J u d g e F r e e d m a n . o f t h e S u p r e m e C o u r t . has dismissed the action brought by Mr*. Leila e . Henriques and Mary A. Mason to partition tba real estate of their sister, Mrs. Miriam Osborn, mother of Howell Osborn, as if she had left no valid will.

Henriques, for an assault upon whom Frank Ellison was sent to Sin* Sing Prison, and the mother of Leila O. Neame. on whose account the assault was provoked.
