Fannie, Freddie aim to make short sales fasterPHILADELPHIA —
Government-backed hous-ing giants Fannie Mae and Freddie Mac are adopting new guidelines to streamline the process for short sales, which most real estate observ-ers expect will outpace foreclosures in the com-ing year.
The guidelines, required by the Federal Housing Finance Agen-cy and effective June 15, would require servicers of mortgages backed by Freddie and Fannie to review and respond to
requests for short sales within 30 calendar days of receipt of a buyer’s offer.
A short sale is a trans-action in which a lender agrees to accept less than the amount owed on the mortgage. It is a “stra-tegic default,” designed to get a borrower out of financial trouble without having to go through the drawn-out legal tangle of the foreclosure process.
A short sale does affect the seller’s credit score, reducing it as much as a foreclosure would, according to Fair Isaac Corp., which developed the system.
On average, accord-ing to recent data from foreclosure search engine RealtyTrac, short sales are taking 306 days from start to finish, compared with 113 days in 2006 as the housing market start-ed to unravel.
Real estate agents who handle such transac-tions have acknowledged that they do take a long time to complete, and that delays often result in loss of the sale.
But lenders are becom-ing more accommodating, though they have issues with short sales because they have been abused by unscrupulous investors
and others, perhaps to the tune of $375 million in annual losses nationwide.
In January, there were more than 35,000 short sales nationwide, on pace for more than 105,000 pre-foreclosure sales for the first quarter.
That would be the high-est quarterly total since the first three months of 2009.
This is not the first time the government has acted to accelerate the short-sale process. In late 2009, the Treasury Department proposed financial incentives and simplified the procedures for completing them. That included a $1,000 pay-ment to servicers and a maximum of $1,000 to go to investors who signed off on payments to sub-ordinate lienholders, the Treasury said. Borrowers were to receive $1,500 in relocation expenses.
The rules, which took effect in April 2010, were supposed to reduce the short-sale process to 10 days, but didn’t.
The pending Fannie Mae/Freddie Mac guide-lines will mandate weekly status updates to the bor-rower if the short sale remains under review after 30 calendar days.
Servicers also will be required to make and then inform borrowers of final decisions within 60 calendar days of receipt of an offer.
By the end of the year, Fannie and Freddie will announce other “enhance-ments” to the short-sale process, including bor-rower-eligibility evalu-ation, simplified docu-ments, and payments to subordinate lienholders.
Housing Finance Agency acting director Edward J. DeMarco said the changes were being considered as “additional tools to prevent foreclo-sure, keep homes occu-pied, and help maintain stable communities.”

To evict a tenant for housekeeping issues, the condition of the unit mustbe BAD. That means it must be MORE THAN messy, full of stuff, orcluttered. A sink full of dirty dishes does not constitute a violation thatrises to the level of a noncompliance with the lease or Florida law.
To terminate a tenancy for poor housekeeping issues, you first need toserve a proper Seven Day Notice of Non Compliance with Opportunityto Cure. A Seven Day Notice to Terminate might follow if you are able toprove that the housekeeping issues listed on the cure notice were notrectified and that the housekeeping is indeed a serious problem thataffects the health and safety of others, or that it is damaging the property.
SOME PROOF THAT IS NECESSARY PRIORTO TERMINATING THE TENANT FOR
HOUSEKEEPING REASONS
1. Photos or video of the condition of the unit. The photos or videoshould show the condition of the place as of the time the cure notice wasserved AND as of the time the termination notice was served.
2. Employees or other residents (witnesses) of the apartmentcommunity who will testify in court about how they are affected by thepoor housekeeping. Perhaps a neighbor has been infested with roachesfrom the tenant’s apartment. Or, the noxious fumes from the pet wasteare bothering a neighbor.
3. If available, a copy of an inspection report from code enforcementor Section 8. If the agencies have not done an inspection, do notrequest one.
Common problems that arise in thesecases include:
a. The tenant got the cure notice and cured some, but not all, of theproblems. This means it may be best to serve another cure notice for theproblems that persisted.
b. The place is a mess, but it is not a lease violation. A landlord’sperception of what is sanitary and what is not, may be very different thanwhat is a genuine lease violation.
c.The landlord is using “poor housekeeping” as a reason for evictionwhere the real problem is something else. If the housekeeping issue is apre-text for some other motivation, the case will surely lose.
d. The tenant has a disability that affects the person’s ability to maintainthe apartment. In this situation, you may need to make a reasonableaccommodation for the tenant. One reasonable accommodation(there may be others) is to permit more than the seven days to curethe noncompliance.

Upon opening the lockbox, an electronic record issent wirelessly to the listing agent, reporting who accessed the house and when. At that point the REALTOR® evenhas an opportunity to digitally send feedback on the property that would go to the listing agent in very near real-time.

Area builders will bring out their best starting May 12-13 as the 2012 edition of the Parade of Homes begins.
The free event, which takes place over two suc-cessive weekends, consists of 20 brand-new houses and two major remodeling projects. The Parade is a program of the Tallahas-see Builders Association and gives members and their many subcontractors a stage to show off design, materials and craftsman-ship, said Mark Worley, chair of this year’s event.
Worley said the average size of the entries this year is 2,400 square feet and the aver-age price is $350,000, if the $1.1 mil-lion Kessler Construction LLC entry in Monticello is excluded. Otherwise, the aver-age price is $396,000.
Though the Parade has fewer entries than in years past, its val-ue to local builders still remains high. Two of the entries have already sold, and the residual effect of participating is often addi-tional buyers wanting the same house on other sites, builders say.
“The Parade of Homes markets itself in the Tal-lahassee community,” Wor-ley said. “It has that much name recognition.”
“From a builder’s per-spective, I don’t think there is a better way to spend a marketing dollar than to be in the Parade of Homes,” said Worley, whose company, Worley Construction Inc., is a past participant in the event.
For consumers, the Parade is an opportunity to see the latest in build-ing materials, construction concepts, energy-saving features and floorplans. The most successful build-ers, in fact, pay close atten-tion to trends and buyer preferences in their effort to meet market demand.
The goal is not build for one’s ego, but to build for the consumer and what the consumer is interested in. “That’s the key to suc-cess,” Worley added.
Marshall Gibbs, a Real-tor who represents Pan-handle Building Servic-es, described this year’s Parade as mirroring con-sumers’ tastes. For exam-
ple, many are trading the big yard and high upkeep for space that is smaller and more functional.
Panhan-dle’s entry at 4963 Hollystone Lane has a court-yard-style backyard with water feature, decorative
shrubs, patio and space for a small family gathering.
Inside, the house has a sunroom, hardwood floor-ing, double-sided gas fire-place, and smart-box tech-nology for phone, data and television systems.
Jim Munroe, president of Panhandle, said that while homes are not as big in square footage as they were a few years ago, buy-ers still want the features and interior details that add visual impact.
“At Panhandle, our sig-nature is the detail in the trim work, the tile, the ceilings and the bath pack-age,” Munroe added.
Parade visitors will also want to know about a
home’s typical costs both to purchase and live in.
“I have more and more people ask me what the average utility bill will be,” Gibbs said. “How much will the taxes be? What’s the maintenance cost of a home this size?” Today, all those variables are factors in the purchase equation.

REMODELERS PUT AWARD-WINNING PROJECTS ON DISPLAYThe Tallahassee Builders Association (TBA) is offering the community the best ofboth worlds this month.
