Terms and Conditions

1. The inter-se-seniority of the promote(s) shall be subject to the claim of

her seniors, who have not been promoted in these order due to various

reasons.

2. If any official is found senior to these officials at any stage due to

re-fixation of seniority in feederucadre, the junior most promote shall be

reverted without giving any notice.

3. The promotes will remain on probation for a period of one year and which

can be extended if their services are not found satisfactory.

4. The promotion is subject to the condition that if anything adverse

regarding their integrity in anyone of their non-available of ACRs

mentioned against their name is found doubtful they will' be reverted

without giving any notice.

1. He is appointed purely on temporary and provisional basis. 2. This appointment is against temporary posts and his confirmation against

substantive posts shall be considered on the basis of their seniority and record of service as and when such posts are available,

3. He will have to take an oath of allegiance to the Constitution of India. 4. He will produce a certificate before joining the duties to the effect that he has

one living wife/husband in case he/she is married. In case he has more than one living wife will be eligible for appointment to the post offered unless the Government after being satisfied that there are special grounds for doing so, exempt him from this condition.

5. He will not be allowed to apply for any post outside the department for a period of at least five years.

6. He will not claim seniority on the basis of these orders. His inter-se seniority will also be decided in accordance with the department rules and instructions of the State Government later on.

7. In other matters, not specifically mentioned in this communication, his services shall be governed by the Civil Services Rules as applicable to Haryana Government Employees and such orders/instructions as may be issued by the Government from time to time.

8. He is further directed to show their original certificate of academic qualifications, experience and other relevant certificates to the Registrar, Education (Schools) of the Directorate of Secondary Education Haryana, Panchkula. He would verify the genuineness of their original certificate.

9. His appointment is subject to the condition that in case he has not produced medical fitness certificate and got verified his character and antecedents verified by the concerned authorities at the time of his initial appointment in the aided schools than Registrar, Education (Schools) will ensure that he will submit his medical fitness certificate first duly issued by the Civil Surgeon concerned only then he should be allowed to join as Clerk in the Directorate of Secondary Education Haryana, Panchkula. Superintendent, Admnistration (Local) will also give character and antecedents verification forms to him and after getting the same filled up by him, further action regarding the same be taken by the Administration Branch of this Directorate accordingly. This will be the personal responsibility of the concerned empl yee.

10. His services shall be governed by the Haryana Education Directorate (State Service Class-III) Rules, 1974 as amended from time to time.

11. If at any time during the course of his temporary appointment, he desires to resign, he will be required to give one month's clear notice or forfeit, in lieu thereof, his salary including allowances etc. for one month or for the period by which the notice falls short of one month. Such a notice will be given to him by the Government also in the case if it is proposed to terminate his services in lieu thereof the Government will be liable to pay his salary, including allowance for one month or for the period by which the notice falls short of one month.

12. No TA/DA will be admissible to him for joining as Clerk. 13. If he gets an appointment as Clerk on the basis of his furnishing false or

fraudulent information/ facts/documents which are detected later on, he would be liable for termination of service without any notice.

• 14. The appointment under these rules shall be a fresh appointment made on the minimum of pay scale of that post, however, the salary of the employee appointed under these rules shall be protected as a measure personal and shall not be less than the salary which he is already drawing. The past service rendered shall not be counted for any other intents and purposes.

15. An employee appointed under these rules shall not be entitled for any

promotion till he/she attains the age of superannuation.

16. An employee under these rules shall not be eligible for pension under the

provisions of Haryana Civil Services (Pension) Rules, 2016. However, for the

purpose of pension, an employee so appointed shall continue to be governed

under Haryana Aided Schools (Special Pension and Contributory Provident

Fund) Rules, 2001, if appointed in the aided school before the 1st January,

2006. The employee appointed on or after the 1st January, 2006 and

appointed in Service shall be governed by the National Pension Scheme (NPS).

. 17. An employee appointed under these rules shall be entitled for the amount of

contribution towards Contributory Provident Fund/ National Pension Scheme

alongwith interest liable to be paid by the concerned aided school

management for the service rendered in the said school and the Management

shall pay the same within a period of one month to the concerned quarters.

18. Arrears of any kind in respect of the employees who are working in aided

schools and are appointed under these orders shall not be paid by the

Government for the period prior to the date of appointment in the Service.

19. No grant-in-aid shall be payable to the aided schools in respect of the posts

which have been taken over in the Service. However, the grant-in-aid shall

continue to be reimbursed as per the provision made in rule 54 of the

Haryana School Education Rules, 2003 for the remaining sanctioned posts on

which incumbents are working in the aided school.

2Q. The leave account of the employees appointed under these rules shall start

with a zero balance.

j.. All other natters, not specifically mentioned in the Haryana Voluntary State

Education Service Rules, 2017, shall be verned by the Haryana Civil

Services Rules and Punjab Financial Rules as applicable to Haryana

Government Employees and by such rules and regulations as may }lave been,

or may hereafter be adopted or made by the competent authority made under

the Constitution of India or under any Law for the time being in force made by

the State Legislature.

If he is willing to accept this offer to appointment as Clerk on the above terms

and conditions, he should submit his joining report within 15 days in the Directorate of

Secondary Education, Haryana, Panchkula and send a copy of the same to the concerned

quarters accordingly.

19. No grant-in-aid shall be payable to the aided schools in respect of the posts which

have been taken over in the Service. However, the grant-in-aid shall continue to be

reimbursed as per the provision made in rule 54 of the Haryana School Education

Rules, 2003 for the remaining sanctioned posts on which incumbents are working in

the aided school.

20. The leave account of the employees appointed under these rules shall start with a

zero balance.

21. All other matters, not specifically mentioned in the Haryana Voluntary State

Education Service Rules, 2017, shall be governed by the Haryana Civil Services Rules

and Punjab Financial Rules as applicable to Haryana Government Employees and by

such rules and regulations as may have been, or may hereafter be adopted or made

by the competent authority made under the Constitution of India or under any Law

for the time being in force made by the State Legislature.

1. They are appointed purely on temporary and provisional basis,

2. These appointments are against temporary posts and their confirmation against

substantive posts shall be considered on the basis of their seniority and record of

service as and when such posts are available.

3. They shall have to take an oath of allegiance to the Constitution of India.

4. They shall produce a certificate before joining the duties to the effect that they have

.one living wife/husband in case he/she is married. None of them who has more than

one living wife/husband, shall be eligible for appointment to the post offered unless

the Government after being satisfied that there are special grounds for doing so,

exempt him/her from this condition.

$. They shall not be allowed to apply for any post outside the department for a period

of at least five.years,

6. They shall not claim seniority on the basis of these orders, Their inter-se seniority

will also be decided in accordance with the department rules and instructions of the

State Government later on.

7. In other matters, not specifically mentioned in this communication, they shall be

governed by the CiVil Services Rules as applicable to Haryana Government

Employees and such orders/instructions as may be issued by the Government from

time to time.

8. All candidates who have been selected as Laboratory Attendants may be further

directed to show their original certificate of academic qualifications, experience and

other relevant certificates to the concerned District Education Officer of their present

place of postings. District Education Officers would verify the genuineness of their original certificate.

9. Their appointment is subject to the condition that in case he/she has not produced

medical fitness certificate and got verified his/her character and antecedents verified

by the concerned authorities at the time of their initial appointment in the aided

schools than concerned District Education Officer will ensure that he/she shall

submit his/her medical fitness certificate first duly issued by the concerned Civil

Surgeons only then he/she should join as Laboratory Attandants in the concerned

schools/offices mentioned against their names. District Education Officer concerned

will also give character and antecedents verification forms to him/her and after

getting the same filled up by them, the same be sent to the Directorate in the HRIVM

Brach through a special messenger within a week positively. This will be the

personal responsibility of the concerned District Education Officer.

10. They shall be governed by the Haryana Education Department, Sub-Offices,

Ministerial (Group-C) Service Rules 1983.

11. If at any time during the course of their temporary appointment, any of the appointee

desires to resign, he/she shall be required to give one month's clear notice or forfeit,

in lieu thereof, his salary including allowances etc. for one month or for the period by

which the notice falls short of one month. Such a notice will be given to him/her by

the Government also in the case if it is proposed to terminate his/her services in lieu

thereof the Government will be liable to pay him/her salary, including allowance for

one month or for the period by which the notice falls short of one month.

12. No TA/DA will be admissible to the candidates for joining as Laboratory Attendants.

13. If he or she gets an appointment as Laboratory Attendants on the basis of his/her

furnishing false or fraudulent information/ facts/documents which are detected later

on, he/she would be liable for termination of service without any notice.

14. The appointment under these rules shall be a fresh appointment made on the

minimum of pay scale of that post, however, the salary of the employee appointed

under these rules shall be protected as a measure personal and shall not be less than

the salary which he/she is already drawing. The past service rendered shall not be

counted for any other intents and purposes.

15. An employee appointed under these rules shall not be entitled for any promotion till

he/she attains the age of superannuation.

16. An employee under these rules shall not be eligible for pension under the provisions

of Haryana Chill Services (Pension) Rules, 2016. However, for the purpose of pension,

an employee so appointed shall continue to be governed under Haryana Aided

Schools (Special Pension and Contributory Provident Fund) Rules, 2001, if appointed

in the aided school before the 1st January, 2006. The employee appointed on or after

the 1st January, 2006 and appointed in Service shall be governed by the National

Pension Scheme (NPS).

.17. An employee appointed under these rules shall be entitled for the amount of

contribution towards Contributory Provident Fund/ National Pension Scheme

alongwith interest liable to be paid by the concerned aided school management for

the service rendered in the said school and the Management shall pay the same

within a period of one month to the concerned quarters.

18. Arrears of any kind in respect of the employees who are working in aided schools

and are appointed under these orders shall not be paid by the Government for the

period prior to the date of appointment in the Service.

The following persons who are working as Class-IV (Sweeper, Mali,

Chowkidar, Peon, Waterman/ Women etc. as the case may be) in the Aided Schools and

have opted voluntarily in accordance with the provision made in Haryana Voluntary

State Education Service Rules, 2017 and found suitable for appointment by the

Screening Committee mentioned in aforesaid rules to the post of Class-IV (Class-IV

(Sweeper, Mali, Chowkidar, Peon, Waterman/ Women etc. as the case may be) in the

Haryana State Secondary Education Department (Group-D) Service Rules, 1998 in the

pay scale as mentioned in DI," of the Schedule 1 of the Pay Matrix of the Haryana Civil

Services (Revised Pay) Rules, 2016 (pre-revised pay scales of Rs. 4440-744Q+GP 100)

plus usual allowances as admissible under the State Government Rules from time to

time.

The following terms and conditions may be imposed in their appointment letter:-

Terms & C9pclippps

1. They are appointed purely on temporary and provisional basis. 2. These appointments are against temporary posts and their confirmation

against substantive posts .shall be considered on the basis of their seniority and record of service as and when such posts are available.

3. They shall have to take an oath of allegiance to the Constitution of India, 4. They shall produce a certificate before joining the duties to the effect that

they have one living wife/husband in case he/she is married. None of them who has more than one living wife/husband, shall be eligible for appointment to the post offered unless the Government after being satisfied that there are special grounds for doing so, exempt him/her from this condition.

5. They shall not be allowed to apply for any post outside the department for a period of at least five years.

6. They shall not claim seniority on the basis of these orders. Their inter-se seniority will also be decided in accordance with the department rules and instructions of the State Government later on.

7. In other matters, not specifically mentioned in this communication, they shall be governed by the Civil Services Rules as applicable to Haryana Government Employees and such orders/instructions as may be issued by the Government from time to time.

8. All candidates who have been selected as Class-IV may be further directed to show their original certificate of academic qualifications, experience and other relevant certificates to the concerned District Education Offiber of their present place of postings. District Education Officers would verify the genuineness of their original certificate.

9. Their appointment is subject to the condition that in case he/she has not produced medical fitness certificate and got verified his/her character and antecedents verified by the concerned authorities at the time of their initial appointment in the aided schools than concerned District Education Officer will ensure that he/she shall submit his/her medical fitness certificate first duly issued by the concerned Civil Surgeon only then he/she should join as Class-IV (Sweeper, Mali, Chowkidar, Peon, Waterman/ Women etc. as the case may be) in the concerned schools/offices. District Education Officer concerned will also give character and antecedents verification forms to him/her and after getting the same filled up by them, the same be sent to the HRME Branch of this Directorate through a special messenger within a week positively. - will be the personal responsibility of the concerned District Education Officer.

10. They shall be governed by the Haryana State Secondary Education Department (Group-D) Service Rules, 1998.

11. If at any time during the course of their temporary appointment, any of the appointee desires to resign, he/she shall be required to give one month's clear notice or forfeit, in lieu thereof, his salary including allowances etc. for one month or for the period by which the notice falls short of one month. Such a notice will be given to him/her by the Government also in the case if it is proposed to terminate his/her services in lieu thereof the Government will be liable to pay him/her salary, including allowance for one month or for the period by which the notice falls short of one month.

12. No TA/DA will be admissible to the candidates for joining as Laboratory Attendant.

13. If he or she gets an appointment as Class-IV on the basis of his/her furnishing false or fraudulent information/ facts/documents which are detected later on, he/she would be liable for termination of service without any notice.

14. The appointment under these rules shall be a fresh appointment made on the minimum of pay scale of that post, however, the salary of the employee appointed under these rules shall be protected as a measure personal and shall not be less than the salary which he/she is already drawing. The past service rendered shall not be counted for any other intents and purposes.

15. An employee appointed under these rules shall not be entitled for any promotion till he/she. attains the age of superannuation.

16. An employee under these rules shall not be eligible for pension under the provisions of Haryana Civil Services (Pension) Rules, 2016. However, for the purpose of ,pension, an employee so appointed shall continue to be governed under -IAryanakided Schools (Special Pension and Contributory Provident Fund) RuleS>-2001,- if appointed in the aided school before the 1st January, 2006. The: employee appointed on or after the 1st January, 2006 and appointed in Service shall be governed by the National Pension Scheme (NPS).

17. An employee appointed under these rules shall be entitled for the amount of contribution towards Contributory Provident Fund/ National Pension Scheme alongwith interest liable to be paid by the concerned aided school management for the service rendered in the said school and the Management shall pay the same within a period of one month to the concerned quarters.

18. Arrears of any kind in respect of the employees who are working in aided schools and are appointed under these orders shall not be paid by the Government for the period prior to the date of appointment in the Service.

19. No grant-in-aid shall be payable to the aided schools in respect of the posts which have been taken over in the Service. However, the grant-in-aid shall continue to be reimbursed as per the provision made in rule 54 of the Haryana School Education Rules, 2003 for the remaining sanctioned posts on which incumbents are working in the aided school.

20. The leave account of the employees appointed under these rules shall start with a zero balance.

21. All other matters, not specifically mentioned in the Haryana Voluntary State Education Service Rules, 2017, shall be governed by the Haryana Civil Services Rules and Punjab Financial Rules as applicable to Haryana Government Employees and by such rules and regulations as may have been, or may hereafter be adopted or made by the competent authority

made under the Constitution of India or under any Law for the time being in force made by the State Legislature.

If he/she are willing to accept this offer to appointment as Class-IV (Sweeper, Mali, Chowkidar, Peon, Waterman/ Women etc. as the case may be) on the above terms and conditions, he/she should submit his/her joining report within 15 days in the concerned schools mentioned against his/her names and send a copy the same to the Directorate of School Education Haryana, Panchkula accordingly.

Whereas Shri Jai Singh the then Principal, GGSSS Juddi (Rewari) filed a Civil

Appeal No. 150 of 2015 — Jai Singh V/s DEO Rewari & others decided on 14.02.2017. Further,

the operative part of order dated 14.02.2017 is reproduced as under:-

" It is ordered that the appeal in hand is partly allowed and the impugned judgment and decree passed by the learned lower court is set aside, Consequently, the suit of the appellant-plantiff is decreed partly and the impugned order dated 21.09.2011, copy of which is Ex. DW-1/B, is hereby declared null and void and accordingly set aside. However, the competent authority is at liberty to proceed further from the stage of serving show cause notice of the proposed penalty upon the appellant-plaintiff and to pass fresh final order as per rules referred to above. Needless to say, anything stated in this judgment shall not be misconstructed as a final opinion on that aspect...."

Whereas, Shri Jai Singh [032041], Principal, Government Senior Secondary

School, Juddi [2614] (Rewari) [ now posted at Government Senior Secondary School, Karawara

Manakpur [2531], Rewari] was charge sheeted under rule-7 of Haryana Civil Services

(Punishment & Apeal) Rule, 1987 on 06.05.2010.

Shri Jai Singh the then Principal, GGSSS Juddi (Rewari) replied to the charge

sheet on 26.05.2010.Finding his reply as unsatisfactory, Shri R C Sharma, HCS (Retd) was

appointed as Inquiry Officer who submitted his report dated 28.10.2010 and proved the said

charges. Thereafter, he was given notice on 07.02.2011 alongwith a copy of the enquiry report

to make a representation within a period of one months as provided in Rule 7(6) of Haryana

Civil Services (Punishment & Appeal), Rule 1987 and the said incumbent submitted his

representation on 04.05.2011 in consequence thereof. Thereafter, taking an overall view of the

matter especially in view of the fact that the charge stand proved, a penalty of stoppage of two

increments with cumulative effect was inflicted upon ,Shri Jai Singh the then Principal, GGSSS

Juddi (Rewari) on 21.09.2011.

Accordingly, order dated 20.09.2011 is set aside by the Hon'ble Court of Shri Ravi

Kumar Sondhi, District Judge, Rewari. In compliance of order dated 14.02.2017 of the Hon'ble

Court a fresh show cause notice is given to you that why two annual increments with

cumulative effect may not be inflicted upon you. In this regard, you are directed to make your

representation, if any, within 15 days to this notice otherwise it will be presumed that you have

nothing to say in the matter and final decision will be taken on merit in the matter.
