We the students of Gretsa University and members of the Gretsa University Students

Association;

ACKNOWLEDGE the supremacy of the almighty God of all creation,

HONOR those who founded our University, Gretsa University,

COMMIT to nurturing and protecting the wellbeing of Gretsa University as a whole.

RECOGNIZE the aspirations of all the former members of Gretsa University Students

Association who tirelessly advocated for the essential values of students’ rights, equity,

freedom, democracy, justice and the rule of law.

EXERCISE our sovereign right to determine the form of governance of the student’s

association and have participated fully in the making of this constitution.

ADOPT, ENACT and give this constitution to ourselves and to the future students of Gretsa

University in line with our core values namely; honesty, integrity, accountability,

transparency, fairness, excellence and concern for others.

CHAPTER ONE: [SOVEREIGNTY OF THE STUDENTS AND THE SUPREMACY

OF THIS CONSTITUTION]

1- Sovereignty of the Students

1.1- All sovereign power belongs to the students of Gretsa University and shall be

exercised only in accordance with this Constitution.

1.2- Sovereign power under this Constitution is delegated to the following student posts,

with regard to the Universities (Amendment) Act No. 48 of 2016 clause 18 (b), who

shall perform their functions in accordance with the Gretsa University Students

Association Constitution;

(1) Every university shall have a student’ association comprising of all students of

the university.

(1A) A students' association shall be governed by a students' council

comprising of—

(a) a Chairperson;

(b) a Vice Chairperson who shall be of opposite gender with the

Chairperson;

(c) a Treasurer;

(d) a Secretary-General who shall be the secretary to the Council;

and

(e) three other members to represent special interests of students;

(i) Secretary for Academics

(ii) Secretary for Sports and Entertainments

(iii)Secretary for Religion

2- Supremacy of this constitution

2.1- This Constitution shall be the supreme law governing all Gretsa University Students

Association members, committees, clubs and societies and any other faction

composite of Gretsa University Students

2.2- Any law(s) formulated by any student(s) of Gretsa University must conform to this

constitution and otherwise that law(s) shall be rendered null and void.

2.3- The validity or legality of this Constitution is not subject to challenge by any Gretsa

University Student Association member, unless by the methods provided herein.

3- Defense of this constitution

3.1- Every Gretsa University Students Association member has a duty to uphold, defend

and respect this Constitution.

3.2- This Constitution in whole only becomes null and void if;

(a) There is a successful referendum done to adopt a new Constitution.

(b) This Constitution has had more than seventy percent of all its articles

amended.

3.3- An article of this Constitution becomes null and void if;

(a) There is a successful meeting, composite of the constitutionally specified

minimum requirements.

3.4- A change in this Constitution in whole or in part shall be followed by a reprint of the

whole Constitution with the amendment(s) and without any other alteration

whatsoever.

CHAPTER TWO: [GRETSA UNIVERSITY STUDENTS ASSOCIATION]

4- Declaration of Gretsa University Students Association

4.1- There is established an association, composite of all Gretsa University students and

that shall represent the interests of all such students, recognized as Gretsa University

Students Association and abbreviated as GUSA.

5- The Scope of Gretsa University Students Association

In accordance with this Constitution, GUSA shall;

5.1- Address all the areas concerning Gretsa University Students.

5.2- Consist of all the legitimate students of Gretsa University.

5.3- Be subject to the policies and regulations of Gretsa University statutes.

5.4- Consist of electoral colleges based on either academic departments, faculties or

schools.

5.5- Be the supreme student body over all other Gretsa University students’ bodies.

6- Official Languages Recognized by the Gretsa University Students Association

6.1- GUSA shall recognize the following languages:

(a) English,

(b) Kiswahili and,

(c) Sign Language.

7- Gretsa University Students Association and Religion

7.1- GUSA shall be a religiously neutral association, promoting and enforcing equity

among all the religions within Gretsa University.

8- Gretsa University Students Association and Culture

8.1- GUSA shall promote and enforce equity of all the cultures within Gretsa University.

8.2- GUSA shall ensure there is recognition of the various cultures in Gretsa University.

9- Gretsa University Students Association Objectives

9.1- Promote the Gretsa University vision, mission, and core values among the students

and to the outside community.

9.2- Ensure a conducive learning environment for each GUSA member.

9.3- Contribute towards a healthy, social and responsible lifestyle of each GUSA member.

9.4- Act, with discretion, as a link between Gretsa University and the outside community.

CHAPTER THREE: [GRETSA UNIVERSITY STUDENTS ASSOCIATION

MEMBERSHIP]

10- Entitlement of Members

10.1- A member of GUSA shall be any person who has met the requirements stipulated in

Article 11.

10.2- Such a person shall be entitled to:

(a) Fair treatment by all the members and committees of GUSA.

(b) Participation in all the activities organized by GUSA, in accordance with this

Constitution.

(c) Recognition as a member of GUSA.

(d) A right to vie for any post in GUSA, in accordance with this Constitution.

11- Acquisition of Membership

11.1- A person becomes eligible to be a GUSA member upon admission to Gretsa

University.

11.2- The following students are eligible GUSA members:

(a) All undergraduate students recognized by Gretsa University.

(b) All post graduate students recognized by Gretsa University.

11.3- Students stated in Article 11.2 are eligible for membership regardless of their mode of

study.

12- Suspension and Cessation of Membership

The membership of a GUSA member shall stand suspended or revoked if:

12.1- Suspension

The membership of a GUSA member shall stand suspended if such a member:

(a) Has been suspended from the University.

(b) Is facing disciplinary sanctions from the University Administration that

interfere with or withdraw the entitlements in Article 10.

(c) Has deferred their studies for a duration, and in a manner acceptable by the

University Administration.

In the case that a GUSA member has their membership suspended such a member:

(a) May re-acquire their membership by:

(i) Following the prescribed mechanism for acceptance back into the

University by the University Administration and,

(ii) Paying the prescribed subscription fees in Article 13.

(b) May choose not to re-acquire their membership and thus:

(i) Their membership stands revoked.

12.2- Revocation

The membership of GUSA member shall stand revoked if such a member:

(a) Chooses not to re-acquire their membership after suspension, Article 12.1.

(b) Has been expelled from the University.

(c) Has completed their studies in the prescribed amount of time and manner as

per the University statutes.

(d) Has withdrawn from being a Gretsa University student.

(e) Has died.

13- Subscription

13.1- The subscription fee for one to continues being a member of GUSA shall:

(a) Be KSH 500, paid each semester, each academic year.

(b) Be deposited in the Gretsa University Account together with the University

fees payment.

13.2- Upon identification of a cause to change the subscription fees, the person(s) shall;

(a) Inform the Executive Committee in writing, through its Secretary General of

the:

(i) Intent to petition a change in the subscription fees,

(ii) Proposed changes in the subscription fees,

(iii)Detailed reasons for the proposed changes and,

(iv) Details of the petitioners, that is the:

(1) Name(s) of the petitioner(s),

(2) Registration number(s) of the petitioner(s) and,

(3) Current telephone number(s) of the petitioner(s).

(b) The Executive Committee shall:

(i) Convene a meeting within two weeks after receipt of the petition in

Article 13.2(a).

(ii) Discuss the merits against the demerits of the petition and:

(1) Proceed the petition to Article 13.2(c) if there is enough reason

to do so.

(2) Inform the petitioner(s) in writing of the failure of the petition

in the case that there are not enough grounds to adopt the

petition.

(iii)Such a failed petition, Article 13.2(b)(ii), shall not be adopted by the

Executive Committee for at least one academic year.

(c) The Executive Committee shall inform the University Administration, in

writing, through the Dean of Students the intent to petition a change in the

GUSA subscription fee.

(d) The University Administration through the Dean of Students may:

(i) Adopt the petition and thus the Executive Committee shall proceed the

petition to Article 13.2(e).

(ii) Inform the Executive Committee in writing of the failure of the

petition in the case that there are not enough grounds to adopt the

petition.

(iii)Such a failed petition, Article 13.2(b)(ii), shall not be adopted by the

Executive Committee for at least one academic year.

(e) The Executive Committee shall:

(i) Inform all the GUSA members, in writing, of a referendum to take

place, and allocate at least four weeks between the day the notice is

publicized and the voting day.

(ii) Allocate necessary financial resources, through the GUSA Treasurer,

to the GUSA Electoral Commission in order to enable it conduct civic

education, prepare and supervise the referendum, tally votes and as

announce the referendum results.

(iii)Allocate a room for the voting day according to the recommendations

by the GUSA Electoral Commission.

(f) The GUSA Electoral Commission shall conduct the referendum in accordance

with Article 81 of the Constitution of Kenya (2010) and:

(i) Such a referendum shall be considered legitimate only if, at least two-

thirds of all registered GUSA members take part in casting a vote.

(ii) In the case that the petition wins the referendum by garnering fifty per

cent plus one vote, of the total votes cast, proceed the petition Article

13.2(g).

(iii)In the case that the petition fails to garner more than fifty percent of the

total votes cast, that petition shall not be adopted by the Executive

Committee for at least one academic year.

(iv) The GUSA Electoral Commission shall declare the motion defeated

and submit, in writing, the results of the referendum.

(g) The GUSA Electoral Commission shall declare the petition to have won the

referendum, compile the results of the elections and submit in writing to the

Executive Committee.

(h) The Executive Committee shall:

(i) Submit the results of the referendum to the Dean of Students.

(ii) Await communication from the Dean of Students.

(i) The Dean of Students shall:

(i) Notify the GUSA members of the change in the GUSA membership

subscription fees and,

(ii) The revised University fee payable by each student.

(j) The changes in the subscription fee shall take effect from the semester that

immediately follows the referendum in Article 13.2(f).

13.3- Changes in the subscription fee can only be instigated if there is a;

(a) Change in the student number enrolled in the University,

(b) Change in the number of GUSA activities in the next financial year or,

(c) need to raise money for a specific purpose.

ELECTORAL COMMISSION]

14- The Electoral Commission

14.1- There is established an Electoral Commission to conduct all the elections involving

GUSA members.

14.2- The Electoral commission shall be referred to a Gretsa University Students

Association Electoral Commission, abbreviated as; GUSA-EC.

14.3- The Vision of GUSA-EC shall be:

To be an independent and credible electoral commission dedicated to uphold

democratic progress in strict adherence to the GUSA Constitution.

14.4- The mission of GUSA-EC shall be;

To advance the course of democracy and good governance for enhanced development

of the Gretsa University Student Association through civic education, and conduct of

free fair and transparent elections.

14.5- The term of office of GUSA-EC member shall be:

(a) One year that does not align with the exit of office of the GUSA Executive

Committee.

(b) From the second working day of June, each year, to one week before the

installation into office of the next GUSA-EC officials.

(c) And, no elections shall be held:

(i) Within one month of assumption of office of GUSA-EC officials.

(ii) Within one and a half months before the expiry of the term of office of

the incumbent GUSA-EC officials.

14.6- GUSA-EC shall be funded solely by GUSA.

14.7- The jurisdiction of GUSA-EC shall be restricted to Gretsa University Premises, and

the conduct of elections and resolutions involving GUSA members only.

15- Members of the Electoral Commission

15.1- The Electoral commission shall be consistent of:

(a) A Chairperson who shall:

(i) Have the following qualification:

(1) Be a full-time student.

(2) Completed at least one academic year in their current level of

study, at the time of appointment into office.

(3) At least three semesters left in their field of study, from the

time of appointment into office.

(4) A clear disciplinary record, ascertained by the Dean of

Students.

(5) Not hold any other GUSA office, or be a member of any

committee.

(6) Acquired a minimum mean grade at least sixty-five percent in

any of their academic transcripts in their current level of study.

(ii) Have the following duties:

(1) Head GUSA-EC.

(2) Announce results for any election conducted by GUSA-EC.

(3) Act as a link between the GUSA-EC and the Executive

Committee and the Dean of Students.

(4) Be a signatory to any financial transaction conducted by

GUSA-EC.

(5) Prescribe to the Dean of Students through the Executive

Committee, from a report prepared by the Secretary General to

the GUSA-EC, measures that will ensure optimal working of

the GUSA-EC, optimal conduct of electoral processes.

(b) A Secretary General who shall:


(1) Be of the opposite gender as the Chairperson of the GUSA-EC.

(2) Be a full-time student.

(1) Prepare and present a report of any election that the GUSA-EC

conducts, to the GUSA-EC Chairperson.

(2) Be the official spokesperson of GUSA-EC.

(3) Be the custodian of all the documents of GUSA-EC.

(4) Assume all the duties of the GUSA-EC Chairperson in the

Chairperson’s absentia.

(5) Be a signatory to any official communication by GUSA-EC.

(6) Be a signatory to any financial transaction conducted by

GUSA-EC.

(c) A Treasurer who shall:


(1) Be a full-time student

(5) Be taking a course in finance, accounting and/or auditing and

have completed at least one academic year.

(6) Acquired a minimum mean grade at least sixty percent in any

of their academic transcripts in their current level of study.

(1) Prepare and report, to the chair of GUSA-EC, a budget to

conduct any election overseen by GUSA-EC.

(2) Be the custodian of all the monies belonging to GUSA-EC,

after disbursement from the GUSA Treasurer.

(3) Prepare and report to the Secretary General of GUSA-EC, the

expenditure of all the monies after the elections are held.

(d) A minimum of three and a maximum of four clerks who shall:


(1) Completed one academic year in their current level of study, at

the time of appointment into office.

(2) Active in student-related activities.

(1) Tally votes in the polling station they have been assigned.

(2) Submit tallied votes to the Secretary General, GUSA-EC.

(3) Guide GUSA members during a voting exercise.

16- Duties of the Electoral Commission

16.1- The duties of the Electoral Commission shall be;

(a) Announcement of the results submitted from the faculty elections.

(b) Vetting of GUSA Executive Committee positions aspirants.

(c) Approve and regulate coalitions and their agents.

(d) Educating Voters through Civic Education Programmes.

(i) GUSA-EC shall make voters aware on how to vote, and the importance

of voting.

(ii) This education includes the manner of voting, the irregularities and the

penalties related to election malpractices.

(iii)Conduct these Civic Education Programmes in the most appropriate

manner and platforms.

(e) Announce Election Results

(i) GUSA-EC shall be the mandated body to announce the results of any

election composite of GUSA members.

(ii) After all the necessary procedures have been followed for a specified

electoral process the GUSA EC shall announce, publicly and without

malicious intent, the results of the elections that were being conducted.

(f) Preparation of elections and elections budget.

(i) Every year by the end of the month of July, the newly appointed

GUSA-EC shall prepare and hand over a budget to the GUSA


(ii) The budget must highlight all the expected expenses of the general

election to be held in the month of October in the same calendar year.

(g) Create awareness of the whole GUSA fraternity for the coming elections.

17- Appointment of Persons to Hold Office in the Electoral Commission

17.1- The Electoral Commission officials shall be vetted and appointed by the Executive

Committee in the presence Dean of Students.

17.2- The Electoral Commission clerks shall be appointed by the Executive Committee.

17.3- For one to become an Electoral Commission official, one must:

(a) Fill the appropriate Form 58.1(a).

(b) Meet the minimum requirements as stipulated of Article 15.

17.4- For one to be an Electoral Commission clerk, one must:

(a) Fill the appropriate Form 58.1(b).

(b) Meet the minimum requirements as stipulated of Article 15.

18- Removal from Office of Persons Holding Office in the Electoral Commission

18.1- A GUSA-EC commissioner may be removed from office in the case that they:

(a) Breach this Constitution.

(b) Have any disciplinary issues within their tenure that may hamper their ability

to perform their constitutionally mandated duties.

(c) Transfer from the University.

(d) Have been proven guilty of electoral malpractice as stipulated Article 21.9(b).

18.2- For any GUSA member(s) to remove a GUSA-EC official from office, they must:

(a) Submit to the Dean of Students the allegations and evidence to such

allegations floated against the affected GUSA-EC official.

(b) The Dean of Students shall take necessary action.

19- Resignation from Office of a Person Holding Office in the Electoral Commission

19.1- An electoral commissioner may resign from office at any time by submitting a letter

of resignation to the Dean of students, having attached Form 58.1(e).

CHAPTER FIVE: [REPRESENTATION OF GRETSA UNIVERSITY STUDENTS

ASSOCIATION MEMBERS]

20- Conduct of Gretsa University Students Association Leaders

20.1- All GUSA leaders shall;

(a) Include:

(i) GUSA Executive Committee members,

(ii) Mr. and Miss. Gretsa University,

(iii)Special Committee members,

(iv) Electoral Commissioners and,

(v) Any other member(s) of an office or committee established or

governed by this Constitution.

(b) Respect all the Gretsa University Staff members and:

(i) Observe the protocols they abide to.

(ii) Present student issues only to relevant dockets.

(c) Respect all Gretsa University Students and:

(i) Inform them of their rights before asking them to accomplish a task.

(ii) Attend to their needs without asking for compensation of any manner

(d) Not exploit any GUSA member or Gretsa University Staff member and:

(i) Such exploitation shall be equated to abuse of office and gross

misconduct

(ii) Such exploitation if proven, shall be used as ground for removal from

office of the affected GUSA leader.

(e) Not embarrass Gretsa University within or without the University.

20.2- GUSA leaders shall dress in a manner that does not depict:

(a) Immodest apparel.

(b) Torn/ripped faded clothing.

(c) Cargo/carpenter pants.

(d) Visible undergarments.

(e) Visible tattoos.

(f) Backless apparel and exposed midriff.

(g) Ear piercing is acceptable if not excessive.

(h) Shirts and tops that are not made to be worn out (shirts or tops with a tail)

should be tucked in.

(i) Casual sandals, including Velcro and flip-flop type sandals are not

appropriate.

(j) Flip-flops are not acceptable.

(k) Low-fitting, hip-hugger pants are not appropriate.

(l) Low cut/tight revealing clothing.

(m) Spaghetti-strap dress/tops.

(n) Dress/skirt more than three inches above the knee cap.

(o) Slits higher than three inches above the knee cap.

(p) Garments with lettering, phrases or pictures that are considered offensive.

(q) Any garments exposing the side of the Torso.

(r) Personal appearance that draws undue attention to oneself.

20.3- Violation of the conduct expected herein shall lead to removal from office of such a

leader.

21- The Electoral Process

21.1- The Electoral Commission shall conduct the election process in a transparent and

constitutional manner as addressed in this constitution and as per the regulations of

the Universities (Amendment) Act of 2016 stipulated herein;

(1B) Every students’ council shall be elected in accordance with this Act and its

membership shall—

(a) reflect national diversity; and

(b) have not more than two-thirds of its members being of the same

gender.

(1C) For purposes of conducting the elections of the members of the student

council referred to in subsection (1A), the student’s association shall constitute

itself into electoral colleges based on either academic departments, schools or

facilities, as may be appropriate.

(1D) The students of each electoral college constituted under subsection (1C) shall

elect three representatives—

(a) from amongst persons who are not candidates under subsection (1A);

and

(b) of who are not more than two thirds of the same gender.

(1E) The representatives of each electoral college shall elect the members of the

student council within thirty days of the election under subsection (1D).

(1F) A member of the student council shall hold office for a term of one year and

may be eligible for re-election for one final term.

(1G) A person who has held office as a member of the student council of a

University for two terms is disqualified from election as a member of the

student council of any other University or constituent college in Kenya.

(1H) Every students' association shall, in consultation with the University,

formulate and enact rules to govern the conduct of elections including

regulation of campaigns, election financing, offences and penalties.

(1I) An election conducted pursuant to this section shall comply with the general

principles of the Kenyan electoral system under Article 81 of the Constitution

and the rules governing the election of members of the student council.

21.2- Aspiration

(a) A candidate shall aspire for a post in the GUSA Executive Committee or as

Delegate under a coalition which shall:

(i) Be registered by the GUSA-EC.

(ii) Have seven (7) members, each aspiring for a singular position in the

GUSA Executive Committee and,

(iii)Of these seven aspirants, have at least one member who is recognized

as disabled, contesting for a position in the Executive Committee,

(iv) Have at least three (3) other members aspiring as delegates per school,

for any or all the schools,

(v) Constitute itself with strict conformity to Article 81 of the Kenyan

Constitution.

(b) A candidate shall confirm with the GUSA Constitution qualifications for any

posts they wish to contest.

(c) The person(s) wishing to contest shall request at least two of their most recent,

consecutive academic transcripts in their current level of study.

(d) The aspiring candidates shall submit to their coalitions their;

(i) National identification card,

(ii) School identification card,

(iii) Recent colored passport size photograph

(iv) Their most current course registration form and,

(v) Two of their most recent, consecutive academic transcripts.

21.3- Registration with GUSA-EC.

This process shall take place from the first week of July to the fourth week of July

each year and:

(a) Coalitions shall present the documents of their members in strict conformity to

Article 21.2, to the GUSA-EC Secretary General.

(b) Each coalition shall submit its name and its logo to the GUSA-EC which shall:

(i) Be unique from any other registered logo or name and,

(ii) Not be offensive.

(c) The coalition shall then copy the very documents in Article 21.3(a) and

Article 21.3(b) to the Dean of Students.

(d) GUSA-EC shall then print a list of all the aspiring coalition; containing the

names, registration numbers and photographs of each coalition members and

the post they wish to contest.

(i) This list must be made public by posting it on all the University notice

boards.

(e) The list referred to in Article 21.3(d) shall be submitted to the Dean of

Students by the GUSA-EC Chairperson.

21.4- Vetting.

(a) Vetting shall only be undertaken by the GUSA-EC and only for the Executive

Committee.

(b) On the second working day of the third week of September, all coalitions shall

be required to avail themselves to the GUSA-EC for vetting.

(c) The vetting process in Article 21.4(b) shall be considered the only legitimate

way one can become a qualified aspirant under a coalition, aspiring for a post

in the Executive Committee.

(d) Vetting shall take place within three days from the time stipulated in Article

21.4(b).

(e) GUSA-EC shall compile the results of the vetting process and copy the same

to the Dean of Students by close of business hours of the fourth working day

of third week of September.

(f) Each candidate vetted must, for them to qualify, meet the minimum

requirements stipulated in Article 25.2.

(g) The aspirants’ qualifications must, upon request by any GUSA member, be

made available.

21.5- Notification of Qualified and Disqualified Candidates.

(a) A preliminary notification of qualified and disqualified coalitions shall take

place on the first working day of the fourth week of September through the

University notice boards.

(b) Disqualified coalitions shall be served in writing the reasons for their

disqualification on the same day as stipulated in Article 21.5(a) and:

(i) Disqualified coalitions have until the third working day of that very

week to petition their disqualification or:

(1) In the case that one or more of their members is disqualified,

replace the disqualified member with a qualified member and

present that member for vetting by the GUSA-EC within the

strict time frame as stipulated in Article 21.5(b)(i) or,

(2) In the case that any other administrative is in question, make

corrections within the stipulated in Article 21.5(b)(i) or,

(3) Concede the disqualification.

(ii) The Dean of Students shall chair the panel that will hear the cases

petitioned in Article 21.5(b)(i) and determine the verdict of the cases

on the fourth working day of the fourth week of September.

(c) Upon determination of wrong doing by the coalition(s) under scope shall:

(i) Have until the close of business hours on the fifth working day of the

fourth week of September or face disqualification.

(ii) Abide by the verdict or face disqualification.

(d) Upon determination of wrong doing by the GUSA-EC, GUSA-EC shall:

(i) Have until close of business hours on the fourth working day of the

fourth week of September to make relevant corrections and,

(ii) Make a public print on all the University notice boards with the

relevant corrections.

(iii)Have its three commissioners removed from office immediately and;

(1) The clerks shall take over as the commissioners assuming all

the duties of the commissioners without limit.

(2) The vacated commissioners shall not be entitled to any

remuneration in any form.

21.6- Campaigns and notification for Elections date.

(a) On the first working day of the first week of October, GUSA-EC shall on all

University notice boards:

(i) Notify the GUSA members of the election date with strict adherence to

this Constitution.

(ii) Notify GUSA members and the coalitions of the commencement of the

campaign period.

(iii)Notify the GUSA members and the coalitions of the termination date

of the campaign period that has commenced.

(b) The campaign period shall last from the day it is announced by GUSA-EC to

2359hrs on the day before the voting day.

(c) Campaigns shall be restricted to:

(i) A manner that does not interrupt the lectures and/or examinations that

are ongoing.

(ii) A manner that does not interrupt the normal administrative functions of

the University.

(iii) A manner that does not amount to harassment, intimidation or any

electoral offence.

(iv) The campaign period only.

21.7- Aspirant financing.

(a) Qualified coalitions with candidates aspiring for various positions shall solely

finance themselves for all their activities before, during and after elections.

21.8- Civic Education.

(a) GUSA-EC shall roll out civic education from the second working day of the

third week of September.

(b) The Civic Education Programme shall last for a period not more than one

week and not less than four working day.

(c) The Civic Education Programme shall target all GUSA members.

(d) GUSA-EC shall prepare a program for civic education for that particular

election. The program shall consist of the method, the venue and the deadline

as well as all other relevant information.

(e) After the civic education program, the Electoral Commission shall prepare a

report of its findings and present it to the newly elected GUSA Executive

Committee secretary general, once in office.

21.9- Electoral Offences and Penalties for Coalition Aspirants and Agents.

(a) Qualified Aspirants shall abide by electoral rules and regulation as shall be

prescribed by GUSA Constitution and GUSA-EC.

(b) Failure to abide by rules and regulation shall result to;

(i) Writing a letter explaining the allegations made based on electoral

offences.

(ii) Upon verifying the allegations and the aspirant(s) or agent(s) found

guilty, they shall be disqualified, rendering the coalition disqualified if

it does not meet the minimum requirements stipulated in Article 21.2

and Article 21.3 thereafter.

(iii)Electoral offences shall include:

(1) Bribery in any form,

(2) Violence or intimidation in any form,

(3) Bypass of campaign periods and,

(4) Any other electoral malpractice prescribed by the GUSA-EC

before the commencement of the campaign period stipulated in

Article 21.6.

(c) Agents who practice election malpractices shall:

(i) Be given a first warning and the same warning be served to their

respective coalition(s).

(ii) Have their coalition(s) disqualified from contesting in the election

should the same coalition agents be found to have committed any other

electoral malpractice subject to Article 21.9.

21.10- Election Date

The elections must conform to the Universities (Amendment) Act of 2016 and:

(a) Electoral colleges representatives shall be constituted per academic school and

shall:

(i) Be elected in clusters of three per academic school and, as per their

coalition and thus:

(1) Voters shall cast a vote to elect a coalition of delegates per

school,

(2) Only names and logos of coalitions shall appear on the ballot

papers and,

(3) The names and registration numbers of each cluster of

delegates shall appear under each coalition.

(ii) Be elected on the fourth working day of the second week of October

each calendar year.

(iii)Be responsible for electing the members of the Executive Committee.

(b) Executive Committee members shall:

(i) Be elected in a cluster of seven (7) as per their coalitions and thus;

(1) The delegates shall each cast a vote to elect a coalition for the

Executive Committee and,

(2) Only the names of and logos of coalitions shall appear on the

ballot papers.

(ii) Be elected on the fifth working day of second week of October each

calendar year.

(c) The GUSA-EC shall:

Come up with standing orders for that general election with respect to:

(i) The number of coalitions registered to participate in that election,

(ii) The total number of students casting a vote in that election and,

(iii)Strict adherence to this Constitution.

21.11- Announcing of Election Results

(a) Announcement of the elections results must be within a duration that is not

more than one hour after the tallying of all the votes has been concluded.

(b) The tallying of votes must be done in a transparent manner that allows the

electorate to follow up on the votes of each candidate.

(c) The winning coalition shall be that which;

(i) Garners a simple majority of the votes cast and,

(ii) Is declared by the GUSA-EC as winner.

(d) The announcement of the votes final results must be done by the GUSA-EC

Chair.

21.12- Election Petitions

(a) Upon the announcement of the Election results, any of the participating

coalitions or GUSA member(s) may motion a petition against the just

concluded elections by:

(i) Contesting the election results announced.

(ii) Contesting the manner in which the elections were conducted.

(b) Such a petition shall be filed before the close of business day of the first

working day, after the announcement of the just concluded elections results.

(c) The petition shall be filed with the Dean of Students.

(d) The petition filed shall be heard and determined within two working days.

(e) In the case that the petition is kicked out, the newly elected officials shall be

sworn in as stipulated by this Constitution and otherwise;

(i) A fresh election shall be held within one week from the date of

nullification of the just concluded elections.

(ii) GUSA-EC must strictly adhere to the provisions of this Constitution in

the repeat elections.

(iii) All the contesting coalitions shall take part in the repeat elections.

21.12- Assumption of Office of the new GUSA Executive Committee members.

(a) The swearing in of the newly elected GUSA Executive Committee members

shall;

(i) Dissolve the incumbent Executive Committee.

(ii) Be conducted in a swearing in ceremony within the fourth week of

November unless;

(1) There is a petition being heard on the just concluded elections,

(2) The just concluded elections were nullified or,

(3) The expected General Elections did not take place as

scheduled.

(b) The newly elected officials must take oath and append their details on Form

58.1(h)(1).

(c) Upon assumption of office, the Executive Committee members shall have all

the powers stipulated in this Constitution to exercise, and must abide by the

provisions herein.

21.13- Definition of the electoral process terms

(a) Ballot (Ballot Paper)

(i) A paper, or card, with the logos and names of coalitions to be elected

and a check-box besides each coalition, prepared and approved by

GUSA-EC, that will be used to vote in a preferred coalition by the

electorate during an authorized election.

(b) Ballot Box

(i) A container that is colored, marked and containing a slot at the top to

insert a ballot paper, is authorized for use by GUSA-EC, and is used

by the electorate during an authorized election.

(c) Spoilt Vote

(i) A vote that has not been cast but has been marked correctly or

wrongly, and has been confirmed by the coalitions agents.

(d) Cast Vote

(i) A ballot paper that has been marked by a voter put in a ballot box to

vote in a preferred coalition.

(e) Rejected Vote

(i) A cast vote that has no symbol written on it by a voter, or a cast vote

that has any other symbol other than a tick ( ) written on it, or a cast

vote that has more than one check-box marked by a voter.

22- Quorum

22.1- The quorum for the meetings held by GUSA shall be;

(a) Annual General Meeting (A.G.M)

In the case of an annual general meeting, the quorum shall be not less than

two-thirds of GUSA members.

(b) General Meeting

In the case of a general meeting, the quorum shall be not less than two thirds

of GUSA members.

(c) Special Meeting

In the case of a special meeting, the quorum shall be not less than half of

GUSA members.

(d) Executive Committee Meeting

In an Executive Committee meeting, the quorum shall be not less than three-

quarters of the Executive Committee members.

(e) Special Committee Meeting

In a special committee meeting, the quorum shall be not less than half of the

members of that specific committee.

(f) GUSA Clubs, Societies and Political Parties' meetings

If any club, society or party is to have a meeting, the quorum shall be as

stipulated in their constitution. However, the quorum must not be less than

half of the members.

23- Resolution

23.1- There shall be two types of resolutions:

(a) General resolution

This shall be a resolution passed at any GUSA meeting by a simple majority

vote of GUSA members present.

(b) Special resolution

This shall be a resolution passed at any GUSA meeting pertaining any of the

issues stated herein by at least two-thirds of the members present in such a

meeting.

(i) The supremacy of this Constitution.

(ii) The sovereignty of the GUSA members.

(iii) Changing the name of GUSA.

(iv) Membership, subscription and suspension of membership.

(v) Public finance.

(vi) The GUSA Electoral Commission.

(vii) The structure of GUSA.

(viii) The amendment of this Constitution.

(ix) Any other issue that may arise in a special meeting.

23.2- In the case of clubs, societies and political parties, the constitution of such factions

shall guide the terms of a resolution. However, the GUSA constitution shall prevail

over any club, society or political coalition constitution in the case that such a

resolution affects GUSA members who are non-members to such a faction.

CHAPTER SIX: [THE EXECUTIVE COMMITTEE]

24- The Executive Committee

24.1- There is established an Executive Committee that shall be the administrative body of

GUSA, composite of members elected in accordance with this Constitution.

25- Composition of the Executive Committee

25.1- The Executive Committee shall be composed of the following elected leaders:

(a) The Chairperson of GUSA,

(b) The Vice Chairperson of GUSA,

(c) The Secretary General of GUSA,

(d) The Treasurer of GUSA and,

(e) Three other members to represents special interests of students:

(i) Secretary for Academics,

(ii) Secretary for Sports and Entertainment and,

(iii)Secretary for Religion.

25.2- Who shall have the following qualifications:

(a) The Chairperson of GUSA who must;

(i) Be a full-time student taking a Degree of Diploma course.

(ii) Have acquired a minimum mean grade of sixty-five percent in the last

two consecutive academic transcripts in their current level of study

and,

(1) In the case that one has done two consecutive end of semester

examinations but the most recent transcript is not out yet, they

shall request for provisional transcripts from the Academic

Registrar, and these shall be used to tally the mean grade in

Article 25.2(a) (i).

(2) In the case that one has done two consecutive end of semester

examinations but has special or supplementary examinations in

either of the two most current examinations, that person shall

not be eligible to contest.

(3) In the case that one has upgraded to another level of study

within the University, the previous level of study shall be

disregarded and thus the transcripts of the current level of study

shall be the only consideration.

(iii)Must be cleared by the Dean of Students, and GUSA-EC.

(iv) Must be an integral person having no disciplinary record of gross

misconduct or corruption.

(b) The Vice Chairperson of GUSA who must;


(ii) Have acquired a minimum mean grade of sixty-five percent in the last

two consecutive academic transcripts in their current level of study

and,

(1) Provisions of Article 25.2(a) (ii) apply.




(c) The Secretary of GUSA who must;


(ii) Have acquired a minimum mean grade of sixty percent in the last two

consecutive academic transcripts in their current level of study and,





(d) The Treasurer of GUSA who must;








(e) Three other members to represent special interests who must;

(i) Be a full-time student and,

(1) The Secretary for Academics must be a student taking a Degree

or Diploma course.

(2) The Secretary for Sports and the Secretary for Religion can be

in any level of study.







26- Duties of the Executive Committee

26.1- The duties of the Executive Committee shall be as stipulated in the Universities

(Amendment) Act of 2016, stated herein:

(2) The functions of a Students’ Council shall be to—

(a) oversee and plan, in consultation with the Senate, students’ activities for the

promotion of academic, spiritual, moral, harmonious communal life and social

well-being of all students;

(b) Draw to the attention of the appropriate authority, where necessary, special

needs form particular students;

(c) Offer suggestions to the Senate or its equivalent on matters affecting the

wellbeing of students; and

(d) Undertake such other functions as provided in its governance instrument as

approved by the Council.

26.2- The Executive Committee shall:

(a) Support and coordinate activities if GUSA and implement decisions made at

General Meetings.

(b) Oversee all the financial activities of GUSA.

(c) Ensures that up to date and accurate record of GUSA accounts, properties and

liabilities are kept.

(d) Transact monies on behalf of GUSA.

(i) The signatories to the GUSA financial accounts are and shall remain to

be the Chairperson, the Secretary General and the Treasurer of the

(ii) In the event that either one of them is removed from office, dies,

resigns or cannot avail themselves due to any other unavoidable

circumstance, communicated to the Executive Committee officially,

the Vice Chairperson shall be the third signatory.

(iii)In the Event that any two signatories being absent due to causes in

Article 26.2 (d) (ii), the three special interest representatives shall

elect one of them to supplement the signatories.

(iv) In the event that all the three signatories, Article 26.2(d)(i), are absent,

or are unavailable, GUSA shall not make any transaction and all

transactions shall be suspended till the availability of at least one

signatory is confirmed.

(e) Enforce the GUSA Constitution.

(f) Freeze and/or dissolve clubs or societies, or summon and probe club or

societal official in accordance with this Constitution.

(i) A letter, addressed to the club or society and copied to the Dean of

students shall be produced and signed by the Executive Committee

Secretary General, detailing legibly and comprehensively, the

reason(s) for the freezing or deregistration of a club or removal from

office of the affected club or society official(s).

(ii) The Executive Committee shall however, in the case that any club or

societal official is found to have committed a punishable deed, not

interfere with the election of new officials in the club or society

involved.

(iii)Such clubs or societies, or officials of such clubs and societies, have a

right to appeal the decision taken by the Executive Committee, to the

Dean of Students.

(1) The decision of the Dean of Students shall prevail over that of

the Executive Committee.

(g) Act, with discretion, as a link between the students and the University

Administration.

(h) Submit, after constitution of committees, the list with names, registration

numbers and current phone numbers of the Chair, the Secretary and members

of each committee to the Dean of Student and keep a copy of same.

(1) If any changes are made, the updates list must be submitted to

the abovementioned dockets.

(i) Investigate and prepare a defense for a student facing disciplinary actions or

any sanctions. The secretary general shall represent a student in a senate

hearing having prepared a defense after comprehensive investigation

disciplinary actions facing student.

(j) Accept, without malice or interference, and implement decisions made at the

special committees’ level as long as these decisions do not contravene the

GUSA Constitution and/or Gretsa University Statutes.

(1) In case an action or decision contravenes the above mentioned,

the Executive Committee is to provide clear, legible and

referenced quotations from the two mentioned documents; that

is, GUSA Constitution and Gretsa University Statutes.

(k) Shall orient new students and hold a meeting with them each semester, within

the first 5 weeks from the opening dates of each semester.

27- Duties of Members of the Executive Committee

27.1- The Chairperson shall;

(a) Be responsible for overall administration of GUSA.

(b) Act as the custodian of the GUSA Constitution and ensure that the constitution

is free from willful and malicious interference.

(c) Preside over the Executive Committee meetings.

(d) Represent students’ interest in all University decision making organs and

meetings provided for by the University statutes.

(e) Be an ex-official member of all the other GUSA committees and clubs.

(f) Make, in the case that need arises, an emergency decision with due

consultation provided that such decision is in the best interest of GUSA and

that such decision is reported in the next meeting of the Executive Committee

and does not contravene this Constitution.

(g) Have the power of casting two votes in case of a tie in the Executive

Committee vote cast.

(h) Be a signatory to all withdrawals from GUSA funds authorized by the

(i) Address the first session of the elected Executive Committee and every first

sitting of the Executive Committee in each semester within the first twenty-

one days.

(j) Be a member of the Gretsa University Senate.

(k) Advocate for, encourage and facilitate current and relevant activities related to

the academic fields; seminars, lectures, speeches, exhibition, quizzes and

symposium.

(l) Promote and urge for provision of high quality academic facilities, resources

and services for effective, broader and better academic programs of the

University.

27.2- The Vice Chairperson shall;

(a) Assume all the duties of the Chairperson in an acting capacity during the

Chairperson’s absence, without limit.

(b) Initiate cooperation with organizations and institutions outside the University

subject to approval by the Executive Committee. This shall be carried out in

liaison with the Dean of Students.

(c) Advice the Executive Committee on matters related to external relations.

(d) Prepare and present monthly progress reports at the Executive Committee

meetings.

(e) Prepare and present semester progress reports at the general meetings.

(f) Coordinate and facilitate community service and related projects in

conjunction with the office of Mr. and Miss. Gretsa University.

(g) Shall supervise the organization and coordination of events within the GUSA

calendar of activities by the Secretary for Sports and Entertainment.

27.3- The Secretary General shall;

(a) Keep official records of the GUSA.

(b) Handle all GUSA correspondence under the general supervision of the


(c) Issue notices convening all meetings of the Executive Congress and GUSA

meetings.

(d) Be a signatory of GUSA financial transactions.

(e) Be a member of the GUSA Disciplinary Committee of Senate.

(f) Keep minutes of all Executive Committee meetings and preserve all records of

proceedings.

(g) Be the official spokesperson for the GUSA.

27.4- The Treasurer shall;

(a) Perform proper book keeping and accurate records of GUSA financial

transactions.

(b) Be of the signatories to all financial transaction of GUSA.

(c) Make funds available for the payment of all GUSA budgeted and approved

activities.

(d) Present GUSA financial report to the student congress upon request.

(e) Present annual, audited financial accounts during the Annual General Meeting

(AGM).

(f) Read the proposed budget of GUSA to the members.

(g) Present the proposed annual budget to the students’ congress for approval.

27.5- The three other members to represent special interests shall;

(a) Secretary for Academics

(i) In liaison with the Dean of Students, provide information relating to

academic life in the University during orientation.

(ii) Organize for timely dissemination of academic information to GUSA

members.

(iii)Mediate when necessary, on academic conflicts between GUSA

members.

(iv) Be a member of the Editorial Board of the students’ newsletter.

(v) Advice the Executive Committee on GUSA members academic

matters.

(b) Secretary for Sports and Entertainment

(i) Keep in safe custody and maintain all equipment and facilities related

to clubs and required for students’ recreational purposes.

(ii) Oversee the conduct of clubs.

(iii)In liaison with the Secretary for Religion and the Secretary General to

the Executive Committee, formulate a calendar of events for the

GUSA members.

(iv) Enforce immunities of clubs.

(v) In liaison with the Secretary for Religion and the Secretary General of

the Executive Committee, organize student recreational activities.

(c) Secretary for Religion

(i) Keep in safe custody and maintain all equipment related to societies.

(ii) Oversee the conduct of societies.

(iii)In liaison with the Secretary for Sports and Entertainment and the

Secretary General to the Executive Committee, formulate a calendar of

events for the GUSA members.

(iv) Enforce immunities of societies.

(v) In liaison with the Secretary for Religion and the Secretary General of

the Executive Committee, organize student religious activities.

28- Vacation from Office of Executive Committee Members

28.1- A member of the Executive Committee shall be considered to have vacated (or been vacated)

from office if the committee member either resigns or is removed from office.

28.2- An Executive Committee member shall only be recognized as to have resigned from office by

submitting Form 58.1(e) to the Dean of Students and otherwise shall be termed as negligence

of constitutionally mandated duties.

28.3- Conditions for removal from office of an Executive Committee member shall be;

(a) Violation of this Constitution in part or as a whole,

(b) Gross misconduct,

(c) Mismanagement of GUSA funds,

(d) Negligence of constitutionally mandated duties or,

(e) A combination of any of the conditions for removal.

28.4- Terms for replacing absent or removed officials.

(a) In the case of temporal absentia exceeding one month of;

(i) The Chairperson.

(1) The Vice Chairperson shall assume all the roles of the

Chairperson and,

(2) The Vice Chairperson shall be entitled to one half of the

Chairperson’s salary added to their own.

(3) The Vice Chairperson shall assume the roles of the Chairperson

without limit.

(4) The Vice Chairperson shall relinquish power upon resumption

of the Chairperson.

(5) The Chairperson shall not be entitled to any pay while on

temporal absentia.

(ii) Any other member of the Executive Committee.

(1) The Executive Committee member shall elect one Executive

Committee member to temporarily hold the position of the absent

member and,

(2) The elected shall be entitled to one half of the absent member’s salary

added to their own.

(3) The elected shall assume the roles of the absent without limit.

(4) The elected shall be relieved of their adopted duties upon resumption

of the absent member.

(5) The absent member shall not be entitled to any pay during their

absence from office.

(b) In the case of permanent absence or removal from office of;

(i) The Chairperson.

(1) The Vice Chairperson shall assume all the roles of the

Chairperson without limit and,

(2) The Vice Chairperson shall be entitled to one half of the

Chairperson’s salary added to their own.

(3) The Vice Chairperson shall terminate their role as Acting

Chairperson upon expiry of their term of office.

(ii) Any other member of the Executive Committee.

(1) The Executive Committee member shall elect one Executive

Committee member to temporarily hold the position of the

absent member and,

(2) The elected shall be entitled to one half of the absent member’s

salary added to their own.

(3) The elected shall terminate their adopted roles upon expiry of

their term of office.

28.6- Procedure for removal of an Executive Committee member from office.

(a) Only one Executive Committee member can be removed from office at one

instance.

(b) The member(s) charging the official shall in writing, serve the affected official

with allegations and proof floated against them.

(c) The member(s) charging the officials shall in writing, simultaneously serve the

allegations and proof to the Dean of Students and the Secretary General to the

Executive Committee and,

(i) In the case that the Secretary General is the defendant of the floated

allegations, they shall be served to the Vice Chairperson.

(d) The Dean of Students shall within one week of receipt of the allegations,

convene a meeting with the plaintiff(s) together with the defendant and any

other interested party and,

(i) Chair the meeting.

(ii) Deliver a verdict on the case under scope.

(iii) Recommend the way forward.

(e) In the case that the defendant does not honor the summon by the Dean of

Students, the case shall proceed in their absence.

28.7- Resigned or removed officials are not;

(a) Recognized as members of the Executive Committee and as such, may not

conduct any business in the name of GUSA in such a capacity.

(b) Entitled to appreciation, salaries or any remunerations in any form facilitated

by the GUSA accounts.

(c) Eligible for reappointment, reelection or nomination into the Executive

Committee.

CHAPTER SEVEN: [PUBLIC FINANCE]

29- Principles of Gretsa University Students Association Finance

29.1- All aspects of GUSA finances shall be guided as indicated herein:

(a) There shall be openness and accountability, in all GUSA financial matters.

(b) There shall be the participation of GUSA members, either directly or through

the Executive Committee, in all GUSA financial matters.

(c) All the revenue raised by any GUSA member in the name of, or for a

purpose(s) of GUSA shall remain as GUSA monies and, no such individual

shall take away any part of the money without public participation unless

otherwise stipulated by this Constitution.

(d) GUSA finances shall be shared equitably amongst the appreciation, the events

of GUSA and the remuneration of the GUSA officials.

(e) GUSA finances shall be used in a prudent, sustainable and responsible way.

(f) Financial management shall be responsible and fiscal reporting shall be clear.

(g) No monies shall be transacted in any form, from the GUSA accounts, without

the consent of the GUSA Treasurer, unless otherwise stipulated in this

Constitution.

30- Gretsa University Students Association Annual Budget

30.1- There shall be an annual budget, that shall be prepared by the GUSA Treasurer and

passed by GUSA Executive Committee.

30.2- The annual budget shall be prepared and approved on or before the first working day

of the second week of February each year.

30.3- The annual shall contain a minimum of the following before it is approved:

(a) The estimated of revenue and expenditure, differentiating between recurrent

and non-recurrent expenditure.

(b) Proposals for financing any anticipated deficit for the period to which they

apply.

(c) Proposals regarding borrowing and how to repay the debts before the

expiration of the current Executive Committee’s term of office.

(d) Any other recommendations by the Treasurer, passed by the Executive

Committee.

30.4- For the annual budget prepared by the GUSA Treasurer to be passed by the Executive

Committee:

(a) The Treasurer shall:

(i) Before the end of the second week January, prepare an annual budget

for GUSA.

(ii) Ensure that the budget conforms to the regulations stipulated in this

Constitution.

(iii)Prepare a report accompanying the annual budget, detailing the reasons

for the structure and content of the budget.

(iv) Seek the opinion of the concerned GUSA factions, before compiling

the final report that shall accompany the annual budget.

(v) Perform all these duties assisted by the Secretary General of the


(b) The Executive Committee shall within three days after receipt of the proposed

annual budget from the GUSA Treasurer:

(i) Assent to the proposed annual budget and the report, by stamping the

proposed annual budget and report with the GUSA stamp and the

signature of the Executive Committee Secretary.

(ii) Draft recommendations, if any, to the annual budget and attach their

report to the proposed annual budget and report by the GUSA

Treasurer. The recommendations by the Executive Committee shall be

stamped and signed by the Executive Committee Secretary.

(c) The GUSA Treasurer shall:

(i) Within two days after receipt of the GUSA annual budget from the

Executive Committee, submit the annual budget to the relevant

University Administrator and inform them the budget is approved.

(ii) Await directions from the University Administration.

(iii)Inform all GUSA members, through the University notice boards, of

the date of reading the annual budget.

31- Gretsa University Students Association Semester Budget

31.1- The semesters budget shall contain all the short activities of a single semester and

their funding.

31.2- The semester budget shall be derived from the annual budget.

31.3- Within two weeks after commencement of each semester, (and within one week after

reading of the annual budget, for the January-April semester), the Executive

Committee shall:

(a) Hold a meeting to discuss the semester budget.

(b) Derive the semester budget from the annual budget.

(c) Present it to the Chairperson of GUSA for assent.

(d) Publish a summary of the semester budget on at least three of the University

main notice boards.

32- Borrowing by Gretsa University Students Association

32.1- Borrowing for the purpose of financing GUSA activities is recognized by this

Constitution.

32.2- The debt borrowed by GUSA must not surpass manageable levels and thus:

(a) The debt taken by GUSA must be sustainable.

(b) The person(s) who promoted the borrowing must be held jointly liable and

must pay the debt in the case of a default, before they graduate from the

University.

(c) All the GUSA members must be aware of such borrowing.

32.3- To borrow a loan in the name of GUSA, for the loan to be taken, the promoter(s) of

borrowing monies must;

(a) Prepare a report detailing:

(i) The extent of the total indebtedness by way of principle and

accumulated interest.

(ii) The use to be made of the proceeds of the loan.

(iii)The measures put in place for the servicing and/or repaying the loan.

(iv) The duration (which shall not be more than the remaining term of

office of the current GUSA Executive Committee) to repay the loan.

(v) From which institution the loan shall be taken.

(b) Present a copy of the report to:

(i) The Secretary General, GUSA Executive Committee.

(ii) The Dean of Students.

(iii)The University Senior Accountant.

(c) Await approval from:

(i) The University Senior Accountant.

(ii) The Dean of Students.

(iii)The Executive Committee

(1) All the above dockets must unanimously ascent to the proposal

to uptake a loan. In the case that the motion does not acquire

the required support:

(1A) Drop the motion to borrow the loan or,

(1B) Start over the process of borrowing a loan again.

(d) Seek a guarantee of the loan from Gretsa University. If the University does not

guarantee the loan, then the loan cannot be acquired in the name of GUSA and

the promoter shall:

(i) Drop the motion to borrow the loan.

(ii) Start over the process of borrowing a loan again.

(e) Notify the GUSA members, on at least three of the main notice board of the

University, the amount of the loan, the intended use and the approval by the

relevant authorities and:

(i) Await a period of one week to give enough time for any GUSA

member to petition against the motion to take the loan in scope.

(ii) If a petition ensues:

(1) The petitioner(s) shall submit a detailed report on why the loan

should not be taken to the Dean of Students.

(2) Within two days from receipt of the petition, the Dean of

Students shall convene a meeting with the Executive

Committee and the petitioner(s).

(3) The Dean of Students shall chair the meeting.

(4) The outcome of the meeting can either nullify the motion to

adopt the loan or commend the motion.

(1A) If the loan motion is nullified, the mover of the motion

shall either abandon the motion or start over the process

again.

(f) If the motion is not successfully challenged, GUSA shall proceed to take the

loan.

33- Auditing of Gretsa University Students Association Accounts

33.1- There is established a position of an auditor who shall:

(a) Be appointed by the Dean of Students once each academic year,

(b) Audit the accounts of GUSA and,

(c) Report only to the Dean of Students.

33.2- The auditor must be:

(a) Be a full-time student pursing a Diploma or Degree, finance or accounts

course.

(b) Independent of the GUSA Executive Committee.

(c) Furnished with all the required and requested materials by the GUSA


33.3- The audit process shall:

(a) Take a maximum of one month upon appointment into office of the Auditor.

(b) Commence on the second week of September each year.

33.4- Upon completion of the audit process:

(a) The Auditor shall:

(i) Upon verification of misuse of public resources:

(1) Submit a detailed report to the Dean of Students.

(2) Recommend relevant disciplinary action against the Executive

Committee.

(3) Recommend reimbursement of the misused funds by the

Executive Committee before the graduation of any of the

members of the Executive Committee.

(4) Recommend measures to curb such misuse of public funds.

(ii) The Dean of Students shall adopt the recommendations by the Auditor.

(b) The Auditor shall be appreciated with a cash amount agreed upon by the Dean

of Students.

34- Procurement of Goods and Services by Gretsa University Students Association

34.1- In the case that a member(s) of GUSA wishes to procure a good and/or a service for

GUSA, such a member shall:

(a) In writing, the member(s) wishing to propose a good and/or service for GUSA

shall address a letter to the Secretary-General of the GUSA Executive

Committee stating the quotations and purpose of the goods and/or services.

(b) The Secretary-General of the GUSA Executive Committee shall then convene

a meeting within a reasonable time frame not exceeding two weeks from the

date of receipt of the letter in Article 34.1 (a).

(c) Upon deliberations, the Executive Committee shall then decide on whether the

goods and/or services should be procured.

(d) In the case that the proposal is declined, then the Executive Committee shall

write to the party that had proposed the reasons for the decline.

(e) In the case that the goods and/or services are to be procured, the Executive

Committee shall write a letter to the Dean of Students indicating that there is

need to purchase the goods and/or services. The original proposal letter for the

purchase of the goods and/or services and the quotations should be attached to

the letter written by the Executive Committee.

(f) The Dean of Students shall then deliberate the same with the relevant

University Authorities.

35- Disposal of Gretsa University Students Association Assets and Liabilities

35.1- In the case that any GUSA asset is to be disposed, the disposal shall follow the

procedure stated herein:

(a) In writing, the member(s) seeking the disposal of the GUSA asset(s) shall

write to the Secretary-General, Executive Committee, detailing the reason(s)

for the need disposal of asset(s) or liability(-ies).

(b) The Secretary-General to the Executive Committee shall then convene a

meeting within a reasonable time frame not exceeding two weeks form the

date of receipt of the letter in article 35.1 (a).

(c) Upon deliberation, the Executive Committee shall write to the Dean of

Students indicating an adoption or dismissal of the motion to dispose of

GUSA asset(s) or liability(-ies).

(d) In the case that the motion is adopted, the Dean of Students and the Executive

Committee shall deliberate on the best way to dispose the asset(s) or liability(-

ies).

36- Remunerations to Executive Committee Members

36.1- GUSA finances shall be used to pay and appreciate GUSA Committee members as

stated herein:

(a) Members of the Executive Committee are entitled to monies that will be

referred to as salaries.

(b) Monies remunerated to the Executive Committee members shall be derived

from the annual budget.

(c) The monies shall be allocated only as per the percentages stated herein:

(i) GUSA Activities shall be allocated 60% of the annual budget.

(ii) Salaries of the Executive Committee member shall be 35% of the

annual budget.

(iii) Executive Committee office maintenance shall be allocated 5% of the

annual budget.

(d) The monies remunerated to each faction of the Executive Committee shall

only be awarded from the 35% and this percentage shall be considered 100%

of the remunerations to be awarded.

(e) The monies must be awarded as indicated herein:

(i) Chairperson : 18%

(ii) Vice Chairperson : 16%

(iii) Secretary General : 13.2%

(iv) Treasurer : 13.2%

(v) Secretary for Academics : 13.2%

(vi) Secretary for Sports and Entertainment : 13.2%

(vii) Secretary for Religion : 13.2%

(f) In the case that the student number increases by 200 in a semester, then the

remunerations (the 35% of the GUSA budget) shall decrease by 2%, however;

(i) In the case that the number of students stagnates in a semester then the

remunerations shall not be increased or decreased.

(ii) In the case that the number of student number decreases by 200 in a

semester, then the remuneration shall be increased by 2% but must not

exceed the 35%.

(g) The Executive Committee remunerations shall not recede below 3%

regardless of the number of students.

37- Appreciation of Gretsa University Students Association Members and Special

Committees

37.1- Upon expiry of their term office, Special Committee members shall receive:

(a) Letter of appreciation from the Executive Committee.

(b) A certificate signed by the Dean of Students, and the GUSA Secretary General

containing:

(i) The name of the special committee member being appreciated.

(ii) The registration number of the committee member being appreciated.

(iii)The name of the special committee the member served, and their

position in the committee.

(iv) A passport-size photograph of such a member being appreciated.

(c) Depending on the annual budget, the Executive Committee may purchase

items (packages) to appreciate the committee members and:

(i) The total sum of all the packages must not exceed 4% percent of the

annual budget.

(ii) The money to be used when purchasing the packages must be included

in the annual budget when it is being prepared.

37.2- Upon expiry of their term office, Executive committee members shall receive:

(a) Letter of appreciation from the Dean of students.

(b) A certificate signed by the Vice Chancellor, and the Dean of students

containing;

(i) The name of the committee member being appreciated.

(ii) The registration number of the committee member being appreciated.

(iii)Their position in the Executive Committee.


37.3- Upon expiry of their term of office, Mr. and Miss. Gretsa shall receive:

(a) ) A letter of appreciation from the Dean of students.

(b) A certificate signed by the Vice Chancellor, and the Dean of students

containing;

(i) Their name.

(ii) Their registration numbers.

(iii)Their title as Mr./Miss Gretsa university (year).

(c) Cash appreciation, in the manner proposed by the Executive Committee, as

long the cash appreciation does not exceed 2%, and is not less than 1.5% of

the annual budget.

(d) Recognition as the Former Mr./Miss. Gretsa University as long as they are

student at Gretsa University.

38- Zero Rating of Gretsa University Students Association Accounts

38.1- If a GUSA member or official (in their individual capacity, in the capacity of an

official or a committee member) sources for money in the name of GUSA, that money

only belongs to GUSA, and not an individual, or group of individuals.

38.2- A person(s) who raises funds in the name of GUSA shall be entitled to not more than

10% of the sourced funds.

38.3- A member of GUSA shall raise funds in their own consent, but must do so discretely

and;

(a) Inform the Executive Committee that they intend to raise funds.

(b) Get consent from the Executive Committee.

38.4- Monies in the account of GUSA shall remain in the account of GUSA upon expiry of

the term of office of the Executive Committee, except the funds authorized by this

Constitution.

39- Bereavement

39.1- In case of death of a GUSA member, the student congress shall:

(a) Contribute towards buying a coffin of the deceased at an amount not

exceeding KSH 10000.

(b) Contribute towards transporting a selected number of students to the deceased

place of burial at a cost that shall not exceed KSH 40,000.

(c) Form a committee consisting of the friends of the deceased who want to

contribute in the funeral arrangements.

39.2- In case a GUSA member loses a father, mother, legal spouse or child;

(a) The Executive Committee shall remunerate a consolation fee to that very

GUSA member.

(b) The consolation fee is subject to review from time to time and,

(c) Must not exceed KSH 10,000.

39.3- In the case that a GUSA Executive Committee member dies, GUSA shall:

(a) Contribute funds to procure a coffin at a cost not exceeding KSH 10,000.

(b) Contribute towards transporting a selected number of students to the deceased

place of burial at a cost that shall not exceed KSH 40,000.

(c) Form a committee consisting of the friends of the deceased who want to

contribute in the funeral arrangements.

CHAPTER EIGHT: [MR. AND MISS. GRETSA UNIVERSITY]

40- Mr. and Miss. Gretsa University

40.1- There is established the office of Mr. and Miss Gretsa University.

40.2- Mr. and Miss. Gretsa University shall be selected from amongst the best in a contest,

Mr. and Miss Gretsa University Beauty Pageant (Year) that shall take place each

year.

40.3- The supervisors of the event must consist of;

(a) A Gretsa University Administrator in the Gretsa University Marketing

Committee.

(b) The Dean of students

40.4- The judges of the event must be;

(a) A maximum of three external judges proficient in the field of modelling.

(b) Selected by the Executive Committee in conjunction with the supervisor;

Article 40.3(a).

40.5- The Mr. and Miss Gretsa University Beauty Pageant (Year) must take place within

the Gretsa University premises and;

(a) Must allow all the GUSA members to attend without any entry fee.

(b) Must allow any GUSA member to contest and be eligible for the crown,

unless otherwise stipulated by this Constitution.

(c) Must take into account special needs students.

(d) Must not be discriminatory in any manner.

41- Duties of Mr. and Miss Gretsa University

41.1- The duties of Mr. and Miss Gretsa University shall be;

(a) Act as the University ambassador in activities involving the University.

(b) To work hand in hand with runners-ups to implement humanitarian projects

and market the University.

(c) To prepare an annual budget of their activities and submit it to the Executive

Committee Secretary General.

(d) Organize community services within and without the University.

(e) Diligently keep records of all communication with external links.

(f) To avail themselves whenever needed by the University Marketing

Committee.

42- Qualifications for the Office of Mr. and Miss Gretsa University

42.1- For one to qualify for contesting in the Mr. and Miss Gretsa University Beauty

Pageant (Year), one must be;

(a) A full-time student.

(b) Active in University students’ activities.

(c) An effective role model.

(d) Efficient in public speaking.

(e) A member of a registered club or society within the University.

(f) Willing to implement at least one humanitarian project once in office and thus;

(i) Must have a written proposal that is;

(1) Unique

(2) Original work

(3) In a format conforming stipulated standards.

(ii) Shall have submitted the proposal to the Mr. and Miss Gretsa

University Supervisor, Article 40.3(a), by the end of the first week of

February each year.

(g) A non-member of the Executive Committee.

43- Vacation from Office of Mr. and Miss. Gretsa University

43.1- Either Mr. or Miss Gretsa University may resign from office any time by;

(a) Writing a letter addressed to their supervisor, Article 40.3(a), and copied to

the Dean of Students and the Secretary of the GUSA Executive Committee

and,

(b) In the case of resignation;

(i) The resigned shall not be entitled to any benefits stipulated in this

Constitution with regard to the office of Mr. and Miss Gretsa

University.

(ii) The first runners-up shall assume office and shall be entitled to all the

powers and benefits of the resigned.

(iii)The resigned is not entitled to;

(1) Vying for that very office again.

(2) Reversal of the resignation process.

(3) Transact any business in the name of Mr. or Miss Gretsa

University.

43.2- Either Mr. or Miss Gretsa University may be removed from office in the case of;

(a) Violation of this constitution in whole or in part.

(b) Gross misconduct.

(c) Mismanagement of GUSA funds.

(d) Negligence of constitutionally mandated duties.

43.3- For either Mr. or Miss Gretsa University to be removed;

(a) The promoter of the motion to remove Mr. or Miss Gretsa University must;

(i) Serve the defendant with the allegations floated against them.

(ii) Simultaneously Serve the supervisors, Article 40.3, with a letter

detailing the intention and cause(s) for removal from office of the

defendant.

(iii) The Dean of Students shall then convene a meeting, within a week

from the date of receipt of the letter, comprising of;

(1) Both Mr. and Miss Gretsa University.

(2) The Vice Chairperson to the Executive Committee.

(3) The Secretary General to the Executive Committee.

(4) The promoter(s) of the motion for removal from office of.

(iv) The Dean of Students shall then hear the case and;

(1) Exonerate the defendant,

(2) Serve the defendant a first and last warning,

(3) Recommend removal from office of the defendant.

(v) The Secretary General to the Executive Committee shall prepare a

report of the meeting convened by the Dean of Students and serve it to

the supervisors, Article 40.3, and the Executive Committee.

(vi) The Secretary General to the Executive Committee and the Executive

Committee in whole shall await a period of one week from the time of

the decision reached by the Dean of Students before publicizing the

decision and;

(1) Await further directions from the supervisors, Article 40.3.

(vii) Upon receipt of further directions, the Executive Committee shall

proceed as advised.

CHAPTER NINE: [CLUBS, SOCIETIES AND ENTERTAINMENT]

44- Clubs, Societies and Entertainment

This Constitution recognizes:

44.1- Clubs and societies, composed of GUSA members and with a patron/matron who

must be a staff member of Gretsa University, as long as such clubs and societies are

formed according to the provisions of this Constitution.

44.2- The constitutions of clubs and societies, and the resolutions made by such clubs and

societies as long as they do not violate this Constitution or the Gretsa University

Statutes.

44.3- The officials (elected or nominated), as per the constitution of such a club or society,

and the members of such clubs and societies.

44.4- The independence of clubs and societies, as enshrined in this Constitution.

This Constitution defines:

44.5- A club as: A group of Gretsa university students (other than a society), governed by a

constitution, who meet from time to time, are recognized by Gretsa University

Administration and the Gretsa University Students Association Executive Committee,

for a common purpose, including sports, games, recreation, charity work and

technological goals among other non-cultural or religious objectives.

44.6- A society as: A group of Gretsa University students, governed by a constitution, who

meet from time to time, are recognized by Gretsa university administration and the

Gretsa University Students Association Executive committee, for a common religious

and/or cultural purpose.

This Constitution enforces that;

44.7- A club of society must:

(a) Have a minimum of ten members inclusive of the club officials and at least

one patron or matron.

(b) Have a written constitution that has a clearly defined mission, vision and

objective(s) of the club or society.

(c) Have a clear, step by step procedure detailing the procedure of becoming and

remaining a member.

(d) Have a clear, step by step procedure detailing the procedure of suspension and

cessation from membership.

(e) Adhere to the GUSA Constitution and the Gretsa University Statutes.

(f) Follow due process for registration.

(g) Have a clear and legible step by step procedure of installation and removal

from office of the club or societal officials.

(h) Upon registration, hold at least one meeting every month, write minutes and

submit a signed and approved copy to the office of the Secretary General of

the Executive Committee.

45- Registration of Clubs and Societies

45.1- For a group of Gretsa University students to be registered as a club or society;

(a) The founder(s) of the club or society must be a Gretsa University Student.

(b) Once a student has an initiative, they should look for at least ten other Gretsa

University students to join their course.

(c) Together, the founder and members shall request a staff member at Gretsa

University to represent them as the patron or matron of the club or society.

(d) The founder and the members are to then come up with a constitution

detailing;

(i) The mission of the club or society.

(ii) The vision of the club or society.

(iii) The structure of administration of the club or society.

(iv) The rules and regulations that govern the conduct of business and the

club or society member.

(e) The founder of the club or society in consultation with the pioneer members is

then to fill Form 58.1(d)(1) and all the relevant particulars, with the following

attached;

(i) The club or society constitution.

(ii) A list of at least ten members with;

(1) The registration number of each member included.

(2) The current mobile phone number of each member.

(3) A copy of the University identification card of pioneer

members and founder(s).

(4) The name and phone number of the patron or matron and their

department.

(f) Submit the form and registration request to the Executive Committee and copy

the documents to the Dean of Students.

(g) Within two days of receipt of the registration request, hold a meeting with the

Secretary for Sports and Entertainment and the Secretary for Religion.

(h) Within five days of receipt of the registration request, the Secretary General to

the Executive Committee together with the Secretary for Sports and

Entertainment and the Secretary for Religion, is to consult with the Dean of

Students to process such a request.

(i) The Secretary General to the Executive Committee is to then write a letter

within three days after consultation with the Dean of Students addressed to the

founder(s) of the club or society. This will inform the club or society of their

successful or unsuccessful application. If unsuccessful;

(i) The letter for unsuccessful application shall detail the reasons for such

an occurrence.

(ii) The letter must be copied to the Dean of Students.

(iii) The founders of the club or society shall have the option of starting

the registration process a fresh with strict adherence to the GUSA

Constitution.

(j) Upon receipt of a letter detailing its qualification, a club or society shall

proceed to conduct its business with strict adherence to its constitution.

46- Immunities of Clubs and Societies

46.1- A duly registered club or society shall;

(a) Not be influenced by anyone, including the Executive Committee, the Gretsa

University Staff or any non-member of such a club or society as long as their

activities do not violate this Constitution and the Gretsa University Statutes.

(b) Be allowed to amend their constitution without interference from non-

members of such a club or society.

(c) Have only registered members of such a club or society participating in

activities organized by such a club or society, unless the club or society

officials stipulate otherwise.

47- Deregistration of Clubs and Societies

47.1- A club or society shall be deregistered if:

(a) It violates the GUSA Constitution or the Gretsa University Statutes.

(b) It is inactive for three consecutive months from the last date of submission of

minutes to the Executive Committee.

(c) If the number of registered members reduces to less than ten.

47.2- The Executive Committee shall only dissolve a club through Form 58.1(f) and the

procedures stipulated herein.

47.2- Upon receipt of the deregistration instruct, the affected club or society may;

(a) Appeal through the Dean of Students or,

(b) Resolve to follow the deregistration instruct and thus,

(i) Shall not conduct any business under the name of the deregistered club

or society and,

(ii) Must re-register with strict adherence to stipulated registration

guidelines in this Constitution.

48- Roles of Clubs and Societies Officials

48.1- Clubs and societies officials, besides the roles they have been assigned in their

respective club shall;

(a) Take full liability for all the activities of the clubs they govern.

(b) Ensure a high level of discipline is observed by their club or society members

within and without the University.

(c) Source for funds their club or society activities.

(d) Keep a clear and legible record of their accounts and submit a copy of the

same to the Secretary General, Executive Committee, at least one week before

the end of each semester.

(e) Act as a link between the Executive Committee, the Gretsa University

Administration and the outside community and their club or society.

(f) Solve in-house conflicts and refer them to the Executive Committee if they

find them unsolvable.

(g) Ensure that their respective club or society elections are held in the appropriate

time and by the GUSA-EC.

(h) Provide monetary, logistic and any other required support, for the GUSA-EC

to conduct elections.

49- Support of Clubs and Societies by the Gretsa University Students Association

49.1- The Executive Committee shall;

(a) Each year, include a ―clubs and societies fund to sponsor registered clubs and

societies, subject to the annual budget.

(b) Allocate funds equitably to all clubs and societies.

CHAPTER TEN: [SPECIAL COMMITTEES]

50- Special Committees

A special committee shall;

50.1- Be formed upon establishment of a course or need that is beyond the capacity

Executive Committee, the Office of Mr. and Miss Gretsa University or the Electoral

Commission.

50.2- Be established by the Executive Committee, in consultations with the Dean of

Students.

50.3- Upon establishment, be governed only by this Constitution and shall not be subject to

interference by members outside that special committee.

50.4- Submit at least two reports in the course of its work and all its paperwork upon

completion of its task to the Secretary General of the Executive Committee and copy

the same to the Dean of Students.

50.5- Consist of a minimum of three and a maximum of five members, who are not;

(a) Members of the Executive Committee.

(b) Chairs or Secretaries to other special committees.

(c) Chairs or Secretaries to clubs or societies.

(d) Facing disciplinary sanctions.

(e) Former Executive Committee members.

50.6- Be immune from forced production of information under scrutiny by such a special

committee.

50.7- Establish rules, within the first three of its meeting to govern its work. The committee

may choose to withhold such rules (with reason), or surrender them to the Executive

Committee.

50.8- Perform its assigned duty diligently and without contravening this Constitution.

50.9- Have a minimum of three and a maximum of seven members.

51- Establishment of a Special Committee

51.1- The Executive Committee shall:

(a) Discuss in an Executive Committee meeting, the agenda being the course or

need that has been established.

(b) In the Executive Committee meeting, discuss the issue that is under

consideration to come up with a recommendation on how to solve the issue

and identify candidates suitable for a special committee.

(c) After the Executive Committee meeting have a maximum of one week to call

the identified persons for an interview.

(d) Have another three working days to come up with a list of the qualified

persons for the job and notify all the GUSA members of the purpose of the

committee and the persons involved.

(e) Appoint a convener to chair the first meeting of the special committee.

(f) Hand over all the documents relevant to the tasked to be attended to by the

special committee to the appointed convener.

51.2- The special committee shall;

(a) Without the presence of any member of the Executive Committee, hold an

election to elect the Chair and Secretary to the special committee as the first

business of the first meeting.

(b) Accept the documents handed over to the convener by the Executive

Committee and familiarize itself with the contents.

(c) Formulate rules to enable it work optimally within the first three meetings.

(d) Hand over the minutes of the first meeting within to the Secretary General,


52- Dissolution of a Special Committee

52.1- The special committee shall be dissolved by the Executive Committee on grounds

that:

(a) Their assigned duties are completed within the specific time line or as

otherwise agreed, and documented, between the special committee and


(b) Documentation has been done to establish that the special committee has

violated the GUSA Constitution.

(c) Documentation has been done to establish that the special committee is not

capable of handling the matter(s) it was formulated for.

52.2- In the case that a special committee has been dissolved, the Secretary General to the

Executive Committee shall:

(a) Write a letter to the Dean of students detailing the reason for dissolution of the

special committee, and, attach all the paperwork submitted by the dissolved

special committee to the letter.

(b) Recommend a way forward following the dissolution.

(c) Through a brief notice, inform the GUSA members by posting on the

University notice boards.

(d) Serve the Secretary of the Special Committee in question with all the

paperwork relevant to the committee‘s dissolution.

52.3- Upon dissolution, the special committee has the right to file a case, against the

dissolution, with the Dean of Students upon which;

(a) The Dean of Students shall hear the case and recommend a way forward.

CHAPTER ELEVEN: [STANDING ORDERS]

53- Standing Orders

53.1- All meetings held by GUSA members shall be governed by these standing orders.

53.2- There shall be room for alteration of standing orders upon agreement by the persons

holding such a meeting.

53.3- Such standing orders must not contravene this Constitution or the Gretsa University

Statutes.

53.4- The following rules shall govern all the meetings held by GUSA members. In any

meeting, formal or a kamukunji, GUSA members shall;

(a) In All meetings, with the exception of a kamukunji, special committee,

commission, club or society meeting, be chaired by the senior most official.

(b) Conduct themselves in a manner that does not cause violence discrimination

or offence to other GUSA members.

(c) Each not take more than five minutes to express a point, unless otherwise

stipulated in this Constitution.

(d) Respect the Chair of such a meeting, and the standing orders governing such a

meeting regardless of their position in GUSA.

(e) Attend, or hold, a meeting consisting of other GUSA members to address

matters concerning GUSA only within Gretsa University.

(f) Deliberate on and formulate the standing orders that shall govern that meeting,

without contravening this Constitution.

CHAPTER TWELVE: [AMENDMENT OF THIS CONSTITUTION]

54- Amendment of this Constitution

54.1- An amendment to this constitution must follow the procedure outlined in herein and

otherwise would make such an amendment null and void.

54.2- Once an amendment is successful, the amended Constitution must be reprinted,

without change to any part, other than the amended part, and the GUSA members and

Dean of students notified of the change.

54.3- A change in a part of the constitution only affects the chapter(s), article(s) and/or

clause(s) amended and thus the rest of the constitution remains unchanged, as the

supreme law governing the Gretsa University Students Association.

54.4- This constitution only becomes null and void in the case that;

(a) A special committee is set up to review the constitution and,

(b) The special committee set up to review this Constitution changes more than

seventy percent of the chapters of this Constitution.

(c) For a special committee to be formed to review the Constitution;

(i) The Executive Committee must notify the GUSA members of the

intention to reviewing the Constitution.

(ii) The Executive Committee must collect handwritten names, registration

numbers, mobile phone number and signatures of at least two thirds of

the GUSA members.

(iii) The Dean of Students must then be notified and,

(iv) A special Constitution Review Committee can be formulated.

(d) The reviewed constitution is passed in a referendum where;

(i) At least two thirds of the GUSA members cast a vote.

(ii) A simple majority votes in favor or the proposed constitution.

55- Procedure for Amendment of this Constitution

55.1- This Constitution in part can be amended if;

(a) The promoter of the motion to amend requisitions support of the Executive

Committee by submitting Form 58.1(g)(1) and all other particulars.

(b) At least half of the GUSA members support the motion to amend a part of the

Constitution before the Executive Committee adopts the initiative.

(i) The promoter of the motion must collect handwritten names,

registration numbers, mobile phone number and signatures of at least

half of the GUSA members.

(c) The Dean of Students shall be notified of the intention to amend.

55.2- This Constitution in whole can only be amended after review by a Constitution

Review Committee formulated in accordance with Article 54.4(c).

55.3- There shall be a minimum requirement for at least two thirds of all GUSA members to

cast a vote if an amendment affects;

(a) The supremacy of this Constitution.

(b) The sovereignty of the members of GUSA.

(c) Change of the name of GUSA.

(d) Membership, Subscription and Suspension of membership.

(e) Public Finance.

(f) Term of office of constitutionally established bodies.

(g) The GUSA-EC.

(h) The review and amendment of more than seventy percent of the chapters of

this Constitution.

56- Schedules

56.1- This section shall contain all the letters of application, emblems of Gretsa University

Students Association, and forms needed for various functions with regard to the

GUSA.

56.2- For a member of GUSA to be appointed into a special committee, Executive

Committee or the Electoral Commission, they must fill the referenced form and

submit it to the Secretary General to the Executive Committee, and copy it to the

Dean of Students.

56.3- For a member(s) of GUSA to form a club or society, as enshrined in this constitution,

they must fill the form referenced in the relevant section, and submit it to the office of

the Secretary General, GUSA and copy it to the Dean of Students, Gretsa university.

56.4- For a member(s) of GUSA to exit office, once they have been appointed or elected

they must fill the form referenced in the relevant section, submit it to the office of the

Secretary General, GUSA and copy it to the Dean of Students, Gretsa University.

56.5- For a member(s) of GUSA to dissolve, suspend or take action against a body

enshrined in this constitution, in addition to following the stipulated procedure, they

must fill the form referenced in the relevant section, submit it to the office of the

Secretary General, GUSA and copy it to the Dean of Students, Gretsa University.

56.6- Fora member(s) of GUSA to instigate a motion to amend this constitution, in addition

to following the detailed procedure, they must fill the form referenced in the relevant

section, submit it to the office of the Secretary General, GUSA and copy it to the

Dean of Students, Gretsa University.

56.7- For any other purpose, other than the ones stipulated in article 56.1 to 56.6, a GUSA

member(s) wishing to perform a function must follow all the required processes in

this Constitution.

CHAPTER FOURTEEN: [GLOSSARY]

This section contains the definition of terms that may contain more than one meaning and

may not be clearly elaborated within the articles they is stated.

Academic Year - A period of one year consistent of two semesters conforming to

the Gretsa University academic calendar.

Amend - To make progressive changes.

Article - A section of this Constitution under a chapter, identified by a

positive integer.

Audit - To conduct an official financial inspection.

CA - Catholic Association

Calendar Year - A period of twelve months defined by the modern-day

Gregorian Calendar.

CU - Christian Union; Consistent of all religions and churches that

believe the Holy Christina Bible save for the Catholics.

Defendant - A person(s) accused of a violation of this Constitution or the

matters handled by this Constitution.

Deregister - To remove from an official list or directory.

(the)Elected - Can be used to refer to a person who has been elected to a

position.

Ex-officio - A person who had been, but is no longer a member of a club,

society or committee.

General Election - Elections that are held once each calendar year to elect

members of the Executive Committee.

International Student- A student registered at Gretsa University that is of a nationality

other than Kenyan.

Plaintiff - A person(s) who initiates a suit against another person(s).

Procure - To obtain something after due process.

Promoter - A GUSA member who is the initiator of a motion to

accomplish a specific goal.

Quorum - The minimum number of GUSA members needed for a

deliberative assembly.

Register - To enter (record) on an official list or directory.

Resolution - The process of solving a particular problem facing GUSA

members.

Signatory - A person(s) who has to sign for a process to occur.

Sovereignty - The full right and power to over itself without influence from

elements outside of it.

Term - A distinctive period as indicated in this Constitution, that

members of a body established by this Constitution must serve

and terminate service.
