No. CCP (NCR)/ DDP/KHRDA-SNPT/2021/02.- In exercise of the powers conferred by sub-section (4) of

Section 5 of the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963

(Punjab Act 41 of 1963) and sub–section (5) of section 203C of the Haryana Municipal Act, 1973 (24 of 1973), the

Governor of Haryana hereby publishes the following Draft Development Plan 2041 AD for Kharkhauda, District

Sonipat, along with restrictions and conditions, given in Annexure A and B proposed to be made applicable to the

controlled areas specified in Annexure B.

Notice is hereby given that the Draft Development Plan shall be taken into consideration by the Government

on or after expiry of a period of thirty days from the date of publication of this notification in the Official Gazette

together with objections and suggestions, if any, which may be received by the Director, Town and Country Planning

Department, Haryana (addressed to Chief Coordinator Planner (NCR)), 2nd Floor, Block A, Nagar Yojna Bhawan,

Plot No. 3, Sector 18A, Chandigarh for the area falling out side Municipal Committee limit and Director, Urban Local

Bodies Department, Haryana, Bays No. 11-14, Sector-4, Panchkula, for the area falling within Municipal Committee

limit, from any person with respect to this Draft Development Plan, before the expiry of the period so specified.

ANNEXURE -A

EXPLANATORY NOTE ON THE DRAFT DEVELOPMENT PLAN KHARKHAUDA-2041 A.D.

(I) Background:

It is believed that during the period of Emperor Shahjahan, the Kharkhauda town came into existence

and the area was surrounded by dense forests. It is said that the town has derived its name from a person

namely; Kharak Uda. The block development office was establishment in the town in 1956. On 28th April,

1980 the town was given the status of municipal committee. As per census of 1990-91, the population of this

town was 13,151 persons. Earlier the administrative unit Kharak was part of Gohana tehsil of Rohtak District,

but in 1803 it was given to Lal Singh as life Jagir by the British. Kharkhuda estate was merged in the British

Government after the death of Lal Singh in 1818 AD. Later on Kharkhauda included in Sonipat district in

1824 and afterward on 30th March 1982, Kharkhauda along with 38 village was created as sub-Tehsil.

(II) Location and regional setting:

The town is located at 28º 52’ North latitude and 76º 54’ East longitude. Kharkhauda town is situated at

a distance of 20 Km. from Delhi and 18 Km. from Distt. Headquarter, Sonepat. This town is well connected

with Delhi and interior of the State by road network.

(III) Physiography:

The topography of this town is almost plain terrain. Drain No. 8 flows in the north of this town. Some

canals and minors also flows in and around the town. The town falls in sub tropical region of India. The

average rainfall is 50 to 70 centimeters. The winds flows from west in winter and from east in summer

seasons. The natural gradient of the slope is North - West.


(IV) Availability of infrastructure:

(a) Utilities

Kharkhauda town has one Sub-Divisional Office, One Tehsil, 33 K.V. electric sub-station, one

telephone exchange and three Banks are working. This town has water supply from water works of

Public Health Department and sewerage facilities are available with the town. The town has only one

Cinema, four Dharmsala and Bus stand situated in the old town. These facilities are not adequate, hence

appropriate provisions of all Model infrastructure facilities have been kept in proposals.

(b) Social infrastructure:

The basic social infrastructure exist in the town such as Civil hospital, Veterinary hospital,

Fire office, College, Police Station, Grid Sub Station, Sewage Treatment Plant, two primary schools,

one senior secondary school and one girls college. The adequate provision of social infrastructure has

also been taken into consideration in the proposed development plan.

(V) Population/ Demography:

The Draft Development Plan of Kharkhauda -2041AD proposes the following population: -

The Population of year 2011 includes the census of India 2011 population of Kharkhauda (M.C.) i.e.

25051, the villages situated in the urbanisable limit of Draft Development Kharkhauda-2041AD i.e.

Pipli-3776, Rampur-2879, Saidpur-3580, Jatola-2197, Gopalpur-3480 and Ferozepur Bangar-3047. Thus total

population of year 2011 in the urbanisable area becomes 40,963 persons. The Draft Development plan of

Kharkhauda has been prepared for population of 5,80,500 persons by the year 2041 A.D.

(VI) Land use Proposals:-

At present the existing town is having a mixed land used pattern. Existence of unbalanced

neighbourhood pattern, presence of slums, unplanned shopping areas without parking facilities, lack of

adequate water supply, sewerage and drainage facilities are the major problems, which insist to prepare a

harmonious plan for this town.

Keeping in view the natural growth trend and for the future development of the town, the proposals of

land use distribution and circulation pattern has been integrated with the existing town which is further

proposed to be expanded towards east to integrate with the Industrial Model Township (IMT), which is

acquired by HSIIDC along Kundli Manesar Palwal (KMP) Expressway. In order to accommodate the

projected population of 5,80,500 persons up to 2041 AD the proposal have been given as Industrial, residential

and other necessary land uses in a coordinated way.

In the Kharkhauda town, numerous water rechargeable zones are present. These areas are along the

north-west area of Kundli Manesar Palwal (KMP) Expressway and falls in the revenue estates of various

villages namely, Gopal Pur, Barona, Rohna, Asrafpur Matindu, Chhanauli, Nasirpur Cholka, Khanda,

Jiauddinpur, Jharoth, Jharauti, Rohat, Fatehpur, Mohamdabad, Kaloi, Garhi Bala, Thana Khurd, Thana Kalan,

Turkpur, Pipli, Kharkhauda. Artificial lakes have been earmarked in the agricultural zone to maintain the

ecological balance of this region.

The Draft Development Plan for Kharkhauda town has been prepared with the projected population of

5,80,500 and town density of 105 PPH which is to be achieved by 2041 AD and is in conformity of density

norms of Sub-Regional Plan of Haryana 2021AD. The extent of various land uses is given below :–

DISCRIPTION OF LAND USES

Residential

In the Draft Development Plan of Kharkhoda-2041AD to accommodate the projected population of 5,80,500,

an area of 1300 hectares (25.75 % of the total proposed area) has been reserved for residential purposes in sector 2, 4,

6 (Part), 7, 9,10,11 and 11-A. To maintain a harmonious development, residential area in form of sectors has been

proposed between the existing town and Industrial Model Township (IMT). The location of these residential sectors is

proposed keeping in view the growth trend of existing town, place of work and other economic activities. These

sectors are planned on neighborhood pattern and all the services and utilities needed shall be provided in the sectors

itself. The residential sector shall be developed to the sector density indicated in the drawing with 20% variation on

either side and in addition to it, the density as prescribed in the New Integrated Licensing Policy (NILP), Deen Dayal

Jan Awaas Yojna Policy (DDJAY) and Affordable Group Housing policy. 20% Group Housing component policy

will also be applicable in a residential sector.

Apart from the proposal to increase the density, the following provisions have also been made in the

Development Plan:

(a) The additional area for infrastructure shall be provided in the already planned / developed residential

sectors to meet out the requirement of the additional population.

(b) The minimum width of the roads in a residential colony / sector shall not be less than 12 meters or as

per the applicable policies.

(c) The minimum area for parks / open spaces in a residential colony / sector shall be planned in such a

manner that it shall meet the minimum norm of 2.5 square metre per person.

A site of 148 hectares with 1125 PPH has been proposed in Industrial Model Township phase-II to cater the

needs of Industrial workers. This residential area proposed within Industrial Model Township phase-II has been

reserved for development exclusively by Haryana State Industrial and Infrastructure Development Corporation and

will be given on rent/lease basis to the industrialists for their workers. Haryana State Industrial and Infrastructure

Development Corporation will propose a model for the same, where in Haryana State Industrial and Infrastructure

Development Corporation may construct the houses and sign an agreement with industrialist for hiring the houses for

workers.

Commercial:

An area of 118 hectare has been reserved/earmarked for commercial purpose which is 2.36% of the total

proposed area. An area of 200 acre has been reserved for city centre to cater the need of town. For commercial

activities two strips having an area 150 acre are reserved in Industrial Model Township (IMT).

Industrial :

The main insistence of the Industrial Development is towards National Capital Territory of Delhi. Hence, the

area of Industrial Model Township (IMT) already acquired by Haryana State Industrial and Infrastructure

Development Corporation, has been kept towards eastern side of Kundli Manesar Palwal (KMP) expressway. There


is also a provision of Orbital Rail Corridor along Kundli Manesar Palwal (KMP) expressway as per NCR Regional

Plan 2021 AD. Therefore, this corridor as well as the provision of orbital rail corridor will help in giving a major

impetus to the industrial development in this industrially backward block.

Keeping in mind the over spill of industrial activities, the main emphasis of the Draft Development Plan of

Kharkhoda-2041AD has been kept to harness the potential of the area being developed as Industrial area.

Accordingly, an area of 2229 Hectares has been earmarked for industrial purposes, which is 44.15 % of the total area

of the proposal.

Transport and Communication

The Kundli Manesar Palwal expressway and proposed Orbital Rail Corridor have been retained in the Draft

Development Plan as guiding factors with the allocation of various land uses. The road network has been planned in a

hierarchical manner to facilitate easy movement of traffic and people. The width of the road network is designated as

The road network has been planned keeping in view the inter-city and intra-city traffic as well as location of

the existing town in its regional setting. Kundli Manesar Palwal expressway and proposed orbital rail corridor is

passing through the heart of the proposal and it connects the National Highway 44 crossing through National

Highway 8 and 10 respectively. For smooth and fast movement of city traffic, the existing Kharkhoda-Delhi road is

proposed to be widened 60 meters with 30 meters green belt. This is the only road of the proposal which makes a

junction with Kundli Manesar Palwal (KMP) expressway. An outer periphery road has been proposed which connects

the existing town with Industrial Model Township (IMT) through main junction on Kundli Manesar Palwal (KMP)

expressway. Apart from the above, a 60 metres wide corridor has been proposed around Industrial Model Township

(IMT) complex for providing smooth and rapid track for industrial traffic. To cater the need of big Industrial Model

Township (IMT) Transport Nagar Railway yard, Bus Stand will be developed at the junction of Kundli Manesar

Palwal (KMP) providing the better public facilities to the inhabitants of the complex.

Public utilities:

The land earmarked for public utility such as major disposal works, water supply, installation and grid

sub-station is 79 hectare which is 1.56 % of the total area of the proposal. The major disposal works are proposed to

be located along natural drainage system where the effluents may be discharged after proper treatment. The

underground water in most of the area is potable and sweet up to 20 to 30 feet depth but the sites for water supply

installations and treatment plants are proposed along the major canals and minors to ensure the adequate water

supply. Considering 135 liters of water per person per day and 15 percent waste, an estimated 5,80,500 people will

need 7,83,67,500 liters of water per day. The source of drink water will be Gurugram Canal / Pai Distributory. The


suitable sites for solid waste disposal have been provided in development plan. The detail of Town level

Haryana State Industrial and Infrastructure Development Corporation (HSIIDC) will make provision for

Common Effluent Treatment Plant/Sewage Treatment Plant in the areas falling out of MC limits.

Public and semi-public uses:

Kharkhauda town is sub-divisional head quarter of Sonepat district and most of the government offices are

located in a scattered manner. The land earmarked in the Draft Development Plan is 139 hectare which is 2.75% of

the total area of the proposal in Sector-1. The detail of town level infrastructure in existing sectors and proposed in

Open spaces:

The land earmarked for open spaces, parks, sports activities, green belt, recreational uses is 483 Hectare which

is 9.57% of the total area of the complex. The proposal of 100 metres wide green belt along Kundli Manesar Palwal

(KMP) expressway and 50 metres wide green belt along Orbital Rail Corridor has been made. To segregate the

residential and commercial uses from Kundli Manesar Palwal (KMP) expressway, a 150 green buffer has been

earmarked to protect the residential area from the traffic and industrial pollutants. The provision of 50 metres green

belt has been made around the Industrial Model Township (IMT) complex. Apart from above, 30 metres green belt

has been proposed along canals/minor passing through the urbanisable area, outer periphery road to maintain the

natural environment. A sizeable area abutting with existing town and Industrial Model Township (IMT) is earmarked

for parks and open spaces and sports activities to maintain the ecological balance of the region. A huge town level

park in an area approximately 115 acres has been earmarked in sector 3 along major corridor which connects the

intersection point of Kundli Manesar Palwal (KMP) expressway. The detail of town level infrastructure in existing

Agricultural zone:

The rest of the controlled area i.e. controlled outside urbanisable area has been designed as agriculture zone.

This zone will, however not eliminate the essential building construction and development within his area such as

extension of existing village Contiguous to Abadi-deh if undertaken under project approved or sponsored by the

government for other ancillary and allied facilities necessary for maintenance and improvement of an agricultural

area.

Water Bodies/Natural Conservation Zone:-

An area of about 84 Hectare which is 1.66% for water bodies are marked in the plan as per Sub Regional

Plan Haryana including ponds and canals etc. Some Water Bodies have been reserved which is a part of village abadi

deh. Natural Conservation Zone (NCZ) are major natural features, identified as the environmentally sensitive areas in

Regional Plan-2021 AD, wherein activities like Agriculture and Horticulture, Pisiculture, Social Forestry/Plantation

including afforestation and Regional Recreational Activities with no construction exceeding 0.5% of the area with the

permission of the competent authority are allowed. In order to identify the Natural Conservation Zone, the ground

truthing exercise has been carried out. Further, the matter is also under consideration in Hon'ble National Green

Tribunal in OA No. 147 of 2014 titled as Legal Aid Committee, National Green Tribunal Bar Association Vs.

Ministry of Environment, Forest and Climate Change and others. Hence, the orders of Hon'ble NGT dated 20.11.2019

& 20.03.2020 and any subsequent decision later on, in the matter of Natual Conservation Zone will be applicable and,

in case, any site is finalized as Natural Conservation Zone, then the provisions of Natural Conservation Zone will be

applicable over that area irrespective of the proposals given in the plan.

Zoning Regulations

The Legal sanctity to the proposals regarding land use is being given to the effect by a set of zoning

regulations (Annexure B) which form a part of this development plan. These regulations will govern the change of

land use and standards of development. They also will elaborately detail out allied and ancillary uses which shall be

permitted in the various major land uses and stipulate that all change of land use and development shall be in

accordance with the details shown in the sector plan thereby ensuring the preparation of detailed sector plans for each

sector to guide the development and enforce proper control.

ANNEXURE B

Governing uses and development of land in the controlled area around Kharkhauda town as shown in Draft

Development Plan Drawing No. D.T.P. (S) 1463/20, dated the 29th June, 2020.

I. General

1. These Zoning regulations forming part of the Draft Development Plan for the controlled areas around Kharkhauda town shall be called zoning regulations of the Draft Development Plan for Controlled

Areas, Kharkhauda.

2. The requirement of these regulations shall extend to the whole of the area covered by the Draft Development Plan and shall be in addition to the requirements of the Haryana Municipal Act, 1973

(24 of 1973) and Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated

Development Act, 1963 (Punjab Act 41 of 1963) and the rules framed there under.

II. Definitions :–

In these regulations :–

(a) ‘Agro based Industries’ means an industrial unit, which uses food grains, fruits or Agro waste as raw-material;

(b) ‘Approved’ means approved by the competent authority;

(c) ‘Building Code’ means the Haryana Building Code 2017;

(d) ‘Building rules’ means the rules contained in part VII of the rules;

(e) ‘Cyber City’ means self contained intelligent city with high quality of infrastructure, attractive surrounding and high-speed communication access to be developed for nucleating the Information

Technology concept and germination of medium and large software companies Information

Technology Enabled services; wherein no manufacturing units may be allowed;

(f) ‘Cyber Park/Information Technology Park’ means an area developed exclusively for locating software development activities, and Information Technology Enabled services wherein no

manufacturing of any kind (including assembling activities) shall be permitted;

(g) ‘Drawing’ means Drawing No. D.T.P. (S) 1463/20, dated the 29th June, 2020.


(h) 'Extensive Industry' means an industry set up with the permission of the Government and in extensive, employing more than 100 workers and may use any kind of motive power of fuel provided

they do not have any obnoxious features;

(i) ‘Farm House’ means a house constructed by the owner of a farm at his land for the purpose of:

(i) Dwelling unit i.e. main use,

(ii) Farm shed i.e. Ancillary use.

Notes :–

(1) The construction of the farm house shall be governed by the restrictions given under clause XIX regarding ‘provision of farm houses outside adadi- deh in agricultural zone’.

(2) ‘Farm sheds’ shall be governed by the restriction mentioned in clause XIX regarding building control and site specifications.

(j) ‘Floor Area Ratio (FAR)’ means a quotient obtained by dividing the multiple total covered area of all floors and hundred, by the area of plot i.e.

FAR= total covered area

x 100 plot area

For the purpose of calculating FAR, cantilevered permitted roof projections, lift room, mumty,

balcony, basement or any floor if used for parking, services and storage, stilt area (unenclosed)

proposed to be used for parking and pedestrian plaza only, open staircase (without mumty), terrace with

or without access, fire staircase, atrium, water tank, open court yard of permitted size shall not be

counted towards FAR:

Provided that area under shaft, chutes, lift well and staircase from stilt to next floor shall be

counted towards FAR only at once on ground floor:

Provided further that in case the ventilation shaft area is more than 3 square metres, it shall not

be counted in FAR;

(k) ‘Fuel Station’ means the fuel filling station providing retail supply of fuel for automobiles which shall include petrol pumps, CNG stations, bio- fuels, charging stations, battery providing stations etc;

(l) ‘Green Belt’ shall mean, strips of land along sector/arterial road shown in the development plan primarily meant for the widening of the sector/arterial road in future;

(m) ‘Group Housing’ means a building designed and developed in the form of flats for residential purpose or any building ancillary to group housing;

(n) ‘Heavy Industry’ means an industry to be set up in public or semi public or private sector with the permission of the Government (the cost of plant machinery etc. as defined in the industrial policy of the

Government);

(o) ‘Information Technology Industrial Units’ means the categories of industries included in the Annexure to the Government of Haryana Information Technology Policy, 2000 and in Appendix-1 to

this notification and/or, as may be defined by the Government of Haryana from time to time;

(p) ‘Ledge or Tand’ means a shelf-like projection, supported in any manner whatsoever, except by means of vertical supports within a room itself but not having projection wider than one metres;

(q) 'Light Industry' means industry not likely to cause injurious or obnoxious noise, smoke, gas, fumes or odors, dust, effluent and any other nuisance to an excessive degree and motivated by electric power;

(r) 'Local Service Industry' means an industry, the manufacture and product of which is generally consumed within the local area, for example: bakeries, ice-cream manufacturing, aerated water,

attachakkies with power, laundry, dry cleaning and dyeing repair and service of automobile, scooters

and cycles, repair of household utensils, shoe making and repairing, fuel depots etc. provided no solid

fuel is used by them.

(s) ‘Loft’ shall mean an intermediate space between two floors on a residual space with maximum height of 1.5 metres and which is constructed or adopted for storage purposes only;
