JEWEL & ESK COLLEGEAdvised in a major variation of their liquor licence. This in-cluded successfully overcoming objections raised by the po-lice regarding where young people have access to the prem-ises. We also advised on the granting of a cinema licence for their auditorium.

MACDONALD RESORTS LIMITEDActed for Macdonald Resorts in a landmark appeal against the decision of the VAT and Duties Tribunal on the supply of the timeshare product “Points”. A reference was made from the Court of Session in Edinburgh to the European Court of Justice. The ECJ have issued their opinion and our argu-ments have prevailed with the result impacting on the entire European timeshare industry as regards the treatment of VAT in respect of the sale of Points.

BRITISH WATERWAYS SCOTLANDActed in a historic first transaction of its nature for British Waterways Scotland to restore significant canal side prop-erties and their lease for 25 years to holiday management company. Bespoke legal documents were required to cater for each party’s needs.

DOBBIES GARDEN CENTRES LIMTEDAdvised Dobbies in various leasing transactions at their stores throughout Scotland and England. Also provided guidance in numerous ongoing licensing matters, including licensing new Centres at Livingston and Braehead; and vari-ations to existing licences at other stores at Ayr, Stirling and Sandyholm, Lanark.

BARCELO HOTELS GENERAL PARTNER LIMITEDAdvised on a major premises licence variation to incorporate an unlicensed area within the demise of the premises licence for the hotel.

NEVIS RANGE DEVELOPMENT CORPORATION PLCAdvised on new leases for the gondola line, down hill moun-tain bike tracks and ropes course. The land is owned by the Forestry Commission, which led to successfully negotiating competing interests between the landlord and the tenant re-garding the use of the land via bespoke lease provisions.

THE HOSEASONS GROUP LIMITEDActed in the acquisition of Cumbrian Cottages which rep-resents more than 2,500 self-catering properties and subse-quently strengthened our client’s offering in key locations like the Lake District and Yorkshire.
