    Guidelines for “Soura Bhoomi Yojane”

    1. Introduction

    The Ministry of New and Renewable Energy (MNRE), Government of India, has issued

    guidelines for setting up decentralised ground mounted grid connected renewable power

    plants under Component-A of PM-KUSUM (Pradhan Mantri Kisan Urja Suraksha evam

    Uththan Mahabhiyaan) scheme and further allocated 11 MW to BESCOM under this

    Component for pilot implementation.

    The “Soura Bhoomi Yojane” initiated by BESCOM aligns with the operational guidelines

    notified for PM-KUSUM scheme by MNRE vide Office Memorandum dated 22.07.2019.

    Under this scheme, landowners can set up either 500 kW or 1 MW capacity grid connected

    ground mounted solar photovoltaic (PV) power plants within 5 km radius of notified

    substations for interconnection with the grid. Brief guidelines for expression of interest from

    landowners along with the list of sub-stations for connecting these individual solar PV plants

    under the scheme was notified vide Ref No.: BESCOM/BC-51/KUSUM/001/2020-21 dated

    17th July 2020.

    This document further elaborates the mechanism of implementation, solicitation and

    participation from key stakeholders at various stages under the scheme. The eligibility and

    qualification criteria required for participation along with roles and responsibilities of key

    stakeholders are also outlined in this document. All the interested parties need to adhere to

    these guidelines.

    Interpretation of the Guidelines

    In case of any ambiguity in the interpretation of any of the provisions of these guidelines,

    the decision of BESCOM shall be final. These guidelines would be reviewed by BESCOM from

    time to time and necessary amendments, if any, will be notified for the benefit of all

    stakeholders.

    2. Implementation mechanism

    Individual farmers/ Group of farmers/ Cooperative Societies/ Panchayats/ Farmer Producer

    Organizations (FPO)/ Water User Associations (WUA) all of whom can be collectively

    referred as landowners hereinafter, can collaborate with EPC contractors / System

    Integrators / Developers to set up 500 kW or 1 MW capacity grid connected ground

    mounted solar PV power plants on barren / uncultivable lands located within 5 km radius of

    the substations notified by BESCOM. Interested landowners can participate either through

    their own investment or lease mode.

    Own investment mode: Landowners can invest in solar PV power plants by arranging own

    funds, collaborate with empanelled EPC contractors/System Integrators for setting up grid

    connected ground mounted solar PV power plant on turnkey basis, operate & maintain the

    plant during the PPA tenure. BESCOM will enter into power purchase agreement (PPA) with

    landowners for a period of 25 years at predetermined terms & conditions. A model power

    purchase agreement notified by MNRE is annexed for the benefit of all stakeholders.

    Lease mode: Landowners unable to arrange own funds for setting up solar PV power plants

    can lease their land parcels to developers, who will in turn set up, own, operate and

    maintain the plant. BESCOM will sign PPA with the developer for purchase of power at

    predetermined terms & conditions. The landowner will get lease rent as mutually agreed

    between the parties. The lease rent may be in terms of Rs per year per acre of land or in

    terms of Rs per unit energy generated per acre of land area. A model land lease agreement

    notified by MNRE is annexed for the benefit of all stakeholders. However, the concerned

    parties (i.e. landowner and developer) are free to formulate and negotiate their own terms

    of the land lease agreement. BESCOM will not be party to the land lease agreement.

    2.1. Online registration of landowners

    BESCOM will invite expression of interest online from eligible Landowners for setting up of

    grid connected ground mounted solar PV power plants. The online application / registration

    window on BESCOM’s portal will be available from 21st September 2020 till 7th October

    2020.

    The landowner shall pay the application registration & processing fee of Rs.500/- + GST, at

    the time of online registration. Application registration number will be sent to the registered

    mobile number for future correspondences.

    The landowner will indicate preferable mode of participation (own investment or lease)

    along with nearest substation for interconnection during the registration of application.

    However, this does not restrict the landowners to change their preference to own

    investment or lease at a later stage of capacity allocation through reverse bidding.

    The Landowners shall mandatorily upload relevant documentary evidence while submitting

    online applications for expression of interest. BESCOM will verify the documentary evidence

    of land holding submitted and notify their details on its website with information such as

    name of the landowner, address, contact details, available land area in acres, distance from

    notified substation, preferred mode of development (own or lease) etc. subject to technical

    feasibility for interconnection at the preferred substations. BESCOM will conduct this

    technical feasibility evaluation in a transparent manner and inform all the stakeholders in

    advance before notification of the final shortlist of eligible landowners. Only the notified list

    of landowners will be allowed to participate in collaboration with BESCOM empanelled EPC

    contractors/System Integrators/Developers under own/lease basis for capacity allocation

    during the reverse bidding stage.

    The Landowners can apply / express interest for any one of the notified substation only. If

    more than one application from the same applicant/landowner is registered, only one

    application with the least area of land proposed will be considered for eligibility.

    Shall be located within five km (5 km) radius from the notified sub-station

    2.2. Empanelment of qualified EPC contractors/System Integrators/Developers

    BESCOM, in parallel, will invite qualified EPC contractors/System Integrators/Developers for

    empanelment under the scheme. The EPC contractors/System Integrators/Developers shall

    submit their empanelment application along with the documents to the office of the

    General Manager (DSM), BESCOM, Corporate Office, K.R.Circle, Bengaluru as per the

    notification.

    The Agency/firm shall pay the empanelment fee of Rs.5000/-, at the time of submission of

    documents.

    Qualification criteria for Empanelment of EPC contractors/System Integrators:

    The Agency/Firm should not have been defaulted against any Work/Service against any of the previous Orders placed by any State / Central Government/Public sector undertakings/ Private Sector as on the date of submission of documents

    B. Financial Criteria:

    BESCOM will notify/update the list of empanelled EPC contractors/System

    Integrators/Developers details, in its website along with information such as Name of the

    Company, Address, Contact details, etc. so as to enable shortlisted Landowners to

    collaborate for investment under own/lease basis for setting up of grid connected ground

    mounted solar based power plants.

    2.3. Capacity allocation through reverse bidding

    BESCOM will invite bids from shortlisted landowners through the GoK e-Procurement portal.

    The request for proposal with terms & conditions for reverse bidding will be notified by

    BESCOM in the due course of time.

    The eligible landowners preferring own investment mode should participate in the reverse

    bidding process in collaboration / jointly with BESCOM empanelled EPC contractors / System

    Integrators. Whereas, BESCOM empanelled developers should participate in the reverse

    bidding process under the lease mode.

    Empanelled EPC contractor / System Integrator should not collaborate with more than one

    landowner registered under the same substation at the time of reverse bidding. However,

    empanelled EPC contractor / System Integrator can collaborate with multiple different

    landowners registered under different substations for capacity allocation. The bids will be

    subject to disqualification, if it is found that the proprietor/partner/director/member of any

    EPC contractor/System Integrator has collaborated with different shortlisted landowners

    registered under the same substation.

    Similarly, the empanelled developers under lease mode shall be restricted to submit only

    one bid per sub-station under the scheme. The bids will be subject to disqualification, if it is

    found that its proprietor/partner/director/member has submitted multiple bids with

    different shortlisted landowners for the same sub-station.

    During the reverse bidding process, all the qualified bidders tagged to their respective

    substations will submit the best tariff proposals for the quoted capacity. After completing

    the reverse bidding process, the entire list of bidders tagged to their substations and quoted

    capacity will be arranged in the ascending order basis their tariff proposal in the reverse

    bidding process.

    If the aggregate capacity offered by bidders who fulfil the technical and financial

    qualification criteria is less than or equal to 11 MW, LoA will be issued to all the eligible

    bidders whose quoted tariff is less than or equal to tariff determined by Hon’ble KERC.

    If the aggregate capacity offered by bidders who fulfil the technical and financial

    qualification criteria is more than 11 MW, reverse bidding process will be initiated to arrive

    at the lowest tariff against the base tariff as determined by Hon’ble KERC.

    Capacity allocation of units will consider the lowest tariff proposal among all the

    substations. However, for any single substation, capacity allocation cannot be more than 1

    MW. If two or more bidders quote same tariff (compared with two decimals) during the

    reverse bidding either for the same substation or different substations, the date and time of

    online registration for eligibility of landowners will be considered for allocation (First come

    first serve basis).

    BESCOM will have discretion powers to achieve the lowest cost of power purchase in the

    capacity allocation of Units (500kW as One (1) unit and 1MW as Two (2) units).

    A sample capacity allocation matrix is illustrated in the table below for benefit of all

    stakeholders.

    2.4. Project execution

    1) LOA issuance

    Letter of Award (LoA) will be issued to all successful bidders, hereinafter referred as

    Solar Power Generator (SPG) subject to technical feasibility and for total capacity of

    11MW.

    2) PPA signing

    The successful SPG within two months of the date of issue of LOA by BESCOM, will

    enter into Power Purchase Agreement (PPA). PPA will be executed for a period of 25

    years from the date of Commercial Operation date (COD).

    BESCOM will be obliged to buy the entire power from SPG within the contract

    capacity. However, the SPG is required to achieve a minimum Capacity Utilization

    Factor (CUF) of 19% on annual basis during the PPA period. However, in case of low

    Solar radiation zones, minimum CUF can be revised by BESCOM. The SPG will be free

    to operate the plant after expiry of the 25 years of PPA period if other conditions like

    land lease, etc., permits.

    3) PBG submission

    SPG shall have to submit Performance Bank Guarantee (PBG) of Rs 5 lakh/MW within

    30 days from the date of issuance of LOA by BESCOM. On submission of PBG, the

    bank guarantee against the EMD shall be returned to the selected bidder. PBG shall

    be drawn in favour of General Manager (DSM), BESCOM and shall have validity for a

    period of 12 months from the date of issuance of LoA. PBG will be returned

    immediately after the successful commissioning of the project, after considering any

    penalties due to delay in commission as per the PPA.

    4) Commissioning

    The SPG shall commission the solar power plant within nine months from date of

    issuance of LoA. The SPG may commission the plant during this period of nine

    months and BESCOM is obliged to purchase power from that commissioned plant

    any time after the issuance of LoA. A duly constituted Committee of BESCOM

    officials will physically inspect the Plant within 10 days from the date of notification

    from the SPG and certify successful commissioning of the plant. In case any SPG fails

    to achieve this milestone, BESCOM shall encash the PBG in the following manner -

    a. Delay up to two months - The PBG on per day basis and proportionate to the

    balance capacity not commissioned.

    b. In case the commissioning of the solar power plant is delayed over two

    months, the PPA capacity shall stand reduced / amended to the Project

    capacity commissioned at the end of 11th month from date of issuance of

    Letter of Award.

    In case of delays of plant commissioning due to the reasons beyond the control of

    the developer, BESCOM after having been satisfied with documentary evidences

    produced by the developer for the purpose, can extend the time for commissioning

    date without any financial implications to the developer.

    5) Work Completion Report:

    Developer shall complete the Project Financing Arrangements for its Project and

    shall provide relevant documents to BESCOM in this regard within six months from

    the Date of issuance of LoA by BESCOM for the project.

    3. Roles & responsibilities

    3.1. Solar Power Generator

    The Solar Power Generator (SPG) will be responsible for the following tasks:

    SPG shall develop the necessary land and related infrastructure to set up the solar

    power plant and ensure timely completion of project and connectivity of the solar

    power plant from 66/11 KV substation as per the prescribed timelines.

    SPG shall sign the PPA and install the plant as per provisions of these guidelines and

    applicable rules and regulations.

    SPG will be responsible for laying of dedicated 11 kV line from Solar Power plant to sub-

    station, construction of bay and related switchgear at substation where the plant is

    connected to the grid and metering is done.

    SPG shall comply with grid connectivity and other regulations as applicable and to

    obtain necessary clearances required from the State Government and other local

    bodies.

    SPG shall submit all necessary documents related to the ownership of land for setting

    up of solar power plant or provided lease agreement for the land on which he planned

    to set up solar power plant.

    SPG shall obtain all necessary approval and consent for related document from the

    appropriate authorities.

    The design, construction, completion, testing and commissioning of the project will be

    carried out by the SPG in accordance with these guidelines, PPA, applicable rules, Grid

    Code, Utility established practices, other relevant regulations and terms and conditions

    of the contract.

    To supply the power generated continuously to BESCOM during the period of 25 years

    stipulated in the contract.

    SPG will ensure adequate arrangements for interconnecting solar power plant,

    metering point, delivery point with the feeding 66/11 KV substation.

    SPG shall comply all the term and conditions under the PPA.

    SPG shall be responsible to coordinate directly with concerned authorities related to

    Forecasting & Scheduling, Deviation Settlement Mechanism and Grid Code and all

    liabilities there under.

    3.2. State Nodal Agency (SNA) – Karnataka Renewable Energy Development Limited (KREDL)

    SNA will coordinate with States/UTs, DISCOMs and farmers for implementation of the

    scheme. They will assist the farmers in project development activities including

    formulation of DPR, PPA/EPC contracts, getting funds from financial institutions, etc.

    For settlement of any issues arising during selection of solar/ other renewable energy

    based power plants and their implementation, a State level Committee under the

    chairmanship of Principal Secretary (Renewable Energy/Energy) will be setup by the

    participating State/UT and SNA of that State will be responsible to coordinate/organize

    the quarterly meetings of the State Level Committee.

    3.3. BESCOM

    Notification of 66/11 kV substation and capacity available on them for setting up solar

    power plants.

    Selection of SPG

    Issuance of LOA and signing of Power Purchase Agreement with the successful bidders

    Facilitating grid connectivity to solar power plants

    Ensure “must-run” status to the solar power plants installed under this scheme and will

    keep the feeders ‘ON’ during sunshine hours of a day as per the PPA.

    If SPG has taken land from a farmer/group of farmers on lease for the project, the

    amount of monthly lease rent would be paid by the BESCOM to the lessor directly in

    his/her bank account before 5th day of the month following the month for which the

    lease rent is due. In such a case, the lease rent paid by the BESCOM will be deducted

    4. Other criteria

    4.1. Quality standards

    In order to ensure only quality systems are installed, prevailing MNRE/BIS specifications and

    quality control orders applicable for solar modules, inverters, BoS and other equipment shall

    be followed.

    MNRE, on 02.01.2019, has issued “Approved Models and Manufacturers of Solar

    Photovoltaic Modules (Requirements for Compulsory Registration) Order, 2019”. The order

    provides for enlistment of eligible models and manufacturers of solar PV cells and modules

    complying with the BIS Standards and publish the same in a list called the “Approved List of

    Models and Manufacturers” (ALMM). Subsequent to March 2020, for all the projects bid out

    after 02.02.2019, only the models and manufacturers included in this list will be eligible for

    use in Government/ Government assisted Projects/ Projects under Government Schemes &

    Programmes, installed in the country, including Projects set-up for sale of electricity to

    Government under "Guidelines for Tariff Based Competitive Bidding Process for

    Procurement of Power from Grid Connected Solar PV Power Projects dated 3rd Aug' 2017

    and the amendments thereof".

    4.2. Connectivity with the sub-station

    Solar plant of capacity up to 1 MW may be connected at 11 kV side of substation and SPG

    will be responsible for laying of dedicated 11 kV line from plant to substation, construction

    of bay and related switchgear at substation where the plant is connected to the grid and

    metering is done. BESCOM will facilitate the SPG in getting Right of Way (RoW) for laying of

    11 kV line. SPG will be responsible for maintaining this dedicated 11 kV line. In case more

    than one SPG are awarded projects to be connected to same substation, they shall be

    permitted to coordinate with each other for setting up common 11kV line for feeding to

    substation if they so desire and with the approval of BESCOM. In this case, the SPGs will

    have to comply with appropriate metering arrangements as per prevailing regulations for

    proper energy accounting. The SPG shall comply grid connectivity and other regulations as

    applicable.

    4.3. Clearances required from the State Government and other local bodies

    SPG is required to obtain necessary clearances as required for setting up the Solar Power

    Plant.

    4.4. Shortfall in minimum generation

    During the PPA term, if for any year, it is found that the SPG has not been able to generate

    minimum energy corresponding to CUF of 19% or as prescribed by BESCOM; such shortfall

    in performance shall make SPG liable to pay the compensation as provided in the PPA to the

    BESCOM. This can be relaxed to the extent of grid non-availability for evacuation, which is

    beyond the control of the SPG. Further, this compensation shall not be applicable in events

    of Force Majeure identified under PPA with BESCOM affecting supply of solar power by SPG.

    4.5. Commercial Operation Date (COD)

    The Commercial Operation Date (COD) shall be considered as the actual date of

    commissioning of the solar power plant as declared by the Commissioning Committee of

    BESCOM officials.
