Introduction and Background and Definitions

AWHILES is a partnership of NHS Wales and Cardiff University health libraries providing health information to support patient care, education, training and research for NHS Wales’ staff, and Cardiff University staff and students on placement. The primary purpose of the AWHILES interlibrary loan service is to provide rapid delivery of journal articles and books between members from the resources of pooled Cardiff University and NHS Wales Health Board/Trust libraries. InterLibrary Loan The NHS Wales CLA Licence CDPA

The term “interlibrary loan” covers both the lending of books and document supply between AWHILES libraries. This is a licence issued by The Copyright Licensing Agency (CLA) to NHS Wales (the Licensee) which permits copying from most books, journals and periodicals within certain extent limits. 1. Lending books between AWHILES libraries 1.1. Requesting books 1.1.1. Requests through AWHILES Libraries may be made by email, telephone, fax, or letter,

though email is the preferred method. 1.1.2. Urgent requests (for immediate patient care or cutting edge research) can be made by

telephone/fax. 1.1.3. When emailing your request, please ensure all details relating to the request are held in

the body of the e-mail message and not held within an attachment. 1.1.4. Most libraries will normally process requests within one working day. 1.1.5. Books will normally be sent via the internal mail system (where this is available) or

second class post, unless the requesting library states they need the item urgently, in which case first class post will be used.

1.1.6. If the requested item is not available, the requesting library will be notified as soon as

possible, normally within one working day.

1.2. Duration of Loan/ Responsibility 1.2.1. The loan period for the item will be as stated in the Voyager library catalogue. Items

should be returned to the lending library no later than 7 days after the end of the loan period indicated.

1.2.2. Overdue notices for non-return of books will be sent by the lending library, preferably by

email. 1.2.3. Renewal requests to the lending library can be made by e-mail or telephone. All

libraries allow three renewals except Cardiff University libraries who allow 25. Books may be renewed if not reserved by another user.

1.2.4. The renewal will be for the same period as the initial loan. 1.2.5. The lending library may ask that expensive or rare items be returned by recorded

delivery and will notify the requesting library if return by recorded delivery is required before supplying.

1.2.6. The requesting library is responsible for the item until it is returned to the lending library

and is discharged. 1.2.7. Any costs incurred, due to damage or loss of item will be charged to the requesting

library. 1.2.8. In accordance with strict data protection guidelines, libraries will co-operate in cases of

defaulting users. 1.3. Inter Library Loan - Excluded Items 1.3.1. The following categories of material may not be borrowed except on the discretion of

the library manager: books marked “Reference” or “Library use only” on the library catalogue; journals; short loan items; videos; CD-ROMS; DVDs and other similar formats.

1.3.2. Other than in exceptional circumstances, some libraries may choose not to lend new

titles added to stock until 3 months after the date of cataloguing (see Appendix 1: Local Policies).

1.3.3. Libraries may decline to lend items that are in local demand, very expensive, rare or

heavy items. 1.3.4. All libraries are happy to extend reference only use rights to NHS Wales’ visiting staff i.e.

a member of NHS staff from a neighbouring health board, who needs to use an item that is not available for loan.

1.4 Participating Cardiff University libraries

1.4.1 All Cardiff University libraries will lend books to AWHILES libraries.

2. Document supply between AWHILES libraries

Document supply between AWHILES libraries is either covered by the NHS Wales CLA licence or the CDPA provided certain conditions relating to this type of copying are met. Under the NHS Wales CLA license, licensed material can be copied (within defined extent limits) and supplied provided that:

all parties are recognised as “authorised users” e.g. the requesting and supplying libraries, and the person making the request

the material is required for NHS Wales’ own internal information purposes. Certain categories of material are excluded under the license (see 3.6.1). If any of these requirements are not met, material may be requested and supplied for non-commercial research or private study under the conditions of the CDPA.

3. Making and distributing copies under the NHS Wales CLA licence

3.1. Preamble

3.1.1. The NHS Wales CLA license covers photocopying, scanning, digital copy re-use (from included e-journals and publications etc, and included publisher websites). The license permits Authorised Users to copy from most books, journals and periodicals, provided that NHS Wales owns at least one original copy of the work or has purchased a subscription to access the work electronically and the copied extract is within defined extent limits (see section 3.5 for extent limits).

3.2. Authorised Users

3.2.1. In respect of Paper Copies: (a) employees of the Licensee (NHS Wales), workers,

consultants engaged by the Licensee and members of the public known as “non-executive members” who sit on a Designated Committee of an NHS Trust or Local Health Board; (b) employees and workers of any HEI or other Library Service Provider who are on temporary or permanent placement with, or providing library services to, the Licensee but only whilst, and to the extent, that they are engaged in the business of the Licensee or in providing such consultancy services to it; and (c) students of any HEI who are on temporary or permanent placement with the Licensee for training and/or receiving instruction as part of their course of study at their HEI but only whilst, and to the extent that, they are engaged in such training and/or receiving such instruction.

3.2.2. In respect of Digital Copies: those individuals in 3.2.1 above who are permitted by the

Licensee to have access to the Licensee’s Intranet, whose identity is authenticated at the time of login and periodically thereafter, consistent with current best practice and whose conduct is subject to regulation by the Licensee.

3.2.3. Where ‘workers’ has the meaning given to it by the Employment Rights Act 1996 and

‘consultants’ means individuals providing consultancy services to the Licensee. 3.2.4. Please note that employees of Cardiff University involved in providing library services to

NHS Wales are considered “Authorised Users” under the NHS Wales CLA license because

Cardiff University is defined as a “Library Service Provider” to Cardiff and Vale University Health Board and Velindre NHS Trust.

3.3. Grant of Licence

3.3.1. Authorised Users may copy, scan or photocopy extracts from original paper or electronic

licensed material and forward copies of these to other Authorised Users as an attachment by e-mail, or by fax/post and there is no need for either party to complete a copyright declaration form or pay a copyright related charge. Note: patients, carers or guardians of patients may receive a single paper copy of licensed material, but are not permitted to make copies themselves under this licence.

3.3.2. Scanned or digital re-use copies of articles, as stated above, may be supplied as

attachments via email (personal or work addresses) provided it is for use within NHS Wales and by Authorised Users (NHS Wales’ staff, members of Health Boards etc). Authorised Users may further forward articles on to other Authorised Users within NHS Wales and once received they may, for their own personal use, store digital copies of licensed material to their local hard drives or personal server space. Scanned or digital re-use copies may be placed on any NHS Wales Intranet for up to 30 days and may be downloaded and distributed between Authorised Users. See Appendix 3 for text to accompany material supplied electronically.

3.3.3. NHS Wales libraries can receive requests for copies of CLA Licensed Material from Cardiff

University Libraries for use by NHS Wales’ Authorised Users. Note: requests from Cardiff University made to NHS Wales libraries for individuals not defined as NHS Wales CLA Authorised Users will need to be submitted using normal inter-library loan services governed by the CDPA.

3.3.4. Other than for patients, carers or guardians of patients, all copies made under this

licence should be for NHS Wales’ own internal information purposes and within the extent limits (see section 3.5). Internal information purposes are defined as:

To share with colleagues at meetings or briefings, internal training sessions, journal clubs etc (copies can be sent to each person either as a paper copy, scanned or digital copy, or placed in a journal club area on an NHS Wales intranet/server for Authorised Users to access)

Health & Safety or Environmental awareness

For research & development

Information relating to an illness, condition or treatment for a patient (single copies only)

To note: if NHS Wales’ staff are undertaking a university course they may copy or receive copies under both the NHS Wales CLA licence in NHS Wales libraries and under their University CLA HE licence. Visit www.cla.co.uk for further information on both these licenses. Note, neither of these licenses cover copying done by individuals for their own private study as this is already provided for under the CDPA.

3.4. Ownership

3.4.1. Under the NHS Wales CLA Licence, Authorised Users may only copy from material either owned, or subscribed to by NHS Wales or permanently donated to an NHS Wales library or, Cardiff University as a “Library Service Provider” to Cardiff and Vale UHB and Velindre NHS Trust. NHS Wales (AWHILES) libraries can therefore request or download material covered by the NHS Wales CLA license which includes material owned or subscribed to by Cardiff University, for their Authorised Users. Certain categories of material and certain works are excluded under this licence. 3.4.2. The Health Library, Brian Cooke Dental Library, Archie Cochrane Library, and Cancer

Research Wales Library are the only Cardiff University libraries able to supply copies from printed material under the NHS Wales CLA licence.

3.5. Extent Limits

3.5.1. Extent Limits: on each occasion Authorised Users may copy within CLA extent limits

which are, whichever is the greater of:

a single chapter of a book or up to 5% of a publication;

two whole articles from a single issue of a periodical or up to 5% of a publication.

3.5.2. Where the issue or a substantial part of it is dedicated to a particular theme, any

number of articles dealing with that particular theme may be copied.

3.6. CLA Excluded Works

3.6.1. Coverage: some publications/categories of works are excluded from the CLA Licence and

may not be copied under this licence. This may or may not apply to either original paper or electronic versions. Please visit “Check Permissions” on the CLA Website at: http://permissions.cla.co.uk/titlesearch.html. For NHS Wales, select the “Public Administration” tab under “Show Permissions”.

3.6.2. Extracts from publications outside the scope of the NHS Wales CLA Licence may be

obtained, for non-commercial research or private study via inter-library loan services from permitted libraries under the terms of the CDPA (see section 4).

4. Making and distributing copies under the CDPA

4.1. Preamble

4.1.1. This section deals with librarians copying material to supply another library or individual which is a permitted act provided for under the Copyright Design and Patents Act 1988 (as amended – SI 1989 No. 1212 and further amended by SI 2014 No. 1372). This permitted act (library privilege) allows libraries to supply, where strict conditions can be met, copies of extracts from publications held, to individuals or other libraries.

4.1.2. This facility should be used when copying is outside the scope of the NHS Wales CLA

licence (see section 3).

4.1.3. Where a library makes a charge for supplying a copy under this section, the sum charged must be calculated by reference to the costs attributable to the production of the copy.

4.2. Copying to supply an individual for non-commercial research or private study (from published

works).

4.2.1. An AWHILES Librarian may, if the conditions are met in 4.2.2 make and supply a single

copy of - 4.2.1.1. One article in any one issue of a periodical, or

4.2.1.2. A reasonable proportion of any other published work, without

infringing copying in the work.

4.2.2. The conditions are –

4.2.2.1. The copy is supplied in response to a request from a person who has provided the librarian with a declaration in writing, and,

4.2.2.2. The librarian is not aware that the declaration is false.

4.2.3. The requesting party (or a representative completing for and on behalf of the requesting party) must therefore complete a copyright declaration form. See Appendix 2 for a copy of the AWHILES ILL request form. Note: the requirement for the requesting party to sign the copyright declaration form is no longer needed.

4.2.4. Requests can also be made electronically including via email. Requests received this way must include the following information: the name of the person who requires the copy and the material which that person requires; a statement that the person has not previously been supplied with a copy of that material by any library; a statement that the person requires the copy for the purposes of research for a non-commercial purpose or private study, will use it only for those purposes and will not supply the copy to any other person; and a statement that to the best of the person’s knowledge, no other person with whom the person works or studies has made, or intends to make, at or about the same time as the person’s request, a request for substantially the same material for substantially the same purpose.

4.2.5. It is the requesting library’s responsibility to obtain and store an article request form for

copyright purposes where appropriate.

4.2.6. Copyright declaration forms should be retained for six clear years.

4.3. Supplying the item to the requester 4.3.1. Journal articles may be scanned and sent as an email attachment to the requesting

library. Upon receipt of the e-mail the requesting library can either print and hand the document to the requester or forward it on the requester by e-mail. At this point the e-mail must be deleted by the receiving library. If a publisher’s PDF is sent as an attachment, the same applies. See Appendix 4 for text to accompany this type of material.

4.4. Commercial Copying

4.4.1. Copying material for a commercial purpose or making multiple copies of material

outside the scope of the NHS Wales CLA Licence (see section 3), may need the permission, in writing, in advance from the rights-holder, or a copyright cleared paid copy from British Library.

4.5. Making copies to supply other libraries

4.5.1. For the purposes of section 41 of the CDPA the conditions specified in paragraph (4.5.2) below, are the conditions which must be complied with when the librarian of a library makes and supplies to another library a copy of any article in a periodical or, as the case may be, of the whole or part of a published work and supply it to another library, without infringing copyright in the work.

4.5.2. The conditions are –

(a) the copy is supplied in response to a request from a library which is not

conducted for profit, and

(b) at the time of making the copy the librarian does not know, or could not reasonably find out, the name and address of a person entitled to authorise the making of a copy of the work. Note: this subsection does not apply where the request is for a copy of an article in a periodical.

4.5.3. Copying of published works cannot be overridden by contract/licence terms. License

terms that prohibit copying a reasonable portion of a work for the purposes of private study or research for a non-commercial purpose do not need to be complied with. However licence terms do still govern what can be done with works accessed on a dedicated terminal e.g. walk in user services.

5. AWHILES Staff and Cardiff University Licensed E-Resources

5.1. AWHILES Library staff accessing Cardiff University licenced e-resources

5.1.1 AWHILES library staff are permitted to act on behalf of authorised Cardiff University staff and students on placement within the NHS Wales (this includes training grade doctors and dentists, honorary title holders and approved educational supervisors) to access Cardiff University e-resources. AWHILES library staff can print out material or send the web link to the material or pdf of the material to the requester.

5.1.2 AWHILES library staff are permitted to access Cardiff University e-resources on behalf of NHS Wales authorised users (who do not have any connection with Cardiff University) under the terms of the NHS Wales CLA license (3.4.1). Material may be printed for the requester or a pdf sent to them.

5.1.3 If material requested is on the NHS Wales CLA Licence excluded list (3.6), AWHILES

librarians should refer to section 4.2 (above), Copying to supply an individual for non-commercial research or private study.

6. Document supply with libraries external to the AWHILES group

6.1.1 Document supply with libraries external to the AWHILES group is covered by the terms and conditions of the CDPA (see section 4).

Appendix 3: Template to accompany material supplied electronically under the NHS Wales CLA license This template can be used by both the supplying library to the requesting library, and the requesting library to the user. The template can be amended to include your own library service details. This template can be included as the first page of the supplied material or in an accompanying email. Dear Colleague This request has been supplied under the terms of the NHS Wales CLA license. You may store digital copies of licensed material on your local hard drive or personal server space. You may further forward this article on to other Authorised Users within NHS Wales via your organisations network and once received they may, for their own personal use, store digital copies of licensed material on their local hard drive or personal server space. Library decides on supplier and whether the request is being made under the

NHS Wales CLA license or the CDPA (see table) and informs the supplying library.

Supplying library can send material back to the requesting library by print or email with a covering text stating that the material was supplied under

the NHS Wales CLA license, and how it can be used and stored. If the material is in electronic format, this can be forwarded on to the

authorised NHS Wales user with the license statement.

Requesting library does not need to keep a copy of the request form.

CDPA Contact supplying library with the request including a statement that the user has completed a copyright declaration form. The supplying library

may make a charge equal to the cost of supplying the item.

Supplying library can send material back to the requesting library by print or an electronic version by email with a covering text stating that the

material was supplied under the CDPA. The material may be printed and given to the user or e-mailed directly to the user with a copy of the

copyright statement. The requesting library should delete the electronic version.

The requesting library will need to keep a copy of the request form for six clear years.
