Case of the damaged catwalk: Can one owner sue another?

Q. We have an owner who damaged part of the catwalk in our build-

ing. As an owner, can I sue the owner who caused damage to the catwalk if our association board refuses to go after the owner who caused the dam-age and who refuses to fix the catwalk?

A. Most likely not. The board of directors is in charge of the opera-

tion of the association. Under Florida law, a unit owner may not act on behalf of the as-sociation. The owner may take legal action against the as-sociation, however, if the board fails or refuses to make repairs that it is obligated to make to the common elements, such

as the catwalk. An owner may have an action against the as-sociation if it refuses to recoup the money it spent on repairs caused by the intentional misconduct or negligence of an owner, tenant, or guest.

Q. I am a renter in a home that is currently in foreclosure. I stopped

paying my landlord since he is in foreclosure. When do I have to move out? Do I have to pay my rent to the bank?

A. Your landlord, the owner, is still the owner. At the end of every bank

foreclosure is an auction. The highest bidder at the auction becomes the new owner. Once the auction occurs and there is

a new owner, any tenant that is still in the home must be served with a notice to vacate under a federal law called the Protecting Tenants at Fore-closure Act. There are certain requirements in order to be protected under this federal law; however, generally, a ten-ant with a bona fide lease will be entitled to stay in the unit for 90 days after being served with such a notice. However, prior to the bank foreclosure concluding, if a tenant fails to pay the owner/landlord rent, the landlord may still have a legal claim for the rent against the tenant even if the owner/landlord’s home is in foreclo-sure.

Q. Is a homeowners as-sociation required to obtain competitive bids

before entering into contracts?

A. generally, if a contract for the purchase, lease, or renting of materi-

als or equipment, or for the provision of services, requires payment by the association that exceeds 10 percent of the total annual budget, including reserves, the association must obtain competitive bids for the materials, equipment, or services.

What made you get into real estate: Always passionate about all things real estate: Art of the deal, interior design, architecture, landscaping. I was the guy at Publix taking every real estate magazine off the rack to thumb through. 

What separates you from other Realtors: Passion, pres-ence, knowledge, the law and seri-ous negotiating skills. I’m 45. If I were 15 years younger, there might be a spot for me on “Million Dollar Listing” (MDL). Congrats to Saman-tha, Chad and Chris for bringing the show to Miami.

Which neighborhoods/areas are your specialties: Not so much an area but a price point. I represent properties exclusively above $1 million. It’s not an ego thing, just a specific niche in which I have worked hard to create market share and where I am very comfortable.

Describe your working style: Casual but intense. I’m not wearing flip-flops, but I’m not a suit and tie guy either. I always answer my phone and my clients know I am available 24/7. I don’t stop.

What advice do you have for buyers: Indecision is your enemy.

You don’t need to make hasty deci-sions, but if you like something, act!

What advice do you have for sellers: Hire the best and brightest to list your home for sale. Interview more than one agent. good agents don’t fear competition. Their clients and track record do all the talking.

how does what you’ve learned about real estate help your clients: Tremendously! It allows them to be themselves. They can be calm, cool, collected or complete basket cases. It doesn’t matter because they have me. I’ve negotiated hundreds of success-ful transactions. I am tactfully aggressive, with a no-nonsense approach. They understand that I am in complete control of their real estate affairs.

What’s the hottest listing you have right now? Loaded question as all of the properties I represent have the bells and whistles that all Buyers want. What’s one thing people would be surprised to know about you: For as hardcore as I am in the field or at the office when I am working, I really like to read, write, relax and spend time with my family. I am as engaging as any of the guys you see on MDL in an agent capacity. But at home, I’m just dad, hanging with my wife and kids or playing fetch with one of my three dogs.
