SECTION 01050 - SPECIAL CONDITIONS

SCOPE

The specifications describe the work to be done and the material

to be provided for performing HVAC testing, adjusting and

balancing (“TAB”) services for the construction of the new

Science Building Phase II, Eastern Kentucky University, Richmond,

Ky.

These Special Conditions shall apply to all Divisions of the

Specifications.

PROJECT DESCRIPTION

The new construction is to be a six-story science building. The

new science building includes classrooms, teaching laboratories,

research laboratories, offices, support spaces, chemical storage

areas, and common spaces. The building includes approximately

174,195 gross square feet. The sixth floor is for mechanical

equipment only.

Building components; extensive laboratory casework and fume hoods

and limited fixed laboratory. The HVAC System consists of a

variable-air-volume with reheat HVAC system, and on-site chillers

(Steam is supplied by the university's central power plant).

DEFINITIONS

The term "Owner" as used throughout the Specifications and

Contract Documents means the Commonwealth of Kentucky, acting

through the Finance and Administration Cabinet and its

Administrative Agent, the Department for Facilities Management.

The “Commissioning Authority” will be Facility Commissioning

SUBSTANTIAL COMPLETION DATE

The TAB Agency is responsible for coordinating the TAB work with

the project schedule through the Prime Contractor. The

substantial completion date for work by the Prime Contract is

April 2017. This will be the completion date the TAB Contact.

Included in these documents is a Contractor’s Construction

Schedule for reference (see FTP Site).

DUCT PRESSURE TESTING

Duct Pressure testing will be by Allowance, time adjusted by Unit

Price

Special Note: Duct Pressure Testing (only) on the Vivarium Area

(As shown on Drawing H1.1b) is not a part of this work. The

Vivarium Duct Testing has already been done under a previous

contract.

Commissioning Authority

The TAB Contractor is responsible for certain aspects of

the commissioning process for this project. These include,

but are not limited to: completion of Checkout and Start-up

Plans, participation in equipment start-up, attendance at

commissioning progress meetings, response to Resolution

Tracking Forms, response to Corrective Action Report,

participation in Owner Training, participate in TAB

verification and participation in Functional and Seasonal

Testing.

Supplemental Services associated with the Commissioning

Process:

1. Attend project Progress Meetings as needed. The

Commissioning Meetings will occur during regularly

scheduled Construction Progress Meetings.

2. Seasonal Testing; The TAB Agency will need to provide assistance with 4 HVAC-related seasonal functional

tests as identified in the Commissioning Plan. It is

anticipated to require 6 hours of assistance.

3. Functional Testing; The TAB Agency will need to

provide assistance with HVAC-related functional tests

as identified in the Commissioning Plan

NOTE: Times listed for this task are estimates. Actual

compensation will be determined as stated in the Allowance

section below.

Unanticipated Services

Work not anticipated in the Base Bid Documents. This may

include; repeated testing needed due to the equipment not

ready for of passing the initial tests, additional services

requested by the Owner or Engineer, etc.

ALLOWANCES

Include in the Base Bid an Allowance for 70 Hours for Duct Air

Pressure Testing, Supplemental Services, Unanticipated Services

and related Travel Time.

The Contract price will be adjusted (more or less) an amount

equal to the net difference between the Allowance amount and the

actual documented amount based on the listed Unit Price: with no

Overhead and Profit line charge.

The Contactor is to document all time spent in association with

this Allowance. Upon completion of the Allowance Work, present

to the Engineer a documented Change Order to properly adjust the

Contract Price. A TAB ALLOWANCE LOG is provided to facilitate

this documentation. Indicate which line items are repeats of

work; not ready, failed, etc., as this will be back-charged to

the appropriate Contractor.

REPORTS

The TAB Agency will submit the final TAB report for review by the

Engineer. All outlets, devices, HVAC equipment, etc., will be

identified, along with a numbering system corresponding to report

unit identification. The TAB Agency will submit a National

Project Performance Guaranty assuring that the project systems

were tested, adjusted and balanced in accordance with the project

specifications and National Standards.

At completion and prior to final payment; Provide the National

Project Performance Guaranty certificate (AABC “National




Performance Guaranty”, NEBB “Quality Assurance Program”

certificate) , submit 3 hard copies of the Final TAB Report and 3

digital (Compact Disc - PDF Format) copies of the Final TAB

Report.

PAYMENT

- Partial payments up to 90% of the Contact Amount may

be requested (invoiced) and may be approved as

appropriate for the acceptable work completed.

- The final 10% will be paid upon approval and

submission of the Final Report, and all other closeout

items.

Show each item of equipment or task completed, in general,

as an individual line item on the Invoice.

All invoicing is to be on the official State Invoice Form

(SAS-25). The final invoice is to be accompanied by a

completed, signed and notarized Final Affidavit (B-210-13 –

see sample (contract) --- Affidavit for Bidders, Offerors

and Contractors (small purchase)). The forms can be found

materials, supplies, services and shall include all items

of cost, overhead and profit for the Contractor and any

Subcontractor involved, and shall be used uniformly

without modification for either additions or deductions.
