Why is Appliance Warranty Limited the best?

Home Appliance Plan: Unique in the market place we offer a Repair Service followed by a Service Check and Service Plan. This is not a scheme where you pay up front and get nothing back, no… we work for you in repairing, checking and maintaining your home appliances in tip top condition.

Weasel Words: For a start we have banished all ‘weasel words’ such as betterment, excess, contamination and wear and tear exclusions – these are the terms other companies often use to reduce the amount of assistance you’re expecting.

Repair and Service Check: At the start of Your Plan, Appliance Warranty Limited may arrange a visit by a fully trained professional technician to repair or check the serviceability and operation of all your Home Appliances.

Telephone Assistance: We include home telephone assistance where Appliance Warranty Limited will provide professional advice and guidance on how to operate, diagnose and solve problems which occur with many of the high tech Home Appliances which we all now use and increasingly rely upon.

Breakdown: Your Home Appliance Plan is designed to meet the cost of repairing or replacing parts of your Home Appliance when a mechanical or electrical part suddenly and unexpectedly stops working as it should, even if this is due to normal wear and tear which is expected when operated as per manufacturer’s instructions.

Important - Read the Small Print: Following on are our terms and conditions which explain how your Home Appliance Plan works and the many benefits you now enjoy as an Appliance Warranty Limited Plan holder. Please ensure that you fully understand the terms and conditions relating to your plan and in particular any Home Appliance servicing requirements and the repairs procedure. Make sure you ‘read and understand fully’ the information provided in the What Your Plan Does Not Include section.

A1 The following words and terminology havethesemeaningsthroughoutYourPlan:

Administration Fee: A fee of £35 to cover ouradministrationcostsandexpenses.

Application:Anyinformationyoumayhavesuppliedto us via either telephone or website quotation orbookingsystemsinsupportofyourrequests.

Appliance Warranty Limited (We, Us, Our): Appliance Warranty Limited, 5 Petre Court, ClaytonLe Moors, Lancashire, BB7 9JL, herein referredto as Appliance Warranty Limited, a wholly ownedsubsidiaryofWiseGroupHoldings.

Authorised Repairer: An independent andprofessional repairer authorised by ApplianceWarrantyLimited.

Breakdown: This is where a mechanical orelectricalPartofyourHomeAppliancesuddenlyandunexpectedlystopsworkingas itshould(whetherornotduetonormal fairwearandtear)whichrequiresrepairorreplacementbeforeitwillworkproperly.

Cancellation Fee: A fee of £50.00 to cover ourcancellationexpenses.

Cancellation Period:Aperiodof30daysfromYourPlanStartDate.

Expected Object(s): are those which are expectedtobe foundandusedby theHomeAppliance in itsusualoperationinaccordancewiththemanufacturer’sinstructions(eg;clothinginawashingmachine).

Geographical Limits: The area in which Your Planis effective which includes; Great Britain, NorthernIreland, Isle of Man and Channel Islands. (Yourresidencemustbewithinthisarea).

Home Appliance:AnyHomeApplianceasidentifiedon Your Plan Schedule. Located at your homeaddress.

Home Appliance Value: The maximum amountthat Your Plan will pay in total during the Period ofYour Plan, including VAT, as shown on Your PlanSchedule. This is usually the cost of a replacementHomeApplianceorthepriceyoupaidforyourHomeAppliance(proofrequired)

Level of Your Plan: As describedwithin Your Plandocument(thisbooklet)andasspecifiedwithinYourpersonalisedPlanSchedule.

Part: Any mechanical, electrical or serviceablePart, capable of replacement, which forms part ofyour Home Appliance’s original specification and isincluded within the Level of Your Plan. (MechanicalPartshavecontact,movementandfunction.Electrical

Parts are powered by electricity. Unless specificallymentioned, wiring, connectors, pipes, hoses andrubberbushesarenotincluded).

Pay As You Go Option: A 12 month Home Appliance Repair & Service Plan with the option to renew monthly (seePlanStartDateandsectionH5.3).

Period of Your Plan: TheperiodshownonYourPlanSchedule.

Plan Holder: (You/Your/Yours) the named owner oftheHomeApplianceasdetailedonthePlanSchedule.

Plan Schedule: Issued by us after receiving yourpaymentbasedupontheApplicationyouhavemadetousandwhichconfirmsouracceptanceofYourPlan.

Plan Start Date: The date Your Plan begins, asdetailed within Your Plan Schedule. Your Plan StartDatemustbeafterbothpaymentisreceivedandanyrequiredServiceCheckhaspassed.

Repair Cost: The total of call out, parts and labourcost,includinganyapplicableVAT.

Repair Authorisation Form: A form issued by UstoYouwhichyoushouldcompleteandreturnfortheRepairCostbepaid.

Repair Number: A number issued by us to youor to your Repairer as proof that a repair has beenauthorised.

Service Check:Thepreliminaryquestionsandcorrectinformationdeclaredbyyouatthetimeofapplication,we may require independent verification of theserviceabilityandeligibilityofYourHomeAppliancebyanAuthorisedRepairer.

Servicing Handbook:ThehandbookissuedwiththeHomeAppliancebythemanufacturer(online,orwithinthe Home Appliance’s integrated data informationcentre) which details the operation, servicing andmaintenancerequirementsforyourHomeAppliance.

Unexpected Object(s): are foreign objects whicharenotexpectedtobefoundandusedbytheHomeAppliance in its usual operation in accordancewiththemanufacturer’sinstructions.

VAT: Value Added Tax which will be calculated atthe prevailing rate (IMPORTANT NOTE: we cannotlegally pay you or your repairer the VAT element ofanyRepairCostwithout a VAT invoicemade out toApplianceWarrantyLimited).

Your Plan: This booklet along with Your PlanApplication, Level of Your Plan details and PlanSchedule which together contain the full terms andconditionsofYourPlan.

B Home Appliance Repair & Service Plan – Benefits IncludedB1 YOUR PLAN-UponyourApplicationandafter

payment has been received for any HomeAppliance to be included within our HomeAppliance Repair & Service Plan (referred toasYourPlan)wemaysendoutanAuthorisedRepairer tocarryoutaServiceCheck. Whenyour Home Appliance passes this processYou will then be issued Your Plan Scheduleand receive the benefits described in YourPlan from Your Plan Start Date. Should yourHomeAppliance fail thisprocessWe reservetheright,inourdiscretiontocancelYourPlanby sending you notice inwriting (byEmail orPost)andby refundingyouanypayment youmayhavemadelesstheCancellationFeeandServiceCheckcosts.

B2 DISCRETION - An important aspect of YourPlan is thatwe both contractually and legallyoperate on a discretionary basis. We usethis discretion to ensure that you receivea fair and equitable resolution to each andevery request you make under Your Plan. Inthe event of any complaint which we cannot resolve between us, Anthea Turner is ourfinal arbiter for the exercise of this discretiononbehalfofApplianceWarrantyLimited,andcanbecontactedviaemailat:[email protected]. This does not affect yourstatutoryrights.

B3 CONTAMINATION - Contamination by anExpectedObject is includedwithinYourPlan.This is where your Home Appliance fails tooperate correctly due to contamination by asingleExpectedObjectwhichwhen removedrenders theHomeAppliance fully operationalwithout need of further repair. ContaminationbyanUnexpectedObjectisexcluded.Wedonotincludeacleaningserviceforblockagesorbuildupofresidues(egfooddebris/limescale/residues/fluffetc).

B4 WEAR AND TEAR-PartswhichhavesufferedaBreakdown(asdefined)duetoadeteriorationinperformanceovertimeasaresultofnormaleveryday expected wear and tear usage areincluded.

B5 ApplianceWarrantyLimitedwillpaytheRepairCost following aBreakdownof a Part of yourHome Appliance, within the GeographicalLimits,outsidethesupplier’sormanufacturer’swarrantyperiod,duringthePeriodofYourPlan,basedupontheLevelofYourPlanandsubjecttothefurtherconditionsandexclusionssetoutherein:

B6 If your HomeAppliance suffers a BreakdownofanycoveredPart,wewill, inourdiscretion,decidewhether topaytheappropriateRepairCost (see B2 which explains our discretion).Todothiswewilldecidewhether tosendoutanAuthorisedRepairer to inspect yourHomeAppliance,whetherornottoapprovearepairofthePartorauthoriseareplacementofaPartor within our discretion replace your HomeAppliance,ifwedecideitisappropriatetodoso in either case pay the appropriate RepairCost.

B7 If your Home Appliance is integrated into orformspartofapieceoffurnitureorunit(s)thatneeds dismantling to gain access to repairor replace your Home Appliance then it isyour responsibility to authorise (at your ownexpense)anysuchwork inorder toallowourAuthorised Repairer to gain access to yourHomeAppliancetorepairit.(Ifindoubt,pleasecheck with us before agreeing to any suchwork).

B8 Wewill pay the Repair Cost of a valid repairuptoandwithinyourHomeApplianceValueatYourPlanStartDate.

B9 ThereisnolimittothenumberofvalidrepairsthatcanbeapprovedduringthePeriodofYourPlanuptoyourHomeApplianceValue.

B10 Thereisnocontribution(excess)requiredfromyou.

B11 There isnoContributionrequiredfromyouforimprovingtheconditionorvalueofyourHomeAppliance (betterment) where a replacementParthasthiseffect.

B12 Anymid-termalterationsyoumaketoincreasetheLevelofYourPlanwillnotcomeintoeffectuntil 30 days from the date of change haveelapsed or until after any further payment ismade,iflater.

C Installation, Operation and Servicing of Your Home ApplianceC1 We expect that you will have followed

the correct installation, operating andservicing instructions which relate to yourHome Appliance as recommended by themanufacturerwithinyourServicingHandbook.

C2 You have a duty of care to look after yourHomeAppliance(seeH2).

C3 You will be expected to pay any additionalchargeswhichrelatetotherectificationofanyinstallationworkortheservicingofyourHomeAppliance.

SIGNIFICANT EXCLUSIONS - NoWarrantyplan covers “everything” as to do so wouldmake the cost of the cover toomuch to bepractical,sowedoneedtomakeyouawarethat the warranty will exclude some things,and we ask that you read Section F “WhatYourPlandoes‘Not’Include”fully.

D Level of Your PlanD1 Your Plan does not include a list of Parts.

Wecoverall Parts (asdefined in sectionA1)of your Home Appliance (or their equivalentif out of stock or discontinued). We may atour discretion, offer to replace your HomeAppliancewithanewsimilar specificationuptotheHomeApplianceValue.AlongwithyourPlan Schedule, these form the Level of Your

Plan.Anyitemwhichisnotspecificallylistedisnotincluded.IfyoubelievethereissomethingwehavemissedofforanitemorfeatureofyourHome Appliance which should be includedthenpleaseinformuswith30daysofYourPlanStartDatewhere,withinourdiscretion,wewilldoourbesttoincludeit.

within the Geographical Limits Your Plan willprovidethefollowing:

F1 YourPlanparticularlyexcludesthefollowing:

F2 HOME APPLIANCES EXCLUDED

F2.1 AnyHomeAppliancewithout a currentand authentic CE Mark or currentmanufacturer’s CE Certificate in force.AnyHomeApplianceprivatelyimportedfromoutsideoftheEUandnotoriginallysupplied via the manufacturer’s EUauthoriseddealer.

F2.2 Any Home Appliance inaccuratelydescribedbyyouwithinyourApplicationoronYourPlanSchedule.

F2.3 Any Home Appliance older than 10yearsfromthedateofmanufactureevenif this age limit is reached during thePeriodofYourPlan.

F2.3.1 The failure of your HomeAppliancetooperateduetothewithdrawal of any servicebyathirdpartyprovider.

F2.4 AnyHomeAppliancewhichatanytimeisdamaged,lost,stolenorsubjecttofireorflood.

F2.5 Any Home Appliance used within abusinessorforabusinesspurpose.

F2.6 Any plug-in Home Appliance with anelectricalpowerconsumptioninexcessof3,000Wattsoranycookerorrangeinexcessof7,500Watts.

F2.7 AnyHomeAppliancewhichisnotownedbyyoupersonally.

F2.7.1 Any Home Appliance which isleased,hiredorrented.

F2.8 AnyHomeAppliancemodifiedfromthemanufacturer’soriginalspecification.

F2.9 AnyHomeAppliancewhereyouaretheowner,proprietorordirectorofaHomeApplianceretailortradesalesbusiness,auctionhouse,repairer, leasing,hireorrentalcompany.

Note: If after Your Plan is established any of the above circumstances come to light, unless we have made special provision which is noted on Your Plan Schedule, Your Plan will be cancelled and all charges refunded less any previously authorised Repair Costs, Service Check costs and the Cancellation Fee.

F3 PARTS EXCLUDED

F3.1 Exterior trim and fittings, glass panels,batteries,fuses,bulbs,LED’s,paintwork.

F3.2 Anyservicepartsperiodically replacedduringthemanufacturer’srecommendedservicing of the Home Appliance (aslisted in yourmanufacturer’s handbook/ service schedule) unless authorisedwithin the costs of a valid repair (atour discretion) providing the HomeAppliance is not within 30 days of itsnextscheduledservice.

F3.3 All non-mechanical and non-electricalParts.

F3.4 AnyPartparticularlyexcludedfromYourPlan.

F3.5 Parts which have not suffered aBreakdown.

F3.6 TherepairorreplacementofanyPartnotauthorisedbyus.

F3.7 The repair or replacement of any Partwhere you (or your own repairer) havedenied us the right to have that PartexaminedbyanAuthorisedRepairer.

F3.8 Damage and/or Contamination to yourHome Appliance by foreign objects orUnexpectedObjects.

F3.9 Any items retro-fitted to your HomeApplianceafterthedateofmanufactureotherthanaspartofarepaircoveredbyYourPlan.

F3.10Any Part damaged due to it beingdropped,forcedorusedincorrectly.

F3.11Parts which fail to operate correctly oraredamagedduetoincorrectinstallationotherthanaspartofarepaircoveredbyYourPlan.

F3.12TheBreakdownofyourHomeAppliancewith inherent, common and regularlyoccurring manufacturing defects orfaults which are well publicised (suchas via a Google Internet search orpresscomment) togetherwith anyPartrequiring replacement due to it beingup-dated, superseded, re-designed orrecalledbythemanufacturer.

F3.13Any Part which has suffered aBreakdownduetoalackoforincorrect

routine servicing, negligence, neglect,misuse, damage, theft or attemptedtheft,accidentoranyPartnot reportedatthetimeofrepair.

F3.14 Parts covered by any other plan,warranty, insurance, guarantee orgoodwillofferofsettlement.

F3.15 Damage caused by blockage (eglimescale/fooddebris)unlessotherwisedetermined to beContamination by anExpectedObject.

F3.16CleaningoftheHomeApplianceorPartsoftheHomeAppliance.

F4 REPORTS BY AUTHORISED REPAIRERS

F4.1 Any Repair Cost which an AuthorisedRepairer confirms is due to any of theabove.

F4.2 Any Repair Cost which an AuthorisedRepairer confirms more than likelyexisted on or before Your Plan StartDate.Insuchcaseswereservetherightto re-charge thecostofanycallout toyourHomeAppliance.

F5 MISCELLANEOUS ITEMS EXCLUDED

F5.1 IfatanytimeduringthePeriodofYourPlanweuseourdiscretion toauthorisearepaironagoodwillbasiswhichwouldotherwisehavebeenexcludedthenthisdoes not set any precedent and doesnotmeanwewill necessarily authoriseanysimilarfuturerepairs.

F5.2 Anyliabilityfordamagetoproperty,lossof earnings, out of pocket expensesor any other loss caused directly orindirectlybyanyAuthorisedRepairerorinanyothereventgivingrisetoarepairrequestunderthetermsofYourPlan.

F5.3 Anyliabilitycauseddirectlyorindirectlyby war, riot or any similar event or byvandalism,theftorattemptedtheftfromtheHomeApplianceorbybadweathersuchaslightning,windorflood.

F5.4 SALVAGE, STORAGE OR DISPOSAL - We accept no responsibility or liabilityfor the salvage, storage or disposal ofyourHomeApplianceorofanyPartorpartunderanyevent.

G Repairs Procedure G1 Thissectionsetsout(inorder)whatyoushould

doifyoususpectyourHomeApplianceneedsourattention,asfollows:

G1.1 IMPORTANT - You should stop usingyourHomeApplianceimmediatelyifyoubecome aware that there is a warninglight or buzzer indicating a fault. Youshould also stop if there is any otherindicationsuchasanunusualvibrationor noise, leaking water, gas or steam.may indicatea fault,but isnotproofoftheBreakdownofanyPart(asdefined)within the terms of Your Plan. In suchcases, isolate the appliance from anyelectricity water or gas supply. If youaggravate any Breakdown causingfurther damage, wemay not settle theRepairCostinfulloratall.

G1.2 IfyoubelievethatanyfaultmaybecomethesubjectofarepairunderthetermsofYourPlan(evenifyouarenotsure)youshouldreportthefaulttousassoonaspracticable.AnyfailuretonotifyusaboutanysuspectedBreakdownwithin7days(withoutgoodreason)mayresultinanysubsequent request for repairs beingrejected.

G1.3 No repair work should commencebeforewehaveapproveditandissueda Repair Number. Should you decidetogivepermissiontoyourownrepairerto commence or complete repair work, without a Repair Number beingobtained,wewill notmeet yourRepairCost because you have denied us ourright to fully investigate your requestand/or inspect your Home Applianceanddetermineanyfaults.

G1.4 Beforeweauthoriseanyrepair,wemaydecidetoinstructanAuthorisedRepairerto inspect your Home Appliance orany Part together with any appropriate documentation. When this right isexercised we shall have no liability foranylosstoyouorarisingfromanydelayyourRepairermayhaveincommencingrepairs.Wemayalsore-chargethecostof any attempted and failed inspectionof your Home Appliance due to yourRepairer failing to present your HomeApplianceatapreviouslyarrangedtimeanddate.

G1.5 We may (at our own cost) transportyourHomeApplianceoranyParttoanAuthorisedRepairerofourownchoiceinordertoaffectrepairs.

G3 Werequirethatyoucontactusfirst,andpreferthatyouuseourAuthorisedRepairer.

G3.1 Youcanappointyourownrepairerandin this event youmustmake sure theyareVATregisteredandthat they followtheRepairsProceduresetoutasfollows:

G4 Whenyoudecidetoappointyourownrepaireryouacceptthatwemaycorrespondwithyourrepairer directly on your behalf in relation torepairsunderYourPlan.

G5 Wewillaskyou(oryourrepairer)toprovidethefollowinginformation:

G5.1 Your Plan number (found on the PlanSchedule)andyournameandaddress,

G5.2 YourHomeApplianceserialnumber,

G5.3 DetailsoftheParttheybelieveisatfault,

G5.4 ThetimeanddatethePartfailed,

G5.5 APartsandLabourestimateforthetotalcostofrepairs,

G5.6 Any photographic evidence to assistassessmentofthefault/Parts

G6 Wewillthenconfirm:

G6.1 ThatthePartisincludedwithinthetermsof Your Plan and whether we exerciseourdiscretionandauthorise theRepairCostandissueaRepairNumberor,

G6.2 Whether we require your HomeAppliance to be examined (at our

expense) by an Authorised Repairerpriortousmakinganyfirmdecisionor,

G6.3 If we prefer to transport your HomeAppliance,oraPart(atourexpense)toanAuthorisedRepairerofourchoiceor,

G7 Diagnostics and Dismantling - It is your ownresponsibility to authorise any preliminarydiagnostics together with the dismantling ofany Part of yourHomeAppliance asmay berequired foranaccuratedeterminationofanyPartBreakdowntobemade.YourPlanwillonlypayforsuchdiagnosticanddismantlingwork,if reasonableand ifassessedbyusasbeingwithin the cost of a valid repair, otherwise allsuchworkisatyourownriskandexpense.

G7.1 If your Home Appliance is integratedintoorformspartofapieceoffurnitureorunit(s)thatneedsdismantlingtogainaccess to repair yourHomeAppliancethenitisyourresponsibilitytoauthorise(atyourownexpense)anysuchworkinordertoallowourAuthorisedRepairertogainaccesstoyourHomeAppliancetorepairit.(If indoubt,pleasecheckwithusbeforeagreeingtoanysuchwork).

G8 Once we have authorised The Repair CostwithintheLevelofYourPlan,pleaseensurethatyourrepairerdoesthefollowing:

G8.1 Makes a note of the Repair Numberissuedbyus,and

H General ConditionsH1 Thefollowingconditionsapplytoallsections

ofYourPlan:

H2 DUTY OF CARE -Youhaveadutyofcareto look after your Home Appliance andcarry out the preventative checks andmaintenance recommended by the HomeAppliancemanufacturerwithintheServicingHandbookandtouseandoperatetheHomeApplianceasdirected.

H3 REPAIR PROCEDURE

H3.1 WepreferthatyouuseourAuthorisedRepairer.

H3.2 In any other case we expect you tofollow our repairs procedure. Anyfailuretodosomayresultinadeclinedecision and non-payment of yourrepair.

H4 PLAN TRANSFER - Your Plan is nottransferableinanyway.

H5 CONTINUOUS AUTHORITY OF SERVICE CHARGES AND PAYMENTS-YouagreetoauthoriseApplianceWarrantyLimitedtotakethe amounts shown onYour PlanScheduleby credit card, debit card, standing orderor direct debit as andwhendue and uponrenewal by your continuous authority. Wedo not keep your payment details withinAppliance Warranty Limited computersystems, we process your payments via asecure outsourced agency. This authoritywillremaininforceuntilyoucancelitoruntilexpiry.

H5.1 Ourservicechargesarevariableanddependentuponthenumberandcostofrepairrequestshandled.

H5.2 You must pay all our charges in fullamount and at the times agreed for

G9.3 receivedcopiesofanyothersupportingdocumentationwemayhaverequested.

G10 If you have not provided all requestedinformationwithin30days,yourrepairrequestwillnotbeauthorised.Aftersuchtime,wewillreview the reason for the delay and decide,withinourdiscretion,whetherornottoacceptyourrepairrequest.

G11 We may decline your repair request andprovide our reasons why your request doesnotmeetwiththetermsandconditionsofYourPlan.

G12 PROTECTION AGAINST FRAUD-Inordertoprotectourselvesagainst fraudulent requests,we may from time to time, carry out moredetailedchecksandinvestigationswhichmaydelayourauthorisationprocess.Weapologiseifyouareinnocentandaskyoutobepatientandcomplywithourrequestsforfurtherinformation.WewillnotbeliableforanylossoftheuseofyourHomeAppliance or other expenses, butdo apologise for any inconvenience thismaycause.

the Period of Your Plan, otherwiseYour Plan will not be valid and allcover will cease immediately withoutreturnofanypaymentsyoumayhavemadeuptothatdateandwithout thesettlementofanyRepairCostyoumayhaverequested.

H5.3 PAY AS YOU GO OPTION-Whenyourequest thePayAsYouGoOption itwillbeforaperiodof12monthswiththe full cost payable over monthlyinstalments.Afteryouhavemadethe3rd of your monthly instalments youhavethe‘option’to:

H5.3.1 changetoamonthlyrenewingplaninwhichcasethemonthlypayment levels applicable tothatplantypewillapply,or

H5.3.2 make a single final payment(completing thepayments foryour12monthplan),

H5.3.3 cancel Your Plan in whichcase General Condition H9.5willapply.

H5.4 Wereservetheright,atourdiscretion,to vary theamount of yourpaymentsorthecostofYourPlanatanytimebygivingyou30daysnoticeinwriting.

Note: To elect to adopt option H5.3.2 or H5.3.3 please email or write to us after making your 3rd payment but before making your 4th payment, otherwise we will automatically continue to renew your plan, monthly.

H5.5 After you have held a 12 month (orlonger)planwithusyoucanrenewitonamonth-by-monthbasis.

H6 PAYMENT OF REPAIR COST-Youwillhaveto pay usdirectly for the total of all RepairCosts for any repairs prior to Your PlanbecomingeffectiveandpriortoourissueofYourPlanSchedule,oratanytimeaftertheexpiryofYourPlan.

H6.1 WewillendeavourtosettletheRepairCost for any validated repair subjectto the terms and conditions of YourPlan,within7days.

H6.2 If you are using an AuthorisedRepairerwewillsettletheRepairCostdirectly,butyouwillhavetosettleanyothercostsoutsideofthissum.

H7 Whereyouarepayingforamonthlyrenewing30 day Home Appliance Plan (Pay As YouGoOption) and youmake a repair requestduring Your Plan,wemay in our discretioninvokesectionH5.3.2.

H8 PLAN RENEWAL - You agree to usautomaticallyrenewingYourPlan,withinourdiscretion,underourthencurrenttermsandwewill inform you inwriting or by email ofany changes to our charges or terms andconditions.

H8.1 If you decide you do not wish torenew you should contact us within14 days after receiving your renewalnotification, Your Plan will not berenewedandwewill refundany newpayments made. If you do nothingYour Plan will then become effective14 days after you receive it but yourright to cancel set out below willapply.

H9 CANCELLATION BY YOU WITHIN CANCELLATION PERIOD - If you decidethat you do not want Your Plan, confirmyour request in writing or by email [email protected] Plan reference number and yoursecuritypassword,ensuringthattheyreachus within 30 days of Your Plan Start Date.Theconsequenceswillbeasfollows:

H9.1 Provided you have not requestedwemeet any Repair Cost, Your Planwill becancelledandyourpaymentsrefundedinfullwithoutanydeduction,

H9.1.1 in circumstances where youhave cancelled Your Plan upto14daysafterthePlanStartDateandyouhaverequestedthat we meet a Repair Cost,and/or where such RepairCosthasnotbeenpaid,YourPlan will be cancelled andyourpaymentsrefundedafterdeducting a proportion ofyour payments calculated ona daily basis up to the dateof cancellation, or where wehave authorised or paid anyRepair Cost cancellation iswithoutanyrefund.

H9.1.2 in circumstances where youhave cancelled Your Planfrom 15 to 30 days after the

PlanStartDateandyouhavealready requested that wemeet a Repair Cost, and/orwhere such Repair Cost hasnot been authorised, YourPlan will be cancelled andyourpaymentsrefundedafterdeducting the CancellationFee and any AuthorisedRepairer costs we haveincurred, or where we haveauthorisedorpaidanyRepairCost cancellation is withoutanyrefund.

H9.2 CANCELLATION BY YOU OUTSIDE CANCELLATION PERIOD - If at anytime after Your Plan Start date, youdecidethatyoudonotwantYourPlan,confirm your request in writing or byemail to [email protected] quoting Your Plan referencenumber and your security password.Your Plan will be cancelled from thedate we receive your request. Therewillbenorefundofanypayments.

H9.3 CANCELLATION BY YOU – RETAILER PLAN - In suchcircumstances where you havepurchasedYourPlanfromaretailerorhad Your Plan supplied by a retailerwithin the cost of any Appliance,confirm your request in writingor by email to [email protected] quoting YourPlan reference number and yoursecurity password. Your Plan will becancelled from the date we receiveyour request.Therewillbeno refundofanypayments.

H9.4 RESIDUAL VALUE-WhereyouhavepurchasedYourPlanfromaretailerorhad Your Plan supplied by a retailerwithin thecostofanyAppliancethenYourPlan’sresidualvalueis£1.00

H9.5 Cancellation by you is in full andfinal settlement of any obligationsApplianceWarrantyLimitedmayhavetowards you under the terms of YourPlan.

H9.6 CANCELLATION BY US - We may cancelYourPlanatanytimebygivingyou30daysnoticeandby refundingyou the balance of any unexpiredvalue of Your Plan without furtherdeduction.

H9.7 WewillcancelYourPlanimmediatelywithout rebateor refundofpaymentsandwithoutfurthernotice:

H9.7.1 if you change your addressto live outside of theGeographicalLimitsor

H9.7.2 ifyou,orsomeoneauthorisedto act on your behalf, havemade any dishonest, falseor exaggerated statement ordeclaration to us in order toobtain Your Plan or in ordertosatisfyourrepairorserviceconditionsor

H9.7.3 if you fail to pay yourpayments in full amount asandwhenagreed,

H9.8 In all caseswewill cancelYourPlanby sending you notice in writing (byEmail,orPost.

H10 YOUR INFORMATION - You should havedeclared all relevant information that mayhave affected our decision to acceptany Home Appliance onto Your Plan. It isimportantthatyoucheckYourPlanScheduleto ensure we have the correct details. Inparticular, you should check that yourHome Appliance’s make, model and serialnumber are accurately described on YourPlan Schedule. You should have answeredour preliminary questions accurately anddeclared any known faults with your HomeAppliance prior to taking out Your Plan.Failure to convey the correct informationat the time that you appliedmay invalidateYourPlan.

H11 You should also ‘double check’ yourHomeAppliance’s previous servicing complieswith our requirements under section H2. IfwehaverequestedafurtherServiceCheck,youshouldco-operatefullywithourrequest.If any of the above information is incorrectYourPlanmaynotbevalid.

H12 FRAUD - Ifwe have reason to believe thatyou or someone authorised to act on yourbehalf, have made any dishonest, false orexaggerated statements or declarations inordertoobtainYourPlanortotryandobtainanyRepairCost,RepairCost(s)thenwewillsuspend any repair authorisation until ourFraud Investigation Team has completedtheir investigation. Within 30 days we willsend you our final response or advise youwhen will be in a position to provide sucha response. Your Plan may be cancelled,norefundorrepairsettlementswillbemadeandthematterreportedtotheauthorities.

H13 VALUE ADDED TAX - Value Added Tax(VAT)will be calculated at the current rateapplicable at the time of charge or timeof repair. If you do not supply us with aRepairer’sVATreceiptdisplayingthenameandaddressofApplianceWarrantyLimited,wewillnotbelegallyabletoreimburseyoutheVATelementoftheRepairCost.

H14 VARIATION-OnanyrenewalofYourPlanwemayvaryanyofthesetermsandconditionswhichwedrawtoyourattention.Thesemaybeinorderto:

H14.1improve the Level of Your Planprovided,

H14.2comply with any new laws orregulations,

H14.3correctanytextorformattingerrors,

H14.4clarifythescopeofYourPlan

H14.5The updated terms and conditionswill takeeffect from thedateof suchrenewal.

J2 PLAN SCHEDULE - Your Plan Scheduleconfirms our acceptance of your ApplicationandisthebasisofthecontractandformspartofYourPlan.Pleasecheckthattheinformationyouhavedeclared tous iscorrectand that itmeets with your requirements. If it does not,please contact us as soon as possible (andin any casewithin 30 days of issue) in ordertomake any applicable alterations. If you failto provide us with the correct information wemayeitherrequireadditionalpaymentsandanAdministrationFeeorevencancelYourPlan.

J3 PRINT COPY OF YOUR PLAN - These areavailable in booklet and PDF format and canbe downloaded from our website at www.appliancewarranty.co.uk. If you require alargeprintpapercopyofYourPlantermsandconditions,pleasecontactusatanytimeandwewillarrangethis.

J4 DATA PROTECTION - Appliance Warranty LimitedisregisteredundertheDataProtectionAct.YouaretheonlypersonauthorisedtomakerepresentationsdirectlytoApplianceWarrantyLimitedaboutYourPlan.Ifyourequireanyotherperson to enquire on your behalf includingreceiving any validated repair payments wewill requireyourspecificpriorauthorisation inwriting unless such persons quote your PlannumberandsecuritypasswordorisconfirmedbyyouasaRepaireractingonyourbehalf.Wemaypassyourdatatoanyrelevantregulatorordispute resolutionprovider.Wemayalso useyourdata for trainingand testingpurposes. Ifyouhavegivenuspermission,yourdetailsmayalsobeusedbyusorthirdpartiesformarketingpurposes. We may disclose your informationtoouragentsforthesepurposes.Weandouragents(ifapplicable)maycontactyoubymail,telephoneoremail.Ifyounolongerwantyourdata to be used by third parties or by us formarketingpurposesandyouhavenotalreadynotifiedus,pleasewritetotheDataProtectionOfficerat:ApplianceWarrantyLimited,5PetreCourt,ClaytonLeMoors,Lancashire,BB55HY.

J5 EXCLUSION OF THIRD PARTY RIGHTS - Your Plan is solely for the benefit of you (thePlan holder) andanypermittedpersonwhichweallowinourdiscretion.NorightsorbenefitswillbegiventoanyotherthirdpartyunderYourPlan.TheprovisionsoftheContracts(RightsofThirdParties)Act1999donotapply.

J6 NOTICES - All notices required to be givenshallbebyEmail,orpost;

J6.1 from Appliance Warranty Limited toyou, at your last known home or emailaddressand,

J6.2 from you to us, at ApplianceWarrantyLimited, 5 Petre Court, Clayton LeMoors,Lancashire,BB55HYorviaanyemailaddressnotedwithinYourPlan.

J6.3 All notices shall be deemed to havebeen received when, in the normalcourseoftransmission,thenoticewouldhavebeendelivered.

J7 LANGUAGE - All Plan documents and allcommunicationswithyouaboutYourPlanwillbeinEnglish.Nootherlanguagewillbeused.

J8 STATUTORY RIGHTS AND REGULATION - This isaHomeAppliancePlanandissubjectto English Law. Nothing in these terms andconditionswill reduce or affect your statutoryrights. For further information about yourStatutory Rights you can contact your LocalAuthority Trading Standards Departmentor Citizens Advice Bureau. Your Plan is notregulatedby the FinancialConductAuthority,Financial Ombudsman, or the FinancialServicesCompensationScheme.
