August 10, 2020 Dear Parents/Families, Staff, and Community Members, After an unprecedented end to the 2019-2020 school year, I write to you with excitement and optimism for the successful reopening of our schools this fall at Devils Lake Public Schools (DLPS). It has been a challenge for our entire community since March, but I hope you have found ways to cope and embrace this new normal. Thank you to the students, staff, parents, and community members who have helped our district succeed in these difficult times. The challenge is now planning for what school will look like during the 2020-2021 school year. This is a difficult task as I recognize the impact and response to COVID-19 have changed rapidly over the past five months. To provide additional time for professional development, building set up, staff preparations, and communication and planning with families, the beginning of school, has been changed to Wednesday, September 2nd. On Tuesday, July 14th, Governor Burgum and Superintendent Baesler released the K-12 Smart Restart Fall 2020 School Reopening Guidance for North Dakota Schools. We have aligned this health and safety reopening plan with this new guidance. The overall goal of this plan is to provide a safe and thorough reintegration plan for our students and staff. Given the dynamic nature of the COVID-19 pandemic, this will be an ongoing and fluid process. We are prepared to change course at any moment should it may be necessary. For academic, social-emotional, and economic reasons, we strive to return to an in-person model of instruction. Yet, cannot ignore the health and safety concerns associated with the virus that remain. I realize that reviewing this plan may not address every question you may have. I recognize that some concepts and actions may be polarizing, and there are strong opinions about what the school district should or should not do. But we must remain open to what is possible and consider all options to keep our schools from contributing to virus spread in our community, while also doing what is right for the health and safety of our students and staff moving forward. I thank you for your time reviewing this plan, for your flexibility and understanding and I really look forward to returning to a new normal with our students and staff. I understand during this time of uncertainty and change there will be questions. I encourage everyone to ask questions and communicate their concerns as we move forward by contacting the district/school office with any questions or concerns you may have. III. Building Level COVID-19 Coordinators

Each school building will have an identified COVID-19 Building Level Coordinator who will be responsible for the health and safety preparedness and response planning. Coordinators will make themselves available to the North Dakota Department of Health 24 hours a day / 7 days a week to respond to phone calls from public health. This position will assist public health in identifying and notifying close contacts in the school setting. The coordinator will report cases of COVID-19, found in the

school setting, to health officials, the Superintendent of DLPS, and the State Superintendent’s office. The building principals will serve as the Building Level Coordinators. If the coordinator is unable to be reached the secondary contact will be either the Assistant Principal or Superintendent. Protect Yourself & Others

WASH YOUR HANDS OFTEN

• Wash with soap and water for at least 20 seconds especially after blowing your nose, coughing, or sneezing.

• If soap and water are not available, use hand sanitizer that contains at least 60% alcohol.

• Avoid touching your eyes, nose, and mouth with unwashed hands.

• Students and Staff are encouraged to wash their hands often throughout the day.

AVOID CLOSE CONTACT

• Keep social distance from others is especially important for people who are at a higher risk of getting sick.

• A minimum of 6 feet is recommended when individuals are together.

COVER COUGHS AND SNEEZES

• Always cover your mouth and nose with a tissue when you couth or sneeze or use the inside of your elbow.

• Throw tissues away and wash hands or use hand sanitizer to prevent spread.

CLEAN AND DISINFECT

• School staff should clean and disinfect frequently touched surfaces daily.

• Shared materials (not recommended) should be cleaned.

• Classrooms will be cleaned nightly by custodial staff.

FACE COVERINGS

• The wearing of masks will be applied in phases based on the phases within the ND Smart Restart Guidance.

• Face coverings may also include clear masks & face shields to accommodate for individual student needs.

• Educators need to teach students how to properly wear a face covering so they are prepared to use them on school buses or other situations in close proximity with others. o Resources from NDDPI and DLPS will be provided to teachers.

MONITOR YOUR HEALTH DAILY

• Be alert for symptoms. Watch for a fever, cough, or shortness of breath.

• Staff and students who are sick should stay home.

• Temperatures of symptomatic students or staff may be taken at the school office. o Symptomatic students will be isolated, and their guardians contacted.

Travel Guidance Anyone who has traveled internationally MUST quarantine for 14 days following their return to the state. Anyone who travels outside of the community or state do not have to quarantine but should exercise additional precautions per CDC recommendations which include, staying home as much as possible, avoid close contact, and follow any state or local travel restrictions currently in place.

Best Intentions Despite taking every reasonable precaution, there is no guarantee that our schools will be without risk as it relates to COVID-19. The virus will be present on our buses, in our classrooms, and at our activities. In certain situations, social distancing is not possible in a school setting. Our actions, as outlined in this plan, will not prevent any student or staff member from being in contact with the virus.

North Dakota Smart Restart DLPS will use the ND Smart Restart Odometer in consultation with state and local officials.

HEALTH & SAFETY PROTOCOLS

Monitoring the health of students and staff will be an important component of a safe and healthy educational

environment. Devils Lake Public Schools (DLPS) will take the following measures to ensure all students and

staff are healthy while they are at school.

Identifying Students & Staff at Higher Risk • Back to School and enrollment processes will include questions asking families to identify if their child is at-risk, based

on a health professional’s diagnosis. This information will be provided to the building principal (COVID-19 Coordinator) who will contact the family and discuss instructional model options.

• The District Office will inquire with all employees if they are at-risk, based on a health professional’s diagnosis. The District office will work in partnership with the building principal/director and the employee to coordinate adjustments to the work schedule or workplace.

• DLPS will implement supportive practices to protect employees at higher risk for severe illness. These include, but are not limited to telework options, alternate duties, alternating schedules, and enforcing of co-workers adherence to health & safety protocols. Accommodations will be provided if necessary to perform essential job functions in accordance with the ADA.

• Health and safety protocols may be adjusted on a case-by-case basis as determined by the Superintendent in consultation with building level administration, at-risk individual and physician.

• When the NDDoH or Ramsey County Health inform the district of a student or staff member that is COVID-19 positive that information will be passed on to the District Office and the building principal / director as allowable within district policy and law.

Isolation & Quarantine • Definitions (see appendix for more information).

o Isolation – For people who are already sick from the virus. A prevention strategy used to separate people who are sick with the virus from healthy people.

o Quarantine – For people who are not sick but have been exposed to the virus. A prevention strategy used to monitor people who were exposed for a period of time.

• DLPS will follow isolation and quarantine guidelines and directives as set by NDDoH and Ramsey County Health.

If a student or staff member becomes sick at school (or school event) • Student

o Direct / escort the child to the office. o The child should be wearing a facial covering and isolated in the building sick room. o Parent / guardian will be contacted immediately to pick up their child. o The building will continue to receive routine cleaning procedures.

• Staff o Inform your supervisor immediately and wear a face mask until they can be replaced if supervising students at that

time. o Leave the school building / grounds and consult with a health care professional. o The building will continue to receive routine cleaning procedures.

o Coworkers are expected to continue to report to work as usual if asymptomatic. o The employee may be eligible for Emergency Paid Sick Leave under the Families First Coronavirus Response Act

(FFCRA). Contact the District Office for more information.

Return to School • When a student or staff member has been isolated or quarantined as directed by NDDoH or Ramsey County Health

they will be allowed to return to school after being cleared by the NDDoH.

Other Situations • Staff member is healthy but has a household member undergoing testing for COVID-19

o Staff member must notify their direct supervisor. o Staff member can continue to report to work, unless being tested themselves. If being tested themselves, they

should self-isolate until test results are received. o The building will continue to receive routine cleaning procedures. o Coworkers are expected to continue to report to work as usual if asymptomatic.

• Student is healthy but has a household member undergoing testing for COVID-19 o The student or their parent/guardian must notify their building principal o The student can continue to report to school, unless being tested themselves. If being tested themselves, they

should self-isolate until test results are received. o Student’s schools will continue to receive routine cleaning procedures.

• Staff member is healthy but has a household member with COVID-19 o Staff member must notify their direct supervisor. o Self-quarantine at home, avoid congregate settings, public activities, and practice social distancing for 14 days

after last exposure or further physician guidance. o The building will continue to receive routine cleaning procedures. o Coworkers are expected to continue to report to work as usual if asymptomatic. o The employee may be eligible for Emergency Paid Sick Leave under the Families First Coronavirus Response Act

The employee has not had a fever (temperature greater than 100.4 degrees) for 24 hours without the use of fever-reducing medications.

Employee's symptoms have improved (for example, employee's cough and shortness of breath). At least 10 days have passed since the employee's first symptoms appeared.

o NDDoH and Ramsey County Public Health will lead the contact investigation. o The employee may be eligible for Emergency Sick Leave under the FFCRA or traditional Family Medical Leave

(FMLA). Contact the District Office for more information. o The employee's workspace/classroom will be cleaned and disinfected as soon as possible. o The building’s common areas (bathrooms, breakroom, etc.) will be cleaned and disinfected. o The employee's coworkers identified as close contacts will be contacted by NDDoH or Ramsey County Public

Health. If the employee's coworker is not contacted by NDDoH or Ramsey County Public Health, the coworker was not considered to be a close contact.

Close contact is defined by the NDDoH as “being less than 6 feet of a COVID-19 case for a prolonged period of time (15 minutes or more). Close contact can occur while caring for, living with, or sharing a

health care waiting area or room with a COVID-19 case, or having direct contact with the infectious secretion of a COVID-19 case (being coughed on).”

New guidance issued September 30, 2020 – “This guidance allows for the consideration of face mask use to determine if a person exposed to someone with COVID-19 will need to quarantine.”

For non-health care, non-essential settings, quarantine is no longer necessary if a potential exposure occurs while both the infectious individual AND the close contacts are wearing face coverings consistently and correctly. These guidelines do NOT apply to household contacts; all household contacts need to quarantine.

o The coworkers will self-monitor for symptoms and continue to work unless notified by NDDoH or Ramsey County Public Health to stay home.

o The staff member is required to provide a return to work document from the NDDoH or their health care provider before returning. The report will be submitted to the staff members direct supervisor.

• Student is confirmed to have COVID-19 o Parent/Guardian immediately informs their building principal.

o Student will self-isolate in their place of residence until the following three are met:

The student has not had a fever (temperature greater than 100.4 degrees) for 24 hours without the use of

fever-reducing medications.

Student symptoms have improved (for example, cough and shortness of breath).

At least 10 days have passed since the student’s first symptoms appeared.

o NDDoH or Ramsey County Public Health will lead the contact investigation.

o Student’s classroom will be cleaned and disinfected as soon as possible. o Common areas (bathrooms, breakroom, etc.) will be cleaned and disinfected.

o Individuals identified as close contacts will be contacted by NDDoH or Ramsey County Public Health. If an

individual is not contacted by NDDoH or Ramsey County Public Health, the individual was not considered to be a

close contact.

Close contact is defined by the CDC as, “anyone who was within 6 feet of an infected person for at least

15 minutes starting from 48 hours before the person began feeling sick until the time the patient was

isolated.”

• A student has a fever and/or respiratory symptoms but was not tested o The parent/guardian must keep their student at home. o Student will self-isolate in their place of residence until the following two are met:

The student has not had a fever (temperature greater than 100.4 degrees) for 24 hours without the use of fever-reducing medications.

Student’s symptoms have improved.

• Staff member is tested, and results indicate employee does not have COVID-19 o Employee is able to return to work once the following criteria are met:

The employee has had no fever (temperature greater than 100.4 degrees) for at least 24 hours without the use of fever-reducing medications.

Employee's other signs and symptoms of illness are improved.

• Student is tested and results indicate the student does not have COVID-19 o Student is able to return to school once the following criteria are met:

The student has had no fever (temperature greater than 100.4 degrees) for at least 24 hours without the use of fever-reducing medications.

Student’s other signs and symptoms of illness are improved.

• Staff member thinks they may have been at the same location as a person who was diagnosed with COVID-19 o The NDDoH or Ramsey County Public Health conducts interviews with all persons diagnosed with COVID-19 to

determine who their close contacts are. People who are identified as close contacts will be notified and will receive instruction on quarantine and monitoring.

o Being in an indoor environment (e.g., store, workplace, restaurant) with someone who has COVID-19 is not necessarily considered having close contact.

o An employee who has not been contacted by the NDDoH or Ramsey County Public Health as a close contact will report to work as usual.

• Student (or their parent/guardian) thinks they may have been at the same location as a person who was diagnosed with COVID-19 o The NDDoH and Ramsey County Public Health conducts interviews with all persons diagnosed with COVID-19 to

• Secondary contacts are contacts of someone who has been identified as a close contact. o Employee will report to work as usual as long as the employee is not sick. o The student will report to school as usual as long as they are not sick.

• Staff member has completed the COVID-19 isolation period, has met the following criteria, and is prepared to return to work o The employee has not had a fever for at least 24 hours (temperature greater than 100.4 degrees) without the use

of fever-reducing medications. o Employee's other symptoms have improved. o At least 10 days have passed since the employee's first symptoms appeared. o The employee is required to provide a return to work document/fitness for duty from the NDDoH or their health

care provider before returning to work. The fitness-for-duty report will be submitted to the District Office. The Business Manager will inform the supervisor of the employee's clearance to return to work. If the employee submits directly to the employee’s supervisor, that supervisor must send the report to the District Office prior to allowing the employee to return.

• Student has completed the COVID-19 isolation period, has met the following criteria, and is prepared to return to school o At least 10 days since symptoms first appeared, o At least 24 hours with no fever without fever-reducing medication, and o Symptoms have improved. o The student is required to provide a return to school document from the NDDoH or their health care provider

before returning to school. The report will be submitted to the main office at the school, who will inform the student’s teacher(s) of the student's clearance to return to work. If the student submits directly to their teacher, that individual must send the report to the school office prior to allowing the student to return.

In accordance with the guidance from the Centers for Disease Control and Prevention (CDC) and the North

Dakota Department of Health (NDDoH), the procedures listed must be followed by all employees of Devils

Lake Public Schools in relation to COVID-19. Any employee member who does not comply with these

procedures will be subject to disciplinary action to include termination.

Note: failure to adhere to quarantine is a Class B misdemeanor, which could result in 30 days imprisonment and/or up to a $1,500 fine (NDCC 23-07.6-02(3)).

TEACHING & LEARNING

Instructional Models The instructional models used by the district will be guided, in part, by the risk level of COVID-19 in the

community as defined within the phases below. This is a guide as instructional models could be altered based

on other factors, such as occupancy levels, age of children, and abilities to move certain classes online.

Traditional Learning Instruction is delivered in-person with some building and group modifications. Teachers and students maintain a normal daily schedule. Safety protocols are implemented to enhance staff and student safety.

Blended Learning Students report to school on a modified schedule. Student schedules may be varied to meet the learning needs of each child. Multiple hybrid models of instructional delivery may be appropriate. Instruction would be conducted both in-person and online.

Distance Learning All instruction is provided off-campus through the use of distance learning resources or suited to the unique needs of the student. Virtual Learning Families that have immunocompromised students or significant safety concerns may for the 2020-2021 school year, commit to virtual learning at each grade level that will provide all instruction to educational standards of the district. Families in this option must commit to a full semester of virtual learning. Instruction may be provided by a third-party program that is monitored by district staff.

Equitable Services Devils Lake Public Schools will work in conjunction with Lake Region Special Education (LRSE) to make educational

decisions for students with IEPs on an individual basis in compliance with the Individuals with Disabilities Education Act

(IDEA) and the North Dakota Department of Public Instruction Office of Special Education. The learning environment,

services, and accommodations for students with disabilities will be determined through the student’s IEP or 504 team.

Our goal is to develop plans that will ensure equitable and effective access to provide FAPE for students with special

needs in ALL learning environments.

Instructional Phases School districts are encouraged to utilize the phased outlined by the North Dakota Department of Health, North Dakota

Department of Public Instructions and Governor’s Office. The district has created guidelines that correspond with each

phase. To accommodate specific needs within the school district and building levels, the district may opt to, as

appropriate, implement health and safety measures in a higher tier. This may include, up to, school closures. This will be

done after consultation with Ramsey County Health and the impacted Building(s) COVID-19 Coordinator. Any change to

the phase would be immediately communicated to allow for appropriate implementation for families and at the

building/district level.

Phase 1 – In-person Learning without Restrictions Students would return to school and all restrictions lifted

Phase 2 – In-person Learning with Restrictions Students return to school with new health & safety requirements.

Phase 4 – Hybrid Learning (Entire District) Students at all levels will have a hybrid bi-weekly AB schedule to limit daily enrollment and accommodate for additional physical distancing.

Phase 5 – Distance Learning Students learn using our district distance learning plan.

Virtual Learning Families that have immunocompromised students or significant safety concerns may for the 2020-2021 school

year, commit to virtual learning at each grade level that will provide all instruction to educational standards of the

district. Families in this option must commit to a full semester of virtual learning. Instruction may be provided by a

third-party program that is monitored by district staff.

First Four Weeks Focus The North Dakota Department of Public Instruction requires the following of districts as part of the ND K-12

SMART RESTART guidance:

• Districts are required to demonstrate ongoing understanding and growth toward academic proficiency

in grade level or advanced grade level content.

• Districts will assess students within the first four weeks of the school year for all students, kindergarten

through grade twelve.

Devils Lake will focus on the following within the first four weeks of school being in session:

• Establishing strong, meaningful relationships as the foundation to effective teaching and learning

• Teaching students HOW to learn remotely (digital competency): modeling and practicing effective

procedures and protocols; familiarizing students with technology-based platforms; learning problem-

solving strategies and resources, etc.

• Assessing student knowledge and skill gaps and needs.

Mental Health The Devils Lake Public Schools is committed to ensuring that students continue receiving support for their

mental health and well-being, their social and emotional learning, career, and academic planning for their

future. The following supports will be offered to our learners and their families:

• Social-Emotional Lessons and resources will be provided through a variety of formats: Seesaw, Google

Classroom, or in person learning. These activities will be intentional to connect, support, empower, and

value adults and students.

• Social-emotional teaching resources will be provided to support student learning.

• We will continue to work with our community partners to make appropriate referrals for students

requiring more intensive support.

• Our team will consult with teachers in support of their work with students who may experience

struggles while working remotely.

• Our team will work to help families remove barriers they may be experiencing while trying to help their

students access the tools needed for their education.

• Our team will continue to be available for students who need additional social emotional support.

• Student screening after 6-weeks of school allows for ongoing support of strengths, needs and

continuous improvement to SEL instruction.

Professional Development The district has/will be taking the following steps to provide professional development for our staff:

• All district staff will be required to attend training on the implementation of our Health and Safety

Plan. The training on this plan will be provided in partnership with our public health agencies during

the back to school inservice days. To provide additional time for professional development, building

setup, staff preparations and communication and planning with families, the beginning of school has

been changed to Wednesday, September 2nd, one week later.

• Each teacher is equipped with a district-issued computer that allows video streaming, network access,

access to various applications and resources, etc. Our technology department is available for any

technology support that is needed.

• Our district professional development team will respond to the professional development needs of our

staff for established online communication and educational platforms, and will provide webinars,

tutorials, and other supports according to request and identified needs.

• Devils Lake Public Schools is a Google Apps school system. Teachers and students will utilize SeeSaw

Zoom, and Google applications including Google classroom, Meet, Hangout, and all affiliated

applications which will allow for seamless information exchange.

• Resources will be available to assist all employees with creating video conferences and meetings to

allow virtual contact.

• School sites will establish meeting times during which employees will troubleshoot, share best

practices, and learn new strategies around effective distance learning from instructional design

coaches and other colleagues.

• Staff may be cross trained to perform essential functions so the school/district can continue operations

even with increased absenteeism.

Following is information regarding compensation and work expectations for employees of Devils Lake Public

Schools related to changes in working conditions of schools and buildings in the event of closure due to COVID-19

related circumstances.

This communication supersedes any previous communication relating to compensation and work expectations.

This information is effective August 10, 2020 and is subject to change at any time as we react to a constantly

changing environment.

In the event a building is shut down, the Devils Lake Public School District will make every effort to keep all

employees working in a similar capacity, however, is unable to guarantee work. The employee(s) impacted will

utilize their applicable leave or leave without pay if applicable leave options are exhausted. If the impacted

employee(s) is/are reassigned during a closure and unwilling to perform the duties of the reassignment then the

employee(s) will utilize their applicable leave or leave without pay if applicable leave options are exhausted.

All District and School Administrators are considered Task Essential Employees and will be working according

Certified Staff Represented Under the Teacher Negotiated Agreement

Devils Lake Public Schools intends to open with face to face instruction with the ability to transition to distance

learning when necessary. All teachers will be expected to work as outlined in the applicable Instructional Models

provided throughout the Health and Safety Smart Restart District Plan.

Full pay per your contract will continue under the Instructional Models provided throughout the Health and Safety

Smart Restart District Plan. However, if a staff member will not be able to work on a contract day, the applicable

leave will be required to be taken. The staff member must notify their Principal/Supervisor and fill out a Request

for Absence form found in the employee’s school main office.

If an absence is related to COVID-19, Federal legislation includes additional sick and family leave that an employee

Families First Coronavirus Response Act: Employee Paid Leave Rights

The Families First Coronavirus Response Act (FFCRA or Act) requires certain employers to

provide employees with paid sick leave or expanded family and medical leave for specified

reasons related to COVID-19. The Department of Labor’s (Department) Wage and Hour Division

(WHD) administers and enforces the new law’s paid leave requirements. These provisions will

apply from the effective date through December 31, 2020.

Generally, the Act provides that employees of covered employers are eligible for:

• Two weeks (up to 80 hours) of paid sick leave at the employee’s regular rate of pay

where the employee is unable to work because the employee is quarantined (pursuant to

Federal, State, or local government order or advice of a health care provider), and/or

experiencing COVID-19 symptoms and seeking a medical diagnosis; or

• Two weeks (up to 80 hours) of paid sick leave at two-thirds the employee’s regular

rate of pay because the employee is unable to work because of a bona fide need to care

for an individual subject to quarantine (pursuant to Federal, State, or local government

order or advice of a health care provider), or to care for a child (under 18 years of age)

whose school or child care provider is closed or unavailable for reasons related to COVID-

19, and/or the employee is experiencing a substantially similar condition as specified by the

Secretary of Health and Human Services, in consultation with the Secretaries of the

Treasury and Labor; and

• Up to an additional 10 weeks of paid expanded family and medical leave at two- thirds

the employee’s regular rate of pay where an employee, who has been employed for at

least 30 calendar days, is unable to work due to a bona fide need for leave to care for a child

whose school or child care provider is closed or unavailable for reasons related to COVID-

19.

Covered Employers: The paid sick leave and expanded family and medical leave provisions of

the FFCRA apply to certain public employers, and private employers with fewer than 500

employees.[1] Most employees of the federal government are covered by Title II of the Family

and Medical Leave Act, which was not amended by this Act, and are therefore not covered by

the expanded family and medical leave provisions of the FFCRA. However, federal employees

covered by Title II of the Family and Medical Leave Act are covered by the paid sick leave

provision.

Small businesses with fewer than 50 employees may qualify for exemption from the

requirement to provide leave due to school closings or child care unavailability if the leave

requirements would jeopardize the viability of the business as a going concern.

Eligible Employees: All employees of covered employers are eligible for two weeks of paid sick

time for specified reasons related to COVID-19. Employees employed for at least 30 days are

eligible for up to an additional 10 weeks of paid family leave to care for a child under certain

circumstances related to COVID-19.[2]

Notice: Where leave is foreseeable, an employee should provide notice of leave to the

employer as is practicable. After the first workday of paid sick time, an employer may require

employees to follow reasonable notice procedures in order to continue receiving paid sick

time.

Qualifying Reasons for Leave:

Under the FFCRA, an employee qualifies for paid sick time if the employee is unable to work (or

unable to telework) due to a need for leave because the employee:

1. is subject to a Federal, State, or local quarantine or isolation order related to COVID-

19;

2. has been advised by a health care provider to self-quarantine related to COVID- 19;

3. is experiencing COVID-19 symptoms and is seeking a medical diagnosis;

4. is caring for an individual subject to an order described in (1) or self-quarantine as

described in (2);

5. is caring for a child whose school or place of care is closed (or child care provider is

unavailable) for reasons related to COVID-19; or

6. 6. is experiencing any other substantially-similar condition specified by the Secretary of

Health and Human Services, in consultation with the Secretaries of Labor and Treasury.

Under the FFCRA, an employee qualifies for expanded family leave if the employee is caring

for a child whose school or place of care is closed (or child care provider is unavailable) for

reasons related to COVID-19.

Duration of Leave:

For reasons (1)-(4) and (6): A full-time employee is eligible for 80 hours of leave, and a part-time

employee is eligible for the number of hours of leave that the employee works on average over a

two-week period.

For reason (5): A full-time employee is eligible for up to 12 weeks of leave (two weeks of paid sick

leave followed by up to 10 weeks of paid expanded family & medical leave) at 40 hours a week,

and a part-time employee is eligible for leave for the number of hours that the employee is

normally scheduled to work over that period.

Calculation of Pay:[3]

For leave reasons (1), (2), or (3): employees taking leave are entitled to pay at either their

regular rate or the applicable minimum wage, whichever is higher, up to $511 per day and

$5,110 in the aggregate (over a 2-week period).

For leave reasons (4) or (6): employees taking leave are entitled to pay at 2/3 their regular rate

or 2/3 the applicable minimum wage, whichever is higher, up to $200 per day and $2,000 in

the aggregate (over a 2-week period).

For leave reason (5): employees taking leave are entitled to pay at 2/3 their regular rate or 2/3

the applicable minimum wage, whichever is higher, up to $200 per day and

$12,000 in the aggregate (over a 12-week period). [4]

[1] Certain provisions may not apply to certain employers with fewer than 50

employees. See Department FFCRA regulations (expected April 2020).

[2] Under the Act, special rules apply for Health Care Providers and Emergency

Responders.

[3] Paid sick time provided under this Act does not carryover from one year to the next.

Employees are not entitled to reimbursement for unused leave upon termination, resignation,

retirement, or other separation from employment.

[4] An employee may elect to substitute any accrued vacation leave, personal leave, or medical

or sick leave for the first two weeks of partial paid leave under this section.
