Prohibition of humanitarian access and looting and diversion of aid deliberately to cause mass starvation and famine employed as a weapon of war; 9. Ethnic profiling, firing from jobs, eviction from rental houses, detention and imprisonment in internment camps of tens of thousands Tigrayan soldiers in the Ethiopian defence forces including those in UN peace keeping missions, wealthy private business owners, those that have been working in Ethiopian Airlines, banks and other public and private companies; 10. Forcible return and attacks on refugee camps; 11. Forced disappearance of close to 20,000 Eritrean refugees from Shimelba and Histats and the repeated and pre-planned destruction of the refugee camps;

Crimes

The major crimes committed since the declaration of the war on Tigray on the 4th of

November 2020 include:

1. Collective punishment;

2. Grave atrocities and heavy indiscriminate shelling and aerial bombing of

populated areas including using Unmanned Aerial Vehicles (drones);

3. Extrajudicial executions of tens of thousands of civilians;

4. Denying people to collect corpses of their loved ones and let the hyenas eat corpse;

5. Widespread rape and sexual violence against women including underage girls-

used as a weapon of war;

6. Systematic starvation of people by looting and deliberately destroying food and

livelihood sources critical for survival;

the region;

11. Forced disappearance of close to 20,000 Eritrean refugees from Shimelba and

Histats and the repeated and pre-planned destruction of the refugee camps;

12. Annexure of a large swath of Tigray by the Amhara militias & systematic

demographic change;

13. Forcing people to acquire Eritrean ID and barring humanitarian assistance from

reaching particularly to the Irob communities in Tigray by the Eritrean forces;

14. Massive displacement of people, including 67,000 refugees from Tigray and more

than 2 million internally displaced persons within Tigray;

15. Systematic destruction of industries such as Almeda Textile Factory, Addis

Pharmaceuticals, Sheba Leather, and Tsemayat Marble Stones;

16. Systematic destruction and pillage of UNESCO registered and other heritage sites,

religious and cultural buildings including in Aksum, Negash, and Debre Damo;

17. Systematic destruction and looting of public and private service institutions and

properties such as universities, hospitals, pharmacies, health centers, schools,

hotels, bakeries;

18. Organised looting and unlawful confiscation of properties of Endowment Fund

for the Rehabilitation of Tigray (EFFORT), a multi-million- dollar public

endowment that belonged to the people and government of Tigray.

Responsibility of criminals ranking and grading

There is sufficient information about the crimes committed and the individuals

responsible for violations. This report applies specific method of determination of

responsibility in the crimes committed. This note lists the suspected criminals based

on their mandate and responsibility bestowed to the public offices they hold. The

criteria used include: their decision-making powers as provided by the Emergency

laws declared, membership to National Security Council, the Command Post, and the

public pronouncements made. In general, the principle of association and

membership to specific public office, committee, group, the units of the armed forces

or armed groups to which these individuals belong have been identified as

responsible.

Marking:

1. Official participation in the policy making, planning, command and execution

of acts that led to violation- Commission- 3 marks

2. Failure to act to prevent crimes while in office with responsibility to do so-

Omission – 3 marks

3. Conspiring with foreign forces – Treason- 3 marks

4. Personal Public pronouncement – incitement to genocidal acts- 3 marks

Evidence gathered and analyzed included reports of eyewitness testimonies from

survivors and victims, documents and testimonies from the media, international

organizations, the UN and other humanitarian actors, public and leaked statements

from Government officials and opposition officials, and satellite imagery.

documentation before boarding their flights. The commission reiterated its

concern that the new regulation which requires passengers to provide

Kebelle ID alongside other official travel documents makes people

susceptible for ethnic profiling and discriminations.

The government affiliated human rights organization disclosed its

concerns on 11/11/2020, in letter sent to the Ethiopian civil aviation

authorities and the Bolle Airport Security Bureau. The letter was signed by

Chief commissionaire Dr. Daniel Bekelle with Cc to Ethiopian attorney

General Office, the Ministry of Transportation and the Addis Ababa city

administration, Ethiopian insider confirmed.

In the two pages long letter, the commission indicated that domestic and

international passengers reported to the commission highlighting that the

aviation authority has been enacting a mandatory Kebelle ID screening in

addition to other official travel documents. The commission further

disclosed that the new regulation can raise two major human rights’

violation concerns. The first concern is that the new regulation has the

potential to restrict peoples fundamental right for freedom of movement.

Acknowledging that passports are adequate to be considered a full-

fledged identification documents, requirements for additional travel

documentation raises another question of relevance.

Reiterating that Addis Ababa city has suspended ID issuing services at this

time, the commission highlighted this problem will generate an

unintended consequence of rights violation.

The second major point indicated in the commission’s letter underlines

that some ID cards issued by various Kebelles either contain recognizable

ethnic markers or are detectable using digital methods. In consideration of

the current grim condition in the country, we have noticed that the new

regulation can lead into massive ethnic profiling, the commission

underlined.

The commission has also asked the Ethiopian civil Aviation to investigate

possible anomalies of the magnitude stated above and take a corrective

measure immediately. The commission added, in order to help the

commission, undertake a thorough assessment of possible human rights

violation, the Aviation authorities requested for an explanation from

concerned authorities.
