    Mother Nature clearly is a tough nut. At time of writing mid-April, no less temperatures were only just now beginning to warm up in the GTA.

    Indeed, an unusually harsh winter has already delayed the start of the spring real estate season in some markets, while low inventory is leading to signi cant price increases in areas where supply isnt keeping pace with demand. Meanwhile, an improving economy in Ontario is leading to growing consumer con dence, creating a strong foundation for residential real estate growth.

    Spring cant come soon enough, in more ways than one.

    Also at press time the day before the Bank of Canadas April 15 interest rate announcement mortgage rates remain at historically low levels.

    Collectively, these conditions are producing a bit of a perfect storm of opportunity for homebuyers in Ontario.

    Theres just something about a new home

    Homeownership is a universal concept that symbolizes success and prosperity. Its one of the reasons up to 100,000 people choose to make the GTA their home every year.

    But theres a significant difference between buying new and buying resale, with new homes holding a number of advantages on several key fronts.

    First and foremost, new homes offer purchasers complete customization from a myriad of designs, patterns and finishes. Condo purchasers can choose how high up they want to live while those buying ground-related homes can even select the homes exterior.

    Things like flooring, cabinetry or countertops come in a variety of packages displayed in the sales centres, allowing purchasers to invest their money in whatever works best for them. Itll all be there for the day they move in.

    Another distinct advantage of buying is the fact that what you see is what you get. A new-home buyer doesnt have to worry about unwelcome surprises because the homes are built from the ground up, customized and are protected by a Tarion warranty.

    In most cases, issues get resolved, and builders large and small are getting better at responding to customer concerns.

    Still, there are unscrupulous or worse, illegal builders that try to circumvent everything from relatively minor registration fees to taxes, all under the guise of saving you money.

    But when theres a problem or issue that needs to be resolved, good luck.

    ats why its important to ensure your new home builder is registered with Tarion to provide the peace of mind that Tarion is backing the warranty, as well as to learn what parts of your new home are covered, for how long, and what the steps and procedures are.

    BECAUSE STUFF DOES, INDEED, HAPPEN.     While at ratehub.ca were in the business of comparing mortgage rates, we know theres more to consider than simply how the interest rate will affect your mortgage payment. Throughout the year, big banks and even smaller lenders will offer incredible promo-tional rates to bring in new clients, but many of those offers come with serious restrictions and penalties.

    Before you jump at the chance to snag the lowest rate, read the fine print in your agreement to see if your new mortgage product comes with any of the following:

    LOW PREPAYMENT PRIVILEGES. Most products give mortgage holders the option to increase their monthly mortgage payment amount once per year and/or make lump-sum payments throughout the year. While many lenders offer 20 per cent/20 per cent prepayment privileges (meaning you could increase your payment by 20 per cent each year and/or make a lump-sum payment of 20 per cent of your original mortgage), some promotional rates only offer 10 per cent/10 per cent. If your goal is to become mortgage debt-free fast, this may not be the right product for you.

    COLLATERAL CHARGE. If the lowest rate ends up being for a collateral mortgage, youll want to carefully consider how taking one on could affect your finances in the future. Collateral mortgages are readvanceable mortgage products that allow you to borrow money from your home at anytime, without having to refinance (and pay the legal fees to do so). Sounds great, right? Unfortunately, they also lock you into staying with that particular lender, even when your mortgage comes up for renewal. To get out of a collateral mortgage, you would need to hire a real estate lawyer (and pay legal fees).

    CLOSED MORTGAGE. While most mortgages in Canada are closed, some mortgage products restrictions are tougher than others. For example, the 1.99 per cent fixed-rate mortgage product one lender offered recently didnt allow borrowers to prepay, negotiate or refinance their mortgage throughout the three-year term. The only way to break your mortgage in that agreement was to sell your home. Again, if you are someone who wants to pay down your mortgage debt fast or may need to borrow from your home in the future, this may not be the best product for you.

    Of course, if your mortgage product comes with the lowest rate on the market and has few restrictions, you should jump at the chance to get it! But if you have any concerns about whats included in the mortgage agree-ment, dont be scared to shop around and f ind the right mortgage for you even if it doesnt come with the absolute lowest rate.

    Q I purchased a rental investment property several years ago. Every year I have filed the rental income on my tax return. I recently sold the property. In addition to my rental income, what tax implications will I have to report? Jared, Toronto

    AHopefully, you made a profit! The real estate market has been healthy for the past several years and continues to be strong, over the long term. Selling a real estate investment property will generate either a capital gain/loss or a recapture of income/terminal loss.

    You will have a capital gain when the proceeds of the sale exceed the original cost of the property. A capital gain must be included in your personal tax return (if you own it personally) and is taxed on 50 per cent of the gains at your personal tax rate. A capital loss occurs when the cost is greater than your proceeds. The capital losses should be included on your personal return and applied against capital gains in that year. Any excess losses can be carried back three years, or carried forward indefinitely to reduce capital gains.

    In calculating the capital gain/loss, determining the adjusted cost of the property is an essential factor. The adjusted cost must include not just the purchase price but also other costs incurred that had to be capitalized. As well, the proceeds of disposition are all the cost, including the selling price and adjustments pertaining to the sale of the investment.

    In addition to the capital gains/losses, you may have a recapture of income. This occurs when you are taking Capital Cost allowance (depreciation) on the building, in any

    of the years that it was owned by you. The balance in this account is called the undepreciated portion.

    A recapture of income occurs when the lesser of the proceeds and the cost of the property is higher than the Undepreciated Capital Cost (UCC). The recapture of income is taxed in its entirety at your personal tax rate. Alternatively, a terminal loss occurs when the lesser of the proceeds and the cost of the property is less than the UCC. This terminal loss can be applied in the current year to reduce other income (such as salaries or business income). Any unused amounts can be carried back three years or carried forward.

    Good record keeping is essential to calculate the correct gains or losses.

    If youre planning to buy a home this year with less than 10 per cent down, you can also plan for higher mortgage costs as of June 1, 2015. Canada Mortgage and Housing Corp. (CMHC) and Genworth Canada have announced that they are raising their mortgage insurance premiums by 15 per cent. CMHC increased its target capital requirements in mid-2014.

    The move isnt expected to have a big impact on homebuyers pocketbooks or Canadas housing markets, CMHC says. The higher premium would amount to an additional $5 per month for the typical borrower with a 95-per-cent loan-to-value ratio on a mortgage of $252,530. However, in Canadas pricier markets, those monthly mortgage costs will inevitably be higher. In addition, the looming rise in mortgage costs could also signal a busier-than-normal spring real estate market, as homebuyers try to beat the clock on the May 31 deadline.

    The increase in mortgage insurance premiums reflects concerns that Canadians are overextending their budgets by taking on more home than they can afford, leaving them in a tight spot when interest rates rise or at the slightest economic turn.

    Experts advise that homebuyers plan ahead, save their money and put down as much as possible, to avoid taking out a high-ratio mortgage. Homebuyers unable to save up this often hefty amount can still buy a home with a down payment of less than 20 per cent, but federally regulated lenders require mortgage loan insurance, which covers them in case of payment default. The lender is responsible for the premiums and passes those costs on to the homebuyer in the form of a lump-sum payment, or more commonly, higher monthly payments.

    CMHC is Canadas largest insurer of residential mortgages.

    Existing mortgages, high-ratio mortgages with more than a 10-per-cent down payment, and mortgages on multi-unit properties will not be affected by the premium increase.

    5 tips to make moving cleaner and Greener

    Protecting the environment is an important concern for consumers and businesses alike, but many dont realize that moving can have a positive impact on the environment.

    Waste caused by the moving process not only stems from packing supplies, but also from the waste accumulated over many years within a home or o ce. Both sources can be extremely taxing on the environment if not properly managed.

    So, here are some suggestions on how to make your move a cleaner, greener process.

    1. PLAN AHEAD:Waiting until the last minute to prepare for a move often makes environmental concerns an afterthought. Start early so you have the extra time to sort through recyclable items in the garage, kitchen and basement for delivery to recycling depots prior to moving day. Typically your garage, basement and attic contain the highest concentration of recyclable waste so start the sorting process there rst. Consider holding a garage sale or donating gently used tools or small appliances to a charity rather than have them end up in a land ll site.

    2. RESEARCH: Survey local recycling options to nd the most convenient solution for recyclables. Many cities o er curb-side pick-up or sort and drop depots. Visit earth911.com for a list of local organizations that can dispose of all types of recyclable materials.

    3. ORGANIZE: Prepare recyclables by organizing into categories: plastic, glass, aluminum, paper, cardboard, etc. Look up the requirements of the local recycler to see if there are any additional steps needed to prepare recyclables beforehand.

    4. CARE FOR HAZARDOUS MATERIAL: As you clean out your garage and basement in preparation to move, be conscientious about the kinds of materials being packed to move with you and which items are to be disposed. Toxic items, such as paint, batteries, house cleaning products, automobile oils, pesticides and fertilizers are dangerous and cannot be transported in the back of a commercial moving truck. Also consider these items cannot be thrown-out with your regular garbage. Look up the specialized recycling depots for toxic products in your city.

    5. REUSE:Do not throw away used boxes when the move is complete. A well-made corrugated box is great for storage or may be reused for a future move. Contact local schools or charity organizations, such as womens shelters, scout troops, and food banks to ask if they need boxes to redistribute donated items. Donating gently used boxes not only reduces waste, but can be a big help in support of a good cause.

    Seasonal switch-up: Make way for spring!

    At first, you were afraid to put away the winter gear because it was impossible to believe that unrelenting, snow-filled season was really over. But as spring slowly slides into place, youre finding spring jackets and raincoats being layered on hangers atop winter jackets. The hall closet is bursting at the seams trying to contain the collection of everything from mitts and snow boots to umbrellas to Wellies. Its time for the seasonal switch-up. Make some space for your spring and summer, and dont give Jack Frost another thought.

    MAKE ROOM FOR SPRINGIts that wonderful time of year again when we can put away the winter gear and lighten the load. Although theres never enough storage space, there are creative ways to better utilize existing spaces when storing out-of-season items.

    Try adding another shelf above the existing one in all the closets, and purchase under-the-bed organizers. If your bed is not high enough, you can get a bed riser to lift it. Consider creating a document on your computer that serves as an index to outline where youve stored what. When winter arrives again, you wont have to rely on your memory to find what you need.

    HOW LONG HAVE YOU BEEN PUTTING OFF THAT RUMMAGE SALE? Have you been saving items for years with the intention of selling them, but never seem to get around to it? Pull out your calendar today and book a definite date to have your sale this spring. Blocking the time now increases the likelihood of following through with it later.

    Another option is to forgo the big sell-off entirely and donate these items instead. It takes several days to orchestrate a successful sale, so determine whether the money youll make is worth the time and energy it will take. After all, you can always get more money but you can never replace lost time.

    JUMP-START YOUR SPRING CLEANING WITH BABY STEPSIf you dont know where to begin when it comes to spring-cleaning your home, start small. Pick just one room. Moving

    clockwise, remove anything that doesnt belong in that room and place it in a move elsewhere box to deliver to the room it should live in. Pull out anything that doesnt give you joy or value and place it in a giveaway box. Toss or recycle any papers and garbage that are left over. Designate this room as a no-clutter zone so you will always have a sanctuary to escape to, regardless of what the rest of the house looks like. HAVE YOU STORED YOUR PARK A?If youve been putting off the task of storing your winter coats because you dont have an extra closet, theres a solution. A sturdy, rolling garment rack makes an ideal spot to store winter coats during the summer.

    Be sure to dry-clean all items before storing, even if they look clean. Body oils and not-yet-visible food stains attract moths especially on wool coats. Cover the clothes with a clean, cotton bed sheet or use a zippered canvas wardrobe cover specifically designed for this purpose to keep your clothes dust-free. If you dont have room for a garment rack, store seasonal items in large garment bags, suitcases or under-bed storage bins.

    Title insurance: What is it, and why do you need it?

    Title insurance is supposed to provide comprehensive insurance coverage for certain title-related risks associated with home buying such as zoning issues, claims of mental incapacity, lack of up-to-date survey and the legal services provided by your lawyer (such as title certification). It insures against such defects in title, which may occur from conflicting ownership claims, liens, undischarged mortgages, consents and the like. It will cover compliance and access issues such as work orders, permit violations, fences, boundaries, tenancies and rights of way. It is supposed to be in force so long as the purchaser or his heirs own the property. Title insurance will outlive the certification of your lawyer, whose insurance stops if he or she dies or ceases to practice law.

    Okay, what if something is wrong and a prospective purchaser will not accept a new title insurance policy at no cost? The insurer will pay out in accordance with the policy, or will, if possible, repair the defect. Title insurance protects from vendors that wont re-adjust or misrepresent things such as the real estate taxes paid. In addition, lawyers insurance is time of incident related, which means in simple English that if your lawyer is dead, retired or stops practice and you make a claim after that, you are not covered.

    Title insurance saves you money. Disbursements money paid to third parties for items such as building compliance letters, subdivision compliance letters and deed registration are lower. We estimate $200 to $300 on a deal after the cost of the policy.

    Almost all of Ontario is now on an electronic registry system. Title insurance has become the norm and many of the transactions are done by computer communications. Make sure the lawyer you select has taken the title insurance courses, has gone to the seminars on Terranet, the electronic registry system, and can properly advise you. The Law Society passed a rule that every lawyer on a residential real estate deal must advise the client of title insurance, the different companies offering it, and how it works. Remember, a lawyer survives by repeat business and referrals, and a lawyers mandate from the Law Society is that the clients best interests must come first.

    We have all read and heard about mortgage and title fraud, where unscrupulous people put fake mortgages on properties or sell houses they do not own. Title insurance indemnifies you against these occurrences.

    To summarize, title insurance does four things better than lawyers insurance through Law Pro (the Law Societys insurance arm): gives better coverage as to the quality of your ownership than a lawyers insurance;

    lasts forever when lawyers dont; saves $300 to $400 in disbursements; protects from mortgage and title fraud.

    Every lawyer has an obligation to make you aware of your title insurance options, so you can choose which way you want to go. Think through your options carefully and choose wisely.
