PART ONE – ELECTION PROCEDURES

This Guide has been produced to assist in the understanding of theElection Act as it applies to candidates. To ensure compliance with thelegislation, please refer to the Election Act.

AbbreviationsIn order to reduce the size of entries, especially with respect to crossreferences to the Election Act, the following abbreviations will be usedthroughout this guide:

Chief Electoral Officer CEOReturning Officer RORegistration Officer RGODeputy Returning Officer DROSection of the Election Act sec.

DefinitionsSection (sec.) 1 of the Election Act defines important terms usedthroughout the election process. This section should be consulted todetermine the specific definition of a word or phrase used in the statute.

Writ of ElectionEach election is officially commenced by the passing of an Order inCouncil and the issue of a Writ of Election by the CEO to each RO.

The election period is a total of 28 days after the date of the Writ ofElection. Nomination day is the 14th day after the date of the Writ ofElection and polling day is the 14th day after nomination day. (sec. 39)

Election ProclamationThe Proclamation contains the following information:

• the place, dates and times fixed for revisions to the Lists of Electors

• the place and times fixed for nomination of candidates, and the datefixed for the closing of nominations

• the locations, dates and times for voting at the advance polls

• the date and times for voting

• the place, date and time for the announcement of the official results

• the name, address and phone number of the RO

As soon as possible following the date of the Writ of Election, each ROwill publish the information on the Proclamation and a map of theelectoral division, including the polling subdivisions. This information willbe published in one or more newspapers of general circulation in eachelectoral division. (sec. 55)

Lists of ElectorsCopies of the Lists of Electors and polling subdivision maps will beprovided by the CEO to each registered party to meet party, constituencyassociation and candidate requirements. (sec. 18)

The same material will be provided by the RO to independentcandidates when the Candidate Nomination Paper is filed. (sec. 63)

Revisions to the Lists of ElectorsThe RO will accept revisions to the Lists of Electors commencing on the5th day after the date of the Writ of Election and continuing each day,except Sundays and holidays, until 4:00 p.m. on Saturday of the weekpreceding the opening of the advance polls. (sec. 50)

Revisions will also be made by electors who have registered online usingVoterlink (www.voterlink.ab.ca).

The revisions will include names of electors who:

• were not included on the List of Electors,

• moved since the List of Electors was prepared, or

• recently became eligible electors.

Lists of Electors and a separate list of additions are available forexamination in the office of the RO following the date of the Writ ofElection. A candidate or official agent may view the List of Electors, ormay request a copy of the Additions to the List of Electors, aftercompleting a declaration. (sec. 51)

Candidates and their campaign staff should encourage persons who areeligible to vote but whose names are not on the List of Electors, tocontact their RO during the revision period so that their names will beincluded on the List of Electors for polling day. This will reducecongestion at the polls by eliminating the need for electors to take adeclaration and produce identification to the DRO or RGO.

ElectorsAn elector is a person who is a Canadian citizen, is 18 years of age orolder and has been ordinarily resident in Alberta for the immediatelypreceding six months. (sec. 1)

Persons Not Eligible to VoteCandidates or persons who have been convicted of a corrupt practiceare ineligible to vote. (secs. 178, 181)

Candidate QualificationsTo qualify for nomination, a candidate must be an elector who is notprohibited from being nominated (sec. 56) and is not disqualified as acandidate in accordance with any other Act. A person does not have tobe ordinarily resident in an electoral division in order to be a candidatein that electoral division.

A candidate must file an Application for Registration of Candidate withElections Alberta to be eligible to be nominated as a candidate.Additional information is available in “A Guide to the Election Financesand Contributions Disclosure Act for Political Parties, ConstituencyAssociations and Candidates”. By legislation, the RO cannot accept aCandidate Nomination Paper before the Application for Registrationof Candidate has been filed with Elections Alberta.

After the Writ of Election is issued and the candidate has registeredunder the Election Finances and Contributions Disclosure Act by filing anApplication for Registration of Candidate, he or she may begin to collectand spend funds on a campaign.

Prospective candidates should consult all applicable Acts in conjunctionwith the Election Act to verify their status prior to completing therequired declaration on their Candidate Nomination Paper. (secs. 56,178, 181)

Candidate’s Official AgentEach candidate is required to appoint an elector as an official agent. Thename, address and telephone number of the appointee must be on theCandidate Nomination Paper and will be published by the RO in anewspaper of general circulation.

The official agent shall not perform the duties of the chief financialofficer unless so appointed. Persons appointed as official agents must beelectors, but need not be ordinarily resident in the electoral divisionwhere their candidate is seeking office. The official agent must consent tothe appointment by signing the appropriate section of the CandidateNomination Paper.

If a change in appointment is made, the candidate shall immediatelynotify the RO in writing of the name, address and telephone number ofthe new official agent. (sec. 60)

A candidate cannot act as an official agent.

Candidate’s NominationThe Candidate Nomination Paper must be filed with the RO, duringoffice hours, after the Election Proclamation is published and before2:00 p.m. of the day fixed for the closing of nominations (nominationday). A candidate must attach a Candidate Nomination EndorsementCertificate signed by a designated representative of the registeredparty unless the candidate is running as an independent. All formsmust bear original signatures; faxed or photocopied signatures willnot be accepted.

The names and signatures of a minimum of 25 qualified electors fromthe electoral division in which the candidate seeks to be nominated arerequired on the Candidate Nomination Paper. Candidates areencouraged to collect more than 25 signatures to ensure the validityof the Candidate Nomination Paper should any signatures belong to

unqualified electors. The nominators’ signatures must be witnessed byan elector. The witness(es) must complete the required oath. A candidatewill require one form for each witness. (secs. 59, 61)

Candidate’s Nomination DepositThe RO will provide the candidate with a receipt for the $500nomination deposit. The receipt constitutes formal acceptance of theCandidate Nomination Paper by the RO. The candidate’s deposit shallbe cash, a certified cheque and/or a bank or postal money order. Thisdeposit will be refunded to the chief financial officer if a financialstatement is filed within four months after polling day (the time periodprescribed by sec. 43(2) of the Election Finances and ContributionsDisclosure Act). (secs. 61, 62)

Material Provided To The CandidateThe RO, on filing of the Candidate Nomination Paper, shall provide thecandidate with:

• a copy of the Proclamation,

• a list of polling place locations,

• Guides for Scrutineers, containing Appointment of Scrutineer forms,

• Campaign worker identification cards, and

• Campaign worker access procedure information.

For an independent candidate, the RO will, in addition, provide:

• a polling subdivision map of the electoral division, and

• one printed and/or one electronic copy of the List of Electors for theelectoral division. (sec. 63)

BallotsCandidates’ names will be listed on the ballots in alphabetical order bysurname. A candidate may include a given name, a middle name, anickname and/or initials, in addition to his or her surname. No titles,degrees, prefixes or suffixes may be included. The CEO may disallow theuse of a nickname that is not generally used by the candidate or that isunacceptable for any other reason. The name of the registered political

party, in the form requested by the political party, will appearimmediately below the name of the endorsed candidate. For a candidatewho has not been endorsed by a registered political party, the wordINDEPENDENT will be printed beneath the candidate’s name. (sec. 83)

ScrutineersA candidate may have scrutineers in attendance at polling stations andRGO’s stations to observe election procedures. Scrutineers must beappointed in writing by the candidate and must be resident electors inthe electoral division. However, if the candidate is unable to appoint aresident elector, he or she may appoint an elector from outside theelectoral division to serve as a scrutineer.

Up to four scrutineers may be appointed per polling station and RGO’sstation. Not more than one scrutineer per candidate per polling stationor RGO’s station may be present at any one time. A scrutineer may beappointed to more than one polling station or RGO’s station. Scrutineersshall take the Oath of Secrecy at each polling station or RGO’s stationbefore performing their duties.

Scrutineers may represent the candidate at each polling station duringthe unofficial count after the polling station is closed.

All scrutineers should be familiar with the contents of “A Guide forScrutineers” which is available from the RO and political party. (secs. 79,92, 93)

PollsThere are four types of polls used to conduct voting in each electoraldivision:

• Special Ballot Poll

Commencing with the Writ of Election, a Special Ballot may be usedby electors who are unable to vote at an advance poll or on pollingday due to:

a) physical incapacity,

b) absence from the electoral division,

c) being an inmate,

d) being an election officer,

e) being a candidate, official agent or scrutineer,

f) being a resident of a designated remote area, or

g) for a reason specified by the CEO.

Electors must apply directly to the RO for the ballot. The RO will normallysend the ballot by Xpresspost mail, unless the elector makes otherarrangements. The elector is responsible for the return of the ballot. TheRO must receive the completed ballot and documentation prior to theclose of polls on polling day.

This Special Ballot poll is administered by the office of the RO. (secs.116-119)

• Advance Poll

ROs must establish a minimum of one and generally not more than fouradvance polling places. These polls will allow electors to vote in advanceof polling day. The normal voting procedure is followed.

Advance polls will be open from 9:00 a.m. to 8:00 p.m. on theThursday, Friday and Saturday prior to polling day. The dates andlocations will be published by the RO in the Proclamation.

• Mobile Poll

ROs may establish one or more polling stations in treatment centres andsupportive living facilities, including seniors’ lodges, which have 10 ormore in-patient or resident electors. The hours of conducting mobile pollvoting on polling day are set by the RO in consultation with the treatmentcentre and supportive living facility representatives. Treatment centre staffmay limit the persons allowed to be present at a mobile poll to the DRO,poll clerk, interpreter and a treatment centre staff member.

Electors in treatment centres will not appear on the List of Electors andmust complete a Mobile Poll Oath prior to voting. Electors who are in-patients at a treatment centre on polling day, and who have not already

voted at the advance poll or by Special Ballot, are deemed to beordinarily resident in the electoral division where the treatment centre islocated. (secs. 120-125)

Electors in supportive living facilities must appear on the List of Electorsor complete the Mobile Poll Oath prior to voting. Electors who areresident in a supportive living facility on polling day and who have notalready voted at the advance poll or by Special Ballot, are deemed to beordinarily resident in the electoral division where the supportive livingfacility is located. (secs.120-125)

• Polling Day Polls

Polling hours are 9:00 a.m. to 8:00 p.m., on the date published in theProclamation. The location of each polling place will be advertised inone or more newspaper(s) of general circulation within the electoraldivision when the Proclamation is published, and again during the lastweek of the election period.

Normally, one polling station will be established for each pollingsubdivision. Several polling stations may be located at one polling place.(secs. 52, 53, 54)

The Election Act permits a candidate to briefly visit polling places duringpolling hours, but campaigning is prohibited. Students and members ofthe media are also permitted to briefly visit, within guidelines. (sec. 92)

Cell phone calls are prohibited within a polling place to avoid disruptions.

The votes cast at all types of polls are counted after the close of polls onpolling day.

Employees’ Time for VotingAn employee who is eligible to vote must be allowed three consecutivehours during the time polls are open for the purpose of casting a balloton polling day. (sec. 132)

Spoiled BallotsIf a voter mistakenly marks the ballot, another ballot may be obtainedfrom the DRO upon returning the spoiled ballot. (sec. 102)

Voter AssistanceThe DRO may appoint an interpreter to translate questions and answersconcerning voting procedures for persons not conversant in the Englishlanguage. An interpreter must take the applicable oath. (sec. 78)

Assistance in marking a ballot may be provided by a friend or an electionofficer at the request of the voter, if the voter is unable to vote in the usualmanner due to a physical incapacity or inability to read the ballot.

If the voter requests assistance from a friend, both must take theappropriate oath before the friend accompanies the voter into a pollingbooth to assist in marking the ballot, as directed by the voter.

If the voter requests assistance from an election officer, the DROaccompanies the voter into the polling booth and, in the presence of thepoll clerk, assists in marking the ballot as directed by the voter.

In each case, the voter or the person assisting the voter returns themarked ballot for removal of the counterfoil before it is deposited intothe ballot box by the voter, or the election officer, upon request.

A blind voter may use the Blind Voter Template to vote if the voter doesnot wish to be assisted by a friend or election officer. (sec. 96)

Unofficial CountThe unofficial count of ballots is conducted for all polling stationsimmediately following the close of polls on polling day.

The procedures involved in the unofficial count are detailed in secs. 111and 112. Each candidate, official agent and/or one of their scrutineersmay attend the count. Disputes on ballots will be recorded and decidedby the DRO.

The DRO will provide one copy of the Statement of Poll to the candidateor the official agent or the scrutineer, provided that one of them ispresent at the conclusion of the unofficial count. (sec. 112)

Official CountThe official count must be completed by the RO not later than the10th day after polling day.

Each candidate or official agent will receive written notice from the ROconcerning the place, date and hours for conducting the official count ofthe ballots from each polling station. The candidate, official agentand/or electors of the electoral division appointed, in writing, by thecandidate, may be present at the official count.

Disputes on ballots will be recorded and decided by the RO. The RO willprovide each candidate or the official agent with a completed ReturningOfficer’s Certificate and Return, indicating the number of votes countedfor each candidate and the name of the candidate declared elected atthe conclusion of the official count. (secs. 136-138)

Campaign Printing and AdvertisingSubject to sec. 134, every printed or electronic election advertisementshall include the name and telephone number of the sponsor, and shallindicate that the sponsor authorizes the advertisement.

There is a prohibition against distributing election material within thepolling place or displaying election or other advertising material withinor on the outside of a building used as a polling place, except thoseposted by election officers as required by the Election Act. (sec. 135)

Candidates should check municipal or local by-laws concerningprohibitions against posting election campaign material.

SurveysPublished surveys must include detailed information including the results,sponsor, sample size and margin of error. Additional requirementsappear in the Election Act. (sec.135.1)

AppealsA candidate or official agent may appeal any decision of the ROconcerning a ballot or may appeal to the Court for a recount orretabulation of the votes. The application must be made not later than 8days after the announcement of the official count. (secs. 144-148)

• Independent candidates may obtain an information package from theRO that includes the Application form and other related information

• Must be filed with the Office of the CEO before you can file yourCandidate Nomination Paper with the RO

• The application must be accurately and fully completed and mustcontain the appropriate signatures, that is:• the chief financial officer must consent to the appointment in writing• a principal officer of the registered party or constituency associationmust endorse the registration; and

• the candidate must confirm his/her eligibility to be a candidate bysigning the form

• A candidate cannot be a chief financial officer for any campaignincluding his or her own

• Should any of the information required on the Application formchange, the Office of the CEO must be notified within thirty (30) daysof the change
