29 Jan – Attempted Actions/ Ore Carrier/ Name WITHHELD/ Flag WITHHELD/ Anchored/ Jingtang Anchorage, China/ DB310102 Details: IFC has acquired information from IMB that an attempted action had occurred onboard an ore carrier (name WITHHELD, flag WITHHELD), while anchored at Lat: 38°52’0N Long: 119°11’0E, Jingtang

Anchorage, China on 29 Jan 2019. Duty crew onboard an anchored ore carrier noticed an unlit barge alongside and raised the alarm. Two robbers wearing masks were seen lowering hoses and escaping from the quarter deck. On searching the ship, oil stains were noticed near the MDO tank sounding pipe. All tanks were sounded. Nothing reported stolen. VTS informed.

28 Jan - Incident/ MEDEVAC/ Cruise Vessel/ One Rescued/ SAR/ Off Nha Trang, Vietnam/ DB290119 Details: Vietnamese maritime forces Monday transferred an American man to a hospital after he went into a coma at sea. Haddock Richard Ray, 78, was traveling on a cruise ship off the central resort town of Nha Trang when he started vomiting. His belly swelled up, he could not move and he went into a coma. The captain of the ship immediately contacted Vietnam’s Maritime Search and Rescue Coordination Center for help. A team from the center, along with medical staff, arrived at the vessel and provided first aid before transferring Ray to a hospital in Nha Trang. The man showed signs of suffering from peritonitis, said an official from the center. Peritonitis is an inflammation of the peritoneum, the tissue that lines the inner wall of the abdomen and covers and supports most of your abdominal organs. It is usually caused by infection from bacteria or fungi. Americans are among the leading foreign visitors to Vietnam, with 687,226 arrivals last year, an 11 percent year-on-year increase.

28 Jan - Unauthorized Activity/ Tanker/ Off Tanjung Sedili, Malaysia/ DB300119 Details: Malaysian Maritime Enforcement Agency (MMEA) Tg. Sedili has arrested a tanker at about 1055LT this morning at about 4NM southeast of Ramunia Bay, Johor. Capt (M) Mohd Zulfadli Bin Nayan, Director of MMEA Tg Sedili said, a tanker was detained by MMEA patrol boat while conducting OP KHAS PAGAR LAUT in conjunction with the coming festive season. The arrest was carried out after the inspection found that the tanker failed to produce permission from the local authorities. The Basseterre Flagged Tanker was manned by six crew including the skipper, aged of 25-50yrs old (Indonesian). 29 Jan - Incident/ MOB/ Fishing Vessel/ One Missing/ SAR/ Off Hon Chuoi, Ca Mau, Vietnam/ DB010219 Details: At 2031H on 29 Jan 2019, Ho Chi Minh Coastal Information Station received a request to search for Mr. Dang Minh Duc falls into the sea at position (65NM southwest of Phu Quoc Island) and

missing. After receiving the information, the Vietnam Coastal Information System quickly sent reports to relevant search and rescue units, and urgently requested boats operating in the surrounding area. Enhance observation and support to find a crew member. Currently, the system of data centers continues to monitor and help information to find fisherman. 29 Jan - Incident/ MOB/ Fishing Vessel/ One Missing/ SAR/ Off Phu Quoc, Kien Giang, Vietnam/ DB010219 Details: At 1434 pm on January 29, Ca Mau Coastal Information Station received news that while operating at ABOUT 11 NM from Hon Chuoi, Mai Van Be (born 1987) was not on-board fishing vessel CM 99010 TS. The following day, the captain and the fishermen on the ship organized a search but had no results and requested additional support from the authorities. Currently, the system of data centers continues to monitor and help information to find fisherman. 30 Jan – Grounding/ Oil Product Tanker/ 12 Rescued/ SAR/ Off Tanjung Penyusop, Malaysia/ DB010219 Details: An Indonesian merchant vessel with 12 foreign crewmembers is believed to have capsized in the waters off Tanjung Pengelih here. A search and rescue is underway, and at press time, no details are available on whether anyone had been rescued or what caused the boat to capsize. Malaysian Maritime Enforcement Agency (MMEA) is expected to have a press conference on the matter soon. Based on information provided by Malaysian ILO, It was reported by the ships agent to the Johor Port Authority that the incident occurred on 30 Jan 2019 at 2112hrs. The vessel grounded off Tenjung Penyusop, search and rescue was activated at 2120LT. The 12 crew was rescued by other vessels nearby that is MT

FORMULA ONE. Initial investigation found no oil spill and the ship had a minor damage. 30 Jan – Incident/ Fire/ General Cargo Vessel/ 11 Rescued/ SAR/ Off Yancheng, China/ DB010219 Details: The entire crew of 11 onboard a cargo ship that caught fire Thursday morning in sea waters off the coast of East China's Jiangsu province have been rescued. The fire broke out around 0645LT when the cargo ship was 100NM off the east shore of Dafeng District in the city of Yancheng, according to the Maritime Search and Rescue Center of the neighboring city of Lianyungang. The center sent a helicopter to the scene while contacting the ships passing by. As of 9:57am, all of the 11 crew members on the ship have been taken to the helicopter. So far, the fire is under control. 31 Jan - Sunk-Capsized/ Two Fishing Vessels/ Four Rescued/ SAR/ Off Johor Bahru, Malaysia/ DB010219 Details: The Malaysian Maritime Enforcement Agency (MMEA) Johor rescues four fishermen after two boats are flipped over in the waters near Stulang Laut, here today. Maritime rescue Sub Center (MRSC) Johor Bahru received MERS 999 call on the incident around 11am by the public before activating the rescue operation and sending assistance to the scene. Also involved in the operation were Maritime Malaysia, Marine Police Force, Fire and Rescue Department Malaysia, Public Defense Force and Johor Port Authority. The boat was turned upside down while trying to pull the fishes up. All the victims were rescued while the boats were pulled to the beach near the scene. The event was believed to happened because of the turbulent sea state and the heavy load of the fishes, all victims went home with no injures.

31 Jan – Fire/ Container Ship/ SAR/ Off Vung Tau, Vietnam/ DB010219 Details: Vietnam ILO was informed that a Singapore flagged container vessel caught fire in the area about 50 NM away from Nha Trang. There was no damage to anyone, the case is being handled by the regional maritime search and rescue center. Fire is on the main deck and in one of the compartment. Area 4 maritime search and rescue center informed that the ship captain was contacted. Currently the ship is trying to overcome the fire and has not asked for rescue, is requesting a specialized ship to not burn, so the center has reported to the national search and rescue committee to mobilize naval ships and forces. Currently, the ship reported the fire was smoldering, so it tried to overcome the problem. According to the Vietnamese people's navy, from the evening of yesterday, Vancouver ships were assisted by two other cargo ships and one Vietnam marine Police vessel in Van Phong. The ship is now anchored in SE Hon Nua, Van Ninh and Khanh Hoa about 4NM. No one was injured in the fire, as of 11pm the fire is completely controlled. Events reported outside of the period: 07 Jan – Grounding/ Dredger Vessel/ Off Plaridel, Misamis Oriental, Philippines/ DB010219 Details: IFC received information from Philippine Coast Guard ILO that a dredger vessel was safely extracted after she ran around at vicinity waters one NM off Plaridel Port, Misamis Oriental on 07 Jan 2019. Based on the report, while it is installing lighted buoys at vicinity waters off Plaridel Port, the vessel encountered strong winds and current causing the vessel to drift and eventually aground. The Master was advised to file Marine Protest.

10 Jan – Grounding/ Civilian LCT/ Allen, Northern Samar, Philippines/ DB010219 Details: IFC received information from Philippine Coast Guard ILO that cargo vessel was safely extracted after she ran aground at vicinity waters off Balwhartico Port, Allen, Northern Samar on 10 Jan 2019. Based on the report, while moored at Balwhartico Port, the Master decided to anchor at approximately 500 meters away from the pier due to strong winds and heavy swell brought about by the Northeast Monsoon. While maneuvering for anchoring, the vessel incidentally ran aground. The Master of the vessel was invited to report to CGS Northern Samar for further investigation and was advised to secure Certificate of Seaworthiness from MARINA before resuming to normal operation and was further advised to file Marine Protest. 12 Jan – Collision/ Civilian LCT vs General Cargo Vessel/ Off Cebu City, Philippines/ DB010219 Details: IFC received information from Philippine Coast Guard ILO that two cargo vessels collided while transiting at vicinity Shell Island in Cebu on 12 Jan 2019. Based on report, around 122125H Jan 2019, Coast Guard Station (CGS) Cebu received a call from VTMS-Central Visayas regarding collision incident involving two cargo vessels in the vicinity of waters off Shell Island, Cebu City. Immediately, joint elements of Coast Guard Special Operations Unit and Coast Guard Sub-Station (CGSS) Aduana immediately deployed to conduct investigation. Initial information gathered that while passing each other in the area, they incidentally made contact resulting to minor damage to both vessels. On 13 Jan 2019, representatives of both parties appeared at CGS Cebu informing that they agreed for an amicable settlement. CGS Cebu advised them to also file a Marine Protest.

18 Jan – Collision/ Cargo Ship vs Local Passenger Vessel/ Coron, Palawan, Philippines/ DB310102 Details: IFC received information from Philippine Coast Guard ILO that a collision incident between a cargo vessel and a local passenger vessel in the port of Coron in Palawan on 18 Jan 2019. Based on the report, while the cargo vessel was conducting docking maneuver, the vessel accidentally hit the starboard quarter upper stern canopy of the passenger vessel moored in the pier. Both parties agreed for amicable settle. Personnel of Coast Guard Station (CGS) Coron advised the Master of both vessels to file a Marine Protest. 20 Jan – Incident/ Missing Vessel/ Fishing Vessel/ Maldives/ DB010219 Details: The Maldives Coast Guard says their officers are still searching for a vessel reported missing on Sunday, with 12 people onboard. The 75-foot fishing vessel was reported missing to the Maldives National Defence Force (MNDF) at 1022LT. The last contact with the vessel was made on 20th January, at about 1900LT. It was near Laamu atoll at the time. 23 Jan – Incident/ Mechanical Failure/ Local Passenger Vessel/ 102 Rescued/ SAR/ Batanes, Philippines/ DB310119 Details: IFC received information from Philippine Coast Guard ILO that a motor banca with 102 passengers and six crew onboard were safely rescued by joint elements of Coast Guard Sub-Station (CGSS) Sabtang, PNP, BFP, MDRRMO, Local Tourism Officer, RHU and other civilian volunteers after their motor banca encountered engine trouble while maneuvering out of Sabtang Port in Batanes on 23 Jan 2019. Based on report, while the small boat is maneuvering her

way out of the port, some old fender’s ropes accidentally coiled into the propeller which caused engine trouble. All passengers were brought back to the port and were assisted to embark to another passenger boat bound to their port of destination in Ivana Port. 24 Jan - Sunk-Capsized/ Small Cargo

Chittagong, Bangladesh/ DB280119

Details: Two lighter vessels carrying total 2,900 tonnes of grains capsized in bay yesterday in two separate incidents. Both vessels were on their way to Narayanganj from Chattogram. A crew member of one of the vessels remained missing at the time of filing this report. The vessel set off for Narayanganj in the morning, after loading 1,700 tonnes of wheat from a mother vessel at Chittogram port's outer anchorage. While crossing Bhasanchar area near Sandwip, the vessel ran aground to a shoal around 1130LT because of shallow water, and tilted on one side, said Md Selim, deputy director (DD) of Bangladesh Inland Water Transport Authority (BIWTA). The vessel sank when high tide started, said the DD, adding that one crew member went missing while others were rescued with the help of Bangladesh Navy, Coast Guard, and staff members of other lighter vessels passing by. Another vessel, MV N Islam, carrying 1,200 tonnes of corn, was hit by another lighter vessel around 1430LT while crossing the same area. A crack developed in the hull of the vessel, and it started to sink. The ship master drove it towards Bhasanchar coast and managed to run aground, but later the ship capsized as water entered into it, said the DD. All 13 crewmen were rescued, he added. A BIWTA vessel set off from Chandpur to mark the spots by anchoring floating buoys to avert further accidents, said Selim.

24 Jan - Sunk-Capsized/ One Cargo Vessel/ 13 Rescued/ SAR/ Off Chittagong, Bangladesh/ DB010219 (01) Details: Two lighter vessels carrying wheat and maize capsized near Bhashanchar coast of Bay of Bengal on Thursday in two separate incidents and one sailor went missing.. One was carrying wheat and the other was carrying maize. Bangladesh Inland Water Transport Authority deputy director Md Selim said that as per BIWTA rule vessels should move after three hours of tide. On Thursday, tide began around 10:00am but one of the vessel tried to cross the channel around 11:00 am. As there was poor water, the vessel got stuck at a shoal and when the water rose it capsized. In the morning the vessel started its journey carrying 1700 tonnes of wheat from Karnaphuli River Chattogram to Narayanganj. There were 13 sailors at the vessel. Among them, 12 were rescued by Bangladesh Navy and Coast Guard. Bangladesh Navy and Coast Guard divers were conducting rescue operation for the missing sailor till filing the report. 24 Jan - Sunk-Capsized/ One Cargo Vessel/ 13 Rescued/ SAR/ Off Chittagong, Bangladesh/ DB010219 (02) Details: This incident occurred around 1:30pm. The vessel collided head-on with another vessel within an hour of its journey from Karnaphuli River, Chattogram. The surface of the vessel was fractured and it capsized. The 13 sailors of the vessel were safe. 25 Jan - Sunk-Capsized/ Sailing Vessel/ Six Rescued/ SAR/ Mumbai, India/ DB280119 Details: Five officers of the Indian Coast Guard (ICG) and an Army jawan were successfully rescued by the Indian Navy after their sail boat encountered gusty wind and went missing off Mumbai coast. The

team was practicing sailing as a part of the ongoing Coast Guard Week celebrations, when strong winds threw them off guard. At 9.35 pm on Friday, the Maritime Operations Centre, Mumbai received information about a missing Seabird class sailing boat with five Coast Guard officers and one Army jawan embarked. It was intimated that the boat is likely to have capsized off Prongs Lighthouse whilst sailing from Marve, Malad to Army Yachting Node at Colaba. “The Western Naval Command immediately launched its night capable Seaking 42C helicopter from INS Shikra for search and rescue. The helicopter, using night vision, located all six survivors in pitch dark night conditions and winched them up and returned to INS Shikra at 2320lLT,” Commander Mehul Karnik, Chief Public Relations Officer, Indian Navy said. All six survivors were thereafter taken to INHS Asvini, Navy Nagar, Colaba for medical examination. They were reported to be out of danger. 26 Jan - Sunk-Capsized/ Fishing Vessel/ One Rescued/ SAR/ Off Misamis Oriental, Philippines/ DB290119 Details: Coastal authorities in Tagoloan, Misamis Oriental rescued a fisherman after his boat sank. Henry Gabitano, aged 73, had been floating 12 hours by sea on Saturday afternoon. It was Friday afternoon from Jasaan, the victim, along with his brother-in-law Jonel Tajuda got struck by big waves causing their boat to overturn on Saturday morning. Tajuda asked for help when he reached the coastline. Gabitano did not think he would be saved since he is very weak. "I said, I was hopeless that no one could rescue me and my back is so painful due to the waves," he said. The fishermen were thankful that both fishermen were saved. Gabitano said he will still go back to fishing because this is the only job he knows.

26 Jan - Sunk-Capsized/ Speed Boat/ 45 Rescued/ Off Phi Phi, Thailand/ DB280119 Details: 43 foreign tourists from Phuket have been saved after water started pouring into a speedboat they were travelling in and capsized on the way to Koh Phi PhiAt 1140LT yesterday a speedboat named ‘Apitsada 1’ with 43 foreign tourists and two Thai guides, left from Chalong Pier to Koh Mai Thon and Koh Phi Phi. When they were between Koh Dokmai (Flower Island) and Koh Keaw (Green Island), about 9.2 NM from Phi Phi, the boat captain discovered that the boat was getting heavier. Crew found water getting inside the vessel and eventually causing it to capsize. There were boats nearby to rescue all the passengers. 26 Jan - Sunk-Capsized/ Small Boat/ Eight Rescued/ SAR/ Off Krabi, Thailand/ DB280119 Details: Six tourists and two boat crew have been saved after a speedboat capsized two kilometers offshore from Koh Lanta in Krabi today. Officials at the Krabi Tourist Assistance Centre were notified of the incident at 1100LT. Navy and national park officers headed to the scene to find a speedboat which had capsized. Eight people were floating in the water for about half an hour before they were rescued. All were wearing floatation vests. On the trip there was one Thai tourist and five foreign tourists who were travelling on the speed boat between Koh Lanta and Koh Mah. When they were two kilometres off shore there were strong winds and waves that battered the boat before it eventually capsized and sank. Yesterday, 43 foreign tourists from Phuket were saved after water started pouring into a speedboat they were travelling in and capsized on the way to Koh Phi Phi.

26 Jan - Incident/ MEDEVAC/ Yacht/ One Rescued/ SAR/ Off Malacca, Malaysia/ DB280119 Details: Bandar Hilir, 26 Jan – One passenger on-board cruise vessel has been rescued by the MMEA to the Mahkota Medical Center (MMC), last night. Maritime State of Melaka & Negeri Sembilan was contacted by the MRSC Johor Bahru, informing MEIN SCHIFF 3 of the cruise ship from Singapore to Port Klang at about 2000LT with a 72 year old German man having health problems and was to be taken immediately to the hospital. Malacca & Negeri Sembilan Maritime Director Maritim Kepten Hj Amran bin Hj Daud said a maritime patrol boat was assigned to a site about five NM from Bandar Hilir to take the patient. According to him, the patient arrived at the Parameswara Jetty, Bandar Hilir at 12.30am and rushed to MMC. This was the first case of MEDEVAC this year at Maritime State of Melaka & Negeri Sembilan. In addition to the enforcement tasks, MMEA also helps the maritime community to make a flight or courtesy for emergency cases either on the island or on the sea. 26 Jan – Incident/ Mechanical Failure/ Tanker/ Strait of Malacca/ DB280119 Details: IFC received a phone call from the the master of a Marshall Islands LNG Tanker informing that she is having difficuties with her Port Engine, presently travelling at 6 knots off Northern Malacca Straits. Master also shared that the port engine may be rectified in two hours. This information has been shared with the ILOs and a VCR message was sent out. 27 Jan - Sunk-Capsized/ Fishing Boat/ Three Rescued/ SAR/ Off Bintan Island, Indonesia/ DB280119 Details: Three fishermen from Galang Batang and Kawal village in Gunung Kijang

Subdistrict, Bintan Island, were involved in an accident at sea when they were fishing in the vicinity of Nikoi Island, Bintan on 270800LT Jan 19. All the fishermen were still in search and rescue until 1350LT, but finally were found in saved on 1400LT. Based on the report, SAR office agency in Tanjung Pinang said that all fishermen were known as Jupri (skipper) from Galang Batang village, Andi from Kawal village, and Ande from Galang Batang village. They were trying to survive by holding on a fiber box lid in the vicinity Nikoi Island. 27 Jan - Sunk-Capsized/ Fishing Boat/ Three Rescued/ SAR/ Off Thousand Islands, Jakarta, Indonesia/ DB280119 Details: A fishing boat reportedly sunk in waters off Karang Bongkok Island in the Thousand Islands regency on Saturday. No casualties were reported. Thousand Islands Public Order Agency officer Yakub said that a faulty engine had caused an accident that capsized the boat. "Based on

reports, the engine died and when there were winds heading northwest, the boat then hit coral and sunk," Yakub told Kompas.com on Saturday. Yakub said there had been no casualties as the three people on board, Riki, Sadikun and Rian, had jumped off moments before the boat started sinking. Nearby residents reported the incident to the Jakarta Fire and Rescue Agency (PKP). PKP head Jakut Satriadi Gunawan said six officers and a rescue boat had been sent to rescue the three fishermen. Penang Maritime Director, Capt (M) Hamizan Bin Harun said that as a result of the inspection, a 42yrs old Thai male with two Thai crewmen all 45yrs old and 51yrs old were on the vessel have committed a mistake under Section 8 (b) of the Fisheries Act 1985 for breach of the legal requirement of fishing which is less than 15 NM from the nearest beach. "The boat with

two trawlers, an estimated 800kg of fish was seized and taken to the Batu Maung Limbungan Jetty, Penang for further investigation and action. Penang Maritime Director, Kepten Maritim Hamizan Bin Harun said that as a result of the inspection, all Myanmar men were on the boat believed to have committed an offense under Section 8 (b) of the Fisheries Act 1985. They were convicted for not having a valid license, and all four men failed to produce valid identification documents. "The boat, together with two fishing trawls, and an estimated 10 kilograms of fish caught were taken to the Batu Maung Limbungan Jetty, Penang for investigation and further action. The case was investigated under the Fisheries Act 1985 and the Immigration Act 1959/63. He also stressed to fishermen boat operators to comply with the law and did not violate fishery license conditions and employed workers with valid identification documents. At the time of arrest at 1830Hrs, The 4 Mynamar nationals aged 28 to 43 were about 14 kilometers west of Pulau Rebak. Kedah Maritime and Perlis Director, Maritime First Admiral Rozali Mohd. Said said the Maritime Operations Center (Langkawi) had received complaints from maritime communities informing that local fishing boats employing foreign workers were catching fish illegally. During the arrest, several unauthorized fishing nets, a dinghy, 19 illegally caught sea cucumbers and 25kg of fish were also seized by the Navy. 24 Jan - One Local Fishing Vessel Detained/ One Local Fisherman Arrested/ Illegal Fishing Methods/ Off Occidental Mindoro, Philippines/ DB290119 Details: A Palaweño fisherman was arrested in San Jose, Occidental Mindoro on 24 Jan 2019 for alleged illegal fishing, fisheries and aquatic resources authorities from the MIMAROPA reported. The suspect was identified as Victorio Sordilla, 43 years old, and a resident of Sitio Silap, Barangay Algeciras, Agutaya town in northern Palawan. The Bureau of Fisheries and Aquatic Resources (BFAR) in the MIMAROPA region conducted the operation with personnel from the Philippine Coast Guard San Jose Station (PCGSJS) after receiving reports of fish caught using dynamite being landed at the San Jose Fish port. Seized from Sordilla were seven boxes of dalagang bukid (goldband/yellow tail fusilie) and talakitok (gigeye trevally). After examination by the authorities, the samples were confirmed to have been caught using explosives. The suspect faces criminal and administrative cases.

The smuggling of goods was from Nunukan to Malaysia. The inspection of cargo vessels took two days and found a number of prohibited / unmanaged goods were attempted to smuggle into the country through the sea. Among the items includes

60 boxes of black glutinous rice, 145 of brown sugar boxes, 62,500pc of pop ice flavors, 48,960 pieces of Tjie Tun Hun medicines, 4,320 pieces of Kuku Bima Ener-g medicines, 1,800 pieces of Extrajos medicine, 9,600 pieces of special UV whitening and 3,000 of pieces neotogen sweet series worth more than RM 244,990.00 (US$60,000). All six crew members aged 26-38 years (Indonesian citizens) together with the items were taken to the marine police base for further action and the case will be investigated under the Customs Act 1967.

29 Jan - Fuel/ Marine Gas Oil/ Tugboat and Unknown Vessel/ Off Pulau Sudong, Singapore/ DB010219 Details: Seven men were arrested on Tuesday (Jan 29) for an alleged illegal transaction of 2.7 tonnes of marine gas oil at the sea off Pulau Sudong. In a statement on Thursday (Jan 31), the police said that the men, aged between 33 and 44, were nabbed in a joint operation with the Maritime and Port Authority of Singapore (MPA). Pulau Sudong is an island off the southern coast of Singapore. Three of them were crew members of a craft belonging to a marine service provider, and the other four were members of a foreign-registered tugboat. Preliminary investigations revealed that the three crew members had allegedly misappropriated 2.7 tonnes of marine gas oil without their company's knowledge. They then sold it to the four crew members of the tugboat. The tugboat has been seized for investigations. "The police coast guard and MPA take a serious view of illegal transaction of marine fuel in Singapore waters," the statement said. "The police coast guard will continue to conduct enforcement and security checks to prevent, deter and detect such illicit activities in Singapore waters." 30 Jan - Domestic Products/ Used Vehicle and Other Items/ Container/ Manila International Container Port, Philippines/ DB010219 Details: Bureau of Customs (BOC) officials on Thursday inspected misdeclared goods worth PHP12.1 million (US$232,000) that were intercepted at the Manila International Container Port (MICP). In a statement, Customs Commissioner Rey Leonardo Guerrero said the items, which were seized on Monday, include a used Bentley car and a used Hino truck with crane. The shipment was declared as used forklift, used diesel engine, and other household goods. However, a full physical

examination revealed that it contained the used vehicles and other items. District Collector Erastus Sandino Austria issued a warrant of seizure and detention against the shipment on Wednesday. MICP records show that the shipment came from Japan and arrived on Dec. 17, 2018. It was processed by customs broker Tomas James Ydel delos Santos of Sampaloc, Manila. The misdeclared shipment was consigned to Pulilan Motors Truck Rebuilding, which is owned by a certain Agustin Mariano Esguerra of 220 Esguerra St., Balatong B, Pulilan, Bulacan. The owner and the customs broker will also face criminal raps for violation of Section 1400 (Misdeclaration, Misclassification, Undervaluation in Goods Declaration) in relation to Section 1113 (Property Subject to Seizure and Forfeiture) of the Customs Modernization and Tariff Act. The BOC chief added that the Customs accreditation of the consignee and the customs broker will be revoked immediately. 30 Jan - Drug/ Kratom/ Fishing Vessel/ Off, Langkawi, Malaysia/ DB010219 Details: A Thai male tekong was arrested along with ketum leaves and cough medicine in the waters near Tanjung Kemarong, near here yesterday. In operation at 1.30pm, the 51-year-old suspect was arrested by Malaysian Maritime Enforcement Agency (Maritime Malaysia) who met 710 grams (g) ketum leaves. Kedah / Perlis Malaysian Maritime Director, First Admiral (M) Rozali Mohd Said, said the preliminary inspection found that the tekong had a valid identification document. "We found two plastic packages containing ketum leaves weighing 710 g and 10 plastic bottles each containing 500 milliliters (ml) suspected of ketum water in the fish storage box.” Also confiscated are four bottles of 100 ml of black liquid believed to be cough medicine," he said in a statement, today. Events reported outside of the period: 23 Jan – Drug / Unknown/ Small Boat/ Off Tanjung Tohor, Malaysia/ DB280119 Details: Malaysian Maritime Enforcement Agency of Batu Pahat Maritime Zone has successfully broken the drug smuggling attempt in Tanjung Tohor waters early this morning. Maritime Commander Mohammad Bin Othman in a statement told him to act on public information, Maritime Malaysia patrol boat patrolling Batu Pahat to Muar waters. The time in the patrol was Maritime Malaysia boat detected a glass fiber boat in suspicious condition. The boat is directed to stop but it continues to accelerate and then goes to the nearby mangroves in order to escape and the suspect has plunged into the mangroves and left the boat behind the mangroves. "The result of the inspection around the boat found a bag containing three plastic packs suspected of drug weighing one kilogram each" he said. The seizure value of the goods is estimated at 150 thousand ringgit (US$36,500). The boat was taken to the Batu Pahat Maritime Zone jetty for further action and will be investigated under the Dangerous Drugs Act 1952. The Maritime Malaysia also channeled information to other enforcement agencies to help detect and arrest the escaped suspect. Maritime Malaysia is also working closely with other agencies to combat smuggling. 24 Jan - Domestic Products / Palm Oil/ Cargo Vessel/ Surigao Port, Philippines/ DB281019 Details: The Bureau of Customs Port of Surigao seized eight drums of suspected palm oil that were allegedly smuggled into the Taganito Special Economic Zone in

Claver, Surigao del Norte. In a statement, BOC-Port of Surigao Customs Intelligence and Investigation Service (CIIS) supervisor Joseph Romano said they seized the smuggled oil on 24 Jan 2019. Romano added that they are still assessing the value of the seized goods and coordinating with their counterpart from the intelligence service of the Armed Forces of the Philippines. The BOC said an anonymous person called their Citizen’s Complaint Hotline and reported that the drums were discharged from the tanker MT Southern Narwal from Japan before it docked at the TSEZ in Claver. The BOC and an officer from the Philippine Economic Zone Authority reportedly discovered the eight drums of palm oil at the yard of the economic zone. Samples from the contraband were taken and submitted for laboratory analysis. Initial investigation showed that the eight drums of suspected palm oil were discharged from MT Southern Narwhal on 13 Jan 2019. Upon checking the Inward Foreign Manifest and Stowage Plan submitted by the captain of the vessel, it was discovered that the drums were not listed as cargoes. The undocumented items were recorded as in violation of Section 113 (l) of the Customs Modernization and Tariff Act, stating that imported or exported goods that did not go through a customs office is subject to seizure and forfeiture. 26 Jan - Cigarettes/ Cargo Vessel/ Off Sungei Jurong, Singapore/ DB310119 Details: 17 men, aged between 22 and 48, were arrested by the Police Coast Guard (PCG) and Singapore Customs for their suspected involvement in smuggling duty-unpaid cigarettes. The authorities conducted a joint operation conducted on 26 January 2019, in which 14 Indonesians and three Singaporeans were arrested at Sungei Jurong. The authorities stated that a total of 3,740 cartons and 448 packets of duty-unpaid cigarettes; two foreign

registered supply vessels and two Singapore registered vehicles were seized as case exhibits. The police said that Singapore Customs is handling the investigation. The total duty and Goods and Services Tax (GST) evaded amounted to about $396,200 (US$300,000) and $28,820 (US$21,000) respectively. Commander of the PCG, Senior Assistant Commissioner of Police Cheang Keng Keong commended the officers for their excellent team work which resulted in the swift arrest. He added that the authorities will spare no efforts and will continue to take firm action against such offenders.

The authorities stressed that buying, selling, conveying, delivering, storing, keeping, having in possession or dealing with duty-unpaid goods are serious offences under the Customs Act and the GST Act. Offenders can be fined up to 40 times the amount of duty and GST evaded and/or jailed for up to six years and vehicles used in the commission of such offences are also liable to be forfeited.

During the inspection, there were eight people on the boat where seven of them were Filipino citizens while a local resident. Further investigation has found that one of the crew members of the boat presented a dubious identity document. The boat was detained and escorted to Kudat Public Jetty for further investigation. The case was investigated under the Immigration Act 1959/63. Events reported outside of the period: 24 Jan – Human Smuggling/ 47 Unknown Migrant/ Off Tawau, Malaysia/ DB280119 Details: A total of 47 illegal immigrants and 11 criminal suspects have been arrested in a joint operation at floating villages of Kampung Kurnia Jaya and Kampung Titingan here early morning yesterday. In

the 4am operation, four suspects were arrested for house break-ins, two for theft and five for drug-related offences. Tawau police chief Assistant Commissioner Fadil Marsus said both floating villages were hotspots for illegal immigrants and criminal activities. “A total of 44 male and three female, aged between 17 and 54 from Indonesia and the Philippines, were arrested for not having valid identification documents. “Overall, over 200 houses with 273 occupants from both villages were checked,” he said in a statement today. Fadil said the 10-hour operation was aimed at curbing crime, as well as the preliminary step to legitimise the villages in line with the plan to make the area as Tawau police headquarters’ foster village. Fadil added that the operation would be intensified to curb crime, as well as to identify any illegal squatters or ‘kongsi’ houses. The operation was joined by 161 personnel and officers from the Immigration Department, Tawau Municipal Council Enforcement Unit, National Anti-Drugs Agency, Sabah Electricity Sdn Bhd, General Operations Force, Marine Police Force and Royal Malaysia Police volunteers.

Recommendations IFC Advises: 1. All mariners to report any incidents timely to the nearest coastal state and to the IFC at the earliest

possible time.

2. Ships moving at slow speed or are choosing to remain at anchor in areas where sea robbery/theft is regularly reported should remain vigilant and adopt necessary and/or added security measures.

3. All mariners to take note on the description of the perpetrators and to take photos of the

perpetrators if possible. Where available, CCTV footage capturing the incident should be provided to the coastal state authorities for follow-on investigation.

4. Shippers and Seafarers operating in the Sulu-Celebes seas are strongly recommended to be vigilant and to establish contact with the Philippines, Malaysian and Indonesian Authorities to report their presence. Please refer to IFC Spot Commentary 4/18 for the latest assessment of the situation in that affected area.

5. Shippers are advised to take note that the threat of terrorist activity in the maritime domain remains

a possibility in the region due to ISIS and the Al-Qaeda. The possibility of this threat was previously quoted in Al-Qaeda’s online magazine “Resurgence”, which called for the disruption of global trade and shipping through acts of piracy, among other tactics. Shippers are therefore advised to exercise vigilance and to adopt self-defensive measures as stated in the Regional Guide to Counter Piracy and Armed Robbery against Ships in Asia, especially when transiting narrow choke points and areas which are known to have experienced incidents of sea robbery/piracy.
