About the International Arbitration InstituteThe University of Miami International Arbitration Institute is pioneering the education of an elite group of students in international arbitration through a developed curriculum offered to both J.D.s and LL.M.s. ProfessorJan Paulsson Professor Jan Paulsson holds the Michael Klein Distinguished Scholar Chair at the University of Miami School of Law. He is the Faculty Chair of the International Arbitration LL.M. Professor Paulsson has participated as counsel or arbitrator in over 700 arbitrations in Europe, Asia, the United States and

Visiting Professor Carolyn LammCarolyn Lamm is a partner and litigator in White & Case’s

international arbitration and dispute resolution, trade matters and cross-border commercial federal court litigation. She is involved primarily in the representation of foreign corporate clients and foreign sovereigns.

Director Marike Paulsson Marike Paulsson is the director of the University of Miami School of Law’s International Arbitration Institute and a Lecturer in Law. She is of counsel with Shook, Hardy & Bacon and a former counsel at Hanotiau & van den Berg in Brussels, Belgium. She has authored numerous publications on international arbitration and the 1958 New York Convention. Professor Paulsson is the author of the upcoming treatise on the New York Convention: “The 1958 New York Convention in Action” and is currently writing her Ph.D. thesis at Leiden University on enforcement of annulled awards under the New York Convention.

The University of Miami has a long tradition of scholarship in interna tional arbitration dating back to the tenure of the Law School’s legendary dean from 1974-82,

Soia Mentschikoff. Dean Mentschikoff and her hus band, the equally imposing

international arbitration in Sweden. Gillis Wetter liked to spend his winters in The International

Arbitral Process (1979).

Mentschikoff, a pioneer of the arbitral process in the 1950s and 60s, conducted groundbreaking research on the idea of the cognitive bias involved in the arbitral decision-making process. She gathered 180 arbitrators from four occupational groups (lawyers, manufacturers, bankers and brokers) and asked them to decide a hypothetical case designed so that both parties

were partially right and partially wrong. The purpose of the experiment was to determine whether professional backgrounds result in cognitive biases and a

greater or lesser willingness to agree with others.

The Institute strives not only for progress through the education of the new generation of arbitration lawyers, but also for progress through research in international

arbitration.

Based on the earlier experimental study conducted by Dean Mentschikoff, the issue of cognitive bias in international arbitration is being further researched by the Institute.

The Institute also caters to a particular reality of international arbitration, namely

background into the accounting and quantum methods used in international arbitration.

The Institute will also conduct research on the 1958 New York Convention’s Drafting History in Spanish and French.

Finally, the Institute will focus on user’s criticism on international arbitration and conduct empirical research in order to move forward.

The second publication will be overseen by visiting professor Andres Jana, partner at

Another publication of the Institute will feature students’ essays on the Young ICCA and YAP events at the occasion of the ICCA Congress held in Miami in 2014. The topics will include: “State Responsibility and Actions Against Wrongful Annulments and Enforcements,” “Pemex Case Note and Its Appropriateness under Art. V. of the New York Convention,” “Use of Procedure under Art III of the New York Convention to Refuse Enforcement in the U.S.

International Law, Due Process and Order Public,” and “Human Rights Violations and Recourse under Treaty Arbitration.”

Director of the Institute, Marike Paulsson, is currently working on her upcoming treatise, “The 1958 New York Convention in Action” and on her Ph.D. with Leiden University.

Professor Jan Paulsson has recently released his book The Idea of Arbitration.

Young Arbitration Practitioners (YAP)/Miami International Arbitration Society (MIAS) Fellow, Kristina Klykova is writing her Ph.D. on arbitral decision-making based on Mentschikoff’s experiment with Leiden University.

The Institute will also publish a primer on the fundamentals of arbitration written by Marike Paulsson and Kristina Klykova.

Leaders of the Institute teach students and mentor them academically and professionally in the University of Miami School of Law’s LL.M. in International Arbitration Program. The program is led by Professor Jan Paulsson. Admission to the LL.M. in International Arbitration is highly selective. The program provides a unique individualized educational opportunity for a small group of top quality students from a range of countries, wishing to acquire an in-depth grounding in

Young ICCA Scholarship The University of Miami School of Law and Young ICCA award one full-tuition scholarship each year to an outstanding Young ICCA member to attend Miami Law’s one-year LL.M. program in International Arbitration. The winner is chosen on the basis of skills, achievements and an essay competition.

Brazilian Attorney ScholarshipThe University of Miami School of Law awards a scholarship to an outstanding Brazilian attorney to attend the University of Miami’s one-year postgraduate LL.M. program in International Arbitration.

The Institute offers personalized mentoring of students by faculty and the ability for students to attend professional conferences, lectures and social events.

The Institute brings international arbitrators and experts to the University of Miami School of Law to lecture throughout the academic year. The Law School has hosted Albert Jan van den Berg, Lucy Reed, Guillermo Aguilar-Alvarez, Francisco Gonzalez de Cossio, Andres Jana and Nassib Ziadé as visiting professors and guest lecturers.

The Institute’s lecture series will feature Professor Jan Paulsson, Johnny Veeder QC, Judge Stephen M. Schwebel and Visiting Professor Carolyn Lamm.

The Institute will also host the White & Case Lecture in International Arbitration each year.

The Institute is offering Practitioners’ Courses on the Fundamentals of International Arbitration led by Jan Paulsson and leading international arbitration specialists. The

Fundamentals Courses are supplemented with training focused on regions such as Latin America and the Caribbean. For advancement, the Institute will offer Master Classes.

In 2016, LWOW X Arbitration, an all-virtual collaboration led by Marike Paulsson, will focus on the global arbitration arena. Teams in this program will create

implementable solutions to procedural, regulatory, or statutory problems in arbitration while honing skills in team work, innovation, project management, problem solving, technology, social networking, and cultural competency skills. This program is based on LawWithoutWalls, originally founded by Miami Law Professor Michele DeStefano, a program which tackles the cutting edge issues at the intersection of law, education, technology, and innovation.

Moot Arbitration Competitions Some successes include “Best Oralist” awards in Moot Madrid and

Frankfurt Investment Arbitration Moot Court competition twice.
