The aim of this booklet is to serve as a first reference tool for the general public and in particular for victims of discrimination. It provides a useful list of those organisations that are actively providing services to victims of discrimination. The services covered are varied and all of the grounds of discrimination are covered. This means that victims of acts of discrimination should be able to find at least one organisation able to provide them with information and guidance on how best to proceed.

This booklet is provided in English and in Maltese, with each section ending with a couple of Frequently Asked Questions that could prove to be useful in understanding discrimination issues and problems. Each organisation entry contains full contact information, a summary description of the organisation, the services they offer and the grounds of discrimination they are active in. The final Index may be used to locate the most appropriate organisation for the particular issue required.

The information was gathered through a process whereby over one thousand local organisations, private and also public, were contacted. All organisations were asked if they provide services to victims of discrimination and, if so, what these services are. Only those organisations that do in fact provide services to discrimination victims are included in this booklet.

Although it is possible that several other organisations offer general services, the aim of this booklet is to offer concrete and useful information to enable victims of discrimination specifically to address their experiences of discrimination.

In order to locate the organisation that best fulfils your needs, you should establish one key element: the relevant ground of discrimination. Then use the Index to find all those organisations that work in the particular field. On the basis of the kind of service offered, and your particular needs, you should be able to identify which organisation is best for your situation. Q. What is discrimination?

A. Discrimination is when persons in a same position are treated differently or when persons in a different position are treated similarly. Not all such kinds of treatment are prohibited by law, as this would depend on the context in which the treatment is seen and also the reasons for such different treatment.

Q. What kind of behaviour or treatment is prohibited by law, and what is allowed?

A. The law does not allow discriminatory treatment that is made on the basis of a person’s age, gender, sexual orientation, disability, race or ethnic origin, or religion or belief. This means that if the reason for the different treatment is based on any of these criteria, it is probably illegal. It is important to determine whether such treatment is the same for persons who are in the same situation but have a different characteristic to any of those mentioned earlier.

Q. Who am I protected from?

A. Anti-discrimination laws in Malta protect you in several areas of daily life, particularly present or potential employment, agencies providing goods or services,, social welfare and education. You are protected from any entity involved in these areas, whether it is governmental or private.

Q. If I feel discriminated against, what can I do?

A. It is advisable to try to solve the situation amicably, whether it is for example your employer, a government department, a landlord

or a shop. If these attempts fail, there are a number of independent entities established purposely to receive complaints of discrimination, look into them and try to resolve them.

The main entities are: the National Commission for the Promotion of Equality (NCPE) that primarily deals with discrimination due to gender and race; the Office of the Ombudsman that could look into discrimination perpetrated by the government (including government departments, agencies, etc.); the University Ombudsman that investigates issues arising at the University of Malta, the Malta College of Arts, Science and Technology (MCAST) and the Institute of Tourism Studies (ITS); the Industrial Tribunal that investigates complaints relating to the workplace; and the National Commission for Persons with Disability (KNPD) that is responsible for discrimination on the basis of disability, including mental disability.

It should also be pointed out that the Courts of Law are also accessible to persons who feel that they have been discriminated against in an unlawful manner. Ultimately, there is also the European Court of Human Rights that offers a measure of last resort in case you do not find any redress locally. The United Nations also have a number of mechanisms that you are entitled to access, but only as a means of last resort.

Q. Who should I complain to?

A. To identify where to lodge your complaint you need to establish two important points: where the discrimination occurred (at work, in a shop, trying to rent an apartment, social welfare application, etc.) and why do you think it happened (because of your skin colour, religion, sexual orientation, etc.). The entities listed earlier

could also assist you in identifying the appropriate course of action to take, as this might not always be straightforward. Organisations or individuals who work in the field could also be of assistance.

Q. Are complaints procedures expensive?

A. The entities listed earlier do not charge any application fee, so the process is free. Of course, should you wish to seek the assistance of a lawyer, you might need to consider the expense this would entail.

Q. Are complaints confidential, or will I suffer personal consequences?

A. Except for the Industrial Tribunal and the Courts of Malta, all procedures are confidential for third parties. However, the agency/ department/employer you are complaining against will in most cases be made aware of your details. Although it is contrary to Maltese law to victimise any person who complains about discriminatory behaviour, it is important to note that none of the entities are in a position to guarantee your security.

Q. How long will it take to decide on my complaint?

A. All entities are keen to resolve matters in as short a time as possible and most cases are in fact concluded in a matter of weeks. Of course, this also depends on your cooperation and that of the organisation you are complaining against.

Q. I’ve filed my complaint, what happens next?

A. This depends on which entity you used to decide your case, although an appropriate investigation will be entered into for those

cases that are deemed to fulfil basic admissibility criteria. In most cases, the entity will try to resolve the issue in an amicable manner, and will act as a mediator between yourself and the agency you are complaining against. If this is not successful, various options are available, depending on the course of action you have chosen.

NCPE and KNPD may choose to file a case in court on your behalf if their conclusions and recommendations are repeatedly ignored, together with referring the matter to the Commissioner of Police if the treatment also constitutes an offence. It is important to highlight the fact that you will be always consulted before any such action is taken, and you always have the choice of discontinuing your complaints procedure if you so wish.

The Ombudsman may decide to refer the matter to higher levels within the public administration such as to the relevant Director or Minister. If the Industrial Tribunal concludes that the treatment was in fact discriminatory it may order remedial compensation (financial or non-) to be granted.

Court procedures may also result in such compensation if the Court finds that the treatment complained of is in fact prohibited by law.

Q. I’m not sure if I’ve been discriminated against, how can I be sure?

A. Try to assess whether someone in a position comparable to your own, save for the discrimination ground (age, disability, sexual orientation, gender, race/ethnic origin, religion/belief), was treated in the same manner as you were or whether they were afforded better treatment. If the treatment was different and it looks like this difference is possibly attributable to any of these six grounds, it is

possible that you were discriminated against. Do not hesitate to contact any of the above entities in case you are unsure.

Q. I was told I was not given the job because the nature of the duties requires a man/woman, and not me. Is this appropriate?

A. This is only appropriate if the criteria (age, gender, etc.) are strictly required by the nature of the job itself and the analysis to determine whether it is so required is conducted in an objective and reasonable manner. This means that generalisations are not permitted as, for example, the conclusion that women are inappropriate for jobs entailing high security risks.

Q. Is it legal for a company to require a particular gender in a job advertisement, or for a property owner to say he/she will not accept applicants from particular nationalities?

A. No. The prohibition of discrimination also extends to those stages before employment is actually entered into as, for example, advertisements, screening procedures, interviews, training, etc. The same may be said for rental and other advertisements, since discrimination on any of the grounds is prohibited in the context of providing a service, such as in a shop, renting property, insurance companies, etc.

Q. I am afraid to get pregnant as I fear I could lose my job, or miss out on promotions/At work I hide that fact that I am gay/lesbian because I’m afraid of the bullying and also possibly of being asked to leave.

A. Your employer would not be justified if you were to be asked to leave, or if you were to be denied a promotion or bonus because of pregnancy, sexual orientation or any elements linked to the above-mentioned grounds (age, disability, gender, sexual orientation, race/ethnic origin, religion/belief).

Q. Because my child is on a wheel chair I have very limited choice in relation to the schools he can attend. Is this right?

A. No, this is not right as anti-discrimination legislation relating to persons with disabilities includes the obligation to ensure adequate accessibility to premises that are either public spaces or spaces accessible by the public. This includes government buildings, banks, public gardens and schools.

Q. My colleagues like to joke about ethnic minorities, but I find these unpleasant. Is there anything I can do about this situation?

A. Anti-discrimination legislation prohibits racial harassment, which refers to behaviour or speech that relates to a person’s or group’s racial or ethnic origin, that violates the dignity of that person or group and that encourages a humiliating environment. If you feel the jokes could fall within this definition, you should raise the issue with your employer or consider filing a complaint.

Q. I heard that harassment is also considered discrimination, but I’m not sure what this means.

A. Yes, behaviour that harasses a person is also discrimination and prohibited by EU and Maltese law. Harassment is generally defined conduct, also verbal such as requests or comments, that intentionally or unintentionally violates a person’s dignity by creating an environment that is intimidating, hostile, degrading, humiliating or offensive. For this behaviour to qualify as discrimination it must be based on any of the protected grounds (age, disability, race/ethnic origin, religion/belief, gender, sexual orientation).

For example, colleagues regularly joking about homosexual persons in a way that could offend or degrade anyone in the same working environment could amount to harassment on grounds of sexual orientation. Racial harassment could occur if a shopkeeper passes derogatory comments about a particular religion, offending any customers in the shop. The same counts for the other grounds of discrimination.
