PERSON TO WHOM THIS NOTICE IS GIVEN:
HAZELLAND PTY LTD ACN: 129 483 923 C/o Aylmore and Associates 7 Southport Street WEST LEEDERVILLE in the state of Western Australia
Hazelland Pty Ltd is the owner of land that comprises all or part of the Site to which this notice relates.
SITE TO WHICH THIS NOTICE RELATES
Lot 20 Adelaide Street, HAZELMERE in Western Australia and being more particularly described as:
Lot 20 on Diagram 76128, as shown on Certificate of Title Volume 2054, Folio 299, being the land as shown in Schedule 1 of this Notice.
REASONS FOR WHICH THE NOTICE IS GIVEN
This notice is given to Hazelland Pty Ltd ("Owner") because, in the opinion of the Chief Executive Officer ("the CEO") of Department of Environment Regulation (DER) the Site is contaminated and there is an immediate and serious risk of harm to human health, the environment or an environmental value. In particular:
• The Site was a former landfill and contains commercial and industrial waste, as well as significant quantities of asbestos containing material including broken asbestos containing material in accessible surface soils.
• Members of the public, including children, may be exposed to a number of potential safety and health risks from the commercial and industrial waste at the Site.
• The site is substantially un-fenced and there is unrestricted access to the site from Adelaide Street, Hazelmere as well as along other site boundaries.
• The presence of commercial and industrial waste including asbestos containing material, together with a significant fuel load is considered to pose an unacceptable risk to human health in the event that the site is impacted by fire.

GROUNDS FOR WHICH THE NOTICE IS GIVEN
• In my capacity as Chief Executive Officer of the Department of Environment Regulation and with the agreement of the Department of Health (DoH) I have concluded that as the Site was a former landfill and contains commercial and industrial waste, as well as significant quantities of asbestos containing materialthat there is an immediate and serious risk of harm to human health to the public and potential site users, either authorised or unauthorised, arising from:
o the uncontrolled exposure to the commercial and industrial waste, including asbestos containing material; and
o the high fire danger risk.
• I require that this immediate and serious risk of harm to human health be abated in accordance with section 51 of the Contaminated Sites Act 2003 (the Act).
REQUIREMENTS OF THIS NOTICE:
Terms used in this Notice shall have meaning as defined in Appendix 1 .
This Notice requires the Owner to take the following measures, which are considered necessary to abate immediate and serious risk to human health ("the Hazard") identified at the Site ("the Measures"):
1. HAZARD ABATEMENT
1 .1 . Within two weeks of the date of service of this Notice, the Owner must notify the CEO of the engagement of a suitable contractor to install perimeter fencing and gates at the Site.
1 .2. Within four weeks of the date of service of this Notice, the Owner must ensure that the perimeter fencing and gates are erected at the site, sufficient to prevent unauthorised access to the site. The Owner must ensure that the fencing:
1 .2.1 . is of a chainmesh/chainwire construction;
1 .2.2. is not less than 1 .8 metres (m) in height; and
1 .2.3. displays warning signs bearing the words "Danger" and "Former Landfill -Commercial and Industrial Waste and Asbestos material is present on this site" and "authorised personnel only" at 50 m intervals.
1 .3. The Owner must maintain the integrity of the fence, including locked gates, to prevent unauthorised access to the Site until such time as this Notice is cancelled by written notice of the CEO.
1 .4. Within two weeks of the date of completion of community engagement actions undertaken in accordance with clause 2.3, and in accordance with the plan approved by the CEO, the Owner must ensure that a fire break, 3 m wide and immediately inside and adjacent to all external property boundaries where practicable, which is free from flammable materials and has a 4 m vertical height clearance free from overhanging branches, is installed at the Site in accordance with the approved health and safety plan.

1 .5. Where the CEO determines that the practical installation of a firebreak is not possible due the presence of obstructions, such as earth mounds, a low ground fuel area is to be installed and maintained with a vegetation height of 5 em or less and with a width of 20 m, perpendicular to the property boundary.
1 .6. Within two weeks of the date of completion of community engagement actions undertaken in accordance with clause 2.3, and in accordance with the health and safety plan approved by the CEO, the Owner must slash or mow unmanaged grass within 3 m of the fire breaks, to a height no greater than 1 0 centimetres (em).
2. COMMUNITY ENGAGEMENT
2.1 . Within two weeks of this Notice being issued, notification of works required to be undertaken in compliance with this Notice must be provided to adjoining commercial land owners and occupiers located to the North and West of the Site, and residential land owners or occupiers located within 200 m of the Site, including all properties located on Adelaide Street, Larwood Crescent, Nottingham Green, Benson Way, Torquay Lane, Teddington Loop, Bowden Drive between Adelaide Street and Benson way, Foxton Boulevard between Adelaide Street and Benson Way, Winton Crescent, Fleet Circuit and Stirling Crescent between Adelaide Street and Benson Way, within the locality of Jacaranda Springs. Notification is to be provided in writing and deposited into mail boxes.
2.2. Within three weeks of this Notice being issued, the Owner must notify the CEO in writing of compliance with clause 2.1 and provide a list of owners and occupiers notified.
2.3. Within three weeks of the approval of the community engagement plan by the CEO, the Environmental Consultant must complete community engagement in accordance with the approved plan and Schedule B8 of the National Environment Protection (Assessment of Site Contamination) Measure 1999 (the NEPM) and the DER guideline Assessment and management of contaminated sites.
3. ENGAGING AN AUDITOR
3.1 . Engage an accredited contaminated sites Auditor within 7 days of this Notice being issued, to audit the Site and report to the CEO on the actions taken to comply with the requirements of this Notice.
3.2. Notify the CEO in writing within 48 hours of engaging the services of the accredited contaminated sites Auditor outlined in clause 3.1 and provide the name and contact details of that person with the notification.
4. ENGAGE ENVIRONMENTAL CONSULTANT
4.1 . Engage an Environmental Consultant within 7 days of this Notice being issued, to prepare a health and safety plan to manage potential risk associated with the installation of fire breaks, as required under clause 1 .4 of this Notice, and to prepare a community engagement plan and to supervise and report on all actions taken to comply with clause 1 . 4 to 2.3 of this Notice in consultation with the accredited contaminated sites Auditor engaged in accordance with clause 3.1 .

5. REPORTING
5.1 . Within 21 days of this Notice being issued, the Environmental Consultant must provide a copy of the health and safety plan and community engagement plan to the Auditor engaged under clause 3.1 of this Notice and the CEO.
5.2. Within 7 days of receipt of the health and safety plan and community engagement plan from the Environmental Consultant under clause 5.1 of this Notice, the Auditor is to provide written advice on the adequacy and compliance of the health and safety plan and community engagement plan in relation to the requirements of the NEPM and DER guideline Assessment and management of contaminated sites, to the CEO for approval. Advice is to include a copy of the Auditor approved health and safety plan and community engagement plan.
5.3. Within 1 4 days of the completion of hazard abatement actions described under clause 1 .1 to 1 .6 of this Notice, the Environmental Consultant must provide the Auditor engaged under clause 3.1 of this Notice and the CEO with a report detailing the actions undertaken to comply with clause 1 .1 to 1 .6 of this Notice, prepared in accordance with sections 6.5 and 1 2 of DER guideline "Assessment and management of contaminated sites" (DER, 201 4) and section 6 of the "Guideline for the Assessment, Remediation and Management of Asbestos-Contaminated Sites in Western Australia" (DoH, May 2009).
5.4. Within 21 days of the completion of hazard abatement actions described under clauses 1 .1 to 2.3 of this Notice, the Auditor must provide a Mandatory Auditor's Report, demonstrating compliance with the requirements of the Notice to the CEO for approval.

IMPORTANT NOTES: OFF SITE ACCESS If, in order to comply with a hazard abatement notice, a person will need to enter land of which the person is not an occupier, the notice may require the person to make reasonable attempts to obtain, within the time specified in the notice, the permission of the occupier or owner, as is relevant, to enter the land to take action to comply with the requirements of the notice.
If a person on whom a notice, which has a requirement binding, fails to obtain the permission of the occupier or owner after making reasonable attempts to do so within the time specified in the notice, the person is to notify the CEO of that failure within 3 days after the latest day on which the person was required to obtain the permission.
AUDITOR In accordance with section 44 of the Contaminated Sites Act 2003 an accredited contaminated sites auditor must be appointed to report on actions taken to comply with the requirements of this notice.
SECTION 43. Notice to be complied with (1) A person on whom a notice is binding must ensure that the requirements of the notice are complied with within such time as is specified in the notice.
Penalty: $500 000, and a daily penalty of $100 000.

APPENDIX 1
DEFINITIONS
In this Notice, unless the contrary intention appears -
'Act' means the Contaminated Sites Act 2003;
'Auditor' means a person accredited as a contaminated sites auditor under the Contaminated Sites Act 2003;
'CEO' means Chief Executive Officer, Department of Environment Regulation
'CEO' for the purpose of correspondence means;

'MAR' means Mandatory Auditor's Report
'NEPM' means the National Environment Protection (Assessment of Site Contamination) Measure 1999;
'Owner' means Hazelland Pty Ltd, the registered property owner;
'Schedule 1' means Schedule 1 of this Notice unless otherwise stated;
'Site' means Lots 20 on Diagram 761 28, being the land depicted in Schedule 1 of this Notice.
'Unmanaged grass' means grass that is 50cm or more in height.

Legislative powers
1. Section 51 of the Contaminated Sites Act 2003 provides for the issuing of a Hazard Abatement Notice (HAN). Section 51 provides as follows:
51. Hazard abatement notice
(1) A hazard abatement notice is to be given if in the opinion of the CEO a site is contaminated and there is an immediate and serious risk of harm to human health, the environment or any environmental value (a hazarcl).
(2) A hazard abatement notice -
(a) is to specify-
(i) the name and address of the person to whom it is given;
(ii) the reason for which it is given; and
(iii) a description of the location and extent of the site sufficient to identify it;
and
(b) is to describe -
(i) the actions required to be taken to abate the hazard; and
(ii) the content and form of information that is to be reported to the CEO.
(3) A hazard abatement notice-
(a) is to set out the requirements-
(i) to be complied with to immediately control or reduce the hazard; and
(ii) for informing and consulting with the community regarding the hazard and the abatement of the hazard, in accordance with any relevant guidelines;
(b) may require a report to be made to the CEO on any action taken under the notice and its outcome; and
(c) may specify the time within which any requirement of the notice is to be complied with.
2. This decision document supports the issuing of a Hazard Abatement Notice (HAN) to Hazelland Pty Ltd (the Owner) in relation to the Site situated at Lot 20 Adelaide Street, Hazelmere, Western Australia.
The Site
3. The Site the subject of the HAN is situated at whole of Lot 20 on Diagram 76128, Certificate of Title Volume 2054, Folio 299, being Lot 20 Adelaide Street, Hazelmere, Western Australia (Attachment 1 ) .
Owner
4. Hazelland Pty Ltd (ACN 129 483 923) [Attachment 2] is the registered owner of the Site as shown on the certificate of title for the Site.
Relevant Facts
5. The Site is a closed former landfill which received commercial and industrial wastes including asbestos containing materials between approximately 1987 and 1997 (Attachment 3).
6. The Site was first classified as possibly contaminated- investigation required on 27 April 2007 under section 13 of the Contaminated Sites Act 2003 (the Act).
7. The Site was re-classified as contaminated- remediation required on 22 November 2010 under section 13 of the Act.
8. The reasons for classification were updated to reflected additional technical information submitted to the Department of Environment Regulation (DER) on 17 November 2015. However the classification of contaminated- remediation required remained unchanged.
9. The reasons for classification state, among other things, that during a site inspection by then Department of Environment and Conservation officers in 2010, large quantities of broken asbestos containing material were observed on the site. The quality and condition of the asbestos material was considered to pose an unacceptable risk to human health.
10. Recent site inspections in May and September 2016 by DER and Department of Health officers have confirmed the continued presence of exposed surface soil contamination by commercial and industrial waste including asbestos containing materials on the site at various accessible locations.
11. Inspections in May and September 2016 further identified the presence of surface asbestos contamination along all property boundaries and major access tracks as well was significant quantities of surface asbestos contamination at a number of isolated locations on the site.
12. The prevalence of commercial and industrial waste, including asbestos containing material in accessible surface soils on the site poses an unacceptable risk to human health for persons accessing the site.
13. A site inspection undertaken on 22 September 2016 by DER and Department of Health officers identified that the perimeter fencing was absent along large
sections of the Adelaide Street site frontage.
14. A site inspection undertaken on 22 September 2016 by DER and Department of Health officers also identified that no warning signage identifying the presence of commercial and industrial waste including asbestos material, or providing other warnings regarding hazards and entry restriction, were present at the site.
15. The inspection on 22 September 2016 noted visual evidence in the form of 'cubby house' type constructions and children's toys, such as balls, indicating that children had been accessing and using the site.
16. The inspection on 22 September 2016 also noted the presence of a number of other physical hazards including derelict machinery, buildings, abandoned drums, fridges, containers and concealed trip and pit-fall hazards within the body of the landfill area.
Fire Risk
17. Site inspections in May, June and September 2016 identified a significant fuel load on the site arising from overgrowth of vegetation.
18. No fire breaks were observed at the site during these inspections.
19. The inspection on 22 September 2016 noted that the area immediately adjoining the boundary fence was free from significant quantities of asbestos containing material.
20. Based on observations during the inspection on 22 September 2016, DER and Department of Health officers consider that fire breaks can safely be installed at the site if such works are managed by an appropriate health and safety plan.
21. The City of Swan has informed DER that a Fire Hazard Reduction Notice has been issued under section 33 of the Bush Fires Act 1954.
Key Findings
22. As detailed in the reasons for site classification, the presence of commercial and industrial waste including significant quantities of asbestos containing material including broken asbestos containing material in accessible surface soils on the site is considered to pose an unacceptable risk to human health.
23. Physical hazards present on the site present an immediate and serious risk of harm to persons including children accessing the site.
24. There is evidence of unauthorised persons including children accessing the site.
25. The site is substantially un-fenced and there is unrestricted access to the site from Adelaide Street, Hazelmere as well as along other site boundaries.
26. Warning sign age at the perimeter of the site as well as at entry points is
inadequate to inform of the hazards present at the site.
27. Installation of appropriate fencing is required to prevent access to the site and mitigate potential exposure risk to identified hazards on the site. Appropriate fencing is considered to be permanent fencing and gates and does not include temporary construction fencing.
28. The significant fuel load on the site and absence of fire breaks is considered to pose a risk, and fire breaks should be installed in accordance with a health and safety plan to manage potential exposures to asbestos or other hazardous material.
29. Based on the current site conditions, fuel load, absence of fire breaks and presence of significant surface contamination from commercial and industrial waste including asbestos material, appropriate mitigation of these risks is required.
HAN Conditions
Installation and Maintenance of Perimeter Fencing and Signage
The Owner will be required to install and maintain appropriate permanent perimeter fencing at the site, sufficient to prevent access to the site and the identified hazards therein, by unauthorized persons including children.
The Owner will be required to erect signage warning of the presence of asbestos at the site and also erection of appropriate hazard signage identifying 'Danger' and 'Former Landfill- Commercial and Industrial Waste and Asbestos material is present on this site' and 'authorised personnel only'. Signage will be required to be placed at all entry and exit points of the site, as well as at 50m intervals on the boundary fence.
Grounds: In accordance with section 51, the CEO considers that the installation and maintenance of perimeter fencing and signage is necessary to reduce an immediate and serious risk of harm posed by the substances of concern at the site, to unauthorized persons including children entering the site.
Installation of Fire Breaks and Hazard Reduction Actions
The Owners will be required to engage a suitably qualified and experienced environmental professional with the competencies described in section 4.2 of Schedule 89- Guideline on Competencies & Acceptance of Environmental Auditors and Related Professionals in the National Environment Protection (assessment of site contamination) Measure 1999 (the NEPM). The consultant will be required to prepare a suitable health and safety plan, to manage all activities associated with the installation of fire breaks, including emu-picking and decontamination of post instillation fire break areas.
The health and safety plan is to be reviewed and approved by the CEO, in consultation with the Department of Health prior to the installation of firebreaks as detailed in the HAN.
Grounds: In accordance with section 51, the CEO considers that the current site condition in relation to fire risk and the presence of commercial and industrial waste
including asbestos containing material on the surface of the site poses an immediate and serious risk of harm to human health, and that the preparation of an appropriate health and safety plans to manage the identified immediate and serious risks is required.
