D R A F T .

A N ORDINANCE TO PROVIDE FOR T H E FORMATION OF A VOLUNTEER FORCE IN PALESTINE.

B E IT ENACTED by the H i g h Commissioner for Palestine, wi th the advice of the Advisory Council thereof :—

1. This Ordinance may be cited as Force Ordinance, 1940.

2. I n this Ordinance, unless the context otherwise requires — " A r m y A c t " means the Army Ac t , 1881 (44 and 45 Vic t ,

c. 58) of the United Kingdom, and includes all acts amending or substituted for the same and all articles of war thereunder in force.

"Commanding Officer" used in relation to the Force means the Commanding Officer of the Force appointed under section 10 or in his absence the next senior officer actually present and doing duty with the Force.

" F o r c e " means the Palestine Volunteer Force formed under this Ordinance.

"Officer" means a person holding the H i g h Commissioner's commission as an officer of the Force.

"Other rank" means warrant officers, non-commissioned of­ficers and privates of the Force.

"Recrui t ing officer" means a person appointed under section 7 to enlist other ranks.

"Member" includes officers and other ranks.

3. It shall be lawful for the H i g h Commissioner whenever it appears advisable to do so by reason of the existence of a state of war to form a Force to be called "the Palestine Volunteer Force" with a view to assisting the Regular Forces in all measures required for the prosecution of the war or ensuring internal security.

4. —(1) It shall be lawful for the H i g h Commissioner on behalf of H i s Majesty to accept the service of any persons being Br i t i sh subjects or Palestinian citizens desiring to join the Force and offer­ing their services to H i s Majesty.

(2) Nothing in this section contained shall be deemed to render it obligatory upon the H i g h Commissioner to accept the services of any person.

5. The H i g h Commissioner shall have power from time to time to determine the strength of the Force and its establishment of officers and other ranks.

6. —(1) The Force may be divided into groups to which the mem­bers shall be respectively assigned by the H i g h Commissioner, namely —

(a) a combatant group;

(b) a reserve group of persons whose services are primarily re­quired in the work in which they are normally engaged;

(c) a reserve group for essential services.

7. The H i g h Commissioner may by writ ing under his hand ap­point any person to enlist suitable persons to serve in the Force.

8. Every other rank shall, upon enlistment, sign an engage­ment in the F o r m set out in the Firs t Schedule to this Ordinance.

9. Every other rank shall, upon enlistment, take the oath or make the declaration in the Fo rm set out in the Second Schedule to this Ordinance to be administered by an officer of the Force or by a recruiting officer.

10. The H i g h Commissioner may appoint a Commanding Of­ficer, an Adjutant and such officers of the Force as he may deem necessary.

11. —(1) Officers and other ranks shall wear such uniform and shall carry and use such arms, ammunition and equipment as the H i g h Commissioner may direct to be supplied to the officers and other ranks by the Government.

(2) The uniform and any arms, ammunition and equipment supplied to any officer or other rank shall remain the property of the Government.

12. The Commanding Officer shall be responsible to the H i g h Commissioner for —

(a) all arms, ammunition, equipment and stores issued to the Force;

(6) all moneys and funds which may be entrusted to h im from time to time for the use of the Force;

(c) the maintenance of the strength of the Force; (d) the discipline and good order of the Force; (e) generally for the proper carrying out of such lawful orders

as may be issued to h im from time to time by the H i g h Com­missioner or any person duly deputed by the H i g h Commis­sioner in that behalf.

13. The provisions of the Army Act shall apply with respect to the discipline of officers and other ranks subject to the following modifications :—

(a) The word " F o r c e " may be read therein for the words "re­gular forces";

(b) The words "other rank" may be read therein for the word "soldier";

(c) The words "The H i g h Commissioner" may be read therein for the words " H i s Majesty" or "Secretary of State" :

Provided that no summary punishment shall be awarded to mem­bers of the Force.

14. —(1) The H i g h Commissioner may discharge any officer and the Commanding Officer may discharge any other rank who has been guilty of misconduct, disobedience or neglect of duty or who, in his opinion, is unsuitable to be a member of the Force, without payment to such officer or other rank of any compensation whatso­ever.

(2) Any officer or other rank discharged under the provisions of subsection (1) shall be liable to deliver up in good order, fair wear and tear and legitimate use only excepted, the uniform and all arms, ammunition and equipment issued to h im.

(3) The H i g h Commissioner may permit any member of the Force to resign from the Force.

15. —(1) The Commanding Officer shall have power to make any agreement or take such action as to h im may seem fit in respect of or relating to any matter incidental to the ordinary requirements of the Force and to institute civil proceedings by the name of his office on behalf of the Force.

(2) A l l civi l proceedings against the Force shall be brought against the Commanding Officer.

16. Members of the Force may receive during their service with the Force such pay, rations and allowances as may be determined by the H i g h Commissioner, chargeable upon the Revenue of Pales­tine.

17. Any member of the Force who is wounded or injured while serving with the Force shall receive such pension or gratuity as the H i g h Commissioner in Council may by rules provide, chargeable upon the Revenue of Palestine.

18. A l l members of the Force who shall by reason of their duties wi th the Force leave wives or families who are unable to support themselves, shall receive such relief for the maintenance of their wives and families as the H i g h Commissioner i n Council may by rules provide, chargeable upon the Revenue of Palestine.

19. The widow or family of any member of the Force who — (a) is killed while serving with the Force; (b) dies within twelve months after being wounded, of wounds

received while serving wi th the Force; (c) dies within twelve months after his lawful retirement from

the Force, from disease or illness contracted through or di­rectly traceable to fatigue or exposure incidental to his ser­vice with the Force;

shall receive such pension or gratuity as may be provided by rules made by the H i g h Commissioner in Council, chargeable upon the Revenue of Palestine.

20. The H i g h Commissioner may make rules for the better car­ry ing out and for giving further and better effect to the provisions •of this Ordinance.

21. The Commanding Officer shall have power to issue Stand­ing Orders relating to the administration and discipline of the Force and for giving effect to any rules made under this Ordinance.

22. —(1) No action shall lie against any member of the Force, nor shall he be subject to any penalty or punishment for any act or thing done by h im while paraded in the lawful discharge of his duty, provided that the act or thing was done in pursuance of a lawful command given to h im by the H i g h Commissioner, or by the Com­manding Officer for the time being, or by an officer acting under the authority of the Commanding Officer for the time being, or in defence of the member's post or person, or otherwise in the lawful performance of his duty.

(2) No action shall be brought for anything done by any member of the Force under this Ordinance unless the same shall be com­menced within three months after the act complained of has been •committed nor unless notice i n writing of such action shall have been given at least one month before such action is commenced.

23. Notwithstanding anything contained in this Ordinance or in any appointment made by the H i g h Commissioner under the provisions of this Ordinance or any engagement signed by any other rank as i n section 8 provided, the H i g h Commissioner may, at any time, by Proclamation, disband the Force or any part thereof with­out payment to the members of the Force or to the members of the part so disbanded of any compensation whatsoeArer and may give such instructions as may be necessary for carrying any such Pro-•clamation into effect.

It is notified for information that the Span­ish Administration has imposed the following restrictions on telegrams, originating in or ad­dressed to Spain: —

(1) Telegrams are accepted at sender's risk. (2) Telegrams are subject to censorship, stop­

page, delay or other treatment without notice to the sender and no claims in re­spect of them wil l be entertained.

(3) Private telegrams in secret language are not admitted but certain duly authorised institutions may use the following codes provided the name of the code used is men­tioned in the telegram: —

The trees are grafted partly on Halimata and partly on Hush-hash, The grove is irrigated by open con­crete canals and the water is bought from the neighbouring grove. The grove is to a certain extent abandoned and is situat­ed on a slight slope running from west to east. The grove is surrounded by a wire fence and at its south-western corner there is a small hut.

2. P a r c e l N o . 92 of B l o c k N o . 3631. A plot of land, the bigger part of which is not suitable for planting. The land is plain and the bigger part thereof is on a Kour-kar h i l l with a deep slope towards east and south. The land varies from light Kourkar to medium and half-heavy. The land is sown at present about 6 dunums approximately beans, about 5״- dunums lentils, and about 5 dunums barley. The land is situated at a distance of about 7-8 minutes walking from the middle of the road leading from Rishon le Zion to Nes Ziona and can be reached by the "Groves' Road".

3. P a r c e l N o . 37 of B l o c k N o . 3631. A plot of land planted with orange trees and situated at a distance of about 2 kms. south from about the middle of the road leading from Rishon le Zion to Nes Ziona. The land is suitable for an orange grove and varies from light medium to medium. The trees are planted at distances 4 x 4 metres one from the other, and about 90% of the trees are of the Shamuti species and 8% of grapefruit of the spe­cies of Seedless March. The grove is ir­rigated by open concrete canals from a cooperative well of which the mortgagor is a partner. In the grove there is a pack­ing house built of Debesh stones 5x10 metres with a roof of concrete bricks and a beton floor nicely arranged. The wind­ows and doors of the packing house are made of iron and there is a big verandah of the size of 14x3 metres with a roof of tin and a concrete floor.
