NOTICE OF PUBLIC MEETING

Notice is hereby given to all interested parties that the Board of Directors of thecaptioned District will hold a public meeting by telephone conference call. Members of thepublic may access the meeting by following the instructions listed at the bottom of this notice.

The meeting will be held at 6:00 p.m. on Tuesday, July 7, 2020.

The subject of the meeting is to consider and act on the following:

On March 16, 2020, in accordance with section 418.016 of the Texas GovernmentCode, Governor Abbott has suspended various provisions of the Texas Open Meetings Act thatrequire government officials and members of the public to be physically present at a specifiedmeeting location (the “Proclamation”). In accordance with the Proclamation, the District hasimplemented procedures to allow members of the public to participate and address the Board ofCommissioners during the telephone conference meeting. The Board of Commissioners ("Board") of Harris County Emergency ServicesDistrict No. 12 ("District") met June 16, 2020 at 6:00 p.m. by telephone conference call, inaccordance with the duly posted notice of the meeting, with a quorum present, as follows:

William B. Anders, PresidentDavid W. Proctor, Vice PresidentLarry Helgesen, SecretaryFrank Staley, TreasurerBryan Clements, Assistant Secretary and Assistant Treasurer

And the following absent:

None.

Also present were Chief Ed Russell, and Mr. Wm. Scott Smith.

The meeting was called to order and declared open for such business as mightregularly come before it.

1. Commissioner Clements presented the invocation.

2. The Board opened the floor for public comment. No public comment waspresented.

3. The Board unanimously approved the minutes of the June 2, 2020meeting.

4. Chief Russell presented the fire chief’s report. The department hasresumed some public relations events. Staffing levels are good with two quarantinedemployees back on the job. Training is continuing as normal. There were 139 responses duringthe prior month. The department is interviewing for fire fighter and captain positions. Thedepartment is continuing the COVID-19 measures that have previously been implemented.

5. The Board unanimously adopted a Resolution approving a riskmitigation plan for the District.

6. The Board unanimously approved the sale of certain appliances byauction and the disposal of nonfunctioning televisions.

7. The Board unanimously approved the bookkeeper’s report and the checkslisted thereon.

8. Commissioner Anders stated that the ECOM meeting will be held thenext business day.

Re: Operations Performance Report to Harris County Emergency Services District 12

Commissioners:

The following information reflects the Department’s Operations Performance Briefing for the first HCESD 12 meeting of July 2020.

BUILDINGS AND FACILITIES A water leak in Station 24’s workout room has been located and repaired. The water leak damaged some floor tiles and acoustical ceiling tiles. Repairs will be made soon.

COVID-19 UPDATE

We, along with our neighboring emergency services, continue to monitor the impact of COVID-19 to our response area.

As part of the Department’s precautionary measures, employee screenings continue to be performed at the beginning of each shift, at 1800 hours, and at the end of each shift. Late last week three employees were temporarily relieved of duty and placed on Administrative Leave with Pay as a COVID-19 precautionary measure. The Department facilities will remain under lockdown until further notice. PROPERTY ACQUISITION The Department is prepared to present property acquisition requests as soon as the appraisals are completed. Personnel Twelve candidate panel interviews have been scheduled from July 7 through July 9.

VEHICLE STATUS

As of this date, all fire apparatus and vehicles are in service.

Boats, transport trailer, and inflatable have been checked and remain in a ready to use condition.

Interlocal Agreement for Training Facility Use

THIS AGREEMENT, is made and entered into this _____ day of __________, 2020 by and

between - Harris County Emergency Services District No. 12, Harris County Emergency Services

District No. 50, and Harris County Emergency Services District No. 60 (hereinafter referred to as

“Parties”) through their duly authorized Board President or Representative.

Witnesseth

Whereas, the Parties seek to provide efficient, safe, and effective fire suppression and

Emergency Response services to their communities; and

Whereas, it is the desire of the Parties to continue and improve the nature and

coordination of emergency assistance to incidents that threaten life of life or property within

the geographic boundaries of their respective jurisdictions;

Whereas, it is the desires of the Parties to provide State of the Art Training to Members

of their respective Departments through “Hands-On” training.

Whereas, pursuant to the Interlocal Cooperation Act, Texas Government Code, Chapter

791, as amended, cities, special districts, and other legally constituted political subdivisions of

the State of Texas are authorized to enter into interlocal agreements and agreements with each

other regarding governmental functions and services as set forth in the Act; and

Whereas, the Parties, in performing Training or Use of Training facilities or in paying for

the use of Training Facilities hereunder shall make that payment or those payments from

current revenues legally available to that Party; and

Whereas, the governing bodies of each Party find that the subject of this Agreement is

necessary for the benefit of the public and that each party has the legal authority to perform

and to provide the governmental service which is the subject matter of this Agreement,

furthermore, the governing bodies find that the performance of this agreement is in the

common interest of all parties; and that the division fairly allocates the cost of the services

under this Agreement; and

Whereas, the Parties to this Agreement understand that entering into the Agreement in

no way obligates any Party to participate in any additional joint projects not herein described

without the express approval of such Party.

Now, Therefore, pursuant to Chapter 791, Texas Government and as otherwise

authorized and permitted by the laws of the State of Texas, for and in consideration of the

covenants, conditions, and undertakings hereinafter described , and subject to each other and

every term and condition of this agreement, the Parties contract, covenant and agree as

follows:

1. The Parties acknowledge that this Agreement is entered into pursuant to the

Texas Interlocal Cooperation Act, Chapter 791, Texas Government Code. The

Parties, in performing Training or Use of Training facilities or in paying for the use

of Training Facilities hereunder shall make that payment or those payments from

current revenues legally available to that Party.

2. The Parties shall conduct regular interdepartmental training session with the

other Parties, and the Parties shall maintain common mobile and portable radio-

frequency capability.

3. Nothing in this Agreement shall limit the ability of any of the Parties from

participating in other Agreements for Training or use of Training Facilities, nor

shall it prohibit any Party from providing Training or use of the Training Facilities

to another jurisdiction which is not a party to this Agreement.

4. The term of this Agreement shall be for one (1) year with recurring annual

renewals for one (1) year each unless a Party gives written notice to terminate.

Any Party shall have the right to terminate upon thirty (30) written notice to the

other Parties. The addition or deletion of Parties to or from this Agreement shall

not affect the Agreement as to the remaining Parties.

5. All Parties shall observe and comply with all Federal, State, and local laws, rules,

ordinances, and regulations affecting the conduct of services provided and the

performance of all obligations undertaken by this Agreement.

6. The Parties agree that each Party shall be responsible for its own actions and

those of its personnel in providing or participating in services pursuant to and

within the scope of this Agreement. It is expressly understood and agreed by the

Parties that no Party shall be held liable for the actions of any other Party or any

of the other Party’s personnel while in any manner furnishing services

hereunder.

7. Each Party’s personnel, apparatus, and equipment shall be under the direction

and control of their own Company Officer. The condition of each Party’s

apparatus and equipment is the sole responsibility of its owner. If apparatus or

equipment is damaged or destroyed during a Training Operation, the

responsibility for repair or replacement is solely that of the Owner. The Party

providing the use of training facilities will never be held responsible for damage

to apparatus and equipment, injury to persons or for the actions of the

Responsible Party.

8. Nothing in this Agreement shall create any rights in any person, firm,

corporation, or other not a Party hereto. No provision of this Agreement is

intended to create a joint venture, partnership, or agency relationship between

any of the Parties.

IN WITNESS THEREOF, this Agreement is executed on the year and date first written

above.
