PREFACE

The first organised Trade Union in India named as the Madras Labour Union was formed in the Year 1918. Since then a large number of unions sprang up in almost all the industrial centres of the country. Similarly, entrepreneurs also formed their organisation to protect their interests. In 1926, the Trade unions Act passed by the India Government. The Act has given legal status to the Registered Trade Unions. The Registrars of Trade Unions in different states are empowered to register the Trade Unions in their respective states. These registered Trade Unions (Workers & Employers) are required to submit annual statutory return to the Registrar regarding their Membership, General Funds, Sources of Income and Items of Expenditure and details of their assets and liabilities, which in turn submit consolidated return of their state in the prescribed proformae to Labour Bureau.

The Labour Bureau, on receiving the annual returns from different States/Union Territories, consolidates and compiles the All India Statistics and disseminates through its publication entitled “Trade Unions in India” and its other regular publications.

I would like to take this opportunity to thank the Registrars of Trade Unions of States/Union Territories who have supplied the information in time and request the non-responding States and Union Territories to supply the requisite returns for the succeeding years to make the report more purposeful. I also place on record my appreciation for the efforts put in by the officers and the staff members of the L.S. Division of Labour Bureau at Chandigarh, whose names appears in the Annexure-II.

Suggestions for further improvement of the Report are welcome.

MAIN FINDINGS OF THE REPORT

GROWTH OF TRADE UNIONS

1. During the year 2006, the percentage of unions submitting returns with respect to estimated number of registered Trade Unions works out to be 9.6 percent.

2. Out of the total of 42,917 registered unions as many as 42,448 unions 98.9 percent belonged to workers and remaining 469 unions 1.2 percent were of Employers.

3. Among States/Union Territories Kerala accounted for the largest number of registered Trade Unions i.e. 9,879.

GROWTH OF WORKERS’ UNIONS

4. The ‘Manufacturing Group’ accounted for 33.5 percent of the total number of worker’s unions submitting returns, followed by ‘Transport, Storage and Communication’ 18.1 percent.

5. The average membership per workers unions was 1,058 only.

6. Out of 42,448 Workers Unions, 92.5 percent were State Unions and remaining 7.5 percent were Central Unions.

7. Only 8,411 workers Unions (19.8 percent) had submitted the returns.

EMPLOYERS’ UNIONS

8. Out of 469 registered employers unions only 60 unions (12.8 percent) had submitted returns.

9. The average membership of Employers’ Union was reported as 184.

10. The total membership of Employers’ Union was reported as 11,023 persons. Out of which, only 2,713 (24.6 percent) were women.

11. The highest number of Employers Unions Submitting returns was 23 each in Real Estate, Renting and Business Activities.

12. The highest membership was reported in’ Financial, Intermediation’ (4,196) followed by ‘Manufacturing’ industry (3,544).

FINANCES OF TRADE UNIONS

13. All the 8,471 trade unions submitting returns had income of Rs.116.91 Crore against the expenditure of Rs.95.59 Crore respectively.

14. Total Income and Expenditure of all Workers Unions was Rs.115.66 Crore and Rs.89.80 Crore respectively.

15. Income and Expenditure of Employers Unions was Rs.1.78 Crore and Rs.5.79 Crore respectively.

ASSETS AND LIABILITIES OF WORKERS’ UNIONS

16. Total Assets/Liabilities of Trade Unions of Workers was reported as Rs.225.80 Crore.

FEDERATIONS OF WORKERS TRADE UNIONS

17. As many as 187 registered federations of workers Trade Unions were reported in 2006.

18. Only 23 federations submitted their returns. Out of these 16 were State Federations and 7 were Central Federations.

19. The Federations had an income of Rs. 2,03,05,075 against an expenditure of Rs.1,59,35,413.

Trade Unions in India, 2006

1.1 The Trade Unions Act, 1926 imposes obligation on registered Trade Unions, to submit annual statutory returns to the Registrar of Trade Unions of respective States/Union Territories, who in turn furnish consolidated returns to Labour Bureau in the prescribed format. The Labour Bureau, thereafter, compiles and disseminates such statistics at All India Level. A facsimile copy of the consolidated returns is enclosed as Annexure –I.

1.2 “Trade Union” under this act means any combination, whether temporary or permanent, formed primarily for the purpose of regulating the relations between workmen and employers or between workmen and workmen or between employers and employers, or for imposing restrictive conditions on the conduct of any trade or business and includes any federation of two or more Trade Unions.

1.3 Trade Unions Act, 1926 provides for the registration of the

Trade Unions with the Registrars of Trade Unions of their territory. Any seven or more members of a Trade Union may by subscribing their names to the rules of the Trade Union and by otherwise complying with the provisions of the Act with respect to registration, apply for the registration of the Trade Union under the Trade Unions Act, 1926. The Act gives protection to registered trade unions in certain cases against civil and criminal action. The Statistics presented in this review are based on the returns/reports received from the States/Union Territories in the prescribed format and the figures cover only the registered trade unions. However the response rate from the States/Union Territories is not very encouraging. During 2006, only 19.8 percent of the registered trade unions form 19 States/Union Territories submitted the prescribed returns to the concerned authority, who in turn furnished the consolidated returns to the Bureau. However, the percentage of unions submitting returns with respect to estimated number of registered trade unions works out to be 9.6 percent.

2. Growth of Trade Unions 2.1 Growth of Trade Unions (Workers’ & Employers’ Combined)

2.1.1 Year-wise number of Registered Trade Unions and their Membership

Information relating to number of registered trade unions, number of unions submitting returns and their membership from 1991 and 1995 to 2006 is given in Statement 2.1. Out of total registered trade unions, only 8,471 Unions (9.6 percent) submitted their returns in the year 2006. The average membership per unions increased from 1048 in 2005 to 1058 in 2006.

2.1.2 State-wise number of Trade Unions and their membership

State-wise distribution of registered trade unions for the year 2006 is presented in Statement 2.2. It may be seen from the statement that during 2006, only 19 States/Union Territories have submitted returns. Among these States/Union Territories, Kerala accounted for the largest number of registered trade unions (9,879) followed by Maharashtra (8,043). Out of the total of 42,917 registered unions, as many as 42,448 unions (98.9 percent) were of Workers Unions and remaining 469 Workers unions (1.2 percent) were of Employer Unions. Out of 42,448 Workers Unions, 92.5 percent were State Unions and remaining 7.5 percent were Central Unions. State Unions are those unions, whose activities/objectives are confined to the boundaries of the state, while Central Unions have activities/objectives beyond a State boundary.

2.2 Growth of Workers’ Unions

2.2.1 Number and Membership of Workers Unions

State-wise data in respect of workers registered trade unions submitting returns and their sex-wise membership during 2006 is given in Statement 3.1. During 2006, out of 42,448 registered workers unions, only 8,411 unions (19.8 percent) had submitted the returns. The average membership per workers unions was 1058 only.

2.2.2 State-wise distribution of Central Unions and State Unions

Statement 3.1 also presents number and membership of workers trade unions separately for Central Unions and State Unions. It may be seen from the table that during 2006, out of 8,411 unions submitting returns as many as 7,665 (91.1 percent) were state unions and remaining 746 (8.9 percent) were Central Unions. Out of the total membership of 89,50,861 persons, the membership of the State and Central Unions was 77,46,184 persons (86.5 percent) and 12,04,677 persons (13.5 percent) respectively. The State of Tamil Nadu accounted for the highest membership of Central and State Unions (23,71,406 persons) followed by Gujarat (15,65,918 persons). Women members accounted for 30.9 percent of the total membership of Central and State Unions. Amongst State Unions, the membership of Women Workers was the highest in Gujarat (10,23,246) followed by Kerala (5,64,752). Amongst Central Unions of Women workers, Tamil Nadu accounted for the largest membership (85,709), followed by Maharashtra (83,201) respectively. Women members accounted for 14.2 percent of the total membership in Central Unions.

2.2.3 Sex and Industry wise distribution of membership in

Workers’ Unions.

Sex-wise and Industry-wise (3 digit level as per NIC 2004) number of workers’ unions submitting returns and their membership for the year 2006 is presented in Statement 3.2. Summary of this statement at major industry division (One digit level) is given below in Table-I.

From Table 1 above it is seen that ‘Manufacturing Group’ accounted for 33.5 percent of the total number of unions submitting returns, followed by ‘Transport, Storage and Communication’ (18.1 percent). The membership was also highest in ‘Manufacturing group’ (19.2 percent), followed by ‘Transport, Storage and Communication’ (19.0 percent).

The proportion of women membership in an industry group to total membership of women in all industry group combined together was the highest in ‘Real Estate, Renting and Business Activities” (35.6 percent) and “Agriculture, Hunting and Forestry” (17.7 percent) followed by “Manufacturing’ (16.5). The break-up of information at minor industry groups (up to 3-digit level of N.I.C. 2004) is given in Statement 3.2.

2.2.4 Workers Trade Unions in Public Sector

State-wise statistics pertaining to the number of Workers’ Unions submitting returns and their membership in Public Sector separately for State Sphere and Central Sphere for the Year 2006 is given in Statement 3.3. An establishment in Public Sector means an establishment owned, controlled or managed by:

(i) The government or the department of the Government. (ii) A government company as defined in Section 617 of the

Company Act, 1956. (iii) A corporation (including Co-operative Society) established

by or under a Central, Provincial or State Act which is owned or controlled or managed by the Government and

(iv) A local authority.

It may be seen from the Statement 3.3 that Public Sector accounted for 29.6 percent of the membership in total workers unions submitting returns. Out of 2,487 unions submitting returns in the Public Sector 843 (33.9 percent) unions were in the Central Sphere. Membership of Trade Unions in the State sphere and Central sphere was 12,76,919 persons and 13,74,185 persons respectively.

2.3 Employers Unions

2.3.1 State-wise number of Employer’s Unions on Register Trade Unions submitting returns and their membership are given in Statement 4.1. In 2006, out of 469 registered, Employers Unions, 60 unions (i.e. 12.8 percent) had submitted returns. All the employers, trade unions submitting returns were State Unions. These unions had a membership of 11,023 persons, out of which only 2,713 (24.6 percent) were women. The average membership per employers union submitting returns was 184.

The industry wise break-up of employers unions submitting returns is given in Statement 4.2. It may be seen from the

statement that the highest number of Employers Unions submitting returns was 23 in ‘Real Estate, Renting and Business Activities’ (industry code K) The highest membership was reported in “Financial Inter-mediation” (4,196 Persons) industry code J followed by “Manufacturing” (3,544 Persons) industry code D.

3. Finances of Trade Unions

3.1 General Funds

Information relating to financial position of registered Trade Unions submitting returns (i.e. Opening Balance, Income, Expenditure and Closing Balance) for the Year 1991 and 1995 to 2006 is presented in Statement 5.1. During 2006 all the 8,471 Trade Unions submitting returns had an income of 116.91 Crore against which an expenditure of Rs. 95.59 Crore were reported.

3.2. Income and Expenditure of Workers’ Unions

State-wise and Industry-wise statistics on Income and Expenditure of Workers Unions submitting returns during 2006, classified according to Central and State Unions are presented in Statements 5.2 and 5.3 respectively.

During 2006, total Income and Expenditure of all workers unions was 115.66 Crore and 89.80 Crore respectively. The income and expenditure of Workers Central Unions was 14.17 Crore and 14.34 Crore respectively. The remaining income and expenditure of 101.49 Crore and 75.47 Crore respectively pertained to State Unions. The highest income and expenditure of Central Unions was reported in Maharashtra whereas for State Unions these were in Tamil Nadu.

3.3 Income and Expenditure of Employers Unions

State wise and Industry wise Income and Expenditure of Employers trade unions are given in Statement 5.4 and Statement 5.5 respectively. As may be seen from Statement 5.4, all the unions submitting returns were State Unions. Income and Expenditure of these unions was Rs. 1.25Crore and Rs.5.79Crore respectively. Among States Karnataka had a maximum Income and Expenditure of Rs. 72.62 Lac and 5.35 Crore respectively. The maximum expenditure was reported in industry group ‘Financial Inter-mediation’ followed by “Real Estate, Renting and Business Activities”.

3.4 Sources of Income of Trade Unions

State-wise and Industry-wise Statistics of Sources of income of trade union, for workers Trade Unions and Employers Trade Unions are given in Statements 5.6 to 5.9. For easy comparison, a summary of component wise sources of Income of both workers and employers union is given below in Table II.

Statistics pertaining to assets and liabilities in respect of trade unions of workers submitting returns is presented in Statement 5.14. Total Assets/Liabilities of Trade Unions were reported as Rs.225.80 Crore. Major constituents of assets of Trade Unions were ‘Miscellaneous’ (42 percent) and ‘Cash’ (30.8 percent) while Major

5. Federations of Workers Trade Unions

5.1. Number, Membership and General Fund

Statistics regarding number, Membership and General Funds of “Workers Federations are given in Statement 6.1. It may be seen from the Statement that during 2006 there was 187 registered Federation of Workers Trade unions, out of which only 23 federations submitted returns. Out of these, 16 were State Federations and remaining 7 were Central Federations. The federations had an income of Rs. 2,03,05,075 against which an expenditure of Rs.1,59,35,413 was reported.

5.2 Sources of Income

During the Year 2006, main sources of income of Federations submitting returns (Statement 6.2) were “Income from Miscellaneous Sources’ (42.8 percent) and ‘Contributions’ (27.0 percent).

5.3 Items of Expenditure

Main sources of total expenditure (Rs.1,59,35,413) of federations of Workers Trade Unions (Table 6.3) were ‘Other Expenses’ (59.2 percent) followed by ‘Expenses on Establishment’ (25.4 percent).

5.4 Assets and Liabilities of Federations of Workers’ Trade Union

Details of Assets and Liabilities of Federations of Workers Unions are given in Statement 6.4. During the year under review, total assets and liabilities of federations were Rs.1,61,43,939, Proportional share of major constituents of assets were ‘Cash’ (75.2 percent) and ‘Miscellaneous’ (23.8 percent). Proportion of major liabilities of federations was ‘General Funds’ (95.9 percent) and ‘Other Liabilities’ (4.1 percent).
