Advocates Act, 1961,

(ii)(a) Must be practising as an Advocate/Pleader in theHigh Courts or Supreme Court or Courts Subordinatethereto and must have practiced for a period of not lessthan seven years on the date of notification

or(b)Must be an Assistant Public Prosecutor having not

less than seven years of experience as an Advocate and/orAssistant Public Prosecutor on the date of notification.

(c) Must have practised for a period otnot less than 7years on the date of notification and continue to be apracticing Advocate/working Assistant Public Prosecutortill the date of selection and appointment.

(iii) The applicants applying under the category of "practicing Advocates" must bepracticing. as Advocate in Courts of Civil and/ or Criminal Jurisdiction on thedate of notification and continue to be practicing Advocate till the date ofselection and appointment.

3. ELIGIBILITY

i.THE APPLICANT:a) Must be a citizen of India;

b) Must possess adequate knowledge to read, write and speak in Englishand Tamil or Malayalam or Telugu.

Note:- The successful candidates who have not studied Tamil as second language inS.S.L.C. / Matric, must pass the Tamil Language Proficiency Test within theperiod of probation.

ii.CHARACTER AND CONDUCT:

(a) The character of a candidate must be such as to make him suitable in allrespects for appointment to the Service. The applicant must produce acertificate of character and good conduct given after the date of notificationfrom three responsible persons not related to him, in the format prescribed inAnnexure-A. Out of the three persons certifying, one must be a SeniorAdvocate or counsel and the other two must be responsible persons, not beingrelatives of the applicants but who are well acquainted with the applicants intheir private life.

(b) No person shall be appointed as a member of the Service unless he is in good

mental and physical health and is free from any disability, except a person

who is claiming reservation under The Right of Persons with Disabilities Act,

2016. Before appointment, candidates with disability shall be required to

appear before the Medical Board constituted for assessment which will

examine them and certify whether they are fit for appointment to the service

and their disability will not affect the effective performance of duty as a

member of the service.

(c) Must satisfy such other conditions prescribed in "the Rules" for appointment

to, the post of District Judge.

4. DISQUALIFICATION FOR APPOINTMENT

No person shall be qualified for appointment to the Service or being in service:-

(i) Who has entered into, or contracted marriage or living in relationship with aperson having a spouse living, or who, having a spouse living, has entered into or

contracted a marriage or living in relationship with any person;

(ii) If dismissed or removed or stigmatic termination from services by, CentralGovernment or High Court or any State Government or Statutory or Local

authority or from any employment, or

If a candidate after being selected as a Assistant Public Prosecutor I JudicialOfficer has been discharged/removed from service or convicted of any offence, or

Ifa candidate who is or has been temporarily or permanently debarred ordisqualified by the High Court or the Union Public Service Commission or anyState Public Service Commission or any other Recruitment Agency, Board orCommission, from appearing for examinations/interview or selections conducted

by it, or

If a candidate has been removed or suspended from its roll by the Bar Council, or

If any disciplinary proceedings or penalty or punishment has been imposed orcontemplated by the Bar Councilor any Disciplinary Authority or Court, whichin the opinion of the Hon'ble High Court, renders him unsuitable for appointmentin Judicial Service, or

If being Assistant Public Prosecutor/Government Pleader/Judicial Officer, placedunder suspension/Disciplinary Proceedings initiated /contemplated or pending.Under Central Civil Services (Classification, Control and Appeal) Rules, 1965 orany other Rules.

(iii) If, being an Advocate, was found guilty of professional misconduct by the BarCouncil under the provisions of Advocates Act, 1961 (Central Act 25 of 1961) ororders of the Court or Judicial forum.

(iv) a) If, the candidates do not fulfil the conditions prescribed in "the Rules", or

b) If, he/she influences or attempts to influence, or obtains or attempts toobtain, any favour in any form at any stage of Selection process; or

c) Impersonates by or for the candidate; or

d) Makes or submits any forged documents in support of his or her candidature;or

e) If he/she conceals any material information or provides any falseinformation or makes false/wrong claim at any stage of selection process, or

f) If he/she uses or attempts to use, improper or illegal means, either forpurpose of being permitted to appear in examination or at any stage ofexamination, in examination room/hall, or

g) If he/she, during written examination harasses or threatens or usesun-parliamentary words or causes physical injury to or misbehaves with,any Officer or employee engaged; or

i) If he/she attempts to enlist support or canvasses in any form for his/hercandidature or selection/appointment, through persons of influence or

.officers of Government/High Court will also disqualify him/her fromappointment.

5. PRACTICE IEXPERIENCE CERTIFICATE /NO OBJECTION CERTIFICATEISERVICE CERTIFICATE TO BE PRODUCED IN ORIGINAL WHEN CALLED FOR -

(a) Besides submitting the Degree Certificate and Enrolment Certificate issuedby the Bar Council, Bar experience certificate shall be submitted byapplicants coming under the category of "Practicing Advocates" in theformat prescribed in Annexure-B. (From the authorities specified below).

(i) In case of applicants practicing as Advocates in the High Court of Madrassuch certificate of practice should be obtained from the Registrar (Judicial)at the Principal Seat or at the Madurai Bench of the High Court, as the casemaybe.

(ii) In case of applicants practicing as Advocates in the High Courts of otherStates and the Supreme Court of India, New Delhi, such certificate should be'obtained from the Registrar, who is in charge of the Judicial side ofrespective High Court or the Supreme Court of India, New Delhi, as the casemay be.

(iii) In the case of Advocates, practicing in Subordinate Courts, such Certificateshould be obtained from the Presiding Officer of the Court in which thecandidate is / has been practicing.

(b) In case of applicant coming under the category of "Assistant Public Prosecutoror Government Pleader /Judicial Officer", besides the appointment order asAssistant Public Prosecutor or Government Pleader, No Objection / ServiceCertificate from the Head of Department /High Court specifying the length ofqualifying service of the candidates' shall be submitted in the format prescribedin Annexure 'C'.

(c) In case of serving Judicial Officers applying for the post, they shall obtain' NoObjection/Service Certificate' from the Registrar General of the High Courtcon~erned specifying the length of service in the format prescribed inAnnexure C.

6. CERTIFICATE OF PHYSICAL FITNESS

Candidate selected for appointment to the post of District Judge (Entry Level) willbe required to produce a certificate of physical fitness in accordance with thestandard prescribed for the Indian Administrative Service, before his/herappointment.

7. FEES

Examination fee Rs.2,OOO/- for all applicants.

Note:, No fee exemption can be claimed by the candidates belonging to ReservedCategory/Differently Abled /Destitute Widow/Ex-Service Men.

8. MODE OF PAYMENT OF EXAMINATION FEES:-

1. After submission of application, the applicant shall take printout of 'Challan' thatis generated and remit the requisite fees along with service charges levied by thebank before the last date prescribed for remittance of fee, at any branch of IndianBank. The branch concerned will retain the Bank Copy of the 'Challan' andreturn the ""Applicant Copy" to the applicant, which shall be retained by theapplicant and cited for all future references/disputes, if any, regarding thepayment of fee.

11. Failure to pay the fee prescribed within the time stipulated will result in rejectionof applica tion.

111. No other mode of payment like Demand Draft/Postal Orde~/Cheque/NEFT/RTGS or any other mode of online payment will be entertained and thoseapplications will he summarily rejected.

IV. Fees once paid, shall not be refunded or adjusted towards any other recruitmentunder any circumstances.

9. SCHEME OF EXAMINATIONS

sheets written partly in English and partly in Tamil or in any other Languagewill not be evaluated and the same will be invalidated.

(ii) The candidate shall appear for all the four papers in the Main WrittenExamination for his answer sheets to be evaluated and in case the candidateabsents himself for one or more papers, all his attended papers will not beevaluated.

(iii) The candidate who has secured less than the minimum marks prescribed foreach paper in the Main Exa~ination shall not be eligible for Viva Voce Test.

(iv) The candidate shall strictly adhere to the instructions given while appearingfor the Preliminary and Main Examination conducted by the High Court. Incase of any deviation, the answer sheets of the candidates concerned will beinvalidated.

(v) It is made clear to the candidates that quoting the principle lai~ down orreiterated in any citation would be enough and quoting of citation shall notcarry any extra weightage. Further the quoting of wrong citation may bedetrimental to candidates.

(vi) Any representation by the candidate for changing the dates ofexamination/selection process, change of examination centre, for relaxation ofconditions mentioned in the advertisement or Examination related directionsor guidelines or minimum marks or qualifications/requirements etc. or forrevaluation, shall not be entertained.

(vii) All the directions/instructions/guidelines and formats issued regardingexamination shall be treated as part of the advertisement.

(viii) Out of the successful candidates in the Main examination, candidates forViva-Voce test will be shortlisted in the ratio of 1:2 or 1:3 or in the ratio asdeemed fit.and proper by the High Court.

(C) VIVA- VOCE TEST

Viva-voce test shall be for hundred (100) marks and candidates shall obtainminimum 40 marks for a pass in the Viva-voce.

candidate, his/her tact and ability to handle varIOUSsituations In the Court,Administrative and Management Skills.

2. Candidates who have obtained a minimum of 40 marks in the viva-voce test 'aloneare eligible for inclusion in the Select List.

3. Since 'Character' and 'Suitability', of a Candidate, are of utmost importance, forbeing considered, for appointment to the Puducherry Judicial Services as DistrictJudge (Entry Level), the Character and Suitability of the candidate would beenquired into and verified by the Competent Authority, prior to the Viva-Voce(Personal Interview).

10. PREPARATION OF SELECT-LIST:

Selection of candidates shall be made on the basis of Total Marks obtained by the

candidates in the Main Written Examination & Viva-voce.

Note:The candidates who are convicted, acquitted, proceedings quashed, discharged,further proceedings closed under section 258 Cr.P.C., investigation stopped undersection 1,67 (5) Cr.P.C., proceedings closed under section 468 Cr.P.C., in such cases thesuitability of such candidates are subject to the final approval of the High Courtbefore their appointment.

11. CENTRE FOR EXAMINATIONS:

The Preliminary and Main Examinations will be held only at Puducherry. The Viva-Voce will be held at Chennai.

Note - (i) Request for change of venue will not be entertained under anycircumstances.

(ii) The High Court reserves right to increase or decrease the number ofexamination venues and re-allot the candidates accordingly.

(iii) Candidates should appear for the Preliminary/Main Examination!Certificate Verification! Viva Voce Test at their own expenses.

12. INFORMATIONIINSTRUCTIONS TO THE CANDIDATES

A. Success in the examination does not confer any right to appointment unless theHigh Court of Madras is satisfied after such enquiry as may be considerednecessary that the candidate is suitable in all respects for appointment ..

B. E. The Candidate shall furnish:

(i) Correct and true information regarding arrest, described but name notspecifically mentioned in FIR, facing/concluded criminal proceedings, chargesframed, accused in private complaints, convictions/proceedings closed!dropped from charges/ discharged /acquitted or proceedings quashed by anyCourt of law, or

(ii) The details with regard to debarment / disqualification by any ~ecruitingagency, criminal or any disciplinary proceedings initiated / pending orfinalised, participation in agitation or affiliated to any Political Organisation,or

(ivrrhe details such as originals of the judgment, order/ or G.O. dropping furtheraction in departmental proceedings or any document that may prove thesuitability of such applicants for a Government appointment in such casesmust be produced at the stage / time of certificate verification without fail.

(v)All information that relates to the suitability of the applicants for theappointment, which arises after the submission of application and till the dateof his /her selection and appointment, shall be reported to the High Court inwriting immediately.

F. Incomplete applications and applications containing wrong claims or incorrectparticulars relating to category of reservation / other basic qualifications /eligibility / agel communal categories / educational qualification / physicalqualification will be liable for rejection. The candidate will also be debarred fromappearing for all future examinations and selections conducted by the MadrasHigh Court. Suppression of facts or false claim, if any is noted subsequently, theselection of the candidate concerned will be declared invalid.

13. INFORMATION UNDER RIGHT TO INFORMATION ACT AND CLAIM FORREVALUATIONIRE- TOTALLING:

a) No candidate is permitted to peruse/obtain copies of the answer .sheets(Preliminary and Main Examination) till finalization of the recruitment process.

b) Information can be sought with regard to details of marks (raw and scaled)awarded to the Candidates in each and every stage, only after the finalization of

the recruitment process.

Key answers intended for valuation for the Preliminary exam will be published inthe High Court's website after completion of the Preliminary Examination.How.ever, no key answers for the Main Examination will be published or provided

to the candidates.

c) Request for re-valuation and re-totalling of marks in the answer sheets of thePreliminary Examination & Main Examination will not be entertained.

d) If any dispute or question arIses relating to disqualification/suitability of theCandidates or interpretations of the Rules, the decision of the Hon'ble High Court

of Madras, shall be final.

14. COMMUNICATION TO THE CANDIDATES AND COMMUNICATION FORGRIEVANCES:

(i) Grievance Redressal Cell for guidance of applicants: In case of anyguidance/information/clarification regarding applications, candidature, etc.,applicants can contact the Registry of High Court, Madras over Telephone No044 - 25301388 on all working days between 10.00 a.m. and 05.45 p.m. orthrough e-mail:recrui tmen t.mhc@gov .in.

(ii) Individual communication regarding the date and time of certificate verification,Viva Voce Test and counselling will not be sent to the candidates by post. Alldetails will be made available on the High Court's website. Candidates will beinformed of the above fact only through SMS and registered e-mail and theyshould visit the High Court's website periodically and keep themselves updated.

(iii) No Call Letter or Hall Ticket will be sent by post and the same will be madeavailable online.

15. OTHER IMPORTANT INFORMATION

(a) The decision of the High Court of Madras as to the eligibility or otherwise of acandidate for admission to the Preliminary Examination, Main Examination orViva Voce Test shall be final. Only candidates, to whom hall tickets have beenissued by the High Court, shall be admitted for Examination (Preliminary andMain) and Viva-voce.

(b) Mobile Phones and other Articles Banned

16. GENERAL INSTRUCTIONS TO CANDIDATES FOR EXAMINATION

1. Candidates have to be decently dressed and should reach the Examination hall 30minutes before commencement of the Examination with the Hall Tickets. On noaccount an applicant will be allowed inside the examination hall after 30 minutes

of the commencement of examination.

2. Candidates shall appear for the examination only in the venue mentioned in theHall Ticket. Change of Venue will not be permitted.

3. Candidates shall show the Hall Ticket to the Invigilator / ChiefInvigilator/lnspection authorities at the examination centre, on demand for

verification.

4. Candidates shall maintain strict discipline in the examination venue. Applicantsfound smoking or inebriated or found to have entered into quarrel of any kind, ormisbehaved with the Chief Invigilator or with the inspection Authorities or withthe Invigilator or with any other applicant who has come to write theexamination in the Examination venue, are liable for severe action including

appropriate criminal action.

5. Tea, Coffee, snacks, soft drinks etc., will not be allowed inside the examination

venue.

6. Candidates should always sit in the seat allotted to them as per their RegisterNumber and must not change it, they shall adhere to the instructions given forfilling up of answer sheets. Before filling up the details they should check theanswer sheets / answer books to see whether it is printed properly, not damagedand has a number assigned on it.If Answer Sheet/Answer Book is defective in any way, the candidate shouldimmediately inform the invigilator before filling up the candidate's particularsand the invigilator will replace it. Once the candidate has commenced writing, the

.answer sheet / answer book will not be replaced.

7. The Candidate will be supplied with Question Booklet 10 minutes beforecommencement of the Examination. Before writing or shading the answer,

candidate should ensure that all the questions are there in seriatim wIthout anyomission and there are no blank pages in Question Booklet. In case any defect isfound it shall be reported to the Invigilator immediately, who will replace thesame with a new Question Booklet.

8. Candidates should carry only, Ball Point Pen (Blue or Black) and Hall Ticketinside the Examination Hall. Other materials are not allowed.

9. Borrowing of any material, instruments from other candidates duringexamination is strictly prohibited.

10. For the Preliminary Examination the candidate should shade the answer fieldcompletely, as per the correct method indicated in the first page of the OMRanswer sheet.

11. Candidates are strictly prohibited from involving in any indiscipline or irregularpractices like, consulting with other applicants, copying, permit his/her papers to

. be copied, carrying notes, seeking the help of an Invigilator / any outsider, etc.Any violation would lead to the applicants being expelled from the ExaminationHall and their Answer sheet will be invalidated. They shall be debarred from thepresent and future examinations.

number, along with the Photostat copy of the question paper, self attested photocopies of source document~/ proof on the basis of which he/she submits objections/clarifications. In such representations, Register Number, Name and address ofthe applicant, Question Number, etc. should invariably be quoted. Norep~esentation received after two days from the date of examination or withoutany of the requisite particulars will evoke any response.

16. .It is cautioned that the Candidates are required to write their Roll No. only inthe ,space provided for that purpose at the first cover-page in the answer book.Writing of, his/her own name or roll no. or any mark of identification in any formor any Number or name or mark, by which the answer-book of a candidate maybe distinguished/ identified from others, in any space other than the one providedfor,' is strictly prohibited and shall, in addition to other grounds, entailcancellation of his/her candidature and withholding of his/her result, withoutassigning any reason. No correspondence, in this regard, shall be entertained.

(ii) Applicants are advised to have a valid Mobile Number/valid personalE-mail ID. (iv) After making payment, the applicant shall select the paymentoption and fill the particulars of the challan and upload the copyof the same to complete the process. On completion, a messagethat "the application has been successfully submitted" willappear on the screen.

(v) The applicants who wish to peruse and take printout of theirfilled in application form shall select the view option anddownload their application in PDF form.

(vi) The applicants need not send the print out to the undersigned orto the High Court.

C.
