NOTICE
The Defendants hereby note that they have, this day, appealed from this Courts final
judgment in this matter (see attached). The Defendants respectfully suggest that the Court now
lacks jurisdiction to decide plaintiffs pending Motion for Permanent Injunction (Doc. No. 71),
as it is a new challenge to a new law, which requires a new lawsuit. See Natl Rifle Assn v.
Chicago, 393 Fed.Appx. 390, *1 (7th
Cir. 2010); Queen v. Alvarez, 979 F.Supp.2d 845, 84950
(N.D. Ill. 2013); Shepard v. Madigan, 958 F.Supp.2d 996, 1000 (S.D. Ill. 2013). See also Fund
for Animals v. Norton, 390 F.Supp.2d 12, 15 (D.D.C. 2005) (While plaintiffs motion is styled
as one to enforce the Courts [previous] Order [striking an agency Rule], it is in essence a
challenge to the [new agency Rule]. Consequently, the proper avenue for plaintiffs arguments is
a new lawsuit challenging the validity of the [new agency Rule].).

the United States Court of Appeals for the District of Columbia Circuit from the Memorandum-
Decision and Order (Docket No. 54) and final judgment of this Court (Scullin, J.) entered
respectively on the 26th

day of July, 2014, granting plaintiffs motion for summary
judgment and denying the defendants motion for summary judgment. The defendants also
appeal from the Memorandum-Decision and Order of this Court entered on the 6th

November, 2014 (Docket No. 75), denying the defendants motion for reconsideration, and all
other orders merged therein or in the final judgment.
