Court rejects Brady’s ‘Deflategate’ appeal
Quarterback Tom Brady’slast best chance to avoid serv-ing a four-game “Deflate-gate” suspension to start thenew season was flatly reject-edWednesday by an appealscourt.The 2ndU.S. Circuit Court
of Appeals in Manhattan is-sued a one-sentence rejectionof requests by the NationalFootball League Players As-sociation and Brady to recon-sider anApril decision that re-instated the suspension.“We are disappointed,” the
players association said in astatement. “The track recordof this league office when itcomes to matters of playerdiscipline is bad for our busi-ness and bad for our game.Wehave a broken system thatmust be fixed.”It added that it will review
its options carefully.TheNFLdeclinedcomment.The court’s action left in-
tact a 2-to-1 ruling by a three-judge panel that found NFLCommissioner Roger Good-ell acted within his powersby upholding the suspensionof the star quarterback forhis role in a scheme to doc-tor footballs used in a Janu-ary 2015 playoff game.The decision affirmed
wide-ranging powers givento the commissioner by theNFL’s collective bargainingagreement. It was a setbackfor organized labor groups ar-guing for due process in em-ployee discipline.
Theplayers association andBrady had requested that thepanel reconsider or that allthe 2nd Circuit judges heararguments and decide anew.Brady’s remaining hope is
to appeal to theU.S. SupremeCourt.“That is an extremely long
shot,” said Nellie Drew, asports law professor at theUniversity at Buffalo. She saidthe 2nd Circuit acted correct-ly and that any changes tohowtheNFLhandles arbitrationsover player issueswill have tobe handled at the negotiatingtable.
She predicted Patriotsbackup quarterback JimmyGaroppolo “will be getting awhole lot of repetitions” as thePatriots prepare for their sea-son opener Sept. 11 at Arizona.
“It’s time toput this thing tobed,” Drew said. “If it wasmykid, I’d say: ‘Let it go.’ ”
League to curtailkids’ fantasy games
The NFL has agreed tocurtail its marketing of fan-tasy football to children ages6 to 12.
Last season, the leaguemarketed fantasy football toyoungsters on its NFL RushFantasy website and app, of-fering cash prizes and gameconsoles to contest winners.It also promoted an elemen-tary school curriculum thatencouraged children to playthe fantasy game.The NFL con f i rmed
Wednesday it has informedseveral advocacy groups thatit willmake significant chang-es to the game. The schoolcurriculumbasedon thegamehasbeendiscontinuedand theleague has promised it willnot promote fantasy sportsin schools in the future.
“We are pleased that theNFL has agreed to makethese changes, and youngchildren will no longer havea financial stake in the out-come of its games,” said JoshGolin, executive director ofthe Campaign for a Com-mercial-Free Childhood. “Itis also good news for parentsthat the league will no longerenlist teachers and schools inan effort to get children intothe habit of playing fantasysports.”
