Buying a brand-new condo o ers an
opportunity to get exactly what you
want. It can be a dream come true
and an investment for the future, but
dont forget, its a legal transaction.
The term get it in writing has never
been more important. Your contract
outlines everything your new home
will have in it and around it. Otherwise
known as the Agreement of Purchase
and Sale, the contract spells out
the terms between you and your
developer and/or builder. Without
it, if there is a misunderstanding or
disagreement, its impossible to prove
what was agreed upon.
Since building a home is much more
complicated than a resale transaction
where the home already exists, there
is no set Agreement of Purchase and
Sale or standard contract. Builders
often prepare their own agreements
so contracts can vary.
Before you sign a contract, review
it carefully and ask questions to
make sure you fully understand
it. Take it to a real estate lawyer.
Once it is signed, it becomes a legal
document, so seeking the services of
an experienced lawyer is an important
step toward ensuring that your dream
home becomes a reality.

Celebrating excellence at the annual BILD Awards

OUR INDUSTRY RECENTLY celebrated
the many city builders whose
projects, designs and campaigns are
not only providing new homes but
working to grow and improve our
communities in the GTA.
At the 36th annual BILD Awards, we
recognized 64 member companies
for their excellence in sales,
marketing, design and construction of
new homes and communities. Prizes
were handed out in 48 categories.
This years program featured many
new modernized categories that
refl ect todays GTA housing market
such as awards for innovation and the
inclusion of midrise developments
within several categories.
For Home Builder of the Year, our
most coveted prize which recognizes
the company that sets the standard for
the rest of the industry, we celebrated
two builders for the fi rst time ever.
In the GTA today, we are building
as many mid- and highrise homes
as lowrise homes due to provincial
intensifi cation policies, so it was
appropriate to recognize the leading
builders from both markets.
Great Gulf Homes won in the
lowrise category for its commitment
to exceptional architectural design
and building quality, considerable
philanthropic activities and customer
service excellence.
For its contribution to industry
innovation, exacting quality control
process and outstanding employee
engagement, Tridel was recognized
for the mid- and highrise market.
Tridel also won the inaugural award
for Best Customer Care and was
named Green Builder of the Year. In
2015, the company built 1,150 new
homes in more than 10 million sq. ft.
of LEED certifi ed buildings.
Best New Community Built,
another award introduced this
year, was presented to Hullmark
Developments and Tridel for Hullmark
Centre in North York. The only award
category that recognizes a fi nished
development, it honours the best
complete community that embodies
provincial smart growth principles.
Two outstanding new GTA
developments were crowned
Projects of the Year. This distinction
recognizes projects that best
combine excellence in design and
marketing while exemplifying quality
and innovation.
The uniquely designed mixed-
used condominium development
Art Shoppe Lofts + Condos by
Freed Developments and Capital
Developments won the Project of the
Year Mid/Highrise award. 35 Wabash
by Zinc Developments received top
honours for lowrise project. This was
one of three awards earned by the
modern townhome development.
Innovation was a major theme
at this years BILD Awards, with an
emphasis on recognizing architectural
design that is increasing housing
choices for entry-level consumers.
The award for Best Innovative Suite
Design went to Building Capital Inc.
for SmartStudios, a modestly priced
274-sq.-ft. condo showcasing multi-
purpose features within the University
Studios project in Oshawa.
Best Innovative Home Design
was awarded to Mason Homes for
the Oakwood, part of its Courtyard
Collection development in Port Hope.
The inventively designed model o ers
the fl exibility to be built as a detached
home, semi-detached home or a
townhome with a sale price starting at
just $387,900.

INVESTING IN A PRE-CONSTRUCTION
condo is not without risk. You are
e ectively buying a contract with the
hope that one day this contract will
become a piece of real estate that is
worth more than the price you are
paying for it today. A lot can happen
in those three to fi ve years while your
condo is being built. Here are two tips
to help ensure your investment is a
successful one.
1 | Always buy below market value
Your goal should always be to buy
something that will increase in value,
and the best way to do that is to
buy something that is priced below
the current market value of a similar
resale property. For example, if a
one-bedroom across the street in
a brand new completed building
sells at $300,000, and you can buy
a similar one-bedroom in a pre-
construction condo at $285,000,
then you are well insulated from any
market fl uctuations over the next few
years and you are positioned to have
a property that is worth more when
completed than when you bought it
before the shovels hit the ground.
2 | Always buy cash-fl ow positive
Investing in real estate is not a
get-rich-quick scheme, but it is
how most of the worlds wealthiest
people have earned their fortunes.

Flipping before project completion
(assignment) is a highly risky strategy
and should be considered only as a
back-up plan.
With this in mind, you should
only buy a pre-construction condo
that will provide you with positive
or break-even cash fl ow with the
standard 20- to 25-per-cent down
payment. If at the current valuation
and given current market rates for
rents, you cannot reasonably expect
to cover all your expenses, then
stay away!

THERES AN OLD JOKE that Toronto
has only two seasons winter and
construction. But as anyone travelling
along the Gardiner Expressway lately
(over the last two years or so), or
along the QEW to or from Hamilton,
or any number of other local
congestion points, can attest, tra c
in the GTA is anything but a laughing
matter.
Unfortunately, such is life in
the Big Smoke now and for the
foreseeable future. Once upon a
time, construction season may have
been only during the warmer weather
months. But those days are over. You
can now count on it almost being a
24/7, year-round endeavor.

immigration, general growth and

Population in the GTA continues
to increase by about 100,000 people
per year. Research suggests that by

IN EARLY MAY, I was part of a panel at
the Land & Development Conference
that discussed the ongoing evolution
of the condominium market. Leor
Margulies, moderator and top
development lawyer, had prepared
some tough questions for the fi ve
market experts.
I kicked o the session with a quick
presentation, noting that there were
62,000 condominium apartments
completed in Canada in 2015, a 33
per cent annual increase according to
CMHC. Condos accounted for over
36 per cent of total completions, the
highest share in over 25 years.
My next few slides concentrated
on the Greater Toronto Area (GTA)
highrise market. In Q1-2016, new-
condo sales jumped 37 per cent
annually, and unsold developer
inventory declined to its lowest level
since 2011. Resale condo transactions
increased 21 per cent year-over-year,
and the sales-to-listings ratio was at
its highest level since 2010, according
to market research fi rm Urbanation
Inc. First quarter resale prices
increased 8.4 per cent annually, while
rental rates for private landlord-held
condominiums appreciated by 6.8 per
cent over Q1-2015.
The numbers speak for themselves,
the market remains red hot. Margulies
asked about foreign investment in
pre-construction condominiums
and Tridels Jim Richie said less than
three per cent of their sales between
2005 and 2014 were to o shore
buyers, while 2015 was about fi ve per

cent. Developers take larger down
payments from international buyers,
and Tridel has never had one of these
purchasers fail to close on their unit.
On the tiresome question of short-
term condo speculators, Richie and
I agreed that there are very few of
these buyers; slower new-condo
price growth, plus transactions costs
have almost eliminated this buyer
group. Data from Urbanation Inc.
shows that the share of units traded
at newly completed and registered
condominium buildings shows a
decline in recent years, suggesting
the majority of investors are buying
to hold and rent their suites. Why
wouldnt they? The Toronto condo
rental market is extremely strong
the 6,136 units leased in Q1-2016
represented an annual increase of 25
per cent!
Mike Czestochowski of CBREs
Land Service Group noted that land
prices have shot up recently due
to increased competition, and it is
likely that those increases will be
passed on to new-condo buyers.
After a number of years of three- to
four-per-cent price growth in the
new-condominium market, the
expectation is that 2016 will see much
higher price increases.
The panel didnt seem too worried
about the condominium market in
Toronto in 2016. We expect further
population growth, strong activity
due to the improved jobs market, and
further demand for condos due to
the increasingly una ordable lowrise
housing market.
The standing-room-only discussion
shows there is still a keen interest
in the condominium market in the
GTA, and many of the leading experts
believe the market will remain stable

MENKES DEVELOPMENTS LTD., on
behalf of a partnership comprised
of Menkes, Greystone Managed
Investments Inc. and Triovest Realty
Advisors Inc., is planning to develop
a landmark mixed-use community in
the waterfront district of downtown
Toronto. The new community will
incorporate employment, retail and
residential uses anchored by a two-
acre public park.
The development site is an 11.5-acre
property, located at the northeast
corner of Queens Quay East and
Freeland Street, one block east of
Yonge Street. Currently the Liquor
Control Board of Ontario (LCBO)
occupies several buildings on the site,
including a retail store, o ce building
and warehouse.
The Menkes partnership signed an
agreement to purchase the property
from the Province of Ontario. They
were selected as the winner following
an open and competitive sale and
selection process.
The proposed development will
include a 24-storey, 600,000-sq.-
ft. o ce tower, 300,000 sq. ft. of
commercial retail space, a new
residential community and a two-
acre park located on the north side of
Queens Quay East, between Freeland
and Cooper Streets. The parks
northern boundary will incorporate
complementary retail spaces along
the future extension of Harbour
Street, which presently ends at Yonge
Street. The parks fi nal design will be
subject to a design competition.
LCBO will be a major tenant of
the proposed Class AAA o ce
tower located at 100 Queens Quay
East, occupying approximately
200,000 sq. ft. of the building. The
buildings ground fl oor will feature
a 25,000-sq.-ft. fl agship LCBO retail
store, replacing the current Queens
Quay store. The existing LCBO
warehouse will be moved o -site.

new condominium, there is a 10-day
cooling-o period that allows you to
back out of the deal a get-out-of-
jail-free card, if you will should you
change your mind. Lately, I have had
a large number of new-home buyers
come to me after the 10-day cooling-
o period for condominiums, or the
conditional periods in a freehold new
home o er, had expired. When I ask
them why they waited, I get one of
three standard responses:
1. I didnt think I needed a lawyer
until it was time to close.

A lawyer must advise you at the
time you make your o er to help you
avoid all of those tricky clauses where
builders look for extra money that
could end up costing you thousands
of extra dollars on closing. It is critical
that you see a lawyer before your deal
is fi rm. It is important that your lawyer
explains all the potential costs you
will face and the potential changes
and delays you may encounter. Insist
on this, and if you dont get what you
want or need, see another lawyer.
Once you understand these issues,
you can then return to the builder
and negotiate your purchase from
a position of knowledge. Lawyers
are service providers, and as the
customer, you need to make sure
you get the necessary information
to make an educated decision. A
home is one of the most important
purchases you will ever make, so do
your research.
You can only get this service from
a real-life, breathing, lawyer who
will point out the good and the bad
in your Agreement of Purchase and
Sale, and who is required by the Law
Society rules to explain title insurance
and by law, has the responsibility to
take care of you.
If a builder says he wont change
anything in the o er, it will have to
be the fairest o er ever written. Do
your due diligence and become an
educated consumer.

careful space planning and ingenious
multifunctional products, you can
have function and style in any square
footage.
TIP 1 | Start with a condo-sized sofa
The sofa is often a great place to start
when planning a small space,
as it usually takes up the most mass,
and it is also the easiest piece to
purchase incorrectly. A sofa that is
too large in a given space can feel
cumbersome. Conversely, a sofa that
is too small can feel like dollhouse
furniture. Luckily, many retailers make
it easier to make the right choice by
carrying apartment-sized, or condo-
appropriate pieces, which are often
smaller-scale translations of their
most popular lines. And of course,
many condo-sized sofas can also be
purchased with a sofa bed option to
give you the fl exibility of creating a
guest room in your small space.
TIP 2 | Use clear furniture
Whats great about furniture made out
of glass, or acrylic, is that it doesnt
take up much visual space. A ghost
chair or a waterfall table will give
you an instant modern update and
provide great function while keeping
the space feeling light. In condos that
have gorgeous large windows, place
pieces that are clear directly in front,
since they wont obstruct the view.

small, stackable, acrylic storage
compartments to divide my drawers.

maintenance fee, you get a lot! One of
the best things about living in a condo
is enjoying the beautiful amenity
spaces and knowing that the building
exterior and landscaping will be cared
for in the years to come, without
having to do any of the maintenance
yourself. It is all about carefree living,
and condominium buyers must look
at maintenance fees realistically. The
monthly payments you make are
necessary to ensuring that your quality
of life remains high, with exterior
and interior elements kept looking
beautiful and in good repair.
I always suggest that condominium
shoppers look at what they would
have to spend to receive the same
services in a lowrise home. Many
homeowners pay for a lawn service,
window cleaners, gardeners, snow
plow services and the like to help
with lowrise maintenance. The
maintenance fee covers these, plus
the care and upkeep of gorgeous
common areas, from hallways and
elevators to chic lobbies and rooftop
gardens.
Think, too, about the concierge
service. These professionals, who
are an integral part of the security
condominium residents enjoy, have
to be paid. If you add a security
system to your lowrise home, you
will incur a monthly payment. Some
condo maintenance fees even include
utilities such as hydro, gas and water
and again, in a lowrise home,

you would have to pay for those

Many condos today o er individual
hydro metering per suite, which is just
fi ne with most purchasers. Peoples
hydro use varies greatly. Some
residents are careful about shutting
o lights, avoiding using appliances
during peak hours and the like. Most
buyers are happy to pay for what they
use. They also appreciate the fact that
if they are away for weeks or months,
their hydro bills are very low. We are
even beginning to see separate water
meters. Of course, when this is the
case, the maintenance fees refl ect
that.
A portion of your condo fees
goes toward the reserve fund.
Administered by the condominium
board, this fund ensures that money is
there in the future should unexpected
problems arise after Tarions warranty
coverage is over.
It is all about looking at things fairly
and recognizing that maintenance
fees go a long way in protecting
your real estate investment. Oh, and
remember that even if your condo
includes an amenity space you think
you may not use (often the swimming
pool), remember that your guests
may enjoy using the pool, and having
it in the building might help with your
resale value in the future. You may
also discover that you do use the
amenity once you move in. Amenities
are extensions of your living space,
and todays common areas are
uncommonly beautiful and bright.
Your maintenance fees help to
free up time so you can use your
condo amenities more. Whether it
is soaking away the cares of the day
in the whirlpool, challenging
neighbours to a game of billiards,
hosting a large gathering in the party
room, barbecuing and dining al fresco
on the terrace, exercising or doing
yoga in the fi tness room or swimming
a few laps, it is worth the money to
have all of this under your roof. And
speaking of exercising, with a fi tness
area in the building, you avoid having
to pay a monthly fee to belong to an
outside gym.
When it comes to paying
condominium maintenance fees,
look at the big picture and youll fi nd
you will want to place yourself in it!
