TOILET FACILITIES IN SCHOOLS 22nd February, 2013 RSQ 74 SHRI Y.S. CHOWDARY (a) whether Government has received any complaints regarding non-availability of basic toilet facilities in some schools across the country; (b) if so, the details thereof; (c) whether Hon’ble Supreme Court has also issued directions to States/Union Territories to ensure that basic toilet facilities particularly for girls students are provided in all schools within six months; and (d) if so, the action taken/being taken by the Centre/States in the matter? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) & (b) As per the District Information System for Education (DISE) 2011-12 (provisional), 87.9% government elementary schools in the country have toilet facilities. Similarly, 57.83% schools at secondary and senior secondary level have toilet facilities as per the Secondary Education Management Information System (SEMIS) 2010-11. (c) The Hon’ble Supreme Court in writ petition (Civil) No. 631 of 2004 in the matter of Environmental and Consumer Protection Foundation vs. Delhi Administration and Others, has directed, in its order dated 3.10.2012 all States and Union Territories to provide, inter alia, toilet facilities for boys and girls, if not already provided, within six months. (d) Under the Sarva Shiksha Abhiyan, 8.53 lakh toilet facilities have been sanctioned across the States / Union Territories for elementary schools. A total of 29,037 toilet blocks have been sanctioned under the Rashtriya Madhyamik Shiksha Abhiyan, in existing and upgraded secondary schools, apart from convergence with the scheme of Ministry of Drinking Water & Sanitation where toilets have also been provided in existing schools in rural areas. (a) & (b) A state-wise statement indicating the percentage of government schools having toilet facilities as per the District Information System for Education (DISE) 2011-12 and the Secondary Education Management Information System (SEMIS) 2010-11 is at Annexure. (c) All new schools constructed under the Sarva Shiksha Abhiyan (SSA) have provision for toilets. The SSA also provides for toilets in existing schools in urban areas. In the case of existing schools in rural areas, toilets are provided in convergence with schemes that are implemented by the Ministry of Drinking Water & Sanitation. Under the SSA, 8.53 lakh toilets facilities have been sanctioned across the States / Union Territories and 29,037 toilets blocks have been sanctioned under the Rashtriya Madhyamik Shiksha Abhiyan, in existing and upgraded secondary schools.

RAMESH (a) whether it is a fact that only 75 percent of Government elementary schools have toilet facility and only 85 percent of Government elementary schools have drinking water facility in Andhra Pradesh; (b) whether it is also a fact that only Rs. 80 crores were spent under SSA for this purpose in 2009-10 out of Rs. 550 crores and Rs. 936 crores out of Rs. 1500 crores in 2010-11; and (c) if so, the reasons for such less utilization in the above mentioned years? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (Dr. Shashi Tharoor) (a) : As per the District Information System for Education (DISE) 2011-12, 80.6% of Government elementary schools in Andhra Pradesh have toilets and 85.4% have drinking water facilities. (b) & (c): An allocation of Rs. 7.19 crore in the year 2009-10 and Rs. 41.65 crore in 2010-11 was made by the Central Government for providing toilets and drinking water facilities under the Sarva Shiksha Abhiyan (SSA) to Andhra Pradesh. The State Government has informed this Ministry that the amounts have been fully utilized for the purpose. TOILETS IN SCHOOLS IN BIHAR 1st March, 2013 RSQ 549 SHRI ANIL KUMAR SAHANI (a) whether there are toilets in schools and separate toilets for boys and girls in co-educational schools in Bihar; (b) whether Government has conducted a survey in this regard; and (c) if so, the results thereof? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) to (c) Every year the National University of Education Planning and Administration (NUEPA) brings out the District Information System for Education (DISE) and the Secondary Education Management Information System (SEMIS) which provides information on school infrastructure at the elementary level and at the secondary / senior secondary levels respectively. As per the DISE 2011-12 (provisional), 73.6% government elementary schools have

boys’ toilets and 50.90% schools have girls’ toilets facilities in Bihar, while the SEMIS data for 2010-11 reveals that 61.56% schools at the secondary / senior secondary level have toilet facilities and 40% schools have separate toilets for girls in that State. TOILETS IN SCHOOLS IN ASSAM 1st March, 2013 RSQ 562 SHRIMATI NAZNIN FARUQUE (a) whether Government has conducted any survey in the State of Assam regarding schools which do not have toilets and the number of co-educational schools in which there are no separate toilets for girl and boy students; (b) if so, the result thereof; and (c) the present status of implementation of the directive of Supreme Court to provide toilets in all schools within a fixed time-frame in Assam? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (Dr. Shashi Tharoor) (a)& (b) : According to the District Information System for Education (DISE), 2011-12, 70% of Government/ aided elementary schools in Assam have toilets, while 48% of the co-educational schools have separate toilets for boys and girls. (c) The State Government of Assam has informed us that as per the direction of the Hon’ble Supreme Court, temporary toilet facilities have been provided to the remaining Government/Government-aided elementary schools in the state. FUNDS UNDER SSA FOR CONSTRUCTION OF TOILETS 8th March, 2013 RSQ *166 DR. V. MAITREYAN (a) the details of funds allocated and disbursed in the last five years for construction of toilets in schools under Sarva Shiksha Abhiyan (SSA), State-wise and year-wise; (b) the proposed status of setting up toilets in the remaining schools, particularly girl schools, in the country under SSA, State-wise and the details thereof; (c) whether absence of the above facilities in these schools has forced girl students, especially in the country-side, to abandon pursuing studies; and (d) if so, the details thereof along with an action plan to bridge such gaps? STATEMENT REFERRED TO IN REPLY TO PART (a) to (d) OF RAJYA SABHA STARRED QUESTION NO. 166 TO BE ANSWERED ON 08.03.2013 ASKED DR. V. MAITREYAN REGARDING FUNDS UNDER SSA FOR CONSTRUCTION OF TOILETS (a) Central funds under the Sarva Shiksha Abhiyan (SSA) are released to the States / Union Territories for the implementation of interventions approved under the Annual Work Plan and Budget (AWP&B) of that State. The State SSA programme then further disburses funds to the districts for specific activities under SSA including construction of toilets. A State-wise statement showing the number of toilets sanctioned and Central share of funds released for implementation of SSA activities, including toilets, during the last five years is at Annexure-I. (b) All new school buildings under SSA are sanctioned as composite buildings with toilets for girls and boys and funds are also provided for existing urban schools which do not have toilets. Under SSA a total of 8.53 lakh toilets have been sanctioned so far, of which, 4.49 lakh are girls’ toilets. In existing rural schools / lacking toilets, such facilities are provided in convergence with the schemes of the Ministry of Drinking Water & Sanitation. The State-wise status of elementary schools without toilets upto September 2011 is at Annexure-II. (c) & (d) From data available in the District Information System for Education (DISE) 2011-12 it is clear that share of girls’ enrolment at primary and upper primary level has risen from 43.7% and 40.9% in 2000-01 to 48.35% and 48.63 % in 2011-12 which is in consonance with their share in population. Opening of schools in the neighbourhood has improved the access of girls to schools, and provisions interalia, of free textbooks, free uniforms, separate toilets for girls, the Kasturba Gandhi Balika Vidyalayas residential upper primary schools and the Mid Day Meal programme have further encouraged participation of girls in elementary education.

(d): Based on the information received from 46 colleges, the University of Delhi has informed us that 45 such classrooms have been constructed. A state-wise statement of percentage of schools with separate toilets for girls in rural and urban areas is at Annexure. (c) From data available in the DISE 2011-12 it is clear that share of girls’ enrolment at primary and upper primary level has risen from 43.7% and 40.9% in 2000-01 to 48.35% and 48.63 % in 2011-12 which is in consonance with their share in population. Opening of schools in the neighbourhood has improved the access of girls to schools, and provisions inter-alia, of free textbooks, free uniforms, separate toilets for girls, the Kasturba Gandhi Balika Vidyalayas residential upper primary schools and the Mid Day Meal programme have further encouraged participation of girls in elementary education. (d) The Right of Children to Free and Compulsory Education (RTE) Act, 2009 provides a time-frame of three years from the commencement of the Act for completion of school infrastructure. All new school buildings under SSA are sanctioned as composite buildings with toilets for girls and funds are also provided for existing urban schools which do not have toilets. Under SSA a total of 4.49 lakh girls’ toilets have been sanctioned so far. In existing rural schools / lacking toilets, such facilities are provided in convergence with the schemes of the Ministry of Drinking Water & Sanitation.

MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (SHRI JITIN PRASADA) (a) & (b): Sarva Shiksha Abhiyan (SSA) provides support for school infrastructure like school buildings, additional classrooms, separate toilets for girls and boys, drinking water facilities, ramps with railing etc. (c) to (e): As per District Information System for Education (DISE) 2011-12, 60.1% primary schools have separate girls’ toilets and 85.7% have a common toilet. In Jharkhand as per DISE 2011-12, 63.8% primary schools have a separate girls’ toilet and 74.7% have common toilet. As per Statistics of School Education (SES) 2010-11, girls’ drop-out rate in Jharkhand at primary level is 25.6%. Free text books, free uniform, mid day meal, special training for mainstreaming out of school children in regular schools and transport/escort facilities in exceptional cases, are inter alia provided under SSA, to improve girls’ retention.

FUNDS TO STATES WITH OBLIGATION TO PROVIDE BASIC FACILITIES IN SCHOOLS 22nd March, 2013 RSQ 2879 SHRI MOTILAL VORA (a) whether Government is aware that a large number of Government schools in the country are running without basic amenities like toilets and several schools are running without school buildings; (b) whether Government, while allocating funds to States under education head, would ensure that States are committed to provide facilities like buildings and toilets in the schools; and (c) if not, the reasons therefor? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) to (c) Under the Sarva Shiksha Abhiyan (SSA) all new school buildings are sanctioned as composite buildings, which include toilets for girls and boys. For existing rural schools, toilet facilities are constructed in convergence with schemes of the Ministry of Drinking Water & Sanitation. As per the District Information System for Education (DISE) 2011-12, 87.9% schools have toilet facilities. In order to meet the requirements of the Right to Education Act, 2009, priority is accorded to the provision of basic school infrastructure; inter alia 3.04 lakh school buildings, 17.92 lakh additional classrooms and 8.53 lakh toilets have been sanctioned across the States/Union Territories so far. The funding for school infrastructure is shared with the States / UTs; the NER States contribute 10% of the total cost, while other States contribute 35%. UPGRADATION OF INFRASTRUCTURE IN SCHOOLS 26th April, 2013 RSQ *442 SHRI D. RAJA (a) whether it is a fact that despite a 52 per cent increase in the Sarva Shiksha Abhiyan budget for the infrastructure upgradation of schools between 2010-11 and 2012-13, it has not translated into any significant increase in the number of schools meeting the Right to Education norms; (b) if so, the details of the infrastructural upgradation of schools made between this period; and (c) the allocation for this sector in 2013-14 budget and the effective steps being taken to improve the infrastructure facilities in the schools? (a)&(b): No, Sir, In 2011-12, there has been an increase of 13,803 government elementary schools over the previous year as per elementary school statistics collected under the District Information System for Education (DISE) annual database. Creation of school infrastructure and buildings takes time and progress is reflected in the subsequent years. Between 2010-11 and 2012-13, 30972 primary school building, 10700 upper primary school buildings, 688421 additional classrooms (in lieu of upper primary schools and as per pupil teacher ratio), 296434 toilets and 31678 drinking water facilities have been sanctioned to States/UTs under the Sarva Shiksha Abhiyan (SSA). (c): For 2013-14, the budgetary provision indicated for SSA is Rs.27258.00 crore, which is 14.17% higher than the RE level of 2012-13. Close monitoring of completion of school infrastructure facilities is undertaken under the SSA, to ensure State’s/UT’s utilize the allocated funds and meet residual gaps as per the RTE Act, 2009, standards. INFRASTRUCTURE FACILITIES IN SCHOOLS 26th April, 2013 RSQ 3509 SHRI PARIMAL NATHWANI a) whether as per the judgment of Supreme Court all infrastructure facilities in schools are to be completed till March, 2013; b) whether the Ministry has guided that all the civil work infrastructure facilities have to be completed till March, 2013 as per RTE Act 2009; c) if so, status of fund released by Government in last three years under SSA to Jharkhand State; d) whether it is a fact that there is a shortage of huge amount of funds in Jharkhand thereon; and e) if so, details of funds allotted against the demand, State-wise? SHASHI THAROOR) (a) Hon’ble Supreme Court in writ petition (Civil) No. 631 of 2004 in the matter of Environmental and Consumer Protection Foundation vs. Delhi Administration and Others, has directed, in its order dated 3.10.2012 to all States and Union Territories (UTs), that the provision of toilet facilities for boys and girls, drinking water facilities, sufficient classrooms, etc. if not already provided, is to be implemented within six months. (b) Yes Sir. The Ministry had guided all States / UTs to expeditiously complete the infrastructural facilities sanctioned under the SSA to comply with the timeline set under Right to Free and Compulsory Education (RTE) Act, 2009. (c) to (e) The details of funds released under the Sarva Shiksha Abhiyan (SSA) to Jharkhand during last three years and unspent balances with the State at the end of each year are as under, which shows that there was no shortage of funds with the State:

TOILETS IN GIRLS SCHOOLS 3rd May, 2013 RSQ 4109 SHRI BAISHNAB PARIDA (a) the status of setting up toilets in various schools, especially in girl schools in the country; (b) whether such toilets set up in Delhi and other regions of the country have been found in a bad shape; (c) whether absence of the above facilities in these schools had forced the girl students especially in the country-side to abandon pursuing education; and (d) if so, the details thereof along with an action plan to bridge such gaps? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) Under the Sarva Shiksha Abhiyan (SSA) 8.53 lakh toilets have been sanctioned including 4.49 lakh girls'' toilets, across the country for government elementary schools till 2012-13 against which States and Union Territories have constructed 6.25 lakh toilets upto March 2013 (provisional). Similarly under the Rashtriya Madhyamik Shiksha Abhiyan (RMSA) 29037 toilet blocks have been sanctioned in existing and upgraded secondary schools, across the country. Apart from this, through convergence with the schemes of Ministry of Drinking Water and Sanitation, toilets have been provided in existing rural schools as well. (b) As per District Information System for Education (DISE) 2011-12 (provisional), 99.2% girls'' toilets in Delhi are functional, whereas, the functional girls'' toilets in all elementary schools across the country is 83.7%. (c) & (d) From the data available in DISE 2011-12 it is clear that the share of girls enrolment at primary level and upper primary level has risen from 43.7% and 40.9% in 2000-01 respectively, to 48.35% and 48.63% in 2011-12 which is in consonance with their share in population. The school statistics also reveal that girls’ dropout rates dropped sharply from 39.4% at primary level in 2001-02 to 25% in 2010-11 which is better than that of boys. The opening of schools in the neighbourhood under the SSA has improved access of girls to schools, and provisions inter-alia, of free textbooks, free uniforms, separate toilets for girls, the Kasturba Gandhi Balika Vidyalaya residential upper primary schools, the National Incentive Scheme for girls and the Mid Day Meal programme have further encouraged the participation of girls in elementary education. Similarly, at the secondary education level, inter alia, the opening of schools within 5 km, the setting up girls'' toilet blocks and the provision for girls'' hostels have contributed to higher participation of girls in secondary education. DRINKING WATER AND SANITATION FACILITIES IN ALL SCHOOLS 3rd May, 2013 RSQ 4116 SHRI Y.S. CHOWDARY (a) whether the Supreme Court had directed Government to provide clean drinking water and sanitation facilities in all the schools by the 31 January, 2013; (b) if so, the details thereof; (c) whether all the States have implemented these directions;

PROMOTION OF ENVIRONMENTAL EDUCATION 5th August, 2013 RSQ 50 SHRI RAJIV PRATAP RUDY (a) whether Government has taken steps to promote environmental education in higher educational institutions; (b) if so, the details thereof and if not, the reasons therefor; (c) whether Government is considering to set up environmental education centres or expand the environmental engineering courses across the Government/aided institutions; and (d) if so, the details thereof and if not, the reasons therefor? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) & (b) : The University Grants Commission (UGC) has reported that as per directions of the Hon’ble Supreme Court of India in Writ Petition 860 of 1991 (M.C. Mehta vs Union of India and others), it has framed a Core Module Syllabus for Environmental Studies, of six months duration, for undergraduate courses and circulated it to the universities/institutes for implementation and compliance. The UGC has further reported that it has stopped development grants in those universities/institutes which have not implemented the course. The All India Council for Technical Education (AICTE) has reported that it has designed model curriculum for its undergraduate Engineering and Technical Courses for addressing environmental concerns, namely: the protection of endangered environment and depleting energy sources; environment friendly solutions to engineering and technical problems; wealth generation using environmentally benign and energy efficient techniques; etc. (c) & (d) : Yes, Sir. The AICTE has reported that there are 43 Government / aided institutions in the country that offer post graduate courses in environmental engineering leading to M.Tech/ M.E. programmes. It has stated that its policy is to encourage institutions to start new courses including environmental engineering within the stipulated rules.

LACK OF BASIC INFRASTRUCTURE IN SCHOOLS 12th August, 2013 RSQ 656 SHRI ISHWARLAL SHANKARLAL JAIN (a) whether the children in the most of states in the country are being taught in the open under the tree; (b) whether the children fall ill frequently due to studying at open places; (c) whether the children are deprived of water and toilets facilities at such places of study; (d) whether most state Governments are also not giving attention towards the menace of studying at open places; (e) whether Government has received any complaint in this regard; (f) if so, the details thereof; and (g) whether keeping in view the condition of children bound to study at open places, Government is taking any steps for their future? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) to (g): As per the District Information System for Education (DISE), 2011-12, there are overall 14,12,178 schools imparting elementary education in the country, out of which 1.68% were without a building, 94.45% schools have drinking water facilities, 72.16% schools have girls toilets and 81.14% schools have boys toilets. Since the inception of the SSA, a total of 3,06,667 school buildings, 18,03,935 additional class-rooms, 8,81,437 toilets and 2,31,865 drinking water facilities have been sanctioned to the State to augment the school infrastructure in Government schools. CONDITION OF SCHOOLS 12th August, 2013 RSQ 663 SHRI PANKAJ BORA (a) whether Government is aware that even after three years the Right to Free and Compulsory Education Act, 2009 came into effect, many schools are unsafe, lack in electricity, toilets and safe drinking water; (b) whether Government is also aware that there is no proper fencing and boundary wall from security point of view besides pupil-teacher ratio and one-classroom-one teacher are yet to be established; and (c) if so, what is Government’s reaction thereto ? SHASHI THAROOR) (a) to (c): As per the District Information System for Education (DISE), 2011-12, there were 10,78,407 government and government aided schools imparting elementary education in the country, out of which, 39.5% schools had

electricity, 65.35% schools had girls toilets, 87.81% schools had boys toilets, 94.26% schools had drinking water facilities, 47.51% schools had boundary wall, 59.05% schools had the requisite pupil teacher ratio (PTR), as prescribed in the Schedule to the RTE Act and 65.41% schools had one classroom per teacher. Since the coming into force of the Right of children to Free and Compulsory Education (RTE) Act, 2009, a total of 43,668 school buildings 7,00,460 additional class-rooms, 5,46,531 toilets and 33,703 drinking water facilities have been sanctioned to the States under the Sarva Shiksha Abhiyan (SSA) programme to augment their school infrastructure in compliance with the RTE Act. BUDGETARY PROVISION FOR INFRASTRUCTURAL FACILITIES IN SCHOOLS 12th August, 2013 RSQ 674 SHRI NATUJI HALAJI THAKOR (a) whether it is a fact that Central Government is not of the view to accord sanction to the proposed budgetary provision of Gujarat to carry out all the civil works, infrastructure facilities in schools till March, 2013; and (b) whether it would bear the responsibility of non implementation of Supreme Court mandate in case Central Government does not allot the proposed additional budget to the State Government immediately? SHASHI THAROOR) (a)&(b): The Government of India has approved an outlay of Rs. 44904.76 lakh including a spillover of Rs. 24810.74 lakh for carrying out the Civil Works/ infrastructure facilities in schools during the current year 2013-14 for the Sarva Shiksha Abhiyan (SSA), in the State of Gujarat. Keeping in view the financial ceiling norm of 33% on civil works under the SSA, the Government has approved priority works viz., the construction of schools in un-served areas, girls’ toilets and drinking water facility in compliance with the Right of Children to Free and Compulsory Education (RTE) Act, 2009, while the Construction of Block Resource Centres (BRCs)/ Cluster Resource Centres (CRCs) buildings and other small works like electrification were not approved. (a) The provisional 8th All India School Education Survey (giving data as on 30.09.2009) conducted by the National Council of Educational Research and Training (NCERT) reveals that out of a total of 524234 Government Primary Schools, 345317 (65.87%) and 416819 (79.51%) Schools were having toilet facilities and drinking water facilities respectively. (b) The Government has endeavoured to improve the quality of school education in the country. The Right of Children to Free and Compulsory Education (RTE) Act, 2009 has become operative with effect from 01.04.2010. The Act mandates that every child in the age groups of 6-14 years shall have the right to free and compulsory education. The Sarva Shiksha Abhiyan (SSA) has been revised to correspond to the provisions of the RTE Act, 2009 in terms of the provision of additional teachers, classrooms and facilities in schools as quality interventions. The SSA has covered rural and backward regions extensively. As per the District Information on School Education (DISE) 2011-12, a total of 87.63% of Government elementary schools had toilets and 94.45% had drinking water facility. The Rashtriya Madhyamik Shiksha Abhiyan (RMSA) launched in March, 2009 envisages inter-alia the opening of new secondary schools (through up-gradation) and the dispensing of additional schools with a special focus on backward areas. Interventions such as the construction of school buildings, additional classrooms, laboratories, toilets etc. are provided for under the RMSA. (c) A statement showing the number of toilets and water facilities built, across the country during the last three years is annexed.

IMPLEMENTATION OF RIGHT TO EDUCATION 19th August, 2013 RSQ 1277 SHRI BAISHNAB PARIDA (a) what is the success of implementation of Right to Education in the country since its enactment; (b) whether its results in implementation are poor especially in the backward and poverty-stricken regions of the country; (c) if so, the details with reasons thereof; and (d) the action plan to fast-track the system to help its benefits reach the under-privileged sections of society? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) to (d): The Right of Children to Free and Compulsory Education (RTE) Act, 2009 mandates the provision of free and compulsory education to all children in the age group of 6-14 years. As per the District Information System for Education (DISE), the enrolment of children at the elementary level has increased from 18.77 crore in 2008-09 to 19.90 crore in 2011-12. The figures for SC enrolment have increased from 3.70 crore in 2008-09 to 3.94 crore in 2011-12. The figures for ST enrolment have increased from 2.07 crore in 2008-09 to 2.17 crore in 2011-12. The central government has focussed on the backward areas in planning and budgeting for the RTE Act. In 2013-14, 12% of the outlay has been approved for 61 districts with concentration of SC population, 12% of the outlay for 109 districts with concentration of ST population and 18% of the outlay for 88 districts with concentration of muslim minority. Since the inception of the SSA and till date, 30,490 school buildings, 2,44,662 additional classrooms, 61,029 toilets, 19,620 drinking water and 90,860 teachers have been sanctioned in SC concentrated districts and 54,326 school buildings, 1,81,295 additional classrooms, 98,054 toilets, 22,445 drinking water and 25,887 teachers have been sanctioned in ST concentrated districts and 38,289 school buildings, 3,09,534 additional classrooms, 61,966 toilets and 13,097 drinking water have been sanctioned in Muslim minority concentration districts.

FAILURE TO IMPLEMENT RTE 19th August, 2013 RSQ 1290 SHRI ISHWAR SINGH (a) whether Government''s failure to implement the Right to Education Act in schools would have any adverse effect on higher education; (b) if so, the details thereof; (c) whether Government, in consultation with State Governments proposes to ensure implementation of RTE Act in schools in letter and spirit; and (d) if so, the details thereof? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) to (d): No Sir. The Right of Children to Free and Compulsory Education (RTE) Act, 2009 mandates the provision of free and compulsory education to all children in the age group of 6-14 years and over time, its continuing implementation will have a positive effect on higher education too. Most eligible habitations in the country have been provided with neighbourhood schools, residential school or transportation facilities, to provide access to elementary education. As per the District Information System for Education (DISE), the enrolment of children at the elementary level has increased from 18.77 crore in 2008-09 to 19.90 crore in 2011-12 which will further enhance the demand for higher education. The schedule to the RTE Act had specified norms and standards for schools for which considerable progress has been made by all the States and UTs with regard to meeting the standards given in the schedule to the RTE Act, 2009. As per the DISE 2011-12, in Government and Government aided schools 59.05% schools had a Pupil Teacher Ratio (PTR) as prescribed, 65.35% of the schools had girls’ toilets, 87.81% had boys’ toilets, 94.26% schools had drinking water and 61.66% had ramps. The focus of SSA/RTE is on improving quality of education so that students passing out of elementary schools are able to pursue secondary, senior secondary and higher education. Since the RTE Act came into force, under the Sarva Shiksha Abhiyan (SSA), a total of 43,668 schools, 7,004,60 additional classrooms, 5,46,513 toilets and 33,703 drinking water facilities have been sanctioned to the States for ensuring compliance with the RTE Act. INFRASTRUCTURAL UPGRADATION IN SCHOOLS 19th August, 2013 RSQ 1315 SHRI M.P. ACHUTHAN (a) whether it is a fact that, despite a 52 per cent increase in the Sarva Shiksha Abhiyan budget for the infrastructural upgradation of schools between 2010-11 and 2012-13, it has not translated into any significant increase in the number of schools meeting the Right to Education norms; (b) if so, the details of the infrastructural upgradation of schools made between this period; and

(c) the budgetery allocation for this sector in the budget 2013-14 and what effective steps are being taken to improve the infrastructure facilities in the schools? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) & (b) No, Sir. There has been a steady increase in the number of schools meeting the norms stipulated in the Right of Children to Free & Compulsory Education (RTE) Act, 2009 during the preceding years. The creation of school infrastructure and buildings takes time and progress is reflected in the subsequent years. Between 2010-11 and 2012-13, 34,664 primary school buildings, 18,017 upper primary school buildings, 5,24,412 additional classrooms, 3,51,552 toilets and 30,917 drinking water facilities have been operationalized across the country under the Sarva Shiksha Abhiyan (SSA) programme. (c) For 2013-14, the budget allocation for infrastructure is Rs. 589270.94 lakh. There has been some delay in carrying out civil works in some States due to non-availability of land. Close monitoring of completion of school infrastructure facilities is undertaken under the SSA, to ensure that the States/UTs utilize the allocated funds and meet residual gaps as per the standards laid down by the RTE Act, 2009. SCHEMES IN GOA 26th August, 2013 RSQ *224 SHRI SHANTARAM NAIK (a) the schemes of the Ministry being implemented in Goa, Department-wise; (b) the financial allocation made with respect to each of the scheme; and (c) the amount spent and the targets achieved with respect to each of the schemes? MINISTER OF HUMAN RESOURCE DEVELOPMENT ( SHRI M.M. PALLAM RAJU ) (a) to (c): A Statement is laid on the Table of the House. STATEMENT REFERRED TO IN REPLY TO PARTS (a) TO (c) OF THE RAJYA SABHA STARRED QUESTION NO. 224 FOR ANSWER ON 26-8-2013 ASKED BY SHRI SHANTARAM NAIK, MP, REGARDING SCHEMES IN GOA (a) to (c) The following Centrally Sponsored Schemes are being implemented in the State of Goa: Department of School Education & Literacy: i. Sarva Shiksha Abhiyan (SSA): Under this scheme, the Government of India released ?10.13 crore to Goa in 2012-13. The State of Goa released ? 3.72 crore as State share. An expenditure of ? 18.53 crore was incurred under SSA in Goa including previous year’s unspent balances. The State constructed 25 additional class rooms, 124 drinking water facilities and 260 toilet facilities in 2012-13. For 2013-14, ? 24.51 crore has been approved for SSA to the State of Goa. ii. Mid Day Meal (MDM): Under this scheme, during the year 2012-13 an amount of ?1365 lakh was allocated and ? 1389.72 lakh have been released. A total of 1.45 lakh children availed of MDM in Goa in 2012-13 as against the target of 1.55 lakh children. The State Government has incurred an expenditure of ?13.90 crore including unspent balance of previous years, as against releases of ?13.65 crore.

iii. Rashtriya Madhyamik Shiksha Abhiyan (RMSA): This scheme is being implemented in Goa from 2009-10 with the objective to universalize access to secondary education, and improve its quality. A total outlay of ?1569.01 lakh has been approved for the State of Goa from 2009-10 to 2013-14 out of which an amount of ? 418.00 lakh has been released for recurring and non-recurring activities under RMSA. An amount of ? 238.4 lakh has been spent by the State upto 31.03.2013. The State has reported completion work in respect of toilet blocks and water facilities in 70 out of 74 schools sanctioned in 2009-10. Rest of the approved civil works are yet to start. iv. National Means cum Merit Scholarship: In the year 2012-13, the State Government of Goa was sanctioned 734 scholarships which included fresh scholarships as well as renewals. An amount of ? 44.04 lakh was released to the scholarship holders in Goa. v. Centrally sponsored Scheme of Teacher Education: Under this scheme, assistance is provided as resource support for State Councils of Educational Research and Training (SCERTs), District Institute of Education and Training (DIETs), Colleges of Teacher Education (CTEs) & Institute of Advanced Studies in Education (IASEs). During the year 2012-13 an amount of ? 46.38 was released and ? 44.71 lakh have been released during the current year, so far. vi. Jan Shikshan Sansthan: Under this scheme, one Jan Shikshan Sansthan has been sanctioned in Goa under the scheme. During the year 2012-13, an amount of ? 12,17,316 has been spent benefitting 2538 beneficiaries against the target of 2385. vii. ICT in Schools: Under this scheme, all the 432 Government and Government aided secondary and higher secondary schools has been covered and an amount of ? 2160 lakh has been released from 2007-08 to 2010-11. Department of Higher Education: i. Scheme of Strengthening of Existing Polytechnics: Under this scheme, a total of 4 polytechnics in Goa have been selected and partial financial assistance of ? 2.00 crore has been released, so far. ii. Scheme of Community Development Through Polytechnics (CDTP): Under this scheme, a total of 5 Polytechnics in Goa have been selected to implement the scheme and an amount of ? 234.70 lakhs has been released benefitting 6940 persons. iii. Scholarship/ Fellowship Schemes: A total of 173 students were awarded scholarships in the year 2012-13 which include fresh scholarships as well as renewals and an amount of ? 28.27 lakh was released to the scholarship holders in Goa. iv. National Mission on Education through Information and Communication Technology (NME-ICT) Scheme: Under the scheme, a total of 2 Universities and 37 Colleges have been connected. LAN of upto 400 nodes on an average has also been envisaged to be provided to the universities under the NMEICT scheme. 75% contribution is provided by the Centre and 25% from States/ Institutions. The expenditure for the connectivity has been approximately ? 2.97 crore for the 2 Universities and ? 14.40 lakhs for the 37 colleges. BUILDINGS OF GOVERNMENT SCHOOLS IN ASSAM 26th August, 2013 RSQ 1765

SHRIMATI NAZNIN FARUQUE (a) whether it is a fact that most of the city Government schools have poor buildings in Assam; (b) if so, the details thereof and the reasons therefor; and (c) the steps being taken by Government to improve its structures? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) to (c): No Sir. The Schedule to Right of Children to Free and Compulsory Education (RTE) Act, 2009 provides for an all-weather building consisting of at least one class-room for every teacher, an office-cum-store-cum-Head teachers’s room subject to enrollment norms, barrier-free access, separate toilets for boys and girls, safe and adequate drinking water facility to all children, a kitchen where mid-day meal is cooked in the school, playground and arrangements for securing the school building by a boundary wall or by fencing. Further, funds are provided under the Sarva Shiksha Abhiyan (SSA) for major repairs of school building subject to the SSA’s programmatic and financial norms. The Government of India has cumulatively sanctioned 10994 primary schools, 1171 upper primary schools, 66909 additional class rooms, 788 drinking water facilities, 37450 toilets and 48808 posts of teachers to the State of Assam till 30th June, 2013 under the Sarva Shiksha Abhiyan (SSA) programme since its inception in 2001-02. Out of these, 10736 primary schools, 1170 upper primary schools, 59954 additional class rooms, 788 drinking water facilities and 31352 toilets have been completed during the same period. Every year the Annual Work Plan & Budget (AWP&B) of States is appraised and approved by the Project Approval Board (PAB) in which civil works proposals are also sanctioned. The sanctions under the civil works for the State of Assam during 2010-11, 2011-12, 2012-13 and 2013-14 were of Rs. 400.31 crore, Rs. 776.54 crore, Rs. 968.54 crore and 99.46 crore respectively. The PAB approved the total outlay of Rs. 726.57 crore, Rs. 1555.83 crore, Rs. 2227.91 crore and Rs. 1605.90 crore during 2010-11, 2011-12, 2012-13 and 2013-14 respectively under the SSA to the Government of Assam. Out of these, the Government of India released Rs. 649.54 crore, Rs. 1188.21 crore and Rs. 1308.82 crore to Assam during 2010-11, 2011-12, 2012-13 respectively under the SSA to the State of Assam. So far, the Assam SSA has been released Rs. 332.30 crore during 2013-14. The released amounts are being used for all the activities including that of civil works. AMENITIES IN SCHOOLS 26th August, 2013 RSQ 1774 SHRIMATI T. RATNA BAI SHRI MOHD. ALI KHAN (a) whether Government is ensuring that all schools will get RO systems, toilets and desks with the cooperation of private organizations and other companies particularly under the Corporate Social Responsibility (CSR); (b) if so, the details thereof, State-wise including Andhra Pradesh particularly in the agency areas during the Eleventh and Twelfth Five Year Plans; and (c) the funds allocated, released and spent for the said period, year-wise? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) to (c): No Sir. However, the Sarva Shiksha Abhiyan (SSA) programme provides for the construction of new schools, additional classrooms, toilets, drinking water facilities and ramps as per the Schedule of Rates notified by the State Government. This assistance is available only to Government run school buildings. Every year the

Annual Work Plan & Budget (AWP&B) of States is appraised and approved by the Project Approval Board (PAB) in which civil works proposals are also sanctioned. The Government of India has cumulatively sanctioned 8143 primary schools, 1940 upper primary schools, 103502 additional class rooms, 9041 drinking water facilities and 42351 toilets for the State of Andhra Pradesh till 30th June, 2013 under the SSA programme since its inception in 2001-02. Out of these, 7739 primary schools, 1940 upper primary schools, 90919 additional class rooms, 9041 drinking water facilities and 36666 toilets have been completed during the same period. The sanctions under the civil works for the State of Andhra Pradesh during 2010-11, 2011-12, 2012-13 and 2013-14 were of Rs. 694.13 crore, Rs. 1450.76 crore, Rs. 1739.28 crore and 351.32 crore respectively. The PAB approved the total outlay of Rs.1736.14 crore, Rs. 4376.41 crore, Rs. 3372.48 crore and Rs. 2808.75 crore during 2010-11, 2011-12, 2012-13 and 2013-14 respectively under the SSA for Andhra Pradesh. Out of these, the Government of India released Rs. 810.00 crore, Rs. 1835.52 crore and Rs. 1360.49 crore to Andhra Pradesh during 2010-11, 2011-12, 2012-13 respectively under the SSA to the Government of Andhra Pradesh. So far the Andhra Pradesh SSA has been released Rs. 675.16 crore during 2013-14. The released amounts were used for all the activities undertaken as part of the SSA including that of civil works. Live demonstration of various equipments used during the rescue and relief operations at the time of a disaster before the students; III. Introduction of disaster management as a compulsory part of the curriculum at secondary level. (b) Students of all the Kendirya Vidyalayas and Jawahar Navodaya Vidyalayas, run by the Govt. of India, all over the country have a common curriculum comprising subjects like prevention and mitigation of common hazards from disaster; introduction to man made Nuclear, Biological and Chemical disasters; and community based disaster management viz. safer construction practices; survival skills; alternate communication system; sharing responsibility

during disaster etc. The Disaster Management as a subject has been introduced in all the schools affiliated with the Central Board of Secondary Education (CBSE) in class VIII to X. The CBSE has also brought out text books for these classes. (c) Schools are equipped with gadgets like fire extinguishers, sand buckets etc. as an on-going programme. DRINKING WATER AND CLEAN TOILETS IN SCHOOLS 09th December, 2013 RSQ 348 DR. T. SUBBARAMI REDDY (a) whether Government has fixed any time-limit with regard to providing safe drinking water and clean toilets in all Government and Government aided schools; (b) if so, the details thereof; (c) whether the Supreme Court has given any direction to Government in this regard and if so, the details thereof; (d) the number of schools in States including Andhra Pradesh, lacking basic infrastructure facilities including safe drinking water and toilet facility, State-wise; and (e) the steps taken by Government to address the issue? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) to (c) The Right of Children to Free and Compulsory Education (RTE) Act, 2009 mandates the appropriate Governments to provide school infrastructure for elementary education in accordance with the norms prescribed in the schedule to the RTE Act. The State Governments / UT administrations are mandated to provide these facilities in all schools as per the time frame mandated under the RTE Act. Further, the Hon’ble Supreme Court in writ petition (Civil) No. 631 of 2004 in the matter of Environmental and Consumer Protection Foundation vs. Delhi Administration and Others, had directed, in its order dated 3.10.2012 that all States and Union Territories provide, inter alia, drinking water and toilet facilities, if not already provided, within six months to schools. (d) & (e) As per the District Information System for Education (DISE) 2011-12, 94.45% schools have drinking water facilities, 81.14% elementary schools have boys'' toilets and 72.16% elementary schools have girls'' toilets. State-wise statement of these facilities is at Annexure. Under the Sarva Shiksha Abhiyan (SSA), 8.81 lakh toilets and 2.31 drinking water facilities have been sanctioned across the country for government elementary schools till 2012-13. Apart from this, convergence with the schemes of Ministry of Drinking Water and Sanitation has been effected by States / UTs and toilets & drinking water have been provided in existing rural schools from that source also.

AVAILABILITY OF POTABLE WATER AND TOILET FACILITIES IN SCHOOLS 10th February, 2014 RSQ 1939 DR. CHANDAN MITRA (a) the number of schools in the country vis-a-vis the number of schools which have been provided potable water and toilet facilities so far, State/UT-wise; (b) the reasons for very slow pace of implementation of directions of the Supreme Court in the matter; and (c) the fresh steps taken by Government to provide drinking water and toilet facilities in all the schools across the country, especially in Madhya Pradesh? MINISTER OF STATE IN THE MINISTRY OF HUMAN RESOURCE DEVELOPMENT (DR. SHASHI THAROOR) (a) to (c) As per the Unified District Information System for Education (UDISE) 2012-13, there are 14,31,702 elementary schools, of which 94.87% schools have drinking water and 89.13% schools have toilets facilities. A state-wise statement showing the details of total schools, schools with toilets and drinking water facilities at the elementary level is at Annexure. All new school buildings under the Sarva Shiksha Abhiyan (SSA) are sanctioned as composite buildings with toilets and drinking water facilities. In addition to this, a total of 8.81 lakh toilets and 2.31 lakh drinking water facilities have been sanctioned till 2013-14 under the SSA. In the case of Madhya Pradesh, 82,515 toilets and 18,381 drinking water facilities have been sanctioned under the SSA till 2013-14. Apart from this, convergence is also affected with the schemes of Ministry of Drinking Water & Sanitation to provide these facilities to schools in rural areas.
