to address the safety of on-propertyresidents, or when they or other persons are entering, exiting and otherwise operating motor vehiclesand unlicensed vehicles on the private roads. Furthermore, from a purely judicial standpoint,implementation of this policy is through enforcement of applicable GH POA Deed Restrictions, as citedabove, not through County or State vehicle statutes generally in effect for "open roads."

Through the use of full-time POA staff and contracted-for enforcement personnel, the P&Penforcement areas shall include:

• Visitor and Contractor Access Control,• Vehicular Traffic Control,• Crime and Mischief Prevention,• Incident Investigation

II. DEFINITIONS

ACCESS CONTROL - Purposefully restricted entry or entry with conditions into the Grand HarborSubdivision.

AUTOMATED GATE ENTRY SYSTEM (AGES}- A complete control system, including swing arms,translating gates, EZTags, RFID's, on-duty Access Control Personnel, Remote Access Cards, andthe Remote Gate Call-box, all used to enable subdivision access.

EZ TAG - Harris County Toll Road Authority windshield electronic device used in the GH AutomatedGate Entry System as part of remote entry process (interchangeable with GH POA-suppliedRFID's).

FREEEGRESS- Unconstrained subdivision entry or exit, usually when the gates are purposefully leftopen, e.g., for 4th of July Parade activities.

GATE ACCESS- Subdivision entrance/exit through gates at Access Control Staff operation locations, orwith in-place EZTag, RFID, or Remote Gate Call box, or Remote Access Card use.

PROPERTY OR PROPERTIES- Anyone or more of the 1012 residential properties within the GrandHarbor/Harbor Side subdivision boundaries.

PROPERTYOWNER - GH real estate owner as recorded in the Montgomery County Property Records.Property ownership enables automatic membership in the GH POA Association.

REMOTE ACCESSCARD - Credit card-size, self-contained RFID, not attached to a vehicle, but issued toproperty owners for automated access.

REMOTE GATE ACCESS- An optional, property-owner amenity for entrance to the Grand Harbor andHarbor Side subdivision

REMOTE GATE CALLBOX ENTRY SYSTEM - Guest or contractor optional gate entry to a residence byuse of a callbox, with a returned, gate-opening signal (i.e., 3-digit callbox call-in to resident,followed by a resident-dialed 1/9" response).

RESIDENT - Occupant (short or long term) of a completed home improvement on a property -generally the Property Owner, when not the Lessee.

REMOTE FREQUENCY IDENTIFICATION DEVICE (RFID) - Vehicle windshield electronic tag which, onceprogrammed, on physical presentation to the gate-vicinity-Iocated RFID Reader, causes themechanical gate entrance opener to be activated. Along with EZ Tags, a key electroniccomponent in the AGES.

VEHICLE OPERATOR - A person (licensed or unlicensed) actively controlling the motion of a motorizedvehicle on GH roads.

VENICLE REGISTRATION FORM - GH POA form required for obtaining RFID from Office Staff. The formestablishes auto ownership and the primary user's location.

III. VISITOR AND CONTRACTOR ACCESS CONTROL

As a "gated community," unpermitted persons and associated vehicular traffic into andthrough the Grand Harbor/Harbor Side subdivision will be subjected to vigorous scrutiny and control.

However, in doing so, the following classes of individuals or groups will require relatively-unencumbered, short or long-term access into the subdivision:

• Residents and Property Owners• Resident's Guests/Visitors• Construction Builders, Contractors and Subcontractors/Tradesmen• Periodic or Episodic Residential Service Contractors• Realtors and Prospective Buyers• Community Events, Open House, Parades

III.A. Residents and Property OwnersResidents and non-resident Property Owners per se can enter and exit the subdivision using

any of the various access means provided by the Automated Gate Entry System (see Definitions).

III.B. Resident's Guests/VisitorsInvited guests/visitors must coordinate with residents to gain entrance into the subdivision,

either through Access Control personnel during entry gate-manned intervals, or after-hours use of theRemote Gate Call box Entry System.

In Remote Gate Callbox Entry System initial set-up, the resident's phone number must first beprogrammed into the gate call boxes and the resident (member) issued a three digit code. When thecode is subsequently provided to guests/visitors, they need only enter into the call box the three digitcode to directly contact the resident. The resident then enables guest entry to the subdivision (gateopening) by pressing "9" on their in-home phone.

The homeowners must decide, on an individual property basis, whether or not they want theirnames to be displayed in an alphabetical resident listing on the call box display, tied to the respectivedigit codes. While lacking privacy, name display greatly assists the visitors should the gate digit codebe forgotten. For this feature's options, the resident must contact the GH POA Office.

For Access Control Personnel-facilitated assistance to guests/visitors, the property owner willhave to take necessary Listing steps outlined in a later section.

III.C. Construction Builders, Contractors and Subcontractors/TradesmenConstruction persons can only gain entrance either by utilizing the Access Control Personnel at

the GH Blvd. Walden Rd. entrance during normal business hours, or the Remote Gate Call box EntrySystem. Once again, a master listing of contractor personnel can be utilized, or construction passesrequested and obtained for extended periods of time during new home improvement projects. Pre-construction coordination between Contractors and POA Access Control staff is required for propermaster listing use and/or contractor pass issuance.

11I.0. Periodic or Episodic Residential Services ContractorsEstablished contractors of a repetitive or single-instance service nature can gain access

through the front gates with prior coordination/permission from the actual resident. It is theproperty owner/residents' responsibility to contact the POA Office or Access Control staff with thecontractor's name/ID and day(s) of the week, or visit dates. Contractors can then be recognized toenter and perform the service at the resident's home.

For contractors performing repetitive residential services longer than thirty (30) days, issuanceand renewal of their permitted access can be obtained from the POA Office, who, in turn, will adviseAccess Control gate personnel to process any new or renewed temporary passes. In no instance shallany issued pass be authorized for longer than six (6) months without repeating the renewal requests.

III.E. Realtors and Prospective BuyersReal estate agent may access Grand Harbor and accompany a prospective buyer to show

property in the subdivision. The real estate agent must submit a business card with the followinginformation: Agent's name, phone number and property company or the name of the real estatebrokerage company who holds their license. Prior coordination with POA Office staff can facilitateday-of entry. Prospective buyers accompanying their agent are not required to show 10.

If a prospective buyer wishes to enter GH to "look around," the vehicle driver's license mustbe displayed and the license number provided to the Access Control Person on duty. In addition, theauto plate number will be recorded at the same time on the entry log.

lII.f. Events, Open House, ParadesIf a GH POA Board-sanctioned committee plans a community-wide event and the event would

benefit from unrestricted access to the community, the committee chair must represent to the Boardthe following points:

1. How the event will benefit the members of the Property Owners Association.2. How the committee will address traffic disruption in the community. Volunteers?3. How the event will be advertised, as the Board must concur on all advertising that could

imply POA sanctioning or financial support.Approval of the event, at the Board's discretion, will include access control open-gate"understandings."

For Ad Hoc community organization's events or resident-specific events (e.g., weddingreceptions or post-funeral gathering at homes), the event organizers must contact the GH POA Officein advance with the details of the event. Open gate intervals and other requirements can beestablished by a formal exchange of letters with the POA Manager and Board of Directors.

III.G. Unauthorized Access EnforcementEnforcement personnel will be randomly placed throughout the community to monitor for

trespassing vehicles and persons. Vehicles not displaying the current Grand Harbor RegistrationSticker and are stationary at the entrance/exit gates will be considered potential trespassers and willbe investigated for further information and possible intervention.

SPECIAL NOTICE: First time entry infractions will be documented on GH POA Form,"Notification of Unauthorized Trespass." (See Deed Restriction Violation Control Policy and Procedure,as scheduled for infractions.) Completed GH POA Form originals will be given to the offender at timeof incident. 1st carbon copy will be filed at the GH POA Office, with 2nd carbon copy retained by lawenforcement officer. Repeated infractions by the same individuals/vehicles WILL BE ADDRESSED withINCREASING INTERVENTION MEASURES (on a per-instance basis) that can include GH POA legal actionor formal criminal complaint against the repeat-offending entity.

IV. VEHICLE ACCESS/CONTROL MEASURES

IV.A. Remote Gate Controller ManagementRemote Frequency Identification Devices (RFID), or Harris County Toll Roads Authority "EZ

Tags" controllers will allow subdivision property owners unrestricted access through the Walden Road"Resident-Only" swing arm gate, or any other entry gate. These vehicle devices establishcommunication with the gate-vicinity-Iocated reader in order to complete the opening function. Dueto RFinterferences, vehicles with EZTags must use them as the primary controller device. Because of

the limited memory space in the Remote Gate Access System, property owners may be limited in thenumber of RFIO'sor Remote Access Cards of their choosing. Refer to fee schedule for applicable fees.

Issuance of RFIO'sand/or programming existing EZTags require the following:1. A Vehicle Owner who is a resident or property owner must make available to the Property

Owners Association the necessary documentation proving vehicle ownership and that the Owner is amember in good standing with the POA. A valid photo 10 and a "Vehicle Registration Form," orlease/purchase contract, with a Grand Harbor/Harbor Side address, is required.

2. Vehicle of a Lessee of a property owner must make available to the GH POA a copy of theLease Agreement. The POA member (property owner) must be a member in good standing with thePOA. A valid photo 10 and vehicle registration form are required of the lessee.

3. Vehicle Operator is a licensed driver residing in the subdivision and is a dependent of ahomeowner in the subdivision. The operator has to make available a valid photo 10 and vehicleregistration form, with a Grand Harbor/Harbor Side address, to obtain Remote Gate Access

For a fee, residents may purchase RFIOand a maximum of two (2) Remote Access Cards whichincludes the item's cost and an administration fee. If the GH POA Association Member is NOT currenton annual maintenance dues and/or fines payments, EZtag will not be programmed for gate use, andno RFIOor access card will be issued without one of the following:

a. Paying all balances due the POA, orb. Making a payment towards the balance and establishing a payment plan.

If a replacement RFIOor card is purchased, any prior RFIOwill be deleted from the databaseand will no longer be operational.

IV.B. Auto Registration FormResidents must fill out an auto registration form which may be obtained on the Grand

Harbor/Harbor Side website or at the POA office (Use ATTACHMENT A). With a properly filled outform, a property owner or resident must bring each vehicle and required documentation to the POAoffice for completion of registration.

IV.C. InsuranceWhile Vehicle Owner Liability insurance is essential, the GH POA does not require a policy to

be in effect at the time of registration. However, a copy of the "Proof of Insurance" card received bythe policy holder from the carrier is acceptable 10 for Vehicle Registration.

IV.D. Vehicle Screening/Windshield StickersVehicle Screening/Windshield Stickers are required so that Access Control personnel and GH

residents, in general, have a rapid way to visually establish ownership of an otherwise unknownvehicle. Stickers in the current configuration are to be installed at the time of Vehicle Registration andRFIOinstallation and card or EZTag activation.

New Grand Harbor/Harbor Side stickers will be issued on a periodic basis. The vehicle must beregistered as prescribed and the owner must bring the vehicle to the POA office to receive the sticker.

V. PROPERTY OWNER ACCESS LISTING

V.A. Permanent Guest ListingGrand Harbor residents may establish a individual "Permanent Guest Listing" for use by

Access Control personnel. With the owner(s) of record vouching for the visitors/guests and sufficientinformation for each person listed, their entry through the Walden Road entrance can be significantly

facilitated. The owner/resident is responsible to providing Permanent Guest Listing as a MicrosoftExcel file with the following attributes for each and every visitor/guest in the designated order:

1. List one time: Owner/Originator's last Name, First Name, Residence/Property Address tobe Visited, Phone Number at the Designated Address,

2. List for each Visitor/Guest: last Name, First name; City of Residence, State of Residence;Relationship to Owner: "R" - Relative, "F" - Friend, "A" - Acquaintance, "C" - Residence ServiceContractor.

The total designated Permanent Guests on this listing shall number ten (10) or less individualpersons.

V.B. "00 NOT ADMIT" ListingGrand Harbor residents may establish the reverse of a Permanent Guest Listing, that being

specific individuals not to be allowed entrance. With no law enforcement authority, Access ControlPersonnel can only deny gate entry and state the owner-provided reasons why entry is to be denied.

SPECIAL NOTICE: There is no assumption of liability by the GH POA for anyunsuccessful exclusion of owner-named individuals.

The principal owner requesting a "Do Not Admit" entry exclusion must provide to the GH POAstaff, the following information:

1. List one time: Owner/Originator's last Name, First Name, Residence/Property AddressNOT TO BEVISITED, Phone Number at the Designated Address, Alternate Contact Number.

2. Information for each "Persona non-grata:" General Reason for Entry Denial; last Name,First Name; Relationship to Owner: "R" - Relative, "F" - Friend, "A" - Acquaintance, "C' - ResidenceService Contractor; Feedback Notification Requested from Access Control to Owner

VI. VEHICLE/DRIVER JURISDICTION AND TRAFFIC ENFORCEMENT

VI.A. Enforcement of State LawsThe gated status of Grand Harbor places it in a category that generally exempts rigid

enforcement of state and local traffic laws within subdivision boundaries, l.e., taxpayer-paid lawenforcement personnel are not obligated to routinely enter Grand Harbor and perform trafficenforcement duties. County or municipal law enforcement personnel can, however, make arrestswhen there is egregious violation of the laws such as reckless driving, excessively speeding so as toendanger, etc. Because of this relatively unique (and restrictive safety status), the GH POA position isto seek alternative means, as follows in VI.B.

VI.B. Enforcement of (Vehicle-related) Deed ViolationsAll licensed and titled motor vehicles permitted in the Grand Harbor community must abide

by the procedures in this policy. Some unlicensed vehicles are permitted in the community (SeeSection IX). Under this policy, all approved traffic and usage control signs represented on recordedPlats and/or placed on Grand Harbor deeded property are included and cover, but are not limited to:Speed Limit, STOP, YiElD, traffic pattern or direction, NO PARKING, towing zone, open and closuretimes, use hours for common areas, and NO TRESPASSINGsigns. From time to time, the GH POA willadopt guidelines commonly in use on public roads and approve the addition of traffic signs anddisplays at appropriate locations for safety purposes.

The current approved maximum speed limit within Association deeded property is Twenty-five (25) miles per hour, except for the county maintained, Peel Rd. which is Thirty (30) miles per hour.In-place Speed limit and YiElD signs must always be addressed with current road/weather conditionstaken into consideration.

VI.C Traffic ViolationsUnder the rules and regulations afforded the Association, a violation of the posted vehicular

policies, i.e. speeding, failure-to-stop, failure-to-yield, no parking, etc., will be considered a deedviolation and subject to fines and penalties as set forth in the deed restrictions enforcementdocuments of the Grand Harbor Property Owners Association.

1. Enforcement personnel, while on-site and on-duty, when observing an operator or drivinginfraction can, and likely will, stop the offender and obtain both vehicle and person basic information,along with time and location. Unlicensed-vehicle operators will be observed to ensure they meetstate driver's personal license requirements.

2. Vehicle Speed Measuring Devices ("Radar Guns") can be used, when available, forauthoritative speed determination no different than open road traffic control procedure and isaccepted as an accurate determination of the speed driven.

3. A "Shift Activity Log" will be completed by enforcement personnel and turned in to thePOA office at the end of each shift.

SPECIALNOTICE: Each documented incident will be processed for equitable resolutionand fine collection no different than for any other deed restriction violation, per the GHPOA"Deed Restrictions Enforcement Policyand Procedure," dated May 4, 2011.

VII. CRIME AND MISCHIEF PREVENTION PATROL

Without qualification or restriction, law enforcement personnel, even when off-duty and inprivate employ, are permitted to enforce all current Federal, State, County, and City laws, within theirparticular jurisdiction. This aspect of law enforcement will be advocated for the SAC program withinthe Grand Harbor/Harbor Side community.

VIII. INCIDENT INVESTIGATION

On rare occasion when an incident occurs and on-duty enforcement personnel are available,inside subdivision incidents will be investigated in near real-time to ensure a timely response to aresident's need for assistance. However, a resident's first line of ASSISTANCEREQUESTMUST ALWAYSBE: IICALL911."

IX. UNLICENSEDVEHICLESOTHERTHAN AUTO

Unlicensed Vehicles other than Automobiles are allowed in the Grand Harbor subdivision. In aGH POA Board of Directors meeting held on May 6, 2008, a resolution directed toward these vehicleswas adopted:

"While Article III,Section 21 of the respective Grand Harbor subdivision section's 'Covenants,Conditions and Restrictions' (CCRs)restricts the use of unlicensed motor vehicles within thesubdivision, the wording of this CCRallows some latitude in its interpretation andenforcement. It is therefore resolved that the operation of "Golf Cart" type personal vehicleson subdivision streets (said operation to be only by driver-licensed individuals) shall beexempt from the restriction of this CCR."

license)on subdivisionroadscoversthe following vehides:1. All Terrain Vehicle (ATV): A motorized vehicle:

• That has a saddle seat,• has three or more wheels,• is designed for off-highway use, and• is not designed by the manufacturer for farm or lawn care.

2. Recreational Off-road Vehicle (ROV): A motor vehicle:• equipped with a non-straddle seat for the use of the rider (and passenger),• designed to propel itself with four or more tires,• designed by the manufacturer for off-highway use,• not designed by the manufacturer for farm or lawn care.

3. Tray Utilitv Vehicle (TUV): A motor vehicle:• equipped with a side by side seating arrangement,• has a cargo tray at the rear of the vehicle, and• is designed by the manufacturer for utility use.

4. Go Cart: A vehicle:• that has a small, low-to-the-ground chassis,• has an open framework and four wheels,• is self-propelled with a motor.

5. Golf Cart: An electric or gasoline motorized vehicle:• that has no less than three wheels,• has a normal maximum speed of between 15-25 mph, and• is manufactured primarily for operation on golf courses.

6. Off-Road Motorcycle (IiDirt Bike"): A two-wheel, motorized vehicle that is:• designed and specialized for off-road events,• light weight, simple, rugged construction with little bodywork and large wheels

with knobby tires, often clamped to the rim with a rim lock.

ATV, Go-Cart, or Off Road Motorcycle operation is strictly prohibited anywhere (paved streets or dirt roads) inthe Grand Harbor/Harbor Side oommunity. Permitted and Non-permitted Vehicles may be driven during POA-approvedevents when authorized by the event's chairperson. Any vehicle to be operated in an event must be registered with thePOA prior to that event, with the event chairperson held responsible for insuring these vehicles are registered.

IX.C. Permitting/Registration

Unlicensed vehicles which are acceptable on the streets of Grand Harbor must be registered in the GH POA Office,and issued an identification sticker within thirty (30) days of purchase or moving into the community. A photograph ofthe vehicle and completed registration form (See Attachment B) must be presented when registering the vehicle at theGH POA Office, along with resident proof of residenc.y. A regisbation sticker will not be issued to residents without theseitems.

Registration stickers must be affixed to the front left side of the vehicle so that it is visible to Access Controlpersonnel. If the owner sells the unlicensed vehicle or otherwise moves out of the community, this decal MUST beremoved and returned to Grand Harbor P.OA (25 % of initial cost refunded for decal remnants).

Unlicensed vehicles must follow all posted traffic signs (stop signs, speed limits, etc.) within the community. Theyare permitted on the registered resident personal property and paved roads only. Unlicensed vehicles are permitted to bedriven at night only if they have two front headlights and two back taillights in operation.

IX.D. Operator Requirements

SPECIAL N017CE: An).01edriving an unlirensedvehide needs eh:hera state~ed driver's permit ora driver's license todrive. An}Q1e driving with a state issued driver's permit needs a state driver's licensed adult with them.

It is a deed violation by anyone driving an unlicensed vehicle that:• is not permitted in the community,• is not following the posted traffic signs,• is not registered with Grand Harbor Property Owner Association,• does not have the Grand Harbor Property 0Nner Assodation regisbatioo sticker adhered to the unlicensed

vehicle while in use,• is non-llcensed/permitted driver in the State ofTexas

Fines for violations will be assessed against the vehicle's registrant (owner/resident), regardless of the driver (e.g.,relatives/visitors at the residence)
