After showing his worst assets at Taylor Swift’s expense during last night’s MTV Video Music Awards, several people pointed to his 2004 tirade when Gretchen Wilson won the American Music Award for Lawsuit: Ellen A Handbasket Record companies including Capitol, Sony, UMG and Warner Bros. last week sued producers of the Ellen DeGeneres Show, including Time Warner, raising some compelling questions for the country music community. The suit asserts that the show has used more than a thousand popular sound recordings without securing the necessary licenses. Interestingly, the suit alleges Ellen producers have secured the composition rights (payable to publishers and songwriters), but have refused to license the sound recordings, which are property of the labels, saying they “did not roll that way.” The songs in question are dominated by pop and tracks from Fleetwood Mac to Fergie, though country titles named include Billy Ray Cyrus’ “Achy Breaky Heart,” Trisha Yearwood’s “How Do I Live” and Faith Hill’s “Mississippi Girl.” Many have been used in DeGeneres’ popular “dance over” feature following her opening monologue. And the suit notes that some of the songs are never licensed for use in daytime television. The suit was filed in Nashville by local attorney Timothy Warnock, who declined to comment for this story. Loeb & Loeb Senior Counsel Denise Stevens was kind enough to help Country Aircheck sort out some of the legalese, however. “These types of licenses are open to negotiation,” she says. As for whether country fans hate Kanye (their love for Swift was never in dispute), Country radio has the answers: WKIS/Miami’s Ken Boesen says the incident was the focus of the Simon & Walker morning show. “Predictably, all lines were busy all morning,” he says. “The feeling from callers was that Kanye West was a bully and nobody likes a bully. Listeners all wanted to chime in to show support for their ‘little blonde sweetheart.’ The calls continue to flood.” “We were all over this,” says KSON/San Diego morning host Cliff Dumas. “Reaction was huge in favor of Taylor and Beyoncé. Throughout the show we had Kanye interrupting.” “Yes, tons of calls,” reports WSIX/Nashville PD Keith Kaufman. “[Swing shifter] Chris Romer reminded people about Vince bitch-slapping Kanye at the Grammys last year. We ran the audio with Vince Gill saying, ‘I just got an award given to me by a Beatle. Have you had that happen yet, Kanye?’” WUSN/Chicago’s Bill Gamble submits this on-air bit: “Listen for the sound of Kanye West interrupting Drew Walker this afternoon to win tickets to the Taylor Swift show. Every time Kanye interrupts, you win tickets to see Taylor.” US99 morning co-host Ramblin’ Ray figures some folks are glad the media glare is turned elsewhere. “The biggest Kanye West fan right about now ... Jay Cutler,” he says. Not all stations heard from an angry audience. “Beside the Bronco’s miracle win in Cincy, it was the theme for the whole morning show,” says KYGO/Denver’s Joel Burke. “But listeners weren’t quite as fired up as I thought they would be. I guess you have to see it in order to understand what happened.” WMZQ/Washington and WPOC/Baltimore PD Meg Stevens says, “We posted the video, both of Kanye and the end with Beyoncé. Most people have the same reaction, he was just an idiot. Most of our listeners didn’t see it live, but [are reacting] from our posts on Facebook and Twitter, and hearing it on the radio. When they hear about it they think he was rude and classless, but no one is angry by any means. The reaction has been Kanye an ass, Beyoncé has class.” Even President Obama expressed his thoughts, calling West a

“jackass” in an off-the-record conversation mistakenly Tweeted by an ABC reporter.

Chart Chat A bow to the Bow, starting with Jason Aldean and extending to SVP/Promotion Carson James, the BBR promotion staff and the entire label on scoring a four-week No. 1 with Aldean’s “Big Green Tractor.” The tune is the first four-week chart-topper since Brad Paisley’s “I’m Still A Guy” concluded it’s run on June 9 of last year. The last time a song enjoyed a longer run than those two was Kenny Chesney’s “Don’t Blink,” which completed a six-week run on Oct. 15, 2007. “Big Green Tractor” has also enjoyed a five-week run on the Activator chart. According to BBR, Aldean has also set a mark as the first country artist to top the all-genre Ringscan chart. And as a topper, the RIAA has issued gold sales certification for the single.

It’s open market, and that answers why some songs are not licensed for use.” Basically, some labels and artists don’t want to give their songs up for use, whether they’re holding out for more lucrative motion picture rights or simply being sensitive about when and where their music is used. Further complicating matters are DVD rights, web rights and other usages beyond the initial broadcast. For its part, show producer Warner Bros. Entertainment refused to comment to Country Aircheck beyond a statement released last week: “We have been working with the major record labels for many months to resolve a music usage issue, after years of a good working relationship between the parties. It is unfortunate that the record labels have resorted to filing a suit over a straightforward business dispute which the show has always been prepared, and remains willing, to resolve on amicable and reasonable terms. This matter does not involve our host, Ellen DeGeneres, who, as everyone knows, is a tremendous music enthusiast and advocate. We hope to have a resolution quickly and look forward to continuing to work with all the labels in a mutually beneficial manner.” Deepening the intrigue surrounding this story is the potential strain it could place on the relationship between artists, labels, managers, publicists and a high-profile national television show. Do artists agree to perform on a program that refuses to pay for the music it uses? Is it easier for an established act to stand on principle versus someone whose career desperately needs the

Conversely, are publicists put in a difficult situation of making the awkward pitch: “Yes, we’re suing you, but the single is doing great!” The greatest indication of just how sensitive this issue has become is the fact that only two of the many managers and publicists contact for this story were willing to speak, and then only off the record. “Anyone who’s quoted is f---ed in terms of getting baby acts on,” one publicist noted. “Ellen’s show sells product, one of few TV appearances that actually does,” says an artist manager. “Plus the artists love her and her staff ... but then you are forced to consider this latest development, which isn’t perceived as being all that artist or songwriter friendly at all. I just hope that it is an issue that Ellen and her team look at, do the fair thing and do it quickly. It could be compared to a writers’ strike, and you’re the one crossing the picket line if you do the show.” CAC
