Dear Sir~The enclosed clipping from the San Luis Obispo County Telegram-Tribune for Friday ,February 22, 1980, illustrates a situationthat I believe is intolerable.First, let me say I am not opposed to nuclear power developmentsince I have worked on problems related to peaceful uses of theatom, and I am not afraid of it. Just respectful.However, in too many instances, the Nuclear Regula tory Commission,(NRC) and its parent organization, the Department of Energy(DOE),have acted at considerably less than the deserved level of expert-ise.The opponents of nuclear power, listed in the second clipping,are well-organized and very well advised by expensive counsel.The "goofs" by the responsible government agencies have beengrist for the opponent's mill and have furnished a basis forextended litigation against the agencies and the owner of the.Diablo Canyonplant, Pacific Gas and Electric Company. Thislitigation has caused a large incre.- ase in plant cost.Technically, I khow the opponents do not have a good case, butby expert use of the poor showing by NRC, the licensing board,and DOE, the "intervenors" have been eff'ective in confusing thepublic and leaving a sense of frustration in those who supportthe development.Please use your good off'ices to convey my dissatisfaction tothe agencies responsible for the unconscionable delays in thedesign, construction, inspection, and approval of nuclear plants.The same criticism can be leveled at the agencies for theirincredibly poor handling of the "Three Nile Island" incident.Newspaper reporters and TV newscasters have successfully made
the "incident" into a real disaster and created a negative"buzz-word" to the delight of nuclear opponents; and also, to

many, "China Syndrome" correctly reflected the TNI "disaster".

I believe, as a taxpayer, voter, and professional engineer(retired), too often the responsible government agencies fallwoefully short in ability to handle the jobs placed in theirhands by the Congress. Yes, the Executive Branch is in chargeof these agencies, but Congress fails in its duty in properlywriting legislation that sets up authority and responsibility.The first failure is in limiting the authority of the agencies;the second, is the uncertain definition of responsibility,particulargyho expeditious prosecution of the permit process.The agencies lack a sense of urgency and appreciation for thecost to applicants of delays and diversions, especially bythose who oppose worthy efforts by properly qualified suppliersof energy, both public and private.Purthev, l see a distinct loss in credibility in governmentagencies from the days of "can do" and "sil1Ldo" in 1942-1950to the present when the agencies say"we wil see" and "we may
try", knowing full well that the life of the agency dependsmore on not doing than on doing.

In correspondence with Congressman Leon Pa.etta,I understand you have authority in the actionsof NRC. Therefore, in sending the enclosed informationto many people in the government and the news media,I am including you.
The enclosed map indicates the semi-circle lyingnorth, east, and south of Diablo Canyon Nuclear Plant.This semi-circle has a 35-mile radius.
1 000 oeoale live within 3 miles of Diablo Canyon.
Here on the Central California Coast we have two findsof weather: On clear days, winds from 1 to 30 mphblow steadily southeastward across the lcwer half ofthe semi-cir cle '.
In a serious leak from Diablo, radiation should beginto fall on about 115,000 movie w'thin two hours.
During our winter storms, ~inds fzom 15 to 50 mphblow wildly northward over the upper hal o thesemi-circle.In a leak from Diablo, about 62,000 people would besoaked b. radioactive rain, in two hours.
The enclosed clipping explains the two black arcsnearest Diablo. The inner 's the evacuation area--6 miles from ground-zero -- advocated by PGR>.The outer is the 10-mile limit which wouM satisfythe Nuclear Regulatory Commission)
If'he meltdown begun at Three Mile Island was completedhere, a geyser of radioactive steam would blow furiouslyfor perhaps a day, befare temperatures of'he Pacificand Chs atomic pile equalized. There is NO HOPE ofevacuating quantities of'eople, before they areovertaken by radiation or death.
For instance, Los Oscs'-Baywocd. Park, 10 mi1e s north ofDiablo, has a single 2-lane road leading away Co Yorro Eay.This road. winds between steep hills and a marsh -'- and.about $600 people waul. &ve to escape ovex it. In arainstorm, they would have about 20 minutes.
No one can prevent a meltdown merely by declaring Chereis no danger of't -- as PG&Z persists in doing. ln eventof' meltdown, you cannatbuild roads to get these'eopleCo safety in time.
Please study the escape-routes:
SOUTH: Freeway 101 is the only fast road, for Chose whocould get onto it.EAST: Route 166 east from Santa Maria is the only fastroad; but it is 50 mi3as to Che nearest meager supply ofgas, food, w'ater. Routes 58, le, g6 lead equally farinto empty desert country. Itve marked tbsp few crossroadswhere there are 1 ar 2 gas stab ions and perhaps a store.
NORTH: Freeway 101 again is t'e only escape. CoastalRoute 1 narrows Co 2 lanes at San Simeon and becomesthe notorious "Big Sur road." Often closed by fog orstorms, it winds for 90 mi3s s along ladder-steep slopesabove Che sea, with only a few supply points for the ruggedcoast ranch'.VEST: Vest, of .course, Chere is only the Pacific.

Dear Mr. Ahearne:
I am writing to advise you of my deep concerns regarding the processwhich will be utilized in response to PG&E's request for a low powertesting permit for the Diablo Canyon nuclear power plant.There are a number of mitigating circumstances which I believeplace Diablo in a different category from the other two plantswhich are currently awaiting licensing. I believe these circum-stances require a different procedure from the one used in theSequoyah and North Ana low power permit decisions.
The Diablo plant is unique in several respects. It is situateda mere two miles from an active earthquake fault, and has activeintervenor involvement in the licensing process. As you know, theAtomic Safety and Licensing Appeal Board will hear oral argumentson seismicity on April 2, 1980, and Appeals Board hearings on theoverturned licensing board decision on security will not be scheduled'ntil the week of June 15, 1980. NRC staff informs me that normally,the fact; that issues are pending on appeal is not an impediment tothe licensing process. Because there are so many outstanding issueswhich may prove problematical, I am requesting that you delay con-sideration of a low power testing. permit until the issues of seismicityemergency planning, security, and TMI-related issues have been throughthe hearing and appeal process and been completely resolved.
I believe this action is warranted for several reasons. First, itseems most inappropriate to allow the reactor to go critical, evenat 5% of power, until the outstanding issues have been resolved.To proceed with low power testing before these issues have beensuccessfully addressed would create a momentum for full power licen-sing which would be quite .difficult to resist even if some safetyissues were still outstanding. If these safety considerations couldnot be successfully resolved, PG&E and the people of Californiawould be faced with ghe additional expense of decommissioning anddecontamination.
