Anytax assessment against the Fund shall be nulland void.eatures and Benefits9Slide 18r3S The Fund's tax exemption clause is found unde9 Section 13 of RA 3673 and is 9eflected in the !RR unde9 Rule !v, Section 11.The tax exemption clause actually talks of two (2) exemptions: the Fund's own tax exemption and the exemption of the membe9's benefits f9om taxes, legal p9ocesses, and liens. !t needs emphasizing he9e that the Fund's exemption only pe9tains to taxes. !t does not not inlcude exemption f9om legal p9ocesses and liens, which the membe9's benefits enjoy.The tax exemption clause of RA 3673 is copied almost ve9batim f9om the tax exemption clause of the SSS, and so we can expect to 9eceive the same exemptions as the SSS is cu99ently enjoying. Please be info9med that SSS p9esently only enjoys exemption f9om the payment of di9ect taxes and is 9equi9ed by the B!R to pay indi9ect taxes, such as the vAT o9 EvAT. We can expect to 9eceive the samet9eatment.9scosico, 10//2003%he government guarantee under RA 9679 is more encompassing as what was previously guaranteed under PD 1752 was "the payment of employees and employers contributions and dividends to the members when they are due." %he present guarantee now extends to all benefits under RA 9679 including its non-dimunition.eatures And BenefitsCovernment Cuarantee(PD 1752 & RA 9679)RA 9679S. 20. Government Guarantee. The benefits prescribed in this Act shaII not be diminished and to guarantee said benefits the Government of the RepubIic of the PhiIippines accepts generaI responsibiIity for the soIvency of the Fund.IRRRuIe IX, Benefits. Provided,that all employers who are not subject of mandatory coverage prior to R.A. 9679 and theseRules shall register for coverage before January 1, 2010, unless a different date is set bythe Board by resolutionund Coverage and NembershipMANDATORY RGISTRATION AND RPORTING OF MPLOYRSSection 6. Registration of mpIoyees. It shaII be the duty of aII empIoyers toregister aII their empIoyees subject of mandatory coverage, by submitting tothe Fund aII data and information that it may require in reIation to theempIoyers respective businesses and empIoyees, within thirty (30) days fromthe start of their business operations. For newIy hired empIoyees, theempIoyer shaII register them with the Fund within thirty (30) days from the startof their empIoymentSection 7. Registration of the SeIf-empIoyed. The seIf-empIoyed who are subjectto compuIsory coverage shaII register with the Fund within thirty (30) daysfrom the date he or she started to be seIf-empIoyed. Method of oIIection and Payment. onthly contributions of members to the Fundshall be collected through payroll deductions by their respective employers, who for this purposeshall act as agent both of the Fund and the member.If a member avaiIs of any Ioan from the Fund and the member consents in writingto amortize or pay the same through saIary deductions, the empIoyer shaII beduty-bound to faithfuIIy impIement the same and shaII continue to do so untiI theIoan is fuIIy paid. UntiI the Ioan is fuIIy paid, the empIoyer shaII not discontinuethe saIary deductions without the prior written consent of the Fund. For thispurpose, the employer shall likewise act as agent both of the Fund and the employee.If a member-borrower who has previousIy consented to amortize or pay his Ioansthrough saIary deductions resigns or otherwise separates from the service of theempIoyer, the empIoyer shaII be bound to inform the Fund of such resignation orseparation immediateIy upon notice thereof, but not Iater than thirty (30) daysfrom the effectivity of said resignation or separation.Every employer shall issue corresponding receipts for all contributions or loan amortizations orpayments deducted from the employees compensation or shall indicate such deductions on theemployees pay slip.und Coverage and NembershipMONTHLY SALARY DDUTIONS FOR LOANAMORTIZATIONSDISPLAD MMBR-BORROWR NO LONGR R"UIRD TO PAY MPLOYRS OUNTRPART ONTRIBUTIONSIRR, RUL VII, Section 5 . ffect of Leave Without Pay or Suspension frommpIoyment. n the event a member-saver goes on leave without pay or is subjectedto disciplinary action where he is suspended from work, the member-savers monthlycontribution together with the corresponding employers monthly contributions shall besuspended for the duration of the leave without pay or suspension from work. Provided,that such member-saver may opt to continue paying and remitting to the Fund directlyhis or her monthly contributions together with the employer counterpart to beshouldered by him or her. A member-borrower, on the other hand, shaII continue topay and remit directIy to the Fund his or her monthIy contributions and Ioanamortizations or payments. %he duty of the employer to deduct monthlyamortizations or payments for the member-borrowers outstanding loan with the Fundas provided for under Section 2 of this Rule shall be suspended for the duration of theleave without pay or suspension from work. Failure or refusal of the employer to pay or to remit the contributions herein prescribedshall not prejudice the right of the covered employee to the benefits under this Act.x x xSection 1. Mandatory ontributory Support of the mpIoyer. n thespirit of social justice and the pursuit of national development, themembers contribution to the Fund shall be with the mandatory contributorysupport of the employer as provided for under these Rules or as may beprovided for by the Board. Notwithstanding any contract to thecontrary, an empIoyer shaII not deduct, directIy or indirectIy, from thecompensation of its empIoyees covered by the Fund, or otherwiserecover from them, the empIoyers contribution with respect to suchempIoyees.BenefitsSection 2. Acts of the mpIoyer shaII not prejudice the member.Failure or refusal of the employer to pay or to remit the contributions hereinprescribed, or as may be provided for by the Board, shall not prejudice theright of the covered employee to the benefits under R.A. 9679 and theseRules.Section 12. Pag-IBIG ontributions are xcIuded fromthe omputation of the Gross Income. Pursuant to Section32 (B) (7) (f) of the National nternal Revenue Code of1997,the Philippines, as amended, Pag-BG Contributionsare excluded from the computation of the gross income andshall be exempt from taxation.Benefits(RA 9679 & IRR)#&GNRAL PROVISIONSPenalty Provision ClauseSection 1.
